Abstract

Nikah sirri represent nuptials from conducted underhand or is not noted officially by state. Nikah sirri do not influence to legality of marry, because record keeping marry do not the inclusive of condition and foundation marry, along with opinion growth punish Islam really the nuptials record-keeping have very role is necessary happening of nuptials, releasedly of act marry serve the purpose of arm law when one of couple do not execute obligation. Although the nuptials record-keeping not yet been arranged in Islam Law, but to analysein perpective punish Islam needed by a dig method law (ijtihad) by moslem scholar, namely method Qiyas, Istihlah, al-Dzari'ah, Urf. Each regulation believed can uphold kindliness represent translating from Islam teaching values. Become according to ijtihad of moslem scholar have a nation that Nikah sirri law is illegal, and record keeping marry is obligation so that cause goodness at Islam people. According to contemporary moslem scholar have a notion that conducted better nuptials record-keeping is so that punished to marry validly according to religion and validate according to state.Kata Kunci : Nikah Sirri, Hukum Islam, Metode Penggalian Hukum.

Abstract

Most Favoured Nations principle require the WTO members for not doing discrimination to products from other WTO members for both tariff bound products and non tariff bound products. This principle is the heart of GAIT, GATS dan TR/Ps. Thing that relevant in term of implementation of the principle is like product application which is examined in certain cases either in the panel level or in the Appelate Body level. Abstract

The Act No. 28 of 2009 of Regional Tax and Retribution is intended to support regional head through tax sector in order to conduct implementation of regional autonomy. There are significant changes in the new law among others are transfer of BPHTB as Districts Tax and implementation of close list system.Implementation of closed list system has several weaknesses such as local government unable to act much if there are provisions of multiple interpretations, which disadvantage the region. Such thing should be demonstrate on regulation related to BPHTB therefore it will create implication of regional disadvantage.

Abstract

This conceptual idea aims to conduct a study of the prevention of criminal acts of illegal levies to realize good governance. This conceptual idea examines issues regarding what are the factors that lead to the ineffectiveness of the surveillance system in preventing illegal acts of crime in public services. The ineffectiveness of the supervision system is due to the lack of direct supervision during the transaction process between service users and the apparatus, the absence of special laws governing criminal acts of illegal levies, and the existing supervisory system has not been built integrally. In order to prevent criminal acts of illegal levies, the construction of an independent supervisory institution model is needed, whose main task and function is to provide witnesses in all transactional activities for the effectiveness of public services.

Abstract

Globalization is a transformation process of social relations in the form of network of activities, interaction and trans-continental and inter-regional concessions and it is a worldwide phenomenon. Globalization also brings up threat for human security, that is a condition that requires the fulfillment of human basic needs in which human dignity must be respected and his participation in the life of community must be realized. This condition has an impact on the change of security concept from State centrism to human security At least seven factors must be fulfilled to realize human security, thats are: economic security, food security, health security, environmental security, personal security, community security and political security. The global awareness motivates the development of the concept, doctrine, norms and institution of Human Rights by making international consensus approved by International Community. This consensus is meant to determine the International standards and quality for the countries in implementing their duties to protect, promote, enforce and fulfill Human Rights. This consensus brings about some duties for the countries bound in it to implement the principles and rules in national domain (pacta sunt servanda). Globalization, indicated by the increasing intensity of inter-country relation and more problems regulated in International Law, results in bigger International Obligation of the countries in the world, among others is the obligation to maintain orderliness and peace in the world and to improve Human Rights

Abstract

Abstract Agrarian problems which stick out lately have their deep roots in the cause of that. Agrarian problems sinewy roots in a long time since colonial, new forced labor until this time are structural. The conflict parties were not among the people, but they against big business in collaboration with the authorities. The style of conquest through a double-edged knife: Repressive State Apparatuses and ideological State Apparatuses. Looking at structural roots of agrarian conflicts which were closely linked, it is necessary to make fundamental changes of national laws agrarian by revamping the unequal agrarian structure so that it becomes more socially equitable of Pancasila. Agrarian conflicts would be eliminated if the domain principle of verklaring not be revived. The principles and values ​​which became the agrarian conflict resolution were to respect the laws in that community and strengthening the rights of agrarian resources. Keywords: Repressive State Apparatuses, Ideological State Apparatuses, Verklaring Domain, Pancasila. Abstrak Persoalan agraria yang mencuat akhir-akhir ini, mempunyai akar kausa yang dalam.Persoalan agraria telah berurat dan berakar pada masa yang panjang sejak masa kolonial, orde baru dan hingga kini yang bersifat struktural. Pihak-pihak yang berkonflik  bukansaja antara rakyat dan rakyat, tetapi juga antara rakyat melawan bisnis raksasa yang berkolaborasi dengan penguasa. Corak penaklukan dilakukan melalui pisau bermata dua: Represive State Apparatuses dan Ideological State Apparatuses. Melihat konflik agraria yang akar strukturalnya berkelindan tersebut, maka perlu melakukan perubahan mendasar terhadap hukum agraria nasional dengan  melakukan perombakan struktur agraria yang timpang menjadi lebih berkeadilan social yang bernafaskan Pancasila. Konflik agraria akan bisa dieliminasi apabila asas domein verklaring tidak dihidupkan kembali. Prinsip dan nilai yang menjadi dasar penyelesaian konflik agraria adalah menghormati hukum-hukum yang hidup di masyarakat dan  penguatan hak-hak masyarakat atas sumber-sumber agraria. Kata kunci:  Represive State Apparatuses, Ideological State Apparatuses, Domein Verklaring, Pancasila.

Abstract

Penegakan hukum untuk mewujudkan keadilan, memunculkan suatu permasalahan yaitu keadilan yang bagaimana yang hendak diwujudkan. Asas legalitas dalam penegakan hukum ternyata hanya mengarahkan pada terwujudnya keadilan formal yaitu keadilan menurut undang-undang. Penegakan hukum idealnya bukan hanya mewujudkan keadilan formal tetapi juga keadilan substansial, yaitu keadilan yang benar-benar sesuai dengan rasa keadilan masyarakat. Oleh karena itu, penegakan hukum hendaknya bukan hanya mendasarkan pada asas legalitas, melainkan juga memperhatikan kebiasaan atau tradisi dan sistem nilai yang terdapat dalam kehidupan masyarakat.

Abstract

Pemberlakuan hukuman mati mengundang perdebatan antar negara abolisionis dan negara retensionis. Di Indonesia, perbedaan pendapat dipengaruhi dampak yang ditimbulkan terlebih jika terpidana WNA, yang akan mengundang protes dari negara lain. Penulis melakukan analisis bagaimana pengaturan hukuman mati dalam aturan hukum berbagai negara dan apakah penerapan hukuman mati kejahatan narkotika tidak bertentangan dengan hukum HAM internasional dan nasional Indonesia. Metode penelitian yang digunakan yuridis normatif, pengumpulan data melalui studi dokumen. Hasil penelitian menunjukkan perbedaan penerapan hukuman mati dikarenakan perbedaan sejarah, ideologi dan cara pandang suatu Negara dalam memaknai hukuman mati terutama terkait HAM, kemudian penerapan hukuman mati kejahatan narkotika pada dasarnya tidak bertentangan baik dengan hukum internasional, maupun hukum nasional terutama hukum HAM internasional.

Abstract

The aim of research to determine the position of state assets set aside in BUMN. The research method used is normative empirical research by using statutory approach. The research found that the First, implementation of management and accountability for the state against state assets set aside in BUMN aims to provide an important role in contributing to the state revenue for part of the profits of BUMNs will be deposited into the state budget as Non Tax Revenue (non-tax). Second, the wealth of a country that has been transformed into the capital of state enterprises, the management should be in the business paradigm (business judgment rules), but the separation of the wealth of the country has not made   the switch into a state that in spite of the wealth of the country’s wealth .
