Abstract

AbstractThe purpose of this study is to find out and explain the economic perspective on various triggering factors that can be the basis for the operation of a legal concept and doctrine – which includes matters of legal incompetence, the existence of elements of coercion, background and factors such as the needs of legal subjects. , the impossibility of legal subjects to act, failure to achieve goals, mutual mistakes about facts and identities, unilateral errors, the existence of an obligation to disclose an event/legal act. The conclusion of this research is basically the economic analysis of law is intended to predict the effect of legal sanctions on the behavior of legal subjects. For economists, sanctions are seen as prices and it can be assumed that people will respond to these sanctions as they respond to prices. The discipline of economics provides a normative standard for evaluating law and policy. Law is not only a technical argument, but an instrument for achieving social ends. Keywords: Economic Analysis, Concepts, Legal Doctrine, Property, Negligence, Crime, PunishmentAbstrak Tujuan dari penelitian ini untuk mengetahui dan menjelaskan  perspektif ekonomi tentang berbagai faktor pemicu yang dapat menjadi pijakan bagi bekerjanya suatu konsep dan doktrin hukum –yang meliputi hal-hal tentang ketidakcakapan hukum, adanya unsur paksaan, latar belakang dan faktor-faktor berupa keperluan subyek hukum, ketidakmungkinan subyek hukum dalam bertindak, kegagalan dalam pencapaian tujuan, kesalahan mutual tentang fakta dan indentitas, kesalahan unilateral, adanya kewajiban untuk pengungkapan suatu peristiwa/ perbuatan hukum. Hasil penelitian menunjukan bahwa pada dasarnya analisis ekonomi tentang hukum dimaksudkan untuk memprediksi efek dari sanksi hukum terhadap perilaku subyek hukum.  Bagi ekonom, sanksi dipandang seperti harga dan dapat diasumsikan bahwa orang akan merespon sanksi ini seperti mereka merespon harga.  Disiplin ilmu ekonomi memberikan standar normatif untuk mengevaluasi hukum dan kebijakan.  Hukum bukan hanya sebagai suatu argumen teknis, tetapi merupakan instrumen untuk mencapai tujuan sosial. Kata Kunci: Analisis Ekonomi, Konsep, Doktrin Hukum, Properti, Kelalaian, Kejahatan, Hukuman

Abstract

Abstract Penegakan hukum merupakan suatu rangkaian kegiatan, proses, keadaan dan harapan  yang kompleks/ rumit. Proses penegakan hukum ini akan berpuncak pada putusan hakim karena kedudukan hakim memang sebagai penegak hukum tertinggi. Hakim dalam memutus dihadapkan pada dua pilihan yakni apakah akan berorientasi pada formal justice atau pada pilihan mewujudkan substansial justice. Pada perwujudan keadilan substantif haruslah keluar dari bingkai positivisme hukum dan melangkah kepada bingkai spiritual. Berdasarkan analisis dapat diketahui bahwa dimensi spiritual merupakan jiwa dalam putusan hakim yang dikemas dalam irah-irah kepala keputusan : demi keadilan berdasarkan Ketuhanan Yang Maha Esa, sehingga hakim dalam memutus harus senantiasa didasari oleh pertimbangan moral spiritual. Spirit seperti ini harus diinternalisasikan dengan sungguh-sungguh dalam diri setiap hakim. Kata Kunci: Penegakan Hukum, Pengadilan, Spiritual Abstract Law enfocement is a series of complicated activity, process, condition and hope. Law enforcement will end on judge verdict because judge has the highest level. In making verdict, judge must face two options namely formal justice oriented or substantive justice oriented. The embodiment of substantive justice must break legal positvism and step into spiritual step. Based on analysis, it can be concluded that spiritual dimension in judge verdict is stated under preamble namely : For Justice Based On Sole God so that judge in imposing verdict must be based on spiritual-morality consideration. Abstract

Abstract Democracy and human rights enforcement activities also assist in the development of law in Indonesia. Starting from changing the legislation to the transition of the dual functions of ABRI in Indonesia to be one of the effects of these two activities. Departing from this background, there are 3 (three) formulations of the problems examined in this paper, among others (1) What is the influence of Human Rights, Democracy and the Rule of Law with politics law in a country ? and (3) How is the politics of legal development implemented during the reformation to post-reformation period in Indonesia? From this research it can be seen that the activities needed by the community such as in Democracy and the Upholding of Human Rights in a country can influence rather than the existing Political Law. Where the influence of Political Law also influences the development of law in the country, one of them is Indonesia and the politics of law cannot be separated from the fluctuations that exist, one of the things that can not be avoided that the development of law in Indonesia where in this is one of the impacts on the law along with the politics of law is Human Rights and Democracy. Keywords: Political Law; Human Rights; Democracy; Legal Development.  Abstrak Kegiatan Demokrasi dan penegakkan Hak Asasi Manusia turut membantu dalam perkembangan hukum di Indonesia. Mulai dari pengubahan peraturan perundang-undangan hingga peralihan dwi fungsi ABRI di Indonesia menjadi salah satu efek yang ditimbulkan dari dua kegiatan tersebut. Berangkat dari latar belakang tersebut maka terdapat 3 (tiga) rumusan masalah yang diteliti dalam tulisan ini antara lain (1) Bagaimana pengaruh dari Hak Asasi Manusia, Demokrasi dan Negara Hukum dengan politik hukum disuatu negara? dan (2) Bagaimana politik pembangunan hukum yang diterapkan selama masa reformasi hingga pasca-reformasi di Indonesia? Dari penelitian tersebut dapat diketahui bahwa Kegiatan yang dibutuhkan masyarakat seperti halnya dalam Demokrasi dan Penegakkan Hak Asasi Masyarakat yang ada di sebuah negara dapat mempengaruhi daripada Politik Hukum yang ada. Dimana dengan terpengaruhnya Politik Hukum maka juga mempengaruhi pula dari perkembangan dari hukum di negara tersebut, salah satunya Indonesia dan politik hukum pun tidak dapat dilepaskan dari gejolak-gejolak yang ada, salah satu hal yang tidak dapat dihindari bahwa perkembangan hukum yang ada di Indonesia dimana dalam hal ini salah satu yang berdampak dalam hukum beserta dengan politik hukum adalah Hak Asasi Manusia dan Demokrasi. Kata Kunci: Politik Hukum; Hak Asasi Manusia; Demokrasi; Perkembangan Hukum.

Abstract

Abstract Village Development is one of the national developments, wich is regulated in the Law Number 6 of 2014 concerning Villages. In village development, community participation is needed, including women's participation, which is currently still minimal in providing aspirations for village development. Therefore, it is necessary to strengthen women's participation in village development in order to accommodate policies related to women so that they are able to realize gender equitable village development. The basis for protecting women and strengthening women's rights in national development is the existence of Law Number 7 of 1984 concerning the Elimination of All Forms of Discrimination against Women. In writing this paper using legal research methods with a literature approach to obtain accurate data. The politics of law regarding strengthening women's participation seeks to accommodate women's aspirations in providing their participation for the protection of women at the regional or village level. Keywords: Women's Participatio, Village Development, and Gender Equitable.  Abstrak Pembangunan Desa merupakan salah satu pembangunan nasional yang diatur dalam Undang-Undang Nomor 6 Tahun 2014 tentang Desa. Dalam pembangunan desa diperlukan partisipasi masyarakat, termasuk partisipasi perempuan yang saat ini masih minim dalam memberikan aspirasi untuk pembangunan desa. Oleh karena itu, diperlukan penguatan partisipasi perempuan dalam pembangunan desa agar dapat mengakomodasi kebijakan terkait perempuan sehingga mampu mewujudkan pembangunan desa yang berkeadilan gender. Landasan perlindungan perempuan dan penguatan hak-hak perempuan dalam pembangunan nasional adalah dengan adanya Undang-Undang Nomor 7 Tahun 1984 tentang Penghapusan Segala Bentuk Diskriminasi terhadap Perempuan. Dalam penulisan skripsi ini menggunakan metode penelitian hukum dengan pendekatan kepustakaan untuk memperoleh data yang akurat. Politik hukum tentang penguatan partisipasi perempuan berupaya mengakomodir aspirasi perempuan dalam memberikan partisipasinya untuk perlindungan perempuan di tingkat daerah atau desa. Kata Kunci : Partisipasi Perempuan, Pembangunan Desa, dan Keadilan Gender.

Abstract

Abstract This study aims to analyze the discourse on the nomination of President and Vice President of non-political parties in Indonesia within the framework of a democratic state. The approach method used in this research is normative juridical and descriptive analytical, namely describing the object that is the subject of the problem, from the description an analysis is taken that is adapted to existing legal theories and puts the law as a building system of norms. The results of this study indicate that the mechanism for nominating the President and Vice President has indeed shown democratic values but only accommodates the nomination route through political parties so that it closes the rights of some citizens who want to run through non-political parties. If the current regulations are applied, so that the mechanism for nominating the President and Vice President in Indonesia is more effective, the criteria for candidate quality must be further improved. The discourse of Presidential and Vice-Presidential Candidates for Non-Political Parties in Indonesia has advantages, namely reducing political oligarchy, presidential system is more effective, providing opportunities for potential candidates in small political parties and non-political parties, recruitment system and regeneration patterns are more loyal and quality. Weaknesses include the presence of an envoy Number 56/PUU-VI/2008 of the Constitutional Court of the Republic of Indonesia, the prevailing regulations still accommodate the constitutional rights of citizens, weakening the function and role of Political Parties, the potential for dismissal of the President and Vice President by the proposal of the House of Representatives. Keywords:  Candidate for President and Vice President, Non-Political Party, Democracy Abstrak Penelitian ini bertujuan untuk menganalisis wacana pencalonan Presiden dan Wakil Presiden non Partai Politik di Indonesia dalam kerangka negara demokrasi. Metode pendekatan yang digunakan dalam penelitian ini adalah yuridis normatif dan bersifat deskriptif analitis yaitu menggambarkan objek yang menjadi pokok permasalahan, dari penggambaran tersebut diambil suatu analisa yang disesuaikan dengan teori-teori hukum yang ada dan meletakan hukum sebagai sebuah bangunan sistem norma. Hasil penelitian ini menunjukkan bahwa mekanisme pencalonan Presiden dan Wakil Presiden memang sudah menunjukan nilai demokrasi namun hanya mengakomodir jalur pencalonan melalui partai politik sehingga menutup hak sebagian warga negara yang ingin mencalonkan diri melalui jalur non-partai politik. apabila memang aturan yang ada saat ini yang diberlakukan, agar mekanisme pencalonan Presiden dan Wakil Presiden di Indonesia lebih efektif maka kriteria kualitas kandidat harus lebih ditingkatkan. Wacana Pencalonan Presiden dan Wakil Presiden Non Partai Politik di Indonesia memiliki kelebihan yaitu mengurangi oligarki politik, sistem presidensiil lebih efektif, memberikan peluang bagi kandidat berpotensi pada partai politik kecil maupun non partai politik, sistem rekrutmen dan pola kaderisasi lebih loyal dan berkualitas. Kelemahannya antara lain adanya utusannya Nomor 56/PUU-VI/2008 Mahkamah Konstitusi Republik Indonesia, regulasi yang berlaku tetap mengakomodir hak konstitusional Warga Negara, melemahkan pungsi dan peran Partai Politik, adanya potensi pemberhentian Presiden dan Wakil Presiden oleh usulan Dewan Perwakilan Rakyat. Kata Kunci : Pencalonan Presiden dan Wakil Presiden, Non Partai Politik, Demokrasi

Abstract

Abstract This journal aims to analyze the determination of replacement value in land acquisition for the public interest with a case study on the construction of the toll road. The appraisal team determines the replacement value in land acquisition for public use by taking into account the physical and non-physical values in accordance with Law No.2 of 2012 and the Indonesian Appraisal Standard. Obstacles in the implementation of providing compensation in land acquisition for the construction of the Semarang-Demak toll road are obstacles that arise from the community holding rights to land, buildings and plants and objects related to land, lack of public awareness to participate in development and lack of awareness. understanding of the meaning of the public interest, the social function of land rights, lack of understanding of the plans and objectives of the project development, which previously provided explanation and counseling from the Land Acquisition Committee for the construction of t Toll Road. There are still people who feel dissatisfied, especially regarding the market value of land, this is because people think that their land is the same as other land why the market value of the land is different. Keywords: Land acquisition; Land Appraisal;  Toll Road Abstrak Jurnal ini bertujuan untuk menganalisis penetapan nilai pengganti dalam pembebasan tanah untuk kepentingan umum dengan studi kasus pada pembuatan jalan tol . Penetapan nilai pengganti dalam pembebasan tanah untuk kepentingan umum dilakukan oleh tim appraisal dengan memperhatikan nilai fisik dan nilai non fisik sesuai dengan UU No 2 tahun 2012 dan Standar Penilaian Indonesia. Hambatan-hambatan dalam pelaksanaan pemberian ganti kerugian dalam pengadaan tanah untuk pembangunan tol Semarang-Demak adalah hambatan yang berasal dari masyarakat pemegang hak atas tanah, bangunan dan tanaman serta benda- benda yang berkaitan dengan tanah, kurangnya kesadaran masyarakat untuk berperan serta dalam pembangunan dan kurang pemahaman terhadap arti kepentingan umum, fungsi sosial hak atas tanah, kurangnya pemahaman mengenai rencana dan tujuan pembangunan proyek tersebut yang sebelumnya telah dilakukan penjelasan dan penyuluhan dari Panitia Pengadaan Tanah untuk pembangunan Tol . Masih ada saja masyarakat yang merasa kurang puas, terutama mengenai nilai pasar tanah, hal ini dikarenakan masyarakat beranggapan bahwa tanah mereka sama dengan tanah yang lain kenapa nilai pasar tanahnya berbeda. Kata Kunci: Pembebasan Tanah; Penilaian Tanah; Pembangunan Jalan Tol

Abstract

Abstract The purpose of this study is to analyze the impact of the procedural time limit on state administrative decisions set out in the Administrative Law in Indonesia, Australia and Canada. The research method used by the writer is descriptive-comparative analysis. That is to conduct a comparative analysis of the impact of the procedural time limit on state administrative decisions in Indonesia, Australia and Canada based on the specified procedural time limit parameters. The results showed that the limit of ninety days after the announcement or receipt of a state administrative decision in Article 55 of Law Number 5 Year 1986 concerning State Administrative Courts has implications for the loss of the right of judicial review, the bias in the substance of the lawsuit, flexibility in judicial procedures, and weakened supervision of administrative decisions of state officials in Indonesia. In contrast to the procedural time limit provisions in commonwealth countries such as Australia and Canada, where the constitution features an extension of the procedural time limit and the discretion given to federal court judges to reject or accept claims, extending the lawsuit deadline, even though the deadline has expired. Keywords: Implication; Procedural Time Limit; State Administrative Decree Abstrak Tujuan penelitian ini adalah melakukan analisis dampak terhadap ketentuan batas jangka waktu pengajuan gugatan (procedural time limit) atas keputusan administrasi negara yang diatur dalam Undang-Undang Administrasi di Indonesia, Australia dan Kanada. Metode penelitian yang digunakan penulis adalah deskriptif-comparative analisis, yaitu melakukan analisa perbandingan dampak batasan jangka waktu prosedur gugatan keputusan administrasi negara di Indonesia, Australia dan Kanada berdasar parameter procedural time limit yang ditentukan. Hasil penelitian menunjukkan bahwa batasan sembilan puluh hari semenjak diumumkan atau diterimanya keputusan administrasi negara di Pasal 55 Undang-Undang Nomor 5 Tahun 1986 tentang Peradilan Tata Usaha Negara, berimplikasi hilangnya hak judicial review, biasnya substansi gugatan, fleksibilitas prosedur acara peradilan, serta melemahnya pengawasan terhadap keputusan administrasi pejabat negara di Indonesia. Berbeda dengan ketentuan procedural time limit di negara-negara commonwealth seperti Australia dan Kanada, konstitusinya memberikan fitur perluasan makna procedural time limit dan diskresi yang diberikan kepada hakim pengadilan federal untuk menolak atau menerima gugatan, memperpanjang batas waktu gugatan, meski batas waktunya sudah berakhir. Kata kunci: Implikasi; Batasan Waktu Prosedural; Keputusan Administrasi Negara

Abstract

Abstract This study aims to understand the development of various views and thoughts on legal theories and philosophies, by looking at the decision-making process by judges as an instrument for law formation and about what things are considered by judges in making decisions and influencing the enactment of the law , The conclusion of this research is, Adjudication in theories of adjudication has the meaning as a decision-making process by judges in adjudicating or resolving a problem from the disputing parties with considerations that can be legally accounted for. . In the concept of adjudication, judges are subject to a legal order, judges are bound to the applicable legislation. It is further stated that there is no legal form outside the applicable regulations. Even in resolving very serious cases, legal provisions must still be a reference that must be followed by judges.Keywords: Judge's Decision, Discourse, Adjudication Theory Abstrak Penelitian ini bertujuan untuk memahami perkembangan atas berbagai pandangan dan pemikiran tentang teori-teori dan filsafat hukum, dengan melihat bahwa proses pengambilan keputusan oleh hakim sebagai instrument bagi pembentukan hukum serta tentang hal-hal apa saja yang menjadi pertimbangan hakim dalam pengambilan putusan dan mempengaruhi berlakunya hukum. Hasil penelitian menunjukan bahwa Adjudikasi (adjudication) dalam teori-teori tentang  adjudikasi (theories of adjudication) mempunyai pengertian sebagai suatu proses pengambilan keputusan oleh hakim dalam mengadili atau menyelesaikan suatu permasalahan dari para pihak yang bersengketa dengan pertimbangan-pertimbangan yang dapat dipertanggungjawabkan secara hukum. Dalam konsep adjudikasi (adjudication), hakim tunduk pada suatu tatanan hukum, hakim terikat pada perundang-undangan yang berlaku. Lebih lanjut disebutkan bahwa tidak ada suatu bentuk hukum di luar peraturan yang berlaku.  Dalam menyelesaikan kasus-kasus yang sangat berat sekalipun, ketentuan-ketentuan hukum harus tetap merupakan acuan yang harus diikuti oleh hakim. Kata kunci: Putusan Hakim, Diskursus, Teori Adjudikasi

Abstract

AbstractIn this study, it will be explained about several matters relating to the actions of the government in its capacity as a body that has the authority as a supervisor, especially in the event of a disaster emergency. In this study regarding government oversight also has several objectives. Studies on disaster management are no longer considered to be the domination of the exact science of concentration, but rather to physical development as a means of disaster management. [1]On the other hand, the discussion this time has also spread or spread to other branches of social science such as sociology and anthropology. When we discuss aspects of disaster management from the perspective of social science it will be more inclined or lead to a behavioralism framework than an individual or someone in translating a disaster which later will also be a factor where the government can determine attitudes related to how to behave or take appropriate supervisory action. . Abstract

Abstract This study aims to determine the Reform of Oil and Gas Management with a Vertical Integrated System to Realize Welfare Based on the Constitution. The approach method used in this research is the Legal Research approach, the research is obtained from library research and legal documents, which means that the research is carried out by reviewing library data and existing references. The results of the research show that first, the oil and gas management system through open access and unbundling that is currently being implemented is the result of the implementation of Law No. 22 of 2001 concerning Oil and Gas, this system is contrary to the constitutional mandate, namely Pancasila. Second, the management of oil and gas through a vertical integrated system can be a means for the welfare of the Indonesian people, this system is a solution to solve oil and gas management problems in Indonesia, the vertical integrated system is a system that has triumphed in the new order era, Keywords: Oil and Gas, Governance, Welfare, Constitution AbstrakPenelitian bertujuan untuk mengetahui Reformasi Pengelolaan Migas dengan Vertical Integrated System guna Mewujudkan Kesejahteraan Berdasarkan Konstitusi. Metode pendekatan yang digunakan dalam penelitian ini adalah metode pendekatan Legal Research, penelitian didapat dari library research dan legal document, yang artinya penelitian dilakukan dengan mengkaji data-data pustaka dan referensi-referensi yang ada. Hasil penelitain menunjukan bahwa pertama, Sistem pengelolaan migas melalui open access dan unbundling yang diberlakukan sekarang merupakan akibat dari implementasi UU No.22 tahun 2001 tentang Minyak dan Gas, sistem ini bertentangan dengan amanat konstitusi yaitu Pancasila. Kedua, Pengelolaan migas melalui vertical integrated system dapat menjadi sarana mensejahterkan rakyat Indonesia, sistem ini merupkan solusi untuk memecahkan masalah pengelolaan migas di Indonesia, vertical integrated system merupakan sistem yang pernah berjaya di masa orde baru, Kata Kunci: Minya dan Gas, Tata kelola, Kesejahteraan, Kontitusi
