Abstract

Presidential Regulation No. 59 of 2024 excludes health care resulting from certain criminal offenses from the National Health Insurance program if other funding schemes, including those of local governments, already cover it. Meanwhile, Law No. 3 of 2026 on the Protection of Witnesses and Victims reinforces local governments' obligation to support victim protection but does not yet clarify the operational mechanisms for funding. This study employs a doctrinal method using a legislative and conceptual approach, along with qualitative analysis through systematic interpretation and legal harmonization. The results indicate that local governments’ responsibility for funding health services for victims of criminal offenses is fulfilled through planning and budgeting, the establishment of local regulations, and collaboration with stakeholders. Implementing regulations for Law No. 3 of 2026 are needed to provide legal certainty regarding the funding mechanisms and the fulfillment of local governments’ responsibilities

Abstract

This study aims to examine the opinions of students from the Faculty of Teacher Training and Education (FKIP) at Ahmad Dahlan University who participated and did not participate in demonstrations regarding the effectiveness of demonstrations as a social control mechanism over the performance of the Indonesian House of Representatives (DPR RI). The study was motivated by differences in students' views concerning the effectiveness of demonstrations in influencing public policy and the performance of the DPR RI. This research employed a descriptive qualitative method with data collected through interviews and documentation. The data were analyzed using the Miles and Huberman model and validated through source triangulation. The findings indicate that students who participated in demonstrations viewed demonstrations as an effective social control instrument for conveying public aspirations, criticizing government policies, monitoring the performance of the DPR RI, and enhancing public political awareness. Meanwhile, students who did not participate in demonstrations considered demonstrations a legitimate form of political participation, but viewed their effectiveness as being limited to expressing aspirations, facilitating political communication, and increasing public awareness. Both groups agreed that demonstrations play an important role as a social control mechanism over the performance of the DPR RI.

Abstract

This normative legal research examines the validity of legal relationships and civil liability arising from the placement of eleven infants in an unlicensed childcare facility in Sleman Regency. The study employs a normative juridical approach through library research and a case-based analysis. The findings indicate that the legal relationship established between the parents and the childcare provider fails to satisfy the objective requirements of a valid agreement as stipulated in Article 1320 of the Indonesian Civil Code due to the absence of a lawful cause. The lack of an operational permit rendered the childcare activities contrary to applicable legal provisions, resulting in the agreement being null and void by operation of law. The study further finds that negligence in the provision of childcare services, which led to health problems among the children, constitutes a tortious act and gives rise to an obligation to compensate for the resulting losses. Accordingly, the childcare provider bears civil liability for the damages incurred, including medical treatment and health recovery expenses. These findings demonstrate that the legal status of a childcare institution plays a significant role in determining both the validity of legal relationships and the scope of civil liability in childcare arrangements.

Abstract

This article examines digital banking disputes arising from biometric authentication in mobile banking, including authentication failures, misuse of biometric data, and bank liability for customer losses. It compares the legal frameworks of Indonesia and Singapore, two countries pursuing financial digitalization with different approaches to consumer and personal data protection. The study uses a normative juridical method with statutory and comparative approaches. The findings indicate that Indonesia has a basic legal framework comprising the Electronic Information and Transactions Law, the Personal Data Protection Law, and Financial Services Authority regulations. However, clearer evidentiary and liability standards and more consistent compensation procedures are needed for biometric-related disputes. Singapore offers a more structured framework through its personal data protection legislation, electronic payments user-protection guidelines, and dispute-resolution arrangements administered by FIDReC. The comparison highlights the importance of security governance, transparent investigations, and accessible dispute resolution in protecting customers

Abstract

Public legal awareness and understanding of how to report fraud through Short Message Service (SMS) remain limited despite the Electronic Information and Transactions Law (ITE Law). This empirical legal study examines SMS fraud in Semarang City. The findings identify weak law enforcement, limited public literacy, and rapid technological change as barriers to prevention and enforcement. Respondents also reported inadequate public outreach about SMS fraud risks. The study highlights the need for an integrated response combining legal education, stronger enforcement, and greater public awareness. Cooperation among government, law enforcement agencies, telecommunications providers, and the public is essential to improve protection against SMS fraud

Abstract

This study was motivated by waste management issues that cause unpleasant odors, environmental pollution, and disturbances to the comfort of the community living near the Sendangsari Integrated Waste Treatment Facility (TPST). This study aims to describe community participation in mitigating the operational impacts of the facility and to analyze the responsibilities of the TPST management based on Article 6 of Sleman Regency Regulation No. 6 of 2023. This study employs a qualitative descriptive approach, with data collected through interviews, observations, and documentation. The findings indicate that community participation occurs both directly and indirectly, primarily through complaints and communication with community leaders or via social media, while direct participation includes protests, the display of banners, and public meetings. The operator’s responsibilities are implemented through public outreach, staff training, odor control, wastewater treatment, and pollution control facilities, reflecting the implementation of Article 6(a), (b), (c), (d), (e), and (g) of the regulation.

Abstract

This study aims to examine the policy on natural resource management from the perspectives of economic principles and local wisdom. It adopts a normative juridical method with a descriptive-analytical approach to explore how state policies should balance economic development with environmental sustainability. The findings reveal that the exploitation of natural resources cannot be justified solely by free-market economic logic, as this may overlook the constitutional mandate to ensure the greatest benefit for the people. Local wisdom, rooted in the traditions and knowledge of indigenous communities, plays a vital role in sustainable resource governance and environmental protection. Article 18B paragraph (2) of the 1945 Constitution of the Republic of Indonesia guarantees the recognition and respect of customary law communities and their local wisdom. This research underscores the importance of policies that integrate legal norms, economic considerations, and sociocultural values.

Abstract

The making of Power of Attorney to Sell Deed Number 155 by Notary Wiwin Roswinanti, S.H. in the Sambong, Batang land case raises fundamental questions on professional ethics and the notarial prudence principle. The land was still registered under Tabari bin Dulah's name, offered by Karnoto who was not the certificate holder, while the object remained pledged as collateral at Koperasi Sekartama Batang. Using an empirical juridical approach, this research analyzes the reasons behind the notary's willingness to issue the deed, the conformity of the notary's conduct with standards of authority, prudence, and professional ethics, and the resulting legal implications. The findings indicate strong violations of the prudence principle and professional ethics, with potential implications including degradation of the deed's authentic evidentiary value, administrative sanctions, ethical liability, and civil liability.

Abstract

This study aims to analyze the enforcement of Semarang City Regional Regulation Number 5 of 2017 concerning the Maintenance of Public Order specifically regarding prostitution in karaoke venues within the former Sunan Kuning red-light district by the Semarang City Public Order Agency (Satpol PP). It also seeks to identify factors influencing enforcement effectiveness and examine the efforts made by Satpol PP to enhance this effectiveness. The study employs a qualitative research method with an in concreto theoretical focus. Data were gathered through interviews, observation, documentation, and literature reviews, then analyzed qualitatively using Soerjono Soekanto’s theory of legal effectiveness. The results indicate that the enforcement of Semarang City Regional Regulation Number 5 of 2017 has been carried out through patrols, surveillance, enforcement operations, the imposition of administrative sanctions, and the sealing of violating business premises. However, implementation has not been fully effective because prostitution patterns have shifted from open to covert, making detection and the gathering of evidence more difficult. Enforcement effectiveness is hindered by factors such as limited personnel and operational budgets, information leaks prior to raids, difficulties in proving violations, and social factors within the surrounding environment. Conversely, supporting factors include a clear legal basis, the commitment of enforcement officers, and community participation in providing information and conducting oversight. Efforts to improve effectiveness involve preventive approaches such as public outreach, guidance, and supervision and repressive measures, including raids, the temporary suspension of business activities, and the sealing of premises proven to be in violation. The study concludes that enhancing the effectiveness of Regional Regulation enforcement requires strengthening cross-sector coordination through collaborative governance, building the institutional capacity of Satpol PP, and fostering sustainable community economic empowerment to address the root social issues in the former Sunan Kuning red-light district

Abstract

This study aims to doctrinally examine the implications of shifting the qualification of morality offenses—specifically adultery and cohabitation—into absolute complaint offenses (absoluut klacht delict) under Law Number 1 of 2023 on the National Penal Code, and to reconstruct its impact on safeguarding citizens' constitutional right to privacy. Employing a normative legal research method with statutory and conceptual approaches, this study finds that the shift in normative status serves as a transformative legal policy instrument designed to deconstruct the threat of over-criminalization and dismantle legal justifications for vigilante acts (eigenrichting). The limitation of legal standing for complaints, granted exclusively to the nuclear family, reflects the state's application of the judicial restraint principle, thereby returning criminal mechanisms to their essence as the ultimum remedium. Furthermore, this regulatory construction successfully formulates an ideal proportionality between the supremacy of universal human rights guarantees and the preservation of the moral order within Indonesia's communal society. This paradigm shift also incorporates the double track system and restorative justice, where the dispute resolution mechanism is directed toward conflict resolution that restores sociological family bonds rather than focusing on retributive imprisonment.
