Abstract

A comprehensive understanding of how the history of the application of Islamic law, especially inheritance law in Indonesia so that it can occur and enter the national legal system, then examines the socio-economic history of Islamic law in Indonesia is the first step to answer it, especially in the historical aspects of Islamic law legislation. This historical study must also be traced from the earliest period, namely since the arrival of Islam to the archipelago, because the existence and position of Islamic law today cannot be separated from the history of Islam in the archipelago itself. With this historical approach, a complete picture will be seen of how the process of wrestling Islamic law legislation, especially inheritance, as well as the aspects and forms of legislation that occurs. This research was conducted through a descriptive analysis approach, therefore the contribution of concrete ideas about the history of the implementation of inheritance law in Indonesia by experts was found

Abstract

Taqnin is an incorporation of Islamic law (fiqh) into a state legal system. The enacted Islamic law has a binding legal force and therefore must be obeyed all citizens. Since introduced by ‘Ibn Muqaffa’ in the reign of the abbasid caliph, the development of taqnin had experienced ups and downs. The taqnin was truly realized, when the Majallah al-Ahkam al-Adhliyah was implemented throughout the Ottoman Empire in 1293 AH/1878 AD. This paper discusses the history of the development of taqnin in Muslim countries, including Indonesia.

Abstract

Marriage is the initial process of starting a family life, in conducting marriage it is recommended also to carry out Walimah Al-rsUrsy or a wedding reception to inform the public that they are married so that later misunderstanding and slander will not occur. Walimah Al-rsUrsy means bridal food. The point is the food that is provided specifically at weddings. In Singkil Subdistrict, Aceh Singkil Regency in carrying out Walimah Al-'Ursy there is the Temetok custom, where each wedding party or circumcision, a large family will be summoned one by one to surround the bride or circumcision offer, then give a certain amount of money usually from the big family. giving in large quantities. With this custom, there are families who feel burdened. This fact raises the question: What is meant by Temetok adat in Walimah Al-'Ursy in Singkil District? What is the Temetok adat process in Walimah Al-'Ursy in Singkil District? -'Ursy in Singkil District ?. In this study the authors used a descriptive analysis method, which is a study that aims to describe a current reality. The technique used in obtaining data is by using field research as a source, namely by conducting interviews with related parties as well as observing and researching the literature, as secondary data, namely by studying and reading books, books book. As for the results that the authors found in this study and supported by the Qur'an and Al-Hadith and Islamic law, the Ulama are of the opinion that the Temetok customary law in Walimah Al-'Ursy is permissible, if no one feels objected and there is no who demanded to be returned with the custom. But if there are people who feel objected and demanded to be returned with adat, then the law is not in accordance with Islamic law. And this needs to be socialized by the Ulama to the people who are still implementing the Temetok custom.

Abstract

Abstrak : Tujuan penelitian ini adalah untuk mengetahui Peran Ilmu Falak dalam Menentukan Arah Kiblat. Jenis penelitan ini adalah penelitian kualitatif dengan teknik field research (Observasi, studi pustaka dan dokumentasi). Sumber data yaitu data primer dan data sekunder. Teknik analisis data dalam penelitian ini adalah miles and huberman, yaitu : reduksi data, penyajian data dan penarikan kesimpulan. Pembahasan pada penelitian ini adalah. Penentuan arah kiblat yang dilakukan oleh umat Islam di Indonesia mengalami perkembangan dari waktu ke waktu sejalan dengan perkembangan ilmu pengetahuan yang ada. Pertama kali, mereka menentukan arah kiblatnya ke barat dengan alasan Saudi Arabia tempat dimana Ka’bah berada terletak di sebelah barat Indonesia. Hal ini dilakukan dengan kira-kira saja tanpa perhitungan dan pengukuran terlebih dahulu. Oleh karena itu, arah qiblat sama persis dengan tempat matahari terbenam. Dengan demikian, arah kiblat itu identik dengan arah barat.Kata Kunci: Ilmu Falak, Kiblat

Abstract

Berbicara tentang Maqashid syariah tentu tidak akan terlepas dari pandangan yang sangat brilian dari Imam Syatibi> yang dia tulis dalam bukunya yang berjudul al-Muwafakat. Tulisan ini membahas tentang maqasid syariah dalam perspektif Imam Syatibi dan dasar-dasar dalam pentukan teori maqashidnya. Tulisan ini menemukan bahwa Dalam teorinya tentang maqasid, Imam al-Syathibi membaginya menjadi dua yakni maksud Syari’ dan maksud maksud mukallaf. Dalam teori yang dikemukakan oleh Syatibi dapatlah disimpulkan bahwa dasar taklif sendiri adalah demi untuk kemashlahatan. Karena itu tidaklah mungkin Allah swt sebagai Syari’ memberikan taklif yang diluar batas kemampuan manusia. Syathibi membangun dasar-dasar teori maqâshid syarî‟ah dengan membagi tiga bagian utama yaitu: Pertama, masalah ta‘lil dan al-mashâlih wa al-mafâsid. Kedua, terkait dengan cara untuk mengetahui maqâshid dan ketiga merupakan operasionalisasi ijtihad al-maqâsyid  terhadap teks dan hukum.

Abstract

Divorce is the breaking up of a legal relationship, also known as talak. In Islamic civil law literature (fiqh) in Indonesia, divorce can be filed by the husband (cerai talak) and divorce can also be filed by the wife (cerai gugat). The divorce proposed by the husband in the fiqh literature is called talak, while it is called the divorce proposed by the khuluk wife (ransom divorce) with the wife's obligation to pay 'iwadh. Between divorce by way of talak and divorce by way of khuluk husband or ex-husband has different obligations as regulated in the Compilation of Islamic Law. This study was conducted to find out the judge's legal considerations regarding the imposition of Iddah and mut'ah living expenses in divorce cases with verstek decisions and their relevance to the imposition of Iddah and mut'ah living expenses in litigation divorce cases. 991/PDT.G/2022/PA.Srh. in terms of the Compilation of Islamic Law. This research is a qualitative research with an empirical juridical approach. The primary data in this study is the decision of the Sei Rampah Religious Court No. 991/PDT.G/2022/PA and secondary data in this study include the Marriage Law, the Compilation of Islamic Law, books, journals and relevant previous research. The data analysis method of this research is descriptive analytical with a deductive pattern. The data collection instrument is the document study method on the decision no. 991/PDT.G/2022/PA.Srh. and interviews. The results showed that the judge's main considerations based on SEMA No. 3 of 2018 concerning the implementation of the formulation of the results of the 2018 Supreme Court Chamber Plenary Meeting as a Guide to the Implementation of Duties for the Court. The legal formulation of the Religious Chamber stated that the wife in a divorce case can be given mut'ah and 'iddah maintenance as long as it is not proven nusyuz.  Keywords: Iddah, Mut'ah, Divorce, Verstek Decision

Abstract

Setiap orang pasti memiliki alasan tersendiri dalam menggunakan produk kosmetika. Namun, sangat disayangkan dilapangan dalam praktek pemilihan produk kosmetik. khususnya dikalangan Mahasiswi FSH UINSU asal dalam memilih produk kosmetika, mereka lupa bahwa Fatwa MUI Nomor 26 Tahun 2013 telah mengatur tentang standart kehalalan produk kosmetika dan menggunaannya. Studi ini diarahkan pada metode penelitian hukum empiris, dan jenis penelitian ini adalah penelitian lapangan (Field Research), data diperoleh dari hasil wawancara, pengumpulan data dan dokumentasi. Dari penelitian ini ditemukan bahwa Mahasiswi dikalangan FSH dalam praktek pemilihan produk kosmetika belum memiliki kesadaran hukum yang cukup dalam memilih produk kosmetika halal, bahkan banyak dari mereka yang belum mengatahui bahwa ada Fatwa MUI yang mengatur tentang hal ini. Selain itu, beberapa tokoh MUI  Kota Medan sepakat mengatakan dalam praktek pemilihan produk kosmetika harus memperhatikan komposisi dan  bahan yang terkandung didalamnya, dan menjadikan produk yang bersertifikasi halal sebagai acuan dalam memilih produk kosmetika agar terhindar dari kemudharatan dan sesuai dengan syariat islam dan merasa lebih aman.Untuk itu perlulah untuk melakukan edukasi agar setiap masyarakat khususnya dikalangan mahasiswi fakultas Syariah dan hukum bisa sadar dan dengan keinginan dirinya sendiri untuk menggunakan produk kosmetika yang sudah bersertifikasi halal.

Abstract

ABSTRACT : This thesis is titled “ Divorce was done by the Hakam in a Petaling Jaya Selangor Syariah Court, Malaysia” ( Analysis based on the opinion of the Imam Syafi‟i). The main problem in this study is, first is to knowing the execution by the Hakam. Second, factors that cause justice can divorce. Third, studied the Imam Syafi‟i view of the divorce in lower syariah court of Petaling Jaya Selangor. Researchers use empirical legal examining divorce-related arrangements that is conducted by hakam contained in section 48, Enactmen Islamic Family Law ( Selangor State) 2003. This research uses data collection techniques with library and field studies. The results showed that and several authorized employess. The results showed that the inauguration of hakam was made after the court agreed to the dispute ( shiqaq) that is always in effect in the period of marriage after the completion of peace affairs at the level of the Office of Peace ( Juru Damai) failed or did not find a way out. Therefore, hakam has the role of gaining authority in pronouncing divore rather than husband if the process of reconciliation fails and the husband is reluctant to recite the divorce. The factors which cause hakam to divorce are the first is, royal taqnin as stipulated by the statutory obligation for the people to obey it. Second, defending the fate of women hung without strings. Third, be a solution for the wife if the husband is reluctant to divorce even though it has caused harm. However, in the opinion of the Imam Syafi‟i here that does not require a wife to sue for divorce on the grounds of shiqaq. On the contrary, the judge who hears these demands should appoint hakam for the husband and hakam for the wife in order to reconcile the husband and wife. Abstract

ABSTRAKArtikel ini di susun melihat fakta yang terjadi di lapangan, di Mesjid Bustanul Mukminin yang mana terjadi perbedaan arah kiblat dalam melaksanakan salat berjamaah. Kenyataan ini menimbulkan pertanyaan: Apa alasan masyarakat desa sehingga terjadi perbedaan arah kiblat dalam melaksanakan salat berjamaah? Bagaimana hukum melaksanakan salat berjamaah dengan mengarah ke dua arah kiblat dalam perspektif  dari Maqashid Syariah? Untuk memperoleh jawaban dari pertanyaan itu studi ini menggunakan metode penelitian kualitatif yang bersifat deskriptif dan analitis, dengan sumber data literatur-literatur yang terkait dengan fokus penelitian dan data dikumpulkan dengan cara wawancara, melihat kitab-kitab yang berkaitan dengan permasalahan, dan juga data melalui perhitungan, selanjutnya data yang terkumpul dikelompokkan dan dianalisis. Berdasarkan analisis dari data-data tersebut dapat diambil kesimpulan bahwa : yang menjadi penyebab terjadinya perbedaan arah kiblat ketidaktahuan sebahagian besar masyarakat tentang pentingnya melaksanakan salat tepat mengarah ke arah kiblat, yang notabene mengarah tepat ke arah kiblat yang benar adalah salah satu syarat sah salat, perbedaan tersebut juga disebabkan karena keegoisan masing-masing pihak dalam menyikapi kebenaran yang ada karena antara nazir dan sebahagian jamaah masih tetap berpegang teguh pada pendapatnya masing-masing, padahal MUI sendiri telah mengeluarkan fatwa mengenai arah kiblat bahwa arah kiblat untuk daerah Indonesia adalah ke arah  Barat Laut dengan kemiringan bervariasi di setiap daerah. Mengenai hal ini ulama Kabupaten Langkat juga memberikan pendapatnya bahwa salat berjamaah yang mereka laksanakan masih sah karena masih mencukupi syarat salat berjamaah, namun bagi makmum yang tidak mengikuti imam dalam melaksanakan salat maka salat makmum tersebut telah batal, hal ini juga termasuk apabila makmum tidak mengikuti arah kiblat yang dipercayai oleh imam, namun apabila makmum tetap yakin dengan arah kiblat yang diyakininya dan mempunyai dalil untuk itu maka apabila ia melakukan Mufaroqoh dalam salat berjamaah maka salatnya masih dikatakan sah dan tidak batal.Kata Kunci : Kiblat, Salat, Mufaroqoh, Jamaah, Maqashid Syariah

Abstract

Garbage is leftover material from human and natural activities. The problem of waste has not been resolved until now. The lack of awareness of everyone to protect the environment can be seen from the amount of waste that is not in its place. This research is a library research or library research. Based on the results of the study, the authors conclude that littering as stipulated in the Medan City Regional Regulation Number 6 of 2015 concerning Garbage Management, littering is prohibited and there are criminal provisions as Article 32 and Article 35 of Medan City Regional Regulation Number 6 of 2015 2015 concerning Waste Management, namely for people who throw garbage carelessly, they are threatened with imprisonment for a maximum of 3 (three) months or a fine of up to Rp. 10,000,000.00 (ten million rupiahs) whereas, for legal entities that commit it, they are subject to a maximum imprisonment 6 (six) months or a maximum fine of Rp. 50,000,000.00 (fifty million rupiah). Judging from the sanctions that have been stipulated in the regional regulation, the implementation that has taken place in the field has not gone according to what has been stipulated. This results in many people throwing garbage carelessly and causing even greater adverse impacts. In Fiqh Jinayah or Islamic Criminal Law, behavior that can harm living things is said to be jinayah behavior. Disposing of garbage indiscriminately can be categorized as ta'zir, where the sanctions against the offender are not specified in the texts, even though the Koran prohibits damaging the environment, the effect can threaten human rights, namely destroying the objectives of Islamic law itself, which is commonly referred to as maqasid Sharia. maintaining religion, soul, mind, lineage, and property.
