Abstract

Actually, many public sectors are directly related to the age of marriage, namely, the issue of population rates (infant birth rate and maternal mortality); raising the level of education; early-age marriage; until efforts to anticipate the level of divorce. Therefore, from the classical to the contemporary era, the age of marriage is indeed something that must be considered in legal policy. This aspires to achieve marital goals and help structure modern society. The data shows that there were 332,489 cases of sued divorce and 133,971 cases of divorce were submitted to religious courts during 2015 throughout Indonesia. The total number of divorce cases in PA during the year was 466,460 cases. This means that there are 1,277 divorce cases per day or 53 divorce cases every hour. Therefore, the upstream problem needs to be considered, in this case the dilemma of the minimum age of marriage. The age of marriage is also one of the themes of family law reform in various Muslim countries. There are variations in numbers and attitudes from various countries.

Abstract

Terkait hukum money politics dalam pemilu, para mayoritas peneliti muslim berpendapat haram, karena money politics sama dengan risywah (suap menyuap). Larangan tersebut ada dalam al-Qur’an sebagai sumber utama hukum Islam. Namun ada ulama membolehkan risywah (penyuapan) yang dilakukan oleh seseorang untuk mendapatkan haknya dan atau untuk mencegah kezhaliman orang lain. Dalam penelitian ini, penulis menganalisa dengan menggunakan metode ijtihad fath al-dzari’ah, penulis menyimpulkan bahwa money politics diperbolehkan dengan beberapa catatan: pertama, tujuaan untuk mempertahankan hak dan mencegah kedzoliman. Kedua, money politics-nya untuk kemashlahatan umat, bukan perorangan, misalnya untuk semenisasi perumahan, sumur bor untuk masjid atau untuk masyarakat sulit air dan lain-lain.  Ketiga, sulit menghindar untuk tidak money politics, contoh kalau ingin menang dalam pemilu, politisi ingin mengumpulkan massa ingin sosialisai programnya. Maka ia harus mengeluarkan uang untuk biaya minum dan makan masyarakat, dan itu sulit untuk dihindari, dan itu termasuk bagian dari money politics.

Abstract

Factors that cause Indonesia to be selected as a transit country for refugees and asylum seekers, among them are first, Indonesia has a vast marine territory of long coastline, but is not supported by strict rule of law. Secondly, Indonesia's position is very weak in addressing the problem  of asylum seekers and refugees from other countries because it has no national regulations that specifically address the issue. Third, the lack of facilities and infrastructure in handling refugees and asylum seekers. Fourth, the presence of  UNHCR  in  Jakarta  became  a  refugee  attraction.  Fifth,  the  culture  or culture of Indonesia, known for its hospitality, gives the impression that Indonesians can easily accept the arrival and whereabouts of refugees. The setting up of asylum seekers and refugees should be  placed in immigration legislation because the issue of asylum seekers and refugees is a foreigner's (immigration status) problem, which touches on international aspects. The handling of refugees, immigrants and asylum seekers faces several obstacles in the process of handling them: First, Internal Constraints; A) the absence of standard standards in legislation regarding the handling of illegal immigrants. b) The legal vacuum that comprehensively regulates asylum seekers and refugees in Indonesian positive law, weakens coordination among agencies in the field. c) Lack of immigration quarantine facilities to accommodate asylum seekers and refugees, d) Limited regular funds. Second, External Constraints. a) Local Government objected to the additional burden of the arrival of troubled foreigners. b) The often sharp distinction between regional culture and the culture of displaced potential foreigners brings about social conflict. c) Arise of social jealousy of the refugees received free humanitarian assistance in the form of shelter and living expenses, while local residents live in a state of deprivation. Residents do not realize that the aid is not from the government, but from UNHCR and or IOM. D) Often the assimilation between asylum-seeker men and refugees with local women, precisely leaves the child's burden. -the children who turn up when repatriation or resettlement are not brought along.

Abstract

The principle of pacta sunt servanda and good faith (good faith) is the basic norms and principles in carrying out international relations carried out between countries and international organizations. This principle is also an important element in implementing international agreements and also being an amplifier so that the agreement must be carried out by the parties to the agreement. The above principle also contains sanctions and consequences if one party breaks the contents of the agreement. So modern western European civilization grew above Islamic civilization. Therefore, the understanding and provisions of Islam cannot be separated from the material and international understanding with various provisions, ranging from organizations, relations between countries to international agreements. Islam highly upholds the agreement and does its best, this can be seen. Never mentioned in the long history of the Muslims, especially in the golden days of Islam that they fell in treason against the agreement that was held with the non-Muslims. Compliance and seriousness in implementing agreements for Muslims is not just a form of agreement, but this will also involve the faith and character of a Muslim in keeping his promises, therefore the principle of pacta sunt servanda and good faith is a principle that is upheld by Muslims even though it is mentioned by different mentions and sentences

Abstract

The Right of Investigation based on article 77 (3) Law Number 7 of 2014 is the right of the House of Representatives in exercising to control the government policies. In the development the Right of Investigation is often used for the interests of the political parties. This research aim to evaluate the implementation of the Right of Investigation of the House of Representatives to the State Institutions particularly in case of the Corruption Eradication Commission and the Bank of Indonesia. This research by using constitutional and legislation approach. The results of this research found that the House of Representatives has reached the end of the process in making the Right of Investigation to the Bank of Indonesia, and the Corruption Eradication Commission that is the suggestion However there is no further implementation from the Government, the Bank of Indonesia, and the Corruption Eradication Commission. The House of Representatives has to make the Right of Investigation wisely. In the making of the Right of Investigation not merely in the basis of political interest.

Abstract

Many previous studies have discussed the themes of endogamy and exogamy marriage, but the differences in the characteristics of this study are that the people studied are in the majority Catholic region, and consist of various ethnicities and cultures. For the Alor Muslim community who still prohibit endogamous marriage due to biological and geneological reasons. Changes in the times and development of society changed the thinking paradigm of some Alor people regarding the prohibition of endogamous marriages that were becoming obsolete. This study wants to see what factors influence the shift in perspective and how the relationship between the Customary, Islamic and State legal systems influences each other in the Alor tribal system in general. John R Bowens legal pluralism theory is used to explain the three legal systems that apply in the life of the Muslim community of the Alor people in Atambua. While the theory of customary law and Islamic struggle is used to see the extent of the dialogue between the two legal systems in understanding the prohibition of endogamous marriage

Abstract

Salah satu persoalan dalam hubungan antar umat beragama ini adalah masalah pernikahan Muslim dengan non-muslim yang selanjutnya kita sebut sebagai “pernikahan beda agama”. Hal ini telah mengakibatkan pergeseran nilai agama yang lebih dinamis daripada yang terjadi pada masa lampau. Seorang muslim laki-laki dan muslim perempuan ini lebih berani untuk memilih pendamping hidup non-muslim. Dapat disimpulkan bahwa Jika Negara melegalkan pernikah beda agama di Indonesia maka sama saja Negara menabrak hukum-hukum agama yang ada di Indonesia, dan melanggar Pasal 29 Undang-Undang Dasar 1945 yang menjamin setiap warga Negaranya untuk memeluk agama dan ibadat menurut agama dan kepercayaannya, sedangkan tiap-tiap agama mempunyai tata cara atau ibadat perkawinan yang berbeda-beda. Pandangan HAM di Indonesia seharusnya lebih merujuk kepada pengaturan HAM yang ada di Undang-Undang Dasar 1945, bukan merujuk kepada DUHAM yang kita sendiripun tidak tahu siapa yang membuatnya dan bahkan apa agendanya bagi Negara yang masih kental keagamaannya.

Abstract

Desa Adat telah ada sebelum Negara Indonesia terbentuk. Setelah Indonesia merdeka, Desa Adat masih tetap ada. Akan tetapi, pada masa pemerintahan rezim Orde  Baru,  Desa-desa Adat yang  ada  diseragamkan melalui Undang-Undang Nomor 5 Tahun 1979 tentang Pemerintahan Desa. Hanya ada beberapa Desa Adat yang masih terus terjaga eksistensinya. Salah satunya yaitu Nagari yang masih eksis di Sumatera Barat. Dari uraian di atas, kiranya menarik untuk mengkaji mengenai eksistensi Nagari di Sumatera Barat sebagai Desa Adat dalam sistem ketatanegaraan di Indonesia, terutama setelah  lahirnya  Undang-Undang  Nomor  6  Tahun  2014  tentang  Desa. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Penelitian ini menggunakan pendekatan peraturan perundang- undangan.   Hasil   penelitian   menunjukkan   bahwa   eksistensi   Nagari   di Sumatera Barat merupakan ‗buah‘ dari  perjuangan panjang masyarakat Minangkabau dan pemerintah daerahnya. Lahirnya Undang-Undang Nomor 6 Tahun 2014 tentang Desa semakin memperkokoh landasan hukum bagi Nagari   untuk   tetap   menjaga   eksistensinya   sebagai   warisan   budaya Minangkabau di Sumatera Barat

Abstract

Regulations and hadith texts explain there is no prohibition to marry when both are equal. Equality is a concept of equivalence between the couples who want to get married to get a sakina, affection and mercy family. In this concept, religious elements is the main and most important in equality. While the others just as a supporting factor, such as: education, offspring, position and economic degree. In determining the partner, every one should be understood the equality concepts and criteria in integrated, inductive and comprehensive, what intended to avoid mistakes in choosing a good couple. In this article, the author examine about: the equality relevance on household harmony in terms of normative and juridical value.

Abstract

Tulisan ini bertujuan untuk menggambarkan upaya Indonesia dalam melakukan upaya pengembalian aset tempat wisata sebagai hasil dari korupsi dalam kerangka undang-undang, dengan menggunakan penelitian kepustakaan yang didasarkan pada literatur. Hasil penelitian ini mengungkap bahwa pengembalian aset tempat wisata yang merupakan hasil dari korupsi menjadi tantangan tersendiri untuk Indonesia karena mengingat dampak yang diakibat dari pengembalian aset tersebut akan timbul masalah lagi, seperti tata pengelolaan yang harus direkonstruksi sehingga perlu terus dilakukan secara masif. Hasil laporan dari Indonesia Corruption Watch (ICW) menyatakan kurang lebih Rp 3 triliun total kerugian negara yang ditimbulkan  dan 482 kasus korupsi sepanjang 2017, meskipun Indonesia memiliki lembaga yang fokus pada pemberantasan dan pencegahan korupsi seperti KPK. Selain itu, diperlukan juga kerjasama secara kolektif utuk membasmi korupsi serta menyelamatkan aset negara yang ada di Indonesia.
