Considering the important role of historical, cultural, social, and attitudinal aspects in the study of law, there has been a shift from instrumental law to constitutive law. While instrumental law considers law beyond the social and cultural spheres, constitutive law integrally embraces law, politics, ideology, and action. Legal consciousness is an important asset for marginalised people who are at high risk of discriminative treatments in occupational and social life. Not only will they are legally aware of their rights and obligations at works, they will have adequate knowledge of where and how to name, blame, and claim in case mistreatment do occur. Legally proficient will allow them build legal protection which is not adequately provided by the authorized bodies.

Tijaniyah tarekat including one fast-growing tarekat in South Kalimantan. At first the congregation is growing in South Kalimantan in 1995, brought by KH Ahmad Ansari is based in the city of Banjarmasin, then spread to various areas in South Kalimantan, Central Kalimantan and even into the Bangkas island. In South Kalimantan there are 21 tarekat and majelis taklim 4 shrines, with the number of followers of about 15,000 people. Tijaniyah congregation has its own characteristics when compared with other tarekat, namely: a) it takes a new format of tarekat, because Ahmad at-Tijani did not require his followers showed the attitude of excessive piety, and he emphasizes the presence of an interpreter intercessor between man and God. It was Ahmad at-Tijani itself. b) It has simple and clear wirid; c) Ahmad at-Tijani recognition reaches two positions, namely as a guardian Qutbb al-Aqthab and khatm al-Waliyah; d) prohibits its followers to follow as membership other institutes; e) it has no pedigree. Even if there are genealogy is shorter than the other tarekat, and f) this tarekat prohibits its followers to smoke because it is considered as najis.

Perkembangan tasawuf di Nusantara menjadi salah satu icon dalam melihat persoalan sufistik. Keragaman pemikiran tasawuf sangat mewarnai pola kehidupan beragama, sedangkan praktek keagamaan yang menjadi refresentasi dari ragam pemikiran beragama menjadi sangat bervariasi dan tidak jarang dihiasi dengan wacana "kontroversial" yang sangat tajam, sehingga terkadang saling mengkafirkan satu dengan lainnya. Dalam konteks institusi keagamaan yang tergolong dalam tarikat juga mempunyai varian yang bermacam-macam, sehingga berbagai kelompok tarikat tersebar di mana-mana dan mempunyai ciri khas masing-masing sesuai dengan wacana keagamaan dan "pengalaman beragama" pengembang tarikat. Dalam beberapa kenyataan ada saja "perbedaan" antara pelaksana tarikat di suatu daerah dengan daerah lainnya meskipun dengan tarikat yang sama. Syeikh Muhammad Arsyad al-Banjari sebagai penulis yang produktif dalam berbagai bidang ilmu-ilmu keislaman, seperti tauhid, fiqh dan tasawuf. Di antara karya beliau adalah kanz al-marifah yang bercorak tasawuf namun dalam beberapa pembahasannya berhubungan dengan praktik keagamaan dan sangat dekat tradisi tarikat, namun tarikat Sammaniyah yang selama ini di dekatkan dengan Arsyad al-Banjari tidak begitu tampak dalam kanz al-marifah namun tarikat Syaziliyah lah yang lebih tampak.

This article presents the research methodology of hadith in the motivation books in Malaysia. There are ten books have been collected and 149 of hadith that have been research in this study. However, the researchers only studied 123 hadith, while 26 hadith are repeated. Based on the analysis of the status of 123 hadith, the researchers found 75 hadith were rated as maqbul hadith (Sahih and hasan), 42 hadith have had on the chain (sanad), and the remaining 6 hadith undetermined status. This study is a contribution to the writing of Islamic studies to enable the reader to know the status of the hadith set forth in motivational books whether it is accepted or rejected. In addition, this study also provides a set of guidelines for writers of motivational books genre to present hadith into their works. It would be beneficial to authors who have no background in Islamic studies and studies of hadith in producing better quality.

To understand the Islam in South Borneo through politics and government aspect must be started from the beginning of Banjar Kingdom as the first islamic kingdom in South Borneo. The Banjar kingdom found by Raden Samudera titled Sultan Suriansyah in the couple of 1525 M. The leader of Banjar Kingdom put Islam as the state official religion. In 1860 M, the Banjar kingdom was dismissed by the collonial dutch government. Since that time, the muslim people in south Borneo had no rule in politic and government. When Indonesia declared his independence and did the general election in 1955s, the political aspiration of muslim people given to Nadhatul Ulama and Masyumi while the next general election (1971-1997), the votes of Islamic party decreased slowly.

The Text of Sakrat al-Maut written by Abdurrauf Assingkili that was collected along with the text of Syar?b al-?syiq?n written by Syekh Hamzah Fansuri and the text of Hujjatus Shidd?q written by Syekh Nuruddin Arranir as well as other writings in the manuscript of Nagara strengthens the influence of the Islamic scholars on Islamic studies in Banjar. Philologically, this manuscript was regarded as a copy made in the 19th century, and it was not the initial manuscript written by Sheikh Abdurrauf in the 17th century. The circulation of Sakrat al-Maut manuscripts is not widespread. It is evident with the minimal number of manuscripts that were found / recorded in the catalog. In Banjar, the teachings contained in the manuscript text of Sakrat al-Maut is not fully adopted by next Banjar scholars.

Rampant fraud masquerading as MLM, make this business less sympathetic received from the public. One way to distinguish between MLM and Money game is to see whether a business development company that has been listed by the DSA (APLI) or not. In the system, MLM is a network that works in stages by utilizing the results of the sales turnover of not recruiting members. Bonus received was the work of members who have successfully marketed the product to others. Enterprise as the system has set bonuses and rewards for members who successfully achieve sales target at certain levels and indeed the achievement of these targets is a motivation for other members to work hard to market their products. The basic concept, how the system works and products/services are marketed throughout the engagement does not conflict with the principles of Islam is deemed valid and should be developed for the benefit of mankind.
