Abstract

Outsourcing memiliki tujuan strategis dan tujuan berjangka panjang. Tujuan strategis dari suatu outsourcing, yaitu bahwa outsourcing digunakan oleh perusahaan untuk meningkatkan kemampuan dan keunggulan kompetitif perusahaan agar dapat mempertahankan hidup dan berkembang. Terdapat dua jenis perusahaan outsourcing yaitu Perusahaan Pemborong Pekerjaan dan perusahaan penyedia jasa, permohonan perizinan dapat di terbitkan dalam waktu paling lama 30 hari kerja sejak permohonan diterima. Izin operasional diberikan dalam jangka waktu 5 tahun dan dapat diperpanjang, pendaftaran perjanjian outsourcing dilakukan di Direktorat Jendral Pembinaan Hubungan Industrial Kementrian Tenaga Kerja dan Transmigrasi. Muncul persoalan kemudian ketika perusahaan penyedia jasa pekerja/buruh melakukan pemberian pekerjaan diluar negeri, hal ini belum ada pengaturannya sehingga ada kekosongan hukum. Pendaftaran perjanjian pekerja outsourcing harus melampirkan draf perjanjian kerja antara perusahaan penyedia jasa dan pekerja/buruh, jika perusahaan penyedia jasa tidak mendaftarkan perjanjian, maka instansi yang bertanggungjawab dibidang ketenagakerjaan dapat mencabut izin operasional.

Abstract

On 23th November 2018, the Federal Security Service of the Russian Federation ("FSB") destroyed and captured three of Ukrainian Military Vessel, as well as detaining 24 of its personnels. As the dispute continues, Ukraine raised this matter to the International Tribunals on Law of The Sea (?ITLOS?), requesting a provisional measure pursuant to Article 280 paragraph 5 UNCLOS to release the vessels and personnels detained. ITLOS has made its order on 25th May 2019, ruling that Russia must release the detainee and return the vessels immediately to Ukraine. However, Russia refused to enforce the order and denied ITLOS jurisdiction over this matter due to the involvement of military aspect in the incident. Therefore, this paper provides an answer to the questions whether Russia?s act constitutes a violation to international law and whether ITLOS has the jurisdiction over the dispute.

Abstract

Demokratisasi di daerah melalui pemilihan kepala daerah bertujuan melahirkan pemimpin daerah yang berkualitas dan berintegritas sehingga dapat mewujudkan daerah lebih baik, fenomena korupsi di daerah setelah penerapan desentralisasi dan otonomi daerah merupakan suatu hal yang penting. Bahwa proyek, sesuai aspirasi rakyat ternyata belum sesuai dengan harapan dan tujuan. Penangkapan melalui oprasi tangkap tangan beberapa kepala daerah yang terlibat korupsi adalah bukti nyata dari cermin buram proses demokrasi di daerah. Pendekatan kajian ini menggunakan tela’ah data skunder dengan analisis deskriptif. Beberapa temuan menunjukkan bahwa ada beberapa sebab menguatnya gejala korupsi di daerah yang dilakukan oleh para kepala daerah disebabkan antara lain karena biaya pemilihan kepala daerah yang mahal, kurangnya kompetensi dalam pengelolaan keuangan daerah, kurang pahamnya peraturan, dan pemahaman terhadap konsep budaya politik yang salah. perlu ditinjau ulang system pemilihan kepala daerah secara langsung untuk dapat mengatasi korupsi di daerah.

Abstract

L’octroi de procuration se compose de deux personnes, l’une en qualité de mandant tandis que l’autre en qualité de mandataire tel que prévu à l’article 1792 du Code Civil. Cependant, le juge a le pouvoir de nommer le mandant sur la base de l’Arrêt du Tribunal de District de Bandung no 204/Pdt.G/2015/PN. Bdg. Il est donc nécessaire de revoir ce cas avec les questions juridiques discutées, à savoir la validité de l’octroi de procuration de vendre par le juge basé sur le droit agraire et les conséquences juridiques de l’exercice du transfert de droit foncier par la decision de justice. La méthode utilisée est une méthode de recherche juridique normative, à savoir la recherche sur les principes juridiques, le concept juridique comme la norme positive. Ensuite, la donnée utilisée est la donnée secondaire. Alors que la méthode d’analyse des données utilisée par l’auteur est une méthode qualitative et l’instrument de collecte des données utilisé est l’étude des documents. Les résultats de cette étude sont que la nomination de procuration par le juge dans l’Arrêt du Tribunal de District de Bandung no 204/Pdt.G/2015/PN. Bdg ne remplit que deux éléments de ce qui devrait être quatre éléments, conformément à l’article 1792 du Code Civil et à la théorie de lastgeving, que l’octroi de procuration de vendre par le juge dans l’Arrêt du Tribunal de District de Bandung no 204/Pdt.G/2015/PN. Bdg n’est pas valide. La conséquence juridique du transfert de droit foncier est que la plaignat peut directement enregistrer ses droits au bureau foncier en soumettant une copie officielle de la décision de justice qui a obtenu la force juridique permanente (l’Arrêt du Tribunal de District de Bandung no 204/Pdt.G/2015/PN. Bdg) au Chef du Bureau Foncier. Cette étape a été réglementée à l’article 55 paragraphe (2) de Règlement Gouvernemental no 24 de 1997 concernant l’Enregistrement Foncier en liaison avec l’article 125 de Règlement du Ministre des Affaires Agraires/ du Chef de l’Agence Foncière Nationale no 3 de 1997 concernant la Disposition d’Application du Règlement Gouvernemental no 24 de 1997 concernant l’Enregistrement Foncier en joignant également la copie du Rapport d’Exécution, le certificat de droit foncier et l’identité du plaignat comme le demandeur.

Abstract

This doctrinal research explained the practice of corporate crime modus. The primary data was interview result with Director General, who was share buyer, meanwhile, secondary data was company document that was related to the case, and it was analyzed qualitatively by hermeneutic interpretation techniques. Furthermore, research result showed that the impact of corporate crime law was the company must be liable in either criminal law or civil law although the managers of the company had changed.

Abstract

Susension of Payment (PKPU) is the time given by the law through the commercial court’s judgment where the Creditor and the Debtor are given the chance to discuss the ways to pay their debts by giving the payment plan as a whole or in partial, including if it is considered necessary to restructure the debts. It is known that there is the implementation of the peace agreement in PKPU. The parties in the implementation of the peace agreement are the Creditor and the Debtor. Moreover, it is also known that there are Preferred Creditor and Concurrent Creditor. However, in regard to the classification of the Creditors, there are several cases that show that the Creditor’s legal standing is debatable and it creates a problem during the implementation of the peace agreement in PKPU.

Abstract

In a legal state, land has a very important role in human life. It can determine the existence and the sustainability of legal actions. In its development, the government or private sector companies provide Official Residences to their employees, or what may be called a state house. Based on the law, the Official Residence is a building owned by the state, and functions as a residence or a dwelling. It serves as a developmental facility for families and supports the job implementation of officials and/or government employees. The humans’ need for land as a place of dwelling may cause conflicts regarding the provision of the Official Residence. The method used in this research is the juridical-normative method. It uses secondary data. The ownership rights transfer of the Official Residence to private sectors may happen without violation of the constitution, as it is regulated in the Presidential Decree No. 11 of 2008 which states that the tenant may own the Official Residence with some conditions. For example, the house must be an Official Residence Group III. The rightful tenant must file a request to its related Department. Then, the tenant and the related department create a Lease Agreement. After the tenant settles the debt, he/she may own the house.

Abstract

The case of work termination which involves businessowners and labor happens widelyin various companies due to the Covid-19 pandemic in Indonesia. This research usesthe normative legal research method. During this Covid-19 pandemic, this worktermination is carried out to save the company and to prevent more victims. Problemswhich happen regarding work termination include the reasons for this termination andthe post-termination compensation. Work relations is a reciprocal relationship which isbased on a two-party agreement. The legal protection for work termination may becarried out during this Covid-19 pandemic. If the rights stated above are not obtainedby the workers, then they may initiate a deliberation. They may also go through conflictresolution procedures on industrial relations outside of court, based on the Republic ofIndonesia’s Constitution No. 2 of 2004.

Abstract

The election of the local government is conducted democratically and it creates many chaos. The resolution of the election disputes is carried out in Supreme Court from the Local Government. One of the democracy forms is by establishing a general election. The solution in overcoming the election of the regional head which is done in the Constitutional Court creates vagueness which then supports the creation of Special Judicature. This analysis has two problems: (1) why is the Special Judicature needed? (2) What are the rules of Special Judicature to settle the dispute of the local government election. To discuss the problems, the researcher uses the doctrinal research using normative juridical approach with deductive thinking method, positivism paradigm then it is analyzed using perspective descriptive method. The results of this analysis are (1) the reason of the creation of special judicature, whether it is Supreme Court or Constitutional Court has no power in overcoming the problem of regional election; to solve the problem there needs to be a special institution to achieve justice. (2) The rules of special judicature are substantive and structural. Substantive means that it must provide law events, structural means a form of an ad hoc. The ad hoc judge is chosen from ex Constitutional Court judge or academician who is expertise in local autonomy and general regional election law. The special judicature should be located in every province.
