Abstract

Abstract: Forestry crime cases in their settlement require expert testimony to provide an explanation of the rules that apply to the management of Protected Forest Areas. This research aims to determine the role of expert witnesses and to find out the obstacles faced by expert witnesses and efforts to overcome the obstacles faced by experts in providing testimony as expert witnesses in the settlement of criminal acts of land grabbing in protected forest areas in Nagari Gurun, Harau District, Lima Puluh Kota District. The results of the research explain that the role of expert witnesses is very important in the trial process, expert witnesses provide information that helps the course of the trial to be clear and bright. Evidence of expert testimony is placed in second place as systematized in Pasal 184 KUHAP. Obstacles as an expert witness in trials or investigative activities, namely 1) Expert witnesses are appointed based on their inherent position not on the specific expertise they have, 2) Lack of competence development activities for ASN in the field of special expertise in forestry and 3) Limited number of Forestry PPNS. Efforts that can be made include 1) Appointing expert witnesses who have certified expertise and knowledge, 2) Holding ASN competency development activities specifically on technical activities in Forestry and 3) Holding PPNS Formation Training.Keywords: Expert Witness, Crime, Forestry.

Abstract

This case involved a dispute over a sale and purchase agreement that was heard by the Bukittinggi District Court under number 2/Pdt.G/2022/PN Bkt. The defendant was charged with unlawful conduct, but defended himself by arguing that his actions could not be categorized as unlawful. The essence of the problem in this dispute is that the plaintiff denies the existence of a sale and purchase agreement, which is the basis of the claim. The formulation of the problem of this research is to find out how the defense of the defendant I’s property rights in the face of the verdict and what defense theory is used, as well as the consideration of the panel of judges in deciding the case. The research method used is the Descriptive method with a Normative Juridical approach, which only uses written regulations from the library as a secondary data source. The results showed that Article 1918 of the Civil Code gives the opposing party the right to submit counter proof to a decision that has permanent legal force. In defending property rights, there are several important elements that can be considered, such as proof of ownership, breach of agreement/contract, and violation of law or procedure.

Abstract

Abstract: This research is motivated by what factors influence a person in making a purchasing decision, including brand image and physical evidence. The decision to buy a product or service is largely determined by the assessment of the quality of the product and service. So because of that this study aims to examine how the influence of Brand Image and Physical Evidence on Residents' Decisions at the Amaris Muaro Bungo Hotel. This study used a quantitative approach, with a sampling technique using purposive sampling. The population and sample in this study are guests who have stayed or are currently staying at the Amaris Muaro Bungo Hotel. Data collection techniques using data collection methods using questionnaires and adapted questionnaires in the validity and reliability tests. Data analysis techniques include data description, analysis requirements test through normality test, heteroscedasticity test, and multicollinearity test. In addition, hypothesis testing is carried out by applying multiple linear regression tests. The results of this study indicate that the Brand Image and Physical Evidence variables have a positive and significant influence on management decisions at Amaris Muaro Bungo Hotel. More specifically, the contribution of the Brand Image (X1) and Physical Evidence (X2) variables to the residential decision (Y) is 64.1%, while 33.9% is influenced by other variables.Keywords: Brand Image, Physical Evidence, Stay Decision.

Abstract

This research aims to provide an overview for hospitals about how to present hospital financial reports using case studies in education hospitals. This research will describe how education hospital presents its financial reports, then this research will also show the quality of the hospital's financial reports and the hospital accountant's understanding of financial reports. The presentation of financial reports for non-profit entities is regulated in ISAK 35. A hospital is a non-profit entity, this means that the hospital uses ISAK 35 in presenting its financial reports. The data in this research was obtained through a survey of financial reports and interview with accountants in charge of presenting financial reports. The education hospital used as the object of this research has fully implemented ISAK 35. The quality of financial reports and the Hospital accountant's understanding of financial reports were found to be very good.

Abstract

Nutritional problems are also one of the indirect causes of maternal and child death that can still be prevented. One of the malnutrition problems for pregnant women is anemia, where there is a decrease in the quantity and quality of red blood cells, this is aggravated by the occurrence of the hemodilution process in pregnancy so that hemoglobin levels decrease which has the potential to increase the risk of illness and death of the mother and fetus. This study aims to determine the relationship between nutritional status and the incidence of anemia in pregnant women in the work area of the Sidomulyo Inpatient Health Center in Pekanbaru City. Carried out in the Working Area of the Sidomulyo Inpatient Health Center in Pekanbaru city, which was carried out in April-July 2023 with a sample of 43 respondents. This type of research is quantitative with a cross sectional study design.  The statistical test used is Chi-Square. The results of the analysis showed a p-value of 0.004, meaning that there is a relationship between nutritional status and the incidence of anemia in pregnant women. Efforts to maintain and improve the nutritional status of pregnant women can be done through antenatal counseling and supervision (Antenatal Care), while in the prevention and overcoming anemia it is necessary to supervise the administration of Fe tablets at least 90 tablets and also make a target map of Fe tablets for pregnant women.

Abstract

This research aims to reveal the moderating effect of gender on the influence of independence on audit quality. This type of research is descriptive and associative research. The sample in this research is State Civil Apparatus (SCA) as internal auditors who work at the Bukittinggi City Inspectorate Office. The sample was selected using a random sampling method of 30 respondents. The data source for this research is primary data from a questionnaire that was announced to respondents with closed questions and secondary data from documentation. The data analysis technique used in this research is quantitative analysis using the Structural Equation Model (SEM) or variant-based Structural Equation Model which can simultaneously test the measurement model as well as test the structural model. The research results reveal that independence has a positive effect on audit quality and female gender is more likely to moderate the influence of independence on audit quality than male gender.

Abstract

Supreme Court Decision No. 1001.K/Pdt/2017 is the plaintiff's cassation against the defendants who providing medical services at the MMC Hospital. As a result of the actions of the plaintiffs, the plaintiff's wife died while Caesar operation finish. The focus of the problem, the Judge canceled the Appeal Decision and also canceled the South Jakarta District Court Decision. The Supreme Court judge chose to conduct a separate trial of the case material. The Supreme Court judge decided to try that the plaintiffs were declared to have committed an unlawful act. Formulation of the problem 1) How is the act against the law (onrechtmatige daad) for medical services? 2) What are the considerations of the judges in deciding on unlawful acts (onrechtmatige daad) for medical services? Descriptive research, using a normative juridical approach. After studying the documents, the research resulted in conclusions 1) The Supreme Court judge in the PMH trial for medical services overturned the decision at the first level court and the second level court decision. The judge assessed the lawsuit material, looked at the evidence and then decided to try the case that the defendants had committed an unlawful act and had to pay compensation in the amount of 1,000,000,000.- (One Billion Rupiah). 2) The judge's considerations in the Supreme Court Decision, basically considers the matter of the case. The judge considered that the PMH elements had already existed when Defendant I convinced the plaintiff's wife to become pregnant and undergo a caesarean section for the fourth time. Defendant I did not explain how dangerous this action was for the plaintiff's wife, including the possibility of the plaintiff's wife dying.

Abstract

Along with the increase in the number of hospitals in Indonesia, the potential for an increase in hospital waste will increase also. One type of waste that has the potential to pollute the environment and adversely affect human health is B3 waste. The aims of this study were (1) to find out the description of the B3 waste sorting at the Tk III Army Hospital, dr. Reksodiwiryo Padang, (2) what is the description of B3 waste storage at the TNI Hospital III dr. Reksodiwiryo Padang and (3) to find out the description of the transport of B3 waste at the TNI Hospital III dr. Reksodiwiryo Padang. The research method is descriptive qualitative using data validation techniques through data triangulation. The results of the study show that the management of infectious B3 waste carried out at Dr. Reksodiwiryo Hospital complies with the requirements listed in the Regulation of the Minister of Environment and Forestry of the Republic of Indonesia Number P.56 of 2015 starting from the segregation of B3 waste, the storage of B3 waste, the transportation of B3 waste. It is recommended (1) RST dr. Reksodiwiryo Tk III Padang is expected to be able to socialize medical staff and visitors to the hospital to dispose of garbage in accordance with the containers provided, (2) for containers for sharps waste, an additional number of safety boxes is added to avoid the use of ordinary cardboard/jerry cans, (3) if emptying of the TPS cannot be carried out within 48 hours, it is necessary to install a cooling device in the TPS room to prevent waste decomposition and gas formation.

Abstract

Child pornography is a form of sexual exploitation, so Protection of children should receive great attention. There are two dangerous things in child pornography; First, involving children in pornography is equivalent to exploiting children for the worst forms of work. Second, allowing children to access pornography will greatly impact the child's growth and development process. The purpose of this study is to determine the position of children as victims in pornography crimes, to find out legal assistance for children as victims of pornography crimes, and to find out criminal law policies towards children as victims of pornography crimes. Based on the background of the problem, it is formulated that the problem is 1) How is the regulation of child pornography law in Indonesian Law 2) How is the regulation of child pornography law in Australian Law 3) How does the regulation of pornography against children through the internet in Indonesian law and Australian Law compare.

Abstract

This research aims to provide a comprehensive overview of the facilities and infrastructure that support clean and healthy living behaviors in the environment of Primary Schools in the city of Padang. Clean and healthy living behaviors play a crucial role in ensuring the health and well-being of students in schools. In this context, this study involves observations, interviews, and document analysis to identify the types of facilities and infrastructure present in Primary Schools in Padang, with a sample size of 11 schools, focusing on 8 indicators of Healthy and Clean Living Behaviors (PHBS) in accordance with the Minister of Health Regulation No. 2269/Menkes/PER/XI/2011 on PHBS Development Guidelines.The research findings indicate that several factors influence the formation of clean and healthy living behaviors in primary schools. Sanitation facilities, such as toilets and handwashing stations, play a primary role in shaping cleanliness habits. Additionally, the availability of spaces for physical activities and sports, as well as a clean environment, also encourage students to adopt a healthy lifestyle. However, challenges related to supporting facilities and infrastructure were also identified. Limited access to adequate sanitation facilities and the lack of facility maintenance pose obstacles to developing clean and healthy living behaviors among students.Therefore, efforts are needed to improve and maintain the facilities and infrastructure that support clean and healthy living behaviors in primary schools. In order to enhance the quality of health education in primary schools, this research contributes valuable information regarding the description of facilities and infrastructure that support clean and healthy living behaviors. It is hoped that the results of this study can serve as a guide for policy development and strategies to create a healthier school environment and support the holistic development of students in the city of Padang.
