Abstract

Abstract

Business is one of the world that cannot stand alone. A country will be develop if business of the world to work and develop. Most aspects from various kinds in other world, also involved both directly and indrectly with the world of this business. In relation to the sometimes do not give a priority for business that ultimately make the effort to bow and follow signs and ofthen even prioritizing business so ignore rules that there has been. Happened Practice Monopoly and competition effort unhealthy in Indonesia look from the big efforts to mastery the practice of up to the downstream upstream. The Constitutions No. 5 of 1999 about The Prohibition Practice Monopoly and The Competition of Business Unhealthy, to hope able bind business of the world of Indonesia.The present of Constitutions No. 5 of 1999 as control tool social that is effort to keep the public interest and prevent practice monopoly and/ competition effort unhealthy create a climate conducive through the business setting competition a healthy and tried to create the effectiveness of and efficiency in business activities. The duty of CSBC are supervise the implementation of Constitutions, with supervision to hopefully the perpetrator effort to compete with healthy so that the economic activities can walk more efficient and gave the benefits to consumers widely. Abstract

The business world is a world that cannot stand alone. A country will develop if the business world runs and develops. A business world that is growing rapidly and advancing without being regulated by clear signs and rules will not be profitable in the end. Many aspects of various other worlds are involved both directly and indirectly with this business world. Such linkages sometimes do not give priority to the business world, which in the end makes the business world must submit and follow the existing signs and often even prioritize the business world so that it ignores the existing rules. Monopolistic Practices and unfair business competition in Indonesia occur from large businesses controlling business practices from upstream to downstream. Law Number 5 Year 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition, is expected to be able to bind the government to be more objective and professional in regulating the business world in Indonesia. The presence of Law Number 5 of 1999 as a means of social control, namely trying to safeguard the public interest and prevent monopolistic practices and/or unfair business competition, creates a conducive business climate through regulating fair business competition and trying to create effectiveness and efficiency in business activities. The duty of the KPPU is to supervise the implementation of the Law, with supervision that it is expected that business actors can compete in a healthy manner so that all economic activities can run more efficiently and benefit consumers widely. KPPU has the authority, among others: to receive reports from the public and or from business actors about allegations of monopolistic practices and or unfair business competition; conduct research on allegations of business activities or actions of business actors that can lead to monopolistic practices and unfair business competition. In examining cases of alleged monopoly and unfair business competition KPPU is also authorized to impose administrative sanctions on business actors who violate the Anti-Monopoly Law.

Abstract

The application of criminal sanctions and actions against children who commit criminal acts of extortion with threats in accordance with the provisions of Article 365 paragraph (1) 1st and 2nd KUHP 1 namely the imposition of criminal sanctions or Article 368 paragraph (1) Jo. Article 55 paragraph (1) paragraph (1) 1st of the Criminal Code, memorizes Article 32 and Article 35 paragraph (1) of Law Number 11 of 2012 concerning Criminal Justice of the Nanak System, as well as other laws and judicial legal considerations in impose criminal sanctions and actions against children who commit criminal acts of extortion by threat is to fulfill all elements of the article in the indictment, as well as witness statements and corresponding statements of defendants coupled with the judge's conviction. In addition, in imposing criminal acts and actions the judge first considers matters that are burdensome and that are mitigating. The Judge's consideration in imposing a criminal offense on a child is to give a deterrent effect to the defendant and so that the defendant does not repeat his actions and to educate the defendant to be aware of his actions, but must pay attention to the rights and needs of the child while serving the sentence. Then the age and consequences of the defendant's actions are one part of the judge's consideration in taking action against the child in the form of a return to parents to be fostered, so that the future defendant can be a better child in all matters and not break the law anymore.

Abstract

Trust in the foundation must show clarity for the beneficiary. At present the foundation is unclear. This ambiguity is caused by the foundation being a social institution, while the benefit is only for individuals who are not public, for example in the trustee. Trustees only use assets if owned by a legal entity, in the principle of beneficiary assets owned by the public. The foundation after the enactment of Law Number 28 of 2004 concerning Amendments to Law Number 16 Year 2001 concerning Foundations does not occur because the trustee cannot own assets that become legal entities. If there is a legal entity, the trustee becomes an absolute owner, it cannot be, the foundation has become ambiguous since the foundation law, the foundation should belong to the beneficiary. Ownership of benefits can be either goods / services or services. But in the management of the foundation, management is carried out on objects (zaak). The application of Trusts institutions in the management of foundation assets in Indonesia prior to the enactment of Law Number 28 of 2004 concerning changes to Law Number 16 of 2001 concerning Foundations by using doctrines in law, then departs from the initial conception of Anglo Saxon legal traditions regarding trust , where the settlor surrenders the right of ownership (dominium) to the trusts in the form of registered owner (legal owner) and beneficiary in the form of equitable owner, it is clear that by surrendering the object in the trust to the trustee, the settlor no longer has any interest any more for objects submitted in trusts (except in resulting trusts). Through the theory formed from the doctrine, it can be stated that the trust is an understanding aimed at an institution tasked with managing property that is not his property and is intended for the benefit of other parties outside the party who gave away the property and trustee.

Abstract

Law enforcement on the guarantee of halal products has not been fully realized given the enactment of UU JPH on certification obligations and the labeling of new halal products 5 years since the enactment of the law in accordance with the provisions of Article 67 paragraph (1), so that law enforcement that includes human resources factors, Law, Facilities and infrastructure, legal culture and socialization to the community are inefficient and effective. To create the benefit of products that will be consumed by Muslims especially non-packaged food products, the implementation of halal certification and labeling implemented one roof service or made into one door and strengthen the authority of the Indonesian Council of Ulama in providing protection and legal certainty to Indonesian consumers by making The Presidential Decree governing the transitional period of the MUI as an institution currently establishing halal certification to BPJPH based on Presidential Regulation No. 83 of 2015 on the Organizational Structure of the Ministry of Religious Affairs. In this case the involvement of MUI becomes an important thing in BPJPH organization. This study uses a normative juridical approach that is research that emphasizes on the use of legal norms in writing that is associated with the practice and perception made by informants. The result of the research is consumer protection in the perspective of al-maslahah not yet maximally seen from several factors as follows: Factor of law of guarantee of halal product which not yet effective, human resource factor has no technology transfer and transfer knowledge, Supporting facilities and infrastructure, Socialization needs to be done by the Government in this case the Ministry of Religious Consumer Protection should be strengthened through the transfer of technology and knowledge. Strengthening the socialization of halal product guarantee from voluntary to mandatory by government and local government to producers and consumers. Establishment of BPJPH structures in the area should be done considering that JPH must be valid throughout Indonesia. Therefore, the procurement of adequate facilities and infrastructure for halal product guarantee is required.

Abstract

Residual and weighting in criminal offenses for theft causes harm and suffering experienced by victims of crime, this has attracted the attention of the author to examine one of the decisions of the South Jakarta District Court Case Number 538 / Pid.B / 2017 / PN.JKT.Sel. Darma alias Subur was charged with a single indictment of violating Article 363 paragraph (1) of the 4th Criminal Code, prosecuted by the South Jakarta District Prosecutor's Public Prosecutor with a prison sentence of 2 (two) years, and terminated by a Court Judge The land of Muara Bulian with criminal penalties of 9 (nine) months. In the decision the defendant has been proven legally and convincingly guilty of committing "criminal acts of theft in a burdensome state". The defendant's actions were carried out during the day with the destruction of the victim's property. The purpose of the research carried out in the framework of writing in this research is to find out the basis of the consideration of the Judge in bringing criminal charges against the perpetrators of criminal offenses against theft with a weighting against Case Number 538 / Pid.B / 2017 / PN.JKT.Sel. The type of research used in writing this thesis is Normative Jurisdiction, which is to study the laws and regulations relating to the consideration of the judge dropping the criminal against the perpetrator of the crime of theft with the weighting of Case Number 538 / Pid.B / 2017 / PN.JKT.Sel.

Abstract

Tindak Pidana Perkosaan adalah suatu perbuatan yang menyimpang (deviant behavior), Perbuatan perkosaan menimbulkan kerugian yang Sangat besar terhadap korban. Kerena menyebabkan hilangnya kesucian yang menjadi kebangaan seorang wanita, yang diambil paksa oleh pelaku. KUHP telah memberikan ancaman hukuman yang berat terhadap pelaku tindak pidana perkosaan, hal ini bertujuan agar Pelaku takut untuk melakukan perbuatan itu. Tapi dalam prakteknya pelaku perkosaan hanya dihukum ringan, Bahkan ada yang bebas. Adapun permasalahan yang akan dibahas dalam pcnelitian ini adalah bagaimana penerapan sanksi pidana perkosaan di Pengadilan Negeri Tangerang, dan Apakah pertimbangan Hakim dalam memberikan sanksi pidana memenuhi rasa keadilan bagi korban. Untuk menyelidiki hal ini penulis menggunakan metode Yuridis Sosiologis dan metode pengumpulan data adalah dengan mengumpulkan data sekunder yang didapat dari penelitian lapangan dan pustaka. Dari data-data yang telah didapat lalu dianalisis lagi dengan metode Kualitatif. Dari hasil penelitian disimpulkan bahwa Pengadilan Negari Tangerang dalam mengadili pelaku Tindak Pidana Perkosaan berpedoman pada Pasal 285 Kitab Undang-Undang Hukum Pidana, akan tetapi sanksi pidana yang diterapkan Hakim masih relative ringan bila dibandingkan dengan ancaman hukuman dalam pasal 285 KUHP. Pertimbangan Hakim dalam menerapkan sanksi pidana dalam kasus perkosaan yaitu Terpenuhi atau tidak unsur-unsur pasal yang dilakukan, keadaan pribadi atau keadaan batin pelaku terhadap perbuatan yang dilakukannya, alat bukti yang sah dalam persidangan, barang bukti yeng diperlihatkan dipersidangan, hal-hal yang memberatkan dan meringankan. Sikap terdakwa selama persidangan, riwayat hidup terdakwa, pandangan hakim sendiri. Pemerkosaan terhadap perempuan tentu tidak diinginkan oleh semua pihak karena sudah melanggar norma-norma didalam masyarakat, disamping perempuan yang menjadi korban akan merasa malu dan hina atau aib bagi keluarga serta takut untuk diketahui oleh orang lain. Setiap orang tua pasti mempunyai kekhawatiran terhadap bahaya yang mungkin terjadi terhadap anak perempuannya, dimana kejahatan perkosaan menjadi keresahan masyarakat, oleh karenanya harus dicegah dan dihukum berat terhadap pelaku pemerkosanya.

Abstract

In order to support the Government's Nawacita program and carry out the functions of facilitators of community welfare development, the Directorate General of Immigration provides several immigration facilities that aim to attract foreign tourists and foreign investors to enter and invest their capital in Indonesia including BVK and Visa on Arrival (VOA). However, this policy is often misused by foreigners who enter and are in the territory of Indonesia to carry out activities that are contrary to the provisions of laws and regulations, therefore there is a need to impose sanctions on foreigners who violate statutory provisions. In the application of criminal law, it is known as the principle of "ultimum remedium" which implies that the criminal law here has the final sanction. This means that in a law that is first regulated is administrative, civil and criminal sanctions. Penalty is placed as the last remedy when other sanctions cannot be enforced. Where in determining an act as a criminal act and its sanctions are known to be the three main principles, namely the principle of legality; principle of subsidiary (ultimum remedium) and principle of equality. But in its implementation there were still doubts from immigration officials in the application of the principle to the imposition of sanctions for immigration violations.

Abstract

Geographically, Takalar Regency is mostly surrounded by the ocean and also borders the Makassar Strait, although geographically it is not the same as other regencies such as those in South Sulawesi (for example Selayar Islands Regency) but according to BPS Takalar Regency that sectors that have contributed Takalar's economy is very large, it is still in the agricultural sector, which is 49.94 percent, with the fisheries sub-sector contributing around 36.73 percent, thus the Regional Government of Takalar Regency should pay more attention to the lives of fishermen so that the fishermen do not change professions to jobs that on land.
