Abstract

Children are the future of the nation, because in its journey is the young generation and the successor to the ideals of the nation's struggle that has a strategic role. As human beings who need to get protection for their rights, at the same time they must also monitor to avoid various things that damage their future, such as being involved in various things that injure their lives such as being involved in Narcotics. Moreover, this was done in his capacity as a student. The development of science is so advanced in various segments of life that it is not only in adults but is almost pervasive among the younger generation, especially students. Therefore, it is the duty of all stakeholders to do things that can be done in order to do understanding and at the same time make prevention with various aspects so that the younger generation will be more specifically students can avoid the dangers that will be caused from the use of narcotics. there is, the study with a model of service that is focused on students at Ternate State High School I (SMA Negeri 1 Ternate) as a partner in exploring more about the impact of drug use. With the hope that this will be a good initial example to do it in another school with the same purpose.

Abstract

Para diplomat Rusia dan China telah mengintensifkan kegiatan spionase mereka di wilayah Ceko selama 2017. Peningkatan itu disebut turut dipengaruhi oleh misi kedutaan Rusia yang cukup besar di Praha, serta pendanaan yang kuat dari China. Laporan tersebut mengungkapkan, mata-mata China telah berupaya mengintervensi Uni Eropa melalui Ceko. Selain itu juga telah memata-matai kementerian pertahanan dan kementerian luar negeri, serta dalam hal ekonomi dan ilmiah. Rusia, dituduh telah berupaya mengganggu NATO dan Uni Eropa dengan melemahkan masing-masing negara anggotanya. Laporan tersebut mengkhususkan kesalahan informasi dalam situs web dan akusisi perusahaan Ceko oleh investor Rusia sebagai alat yang digunakan Kremlin untuk tujuan spionase. Rusia dan China merupakan negara yang paling bertanggungjawab dan bersalah terhadap Spionase di Republik Ceko dalam perspektif Hukum Internasional, karena peran kedua negara tersebut (Rusia dan China) berakibat buruk terhadap Republik Ceko. Tentu saja para diplomat atau agen rahasia yang melakukan spionase di Republik Ceko telah melanggar hukum diplomatik dan hukum konsuler. Misi kedutaan Rusia yang cukup besar di Praha, serta pendanaan yang kuat dari China merupakan bukti nyata keterlibatan kedua negara tersebut dalam praktik Spionase di Republik Ceko.

Abstract

One of the most fertile and systemic areas of corruption is in the field of government procurement of goods/services. This sector has a very large influence in building economic power in a country, and also the vulnerability of this sector to the risk of administrative malls and corrupt acts that harm the country's finances. Throughout the establishment of the Corruption Eradication Commission (KPK), no less than 50 (fifty) cases related to irregularities in the procurement of government goods / services in which cases resulted in state losses of 35 (thirty-five) percent of the total project value. The problem is how the influence of officials to bidders who give bribes that lead to criminal acts of corruption? And what is the authority of officials in making policies in the procurement of goods and services in legislation? The research method, this research is included in the form of normative juridical research that is research that emphasizes the use of legal norms in writing. In conclusion, the influence of Officials on Tender Participants Who Gives Bribes, Causing Corruption. Entrepreneurs use the influence of central officials to move / persuade regional heads to intervene in the procurement process in order to win certain entrepreneurs/partners and raise prices or the value of contracts and the intended entrepreneurs / partners give some money to central or regional officials. The entrepreneur influences the regional head / regional official to intervene in the procurement process so that certain partners are won in a tender or appointed directly and the price of goods / services is raised (mark-up), then the rest is divided up.

Abstract

Procurement of goods and services or in foreign terms called procurement arises because of the need for goods for services such as stationery, medical equipment, fuel belonging to government vehicles, maintenance of government buildings where the implementation must be in accordance with the provisions of the legislation applies, because in the implementation of the procurement of government goods and services concerning Ministries / Institutions / Work Units of the Regional Apparatus / Government Institutions in a large enough amount or value, the procedures and procedures are clearly regulated and detailed in the applicable laws and regulations . The problem is how are the legal arrangements for the use of green open living funds? How is the legal practice of using green open space funds outside of their designation? And how about the deviation of funds from the use of green open space funds in the case of a court decision? This research is included in the form of normative juridical research. The conclusion is that in legal practice the use of green open space funds outside of its designation, namely in the legal practice, the procurement of goods and services starts from the purchase / sale of goods on the market directly (in cash), then develops towards the purchase of a payment term, by making documents accountability (buyer and seller), and ultimately through procurement through an auction process. In the process, the procurement of goods and services involves several related parties, so there needs to be ethics, norms, and principles for the procurement of goods and services to be able to regulate or be used as the basis for determining the policies for the procurement of goods and services.

Abstract

Evil agreement in corruption is regulated in Article 15 of Law Number 20 Year 2001 concerning Amendment to Law No. 31 of 1999 concerning Eradication of Corruption Crime. In Article 15 of Law Number 20 Year 2001 concerning the Eradication of Corruption Crime, people who are proven to have committed conspiracy to commit corruption can be subject to maximum imprisonment for life, or as short as four years in prison. A fine of Rp. 200 million to Rp. 1 billion will also be given to defendants for conspiracy. The conclusion is in interpreting Article 15 of Law Number 31 of 1999 concerning the Eradication of Corruption Crimes as amended by Law Number 20 of 2001 using Hans-Georg Gadamer's study of legal hermeneutics law, which according to him can use philosophical hermeneutics to take ontology assignments , that is, the task with regard to the inevitable relationship between the text and the reader, the past, the present that enables understanding. If speaking of the past it is interpreted historically interpretive (interpretation according to history), in this case the judge to obtain an explanation of a provision examining the talk of people regarding the provisions during the formation process (wetshistorisch), or the judge must examine the previous provisions that precedes the current provisions (rechtshistorisch). A judge must see history from the meaning of evil agreement.

Abstract

Regulation of the Chief National Police of the Republic of Indonesia Number 14 Year 2014 concerning Services Unit for Procurement of Goods/Services at the North Maluku Regional Police Logistics Bureau for the implementation of the procurement process for goods and services has been running in accordance with existing rules. But there are some things that have not been carried out based on the Regulation. With regard to consistency in the implementation of the rules, inconsistencies occur in the rules that have been set, because there are indeed some things that cannot be fulfilled by the organizational unit so that there are still mismatches between the realization and implementation of the rules themselves. Factors which become obstacles in the implementation of the Regulation of the Chief National Police of the Republic of Indonesia Number 14 Year 2014 include (1) Human Resources Factors; (2) Facilities and Infrastructure Factors; and (3) Rule/Legality Factors.

Abstract

The position of the inspectorate as a supervisory body in the governance of regional government must be strengthened by the government making its own law. This is important in order to realize local governance, one of which is that it can prevent corruption must be accompanied by the strengthening of the inspectorate institution, through a separate Act with the Government's Internal Oversight System that can be accounted for. In order for authority, duties and functions to function as expected, regulations that must clearly regulate the position of the inspectorate in a regional government structure clearly match their role. Factors that play a role in strengthening the inspectorate as a supervisory institution in regional governance, must be born a separate law with the Government's Internal Monitoring System, which is not only at the center but also in the regions. Thus, the various strength factors become the strengthening of the inspectorate as a supervisory institution that can realize good and correct local governance.

Abstract

This writing concerning the comparison of the system of business entity liability in the form of a Limited Liability Company legal entity with a non-legal entity business entity which is sentenced to a bankruptcy decision. With the decision of the Pilit statement to the extent of the responsibility of the board of directors, personally the directors, the board of commissioners and the personal board of commissioners. Likewise, the extent to which the responsibility for the Firm is sentenced to a decision on bankruptcy. The point here is that whether the directors must be responsible for the decision on bankruptcy statements where the directors have been careful, did not make mistakes, did not commit negligence and did not have personal interests, and carried out as outlined in the Articles of Association of the Limited Liability Company. Likewise for Firms that are sentenced to bankruptcy decisions, where firms do not have wealth that is separate from the wealth of the firm and the wealth of the firm's management. For this reason, I have conducted a study of Law No. 37 of 2004 concerning Bankruptcy Laws and Delays in Obligations of Debt Payments, Law Number 40 of 2007 concerning Limited Liability Companies, and Burgerlijk Wetboek (B.W.) or Civil Code.

Abstract

Kemajuan ilmu dan tekhnologi membawa sisi positif dan sisi negatif dalam kehidupan manusia, salah satunya adalah transplantasi organ tubuh manusia yang hingga saat ini masih menjadi perdebatan di kalangan para Ulama dari segi hukum Agama Islam. Tujuan dari penulisan ini adalah untuk mengetahui pengaruh transplantasi organ tubuh kepada manusia dan bagaimana transplantasi organ tubuh ini dalam sudut pandang Hukum Islam.Transplantasi adalah perpindahan sebagian atau seluruh jaringan atau organ dari satu individu atau pada individu itu sendiri, atau pada individu lainnya, baik yang sama maupun yang berbeda spesies.Saat ini yang lazim adalah pemindahan suatu jaringan atau orang antar manusia. Dan transplantasi ini dimaksudkan untuk mengganti organ yang rusak atau tidak berfungsi pada penerima dengan organ lain yang masih berfungsi dari pendonor. Jika diliat dari penerima transplantasi meliputi: auto transplantasi, homo transplantasi, heterotransplantasi, autograf, apat allograf, isograf, xenografi dan xenotransplantation,transplantasi split,serta transplantasi domino. Penulis menggunakan Al Quran Al Hadist dan pendekatan yuridis normatif, karena pendekatannya maka penelitian hukum model ini disebut dengan penelitian hukum normatif.

Abstract

Proses pembuktian perkara perdata di pengadilan dapat dilakukan oleh hakim dengan melihat apakah suatu hubungan hukum yang menjadi dasar gugatan benar-benar ada atau tidak. Adanya hubungan hukum inilah yang harus terbukti apabila penggugat menginginkan kemenangan dalam satu perkara. apabila penggugat tidak bisa membuktikan dalil-dalilnya, maka gugatannya dapat ditolak. Tidak semua dalil-dalil yang menjadi dasar gugatannya harus dibuktikan kebenarannya, sebab dalil-dalil yang tidak disangkal apalagi yang diakui oleh pihak lawan sepenuhnya tidak perlu dibuktikan. Dalam soal pembuktian tidak selalu pihak penggugat saja yang harus membuktikan dalilnya. Hakim yang memeriksa perkara itu yang akan menentukan siapa diantara pihak-pihak yang berperkara akan diwajibkan untuk memberikan bukti, apakah itu pihak penggugat atau sebaliknya, Hakim harus bertindak arif dan bijaksana dan tidak boleh berat sebelah. Penggunaan alat-alat bukti pada perkara perdata di pengadilan meliputi 5 (lima) macam alat-alat bukti yaitu: Bukti surat, Bukti saksi, persangkaan, pengakuan dan sumpah, didalam peraktek masih terdapat satu macam alat bukti lagi yang sering dipergunakan ialah pengetahuan hakim adalah hal yang diketahui oleh hakim itu sendiri dalam sidang.
