Abstract

Notaries as public officials have an obligation to apply the principle of recognizing beneficial owners in a corporation where this obligation is not regulated in UUJN. On the one hand, a notary does play an important role in disclosing beneficial ownership of a corporation, but on the other hand, the transparency of beneficial ownership disclosure must be based on honest and clear information from parties representing the corporation. This is due to the existence of beneficial ownership which cannot be fully detected by a notary. The problems are what are the legal consequences if the principle of recognizing beneficial owners (BO) is not implemented and what is the urgency of applying the principle of recognizing beneficial owners (BO) in carrying out notary duties. This legal research uses normative legal research, namely library research, which is a data collection method by studying books, laws and regulations, and writings related to this research. While the nature of the research is analytical descriptive, that is, it gives a clear and detailed description of an event that occurred. The results of research on legal consequences if the principle of recognizing beneficial owners (BO) is not implemented are given administrative sanctions, namely revoking the notary's license if violations are found, supervision in the implementation of the application of the BO principle is carried out by the Minister of Law and Human Rights through the Director General of General Legal Administration. Meanwhile, the notary's responsibility for the deed he made is that in civil terms the notary is only responsible for the head of the deed, meaning that it contains the authority of the appearers in signing the deed, then for the closing deed which contains the authority of the witnesses then the appearers are confronted with signing the deed, whereas against contents of the deed the notary is only responsible that the deed he made does not violate the clauses prohibited by law and the provisions stipulated in Article 1320 of the Civil Code. Criminally, a notary can be prosecuted in court if at a later date, the competent authorities can prove that the notary has consciously entered information that benefits one party and harms the other party. And the urgency of applying the principle of recognizing beneficial owners (BO) in carrying out notary duties is that basically the obligation to disclose beneficial ownership is carried out by parties who wish to use the services of a notary. The role and position of a notary is as a supporting system in disclosing beneficial ownership of a corporation, namely in this case during the process of inputting data related to the establishment or changes to the corporate statutes/bylaws. Thus the obligation related to disclosure of beneficial ownership cannot be borne by the notary but the service user.

Abstract

The confiscation of the assets of the Taxpayer has been regulated in the Tax Collection Law with a Forced Letter. There are many tax arrears and additional debt by taxpayers every year with the realization of the disbursement of tax arrears that is not balanced with the number of existing tax arrears. The problems that occurred at KPP Pratama Padang Dua had not fully complied with the procedures and provisions of the General Tax Provisions Law and the Law on Tax Collection by Forced Letter. The main problem in this research is how is the implementation of collecting tax debts with a forced letter and what is the mechanism for using the assets of the tax bearer stored in the bank as a debt settlement. This legal research uses an empirical juridical approach, namely a research that uses an approach to the problem by looking at the applicable legal norms and then connecting it with the legal facts contained in the field. While this type of research is descriptive analytical. Data collection techniques were carried out through structured interviews and document studies. The results of the research implementation of the collection of tax debts with forced letters are first, basically tax collection is carried out if the tax bearer does not pay off the tax debt and tax collection fees, second, against the tax bearer who does not pay off the tax debt, officials can take action to collect taxes, third, implementation Tax Collection stages are carried out in accordance with statutory provisions in the field of Tax Collection with Distress Warrants, fourth, the implementation of Tax Collection stages is carried out against Tax Bearers by considering the order of priority. However, the priority is the significant value of the tax debt. The problems that occurred at KPP Pratama Padang Dua had not fully complied with the provisions of the KUP Law and the PPSP Law. And the mechanism for using the taxpayer's assets stored in the bank as a debt settlement, namely when a forced letter has been issued, at least 2x24 hours directly block the account, the way the KPP writes to the destination bank, then the bank blocks it, the bailiff (tax officer) will meet the taxpayer to discuss how payment will be made, if the taxpayer will pay off with money in a blocked account before 14 days, then the officer makes a billing and Minutes of Overbooking and an unblocking letter but if more than 14 days there is no response from the taxpayer, then the Officer can can directly transfer to the tax payable. However, in this case KPP Pratama Padang Dua has not fully implemented it for tax arrears whose accounts have been blocked. The settlement of tax debts with the assets of the taxpayers stored in the bank has been carried out by KPP Pratama Padang Dua, although it has been successfully implemented, it has not yet achieved maximum results in disbursing tax arrears.

Abstract

Soil is one part of the earth that has a close relationship with human life, it can even be said that every human being is related to land. Article 33 paragraph 3 of the 1945 Constitution of the Republic of Indonesia stipulates that: Earth, air and the natural resources contained therein are controlled by the State and used for the greatest prosperity of the people. However, land disputes still arise in the community, therefore this thesis takes the title of land ownership dispute resolution at the Solok City Land Office (a case study of land disputes between PT Gelora Ganto Sejahtera and Syamsu Tulus). In this writing, the problem formulation is 1. How to settle land disputes at the Solok City Land Office. 2 How is the authority of the Solok City land office in resolving land disputes. 3. What are the results of land dispute resolution at the Solok City Land Office. In writing this research, the method used is empirical juridical. Empirical juridical research is an approach by looking at a legal reality in society. The research conducted in this paper is descriptive analytical in nature, namely a form of research that aims to describe the applicable laws and regulations, associated with legal theories and the practice of implementing positive law. Disputes are situations and conditions in which people experience factual conflict or release according to their warnings. Land disputes can be resolved in 3 (three) ways, namely: a) Settlement by deliberation. b) Settlement through the judiciary, namely submitted to the general court in a civil or criminal manner. Based on this research, there is a land rights dispute that has been issued with a building use rights certificate in the name of PT. GGS entered. Then Samsyu Tulus objected that the settlement was carried out at the Solok City Land Office, then the settlement was not reached so that it entered the litigation route or went to court, from this research it was concluded that the Land Dispute Settlement in Solok City could be carried out on the basis of public complaints. The results of the mediation that have been agreed upon will result in changes to data, which can be in the form of a decision to cancel land rights, cancel certificates and also change data on certificates, measurement papers, land books and/or other public registers.

Abstract

This study uses a normative juridical research type that refers to law or legislation and other literature as literacy support. The research approach used is in the form of statutory and conceptual approaches to answer the problems being researched with primary legal sources in this study in the form of laws Law Number 8 of 1999 concerning Consumer Protection. The results of this study explain that there is a neglect of the theory of legal certainty in regulating health information on electronic cigarettes in Indonesia. This is because the regulation of electronic cigarettes until now is only contained in the Minister of Finance Regulation No.146/PMK.010/2017 concerning customs and excise rates only and is not accompanied by legality related to electronic cigarette health information, of course this regulatory vacuum is very contrary to guarantees on consumer rights contained in article 4 of Law no. 8 of 1999 namely the right to correct, clear and honest information about a product/goods. So it is very dangerous if consumers are essentially Indonesian people consuming goods whose health standards are unclear.

Abstract

This research was conducted with the aim of knowing how to protect electricity consumers in Law no. 8 of 1999 concerning Consumer Protection and Law no. 30 of 2009 concerning Electricity and how legal remedies can be taken by electricity consumers in the event of a unilateral power outage by PT. PLN (Persero). By using normative juridical research methods, it can be concluded: 1. Protection of electricity consumers has been protected by the Government in Law Number 8 of 1999 concerning Consumer Protection and Law Number 30 of 2009 concerning Electricity. The Consumer Protection Act states that consumers have the right to convenience, security and safety in consuming goods and/or services. Meanwhile, the Electricity Law states that consumers have the right to receive electricity continuously with good quality and reliability. So it is the obligation of PT PLN (Persero) as the holder of a business permit for the supply of electricity, to provide electricity that meets the applicable quality and reliability standards. If the power outages that occur are less than the service standards set by the Government, consumers are entitled to compensation from PT PLN (Persero). 2. The initial effort that consumers can take in the event of a unilateral power outage by PT PLN (Persero) is to submit a complaint to PT PLN (Persero).

Abstract

This article delves into the role of the Bhinneka Tunggal Ika concept in shaping the national legal framework of the Republic of Indonesia. Within the context of diversity that characterizes the nation, Bhinneka Tunggal Ika is elevated as the central pillar coloring the legal formation process. The analysis involves a review of the values of diversity, unity, and oneness embedded in this concept, as well as how it is implemented in the national legal foundation. The aim of this article is to provide a profound understanding of how Bhinneka Tunggal Ika serves not only as a national motto but also as a philosophical basis inspiring the creation of an inclusive legal framework capable of responding to the dynamics of the heterogeneous Indonesian society. Through this analysis, it is expected that this article will contribute to a richer understanding of the relationship between Bhinneka Tunggal Ika and the sustainable formation of the national legal system in the Republic of Indonesia.

Abstract

One of the efforts made by the state in order to realize legal protection for every citizen is to carry out honest and fair law enforcement, including the state's efforts to and overcome the occurrence of criminal acts that can disrupt public security and public order. Current criminal law enforcement practices This is known as a new term, namely whitsle blower. Etymologically whitsle blower comes from the word whitsle which means "whistle" or "whistle sound", while blower means whistle blower or reporter, secret leaker, or whistleblower. The existence of the whitsle blower is very important in uncovering serious and organized criminal acts, especially crimes Corruption crimes have not received adequate legal protection. This can be seen from a number of cases of criminalization of whistleblowers by law enforcers. This research is normative research. research carried out by examining the literature using a statute approach. Regulation of whitsle blowers and justice collaborations in SEMA Number 04 of 2011. The role of whitsle blowers in Indonesia needs to continue to be encouraged and socialized, also implemented, both by government institutions, private companies and public institutions . Although the practice of protecting whitsle blowers is not without challenges, amidst the lack of protection for whitsle blowers in Indonesia, a whitsle blower can be threatened because of their reports or testimony regarding alleged violations and crimes that have occurred.

Abstract

Proses penyelidikan kasus dugaan pelanggaran disiplin dan kode etik profesi Polri (KEPP) yang dilakukan oleh oknum kepolisian di wilayah kerja Polda Sumbar yang dilaksanakan oleh Unit Subbidpaminal mengacu kepada Pasal 9 s/d Pasal 27 Perkadiv Nomor 1 tahun 2015 tentang Standar Operasional Prosedur Penyelidikan Pengamanan Internal Di Lingkungan Kepolisian Negara Republik Indonesia dilakukan dalam beberapa tahapan yang meliputi perencanaan, pengumpulan, pengolahan dan pelaporan. Permasalahan dalam tesis ini adalah 1) Bagaimanakah penegakan disiplin dan kode etik profesi Polri di Polda Sumbar? 2) Aspek-aspek apa saja yang berkaitan dengan peran Sub Bidang Pengamanan Internal Bidpropam Polda Sumbar dalam penetapan hasil penyelidikan dugaan pelanggaran disiplin dan kode etik profesi Polri? 3) Bagaimanakah cara mengoptimalkan peran Sub Bidang Pengamanan Internal Bidpropam Polda Sumbar dalam menetapkan hasil penyelidikan dugaan pelanggaran disiplin dan kode etik profesi Polri? Metode yang dipakai adalah metode pendekatan yuridis empiris atau sosiologis dengan tipe penelitiannya yaitu deskriptif dengan menggunakan data primer dan data sekunder. Hasil Penelitian dan pembahasan memperlihatkan bahwa: 1) Penegakan disiplin dilakukan dengan memperhatikan prinsip legalitas, profesionalistas, proporsionalitas, akuntabilitas dan tidak diskriminatif. Setiap penegakan disipilin terhadap anggota polri sudah sesuai dengan standar operasional proses prosedur yang berlaku dalam lingkungan polri. Penegakan disiplin dan Kode Etik Profesi Polri (KEPP) yang telah dilaksanakan di wilayah hukum Polda Sumbar. 2) Aspek yang berkaitan dengan peran Subbidpaminal Bidpropam Polda Sumbar dalam penegakan hukum terkait penyelidikan terhadap dugaan pelanggaran disiplin dan pelanggaran KEPP dipengaruhi oleh faktor internal dan eksternal, diantaranya adalah: sumber daya manusia, sarana atau fasilitas, anggaran dan masyarakat. 3) Pengoptimalan peran Subbidpaminal Bidpropam Polda Sumbar dalam menetapkan hasil penyelidikan dugaan pelanggaran disiplin dan KEPP dilakukan melalui strategi sebagai berikut: a) Meningkatkan jumlah personel Polri b) Mengadakan kendaraan operasional dan peralatan komunikasi handy talky (HT) sesuai kebutuhan c) Menyiapkan anggaran sesuai kebutuhan d) Menyusun tata cara terkait proses pengaduan yang dilakukan pelapor ke instansi kepolisian dan sosialisasi.

Abstract

One of the plots of land where land registration is carried out by issuing a certificate is Certificate of Ownership Number 00164/Nagari Padang Magek. The certificate is the object of a dispute which has been decided by the Batusangkar District Court Decision Number 67/Pid.B/2021/PN Bsk, which has obtained permanent legal force (inkracht van gewijsde). Based on the Decision of the Batusangkar District Court Number 67/Pid.B/2021/PN Bsk, the issuance of Certificate of Ownership Number 00164/Nagari Padang Magek, namely a Statement of Physical Control of the Field and a Certificate of Land Ownership Number 074/SK/PMT/2000, is a fake document. So the Certificate of Ownership Number 00164/Nagari Padang Magek has a legal defect. The formulation of the problem examined in this research is: 1) what is the legal position of a certificate of ownership due to juridical defects as proof of ownership of rights?; 2) what are the legal consequences of ownership of land rights following the Batusangkar District Court Decision Number 67/Pid.B/2021/PN Bsk? The research method that the author uses is normative juridical, with a case approach. The type of data used is secondary data, which consists of primary, secondary and tertiary legal materials. The data collection technique used is document study. The results of the author's findings are the position of Ownership Certificate Number 00164/Nagari Padang Magek, which has changed the data on the certificate above to become Ownership Certificate Number 1892/Nagari Padang Magek, Land Plot Identification Number 03.10.03.02.01654, with Measurement Letter Number: 2616/2021 dated 27 April 2021, area 940, in the names of Tisra Juwita and Hasni Wirda, still valid and valid. The next finding is that in the Batusangkar District Court Decision Number 67/Pid.B/2021/PN Bsk, the basis for issuing the certificate used was a fake letter related to the ages of the parties, namely Tisra Juwita and Hasni Wirda, not a fake regarding the subject of their rights. So the plot of land registered in Certificate of Ownership Number 00164 is still legally valid in the names of Tisra Juwita and Hasni Wirda. Certificates issued based on fake documents can be canceled by submitting a written application to the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency through the Head of the Land Office where the object is located, in this case the Head of the Tanah Datar Regency Land Office.

Abstract

This study discusses the Gianyar District Court Decision No. 259/Pdt.G/2020/PN.Gin, which declared that Deed No. 10 and Deed No. 12, related to the purchase of land, constitute an unlawful act under Article 1365 of the Indonesian Civil Code. The focus of this research is: (1) How is the regulation of the creation of valid agreement deeds by a notary; (2) The notary's responsibility in the creation of nominee agreements; and (3) The judge's considerations in the court's decision regarding the nominee agreement. Using a normative juridical approach, this study utilizes both secondary and primary data. The results show that the notary has a significant responsibility to ensure that the deeds comply with the prevailing laws and regulations, and to prevent any coercion or fraud. Regarding the nominee agreement, the judge ruled that the agreement was made to circumvent the law, violating Articles 1337 and 1320 of the Indonesian Civil Code, as it does not meet the objective requirement of a valid agreement, namely "a lawful cause." This nominee agreement was created with the intention of evading legal provisions prohibiting foreign nationals from owning land titles in Indonesia.
