Abstract

The implementation of the Notary's duties and position is based on the high level of integrity and honesty of the Notary, the results of the work in making deeds and maintaining protocols as authentic evidence regarding the interests of justice seekers, both personal interests and business interests, so that the implementation of the Notary's duties and positions must be supported by moral will. which can be accounted for. The problem of this research: what are the legal regulations regarding the procedures for making authentic deeds by Notaries as Public Officials, the legal relationship between Notaries and Facing Parties in making authentic deeds, as well as the Notary's legal responsibility for authentic deeds in connection with criminal acts of forgery? Notary is a Public Official, authorized to make authentic deeds regarding all acts, agreements and stipulations which are required by a general regulation to be stated in an authentic deed, guarantee certainty of date, keep the deed and provide grosses, copies and quotations throughout the making of such a deed by a general rule is also not assigned or excluded to officials or other people. The presenter comes to the Notary, so that the actions or deeds are formulated into an authentic deed according to the authority of the Notary, and then the Notary makes a deed at the request or desire of the Presenter, in this case providing a basis for the Notary and the Presenter that a legal relationship exists. The legal responsibility of a Notary as a Public Official regarding authentic deeds related to criminal acts of forgery is: A Notary can be said to be free from legal responsibility if the authentic deed he has made and/or executed in front of him has fulfilled the formal requirements. If the Notary is proven to have violated the provisions of the law, namely fulfilling the criminal elements contained in the Criminal Code, then the notary can be held criminally responsible. Notaries in carrying out their duties must be careful, act honestly, impartially, and safeguard the interests of related parties. In making a deed, introduce the person present, based on identity, ask, then listen and pay attention to the wishes of the parties, examine documentary evidence, provide suggestions and create a framework for the deed to fulfill the wishes or desires of the parties, fulfill all administrative techniques for making the deed such as reading, signing, provide copies and filings for minutes, and carry out other obligations related to the duties of the Notary position.

Abstract

The main task of a notary is to create or record events authentically. For parties who make an agreement before a Notary, if a dispute arises related to the deed, then usually the first person to ask for advice is the Notary concerned. The main problem in this research is how the notary plays the role of the peace settlement agreement carried out by the parties before the notary regarding the dispute over the Deed of Jual Beili Peingikatan Agreement (PPJB). This legal research uses an empirical juridical method, namely a method of approaching problems by looking at applicable legal norms and then connecting them with legal facts found in the field. Meanwhile, this type of research is descriptive analytical, namely providing a clear and detailed description of an event that occurred. The results of the research, the role of a notary in the selection process of the Deed of Juial Beili Agreement (PPJB) made by the parties in front of him is that the notary can act by providing input regarding disputes between the parties in the deed made by the notary. This function is the role of the notary voluntarily as a party. who understands his duties and functions as a notary, and in this case the notary is also considered to really understand the essence of the ongoing problems and the peace litigation carried out by the parties before the notary regarding disputes over the Deed of Juial Beili Peining Agreement (PPJB), namely that the notary has the same ideals. Intuitive signatures provide legal guidance as well as providing information related to the execution of authentic deeds, as stipulated in Article 15 Paragraph (2) huiruif eiUiUiJN. In this case, the notary provides legal counseling to make the next deed after the parties have reconciled, namely in the form of a peace deed accompanied by a power of sale deed.

Abstract

The implementation of general elections in Indonesia requires a consistent and sustainable electoral system in order to minimize changes in new laws or regulations in each election. General elections as a key element of democratic implementation which involves direct participation of citizens in the election of state and government administrators. Democracy and elections have a close relationship because elections are a means to achieve democracy and oversee the process of transferring people's power to their representatives through political candidates. Elections are governed by constitutional principles and in accordance with the direction of state policy, one of which is through financial support by the state in elections and election participants. The implementation of campaigns by election participants definitely requires sources of funds obtained and derived from various sources based on applicable legal provisions and restrictions. The existence of Law Number 7 of 2017 concerning General Elections which also regulates campaign finance aims to ensure the achievement of fairness and transparency. Campaign finance limits apply of course with strict mechanisms because election finance often intersects with issues of transparency, accountability, money politics, corruption risks and resistance to politicization. Therefore, strict regulation and effective monitoring are needed. This study analyses election regulations in Indonesia with a focus on campaign finance. The juridical-normative approach is used to understand the written law and its implementation in practice. Data analysis is descriptive qualitative which aims to understand the dynamics of the use and important role of campaign funds in organizing general elections.

Abstract

Tanah publik ( public land ) dikuasai oleh negara dan dipergunakan sebesar-besarnya untuk kemakmuran rakyat. Tujuan penelitian ini untuk mengetahui bagaimana hukum mengelola lahan yang bukan hak milik. Pengelolaan tanah bukan hak milik tanpa izin merupakan tindakan ilegal yang melanggar hukum, baik dari perspektif hukum negara maupun hukum syariah. Tujuan penelitian ini mengeksplorasi permasalahan pengelolaan wisata alam ilegal di Desa Botung, Kabupaten Padang Lawas, Sumatera Utara, dengan fokus pada Persepktif Wahbah Az-zuhaili. Hasil penelitian menyoroti kompleksitas masalah tersebut dan perlunya mematuhi hukum yang mengatur hak atas tanah serta memperoleh izin dari pemerintah dalam pengelolaan sumber daya alam atau wisata alam. Konflik antara persepktif hukum negara dan syariah islam menjadi sorotan dalam penelitian ini. Solusi yang sesuai dengan hukum yang berlaku perlu ditemukan untuk memastikan pengelolaan sumber daya alam yang adil dan sesuai dengan hukum yang berlaku. Metode penelitian yang digunakan adalah metode penelitian yuridis empiris dengan pendekatan kualitatif.

Abstract

The local wisdom of the Indonesian people can be the basis for the concept of sustainable development. However, the challenge is that the complexity of legal rules can cause clashes in the context of the relationship between the right to control the state and the local wisdom values ​​that live and grow in the Nagari Pariangan community, Tanah Datar Regency, West Sumatra. This condition needs to be studied to find an appropriate legal construction that is integrated with the social system. This research aims to identify local wisdom values ​​with an environmental legal perspective possessed by the people of Nagari Pariangan. Examining and describing customary institutions in Nagari Pariangan in integrating customary norms with environmental law. This research used a qualitative approach with descriptive methods, which aimed to analyze and describe the integration of environmental law with local wisdom values. The subjects of this research were the Nagari Traditional Leaders, the Nagari Government, Tuangku Nagari and the local community. Research data collection used observational methods, focus group discussions, interviews and documentation from various sources that were related and support data analysis using data reduction, data presentation and drawing conclusions. The results of the research showed that, 1) The local wisdom values ​​of Nagari Pariangan as guidelines for community life in protecting the environment are manifested in customary norms that natural resources in the form of land/fields/rice fields, forests and rivers cannot belong to individuals but rather belong to groups/groups. traditional tribes and their management must obtain approval from Ninik Mamak; 2) The Tigo Tungku Sajarangan government integrates Nagari Pariangan traditional norms with environmental law which is realized in consensus deliberation between Ninik Mamak in every development plan launched by the Nagari Government, Regency, Provincial and Central Governments. If the results of the consensus deliberation are unanimous then it becomes the final decision made by each of the children/nephews/community, which supports the integration of environmental law with customary law and local wisdom.

Abstract

One of the professions of residents in Hamparan Perak Village is as a tailor. The problem often faced by tailors in Hamparan Village is that consumers do not take orders. The aim of this research is to determine the factors causing not taking orders for stitches and the impact and legal consequences of not taking orders for stitches from the perspective of DSN-MUI Fatwa NO: 112/DSN-MUI/IX/2017 Concerning Ijarah Contracts. This type of research is empirical juridical with a living case studies approach and a conceptual approach. Data was collected using interviews and document study methods, then the data was processed and analyzed using qualitative methods. The results of the research showed that stitches were not taken because the orderer did not have the money when the time came for the order to be taken, therefore the tailor suffered material and material losses, namely energy and costs to buy additional materials to adjust the order. Based on the DSN-MUI Fatwa NO: 112/DSN-MUI/IX/2017 concerning the Ijarah Agreement, the legal consequences of not taking the order by the customer, means that the tailor in this case has the right to sell the order to a limited extent and only take it as sewing wages as agreed at the beginning and additional maintenance costs are added so that the stitching matches what the customer ordered while it is in the hands of the tailor.

Abstract

This article explores the epic and controversial dimensions in the context of Pancasila Revitalization as revealed through an in-depth study of the Job Creation Law. The revitalization of Pancasila is the primary basis for responding to social and economic changes in the contemporary era, which are reflected in the latest legal reforms. Through an interdisciplinary approach, this article outlines the journey of the Pancasila Revitalization epic, revealing its critical role in shaping the national legal structure. Not only as an ideological doctrine, Pancasila is the conceptual basis for designing and implementing the Job Creation Law. However, this part of the epic also involves several controversies arising from various societal levels. The controversy discussion includes multiple perspectives, ranging from the economic impact to the social tensions. This article explores the layers of complexity that arise from the combination of the noble ideals of Pancasila and the reality of its implementation in the Job Creation Law. By highlighting crucial points, this article aims to provide a deeper understanding of the relationship between Pancasila, current legislation, and societal dynamics. In this way, readers are invited to reflect on the significance of the Revitalization of Pancasila in shaping the future direction of law and justice in Indonesia.

Abstract

This research aims to examine the crucial role of legal advisors in criminal justice systems in ensuring the fulfillment of legal aid rights for suspects or defendants, as prescribed by Article 54 of the Indonesian Criminal Code (KUHAP). Legal advisors play a vital role in guaranteeing that suspects or defendants have access to adequate legal assistance throughout the trial proceedings. The research employs empirical normative methods, collecting data through literature reviews and analyzing relevant case studies. The findings indicate that legal advisors have a significant impact on upholding justice and safeguarding the rights of suspects or defendants. They assist in comprehending legal rights, providing suitable legal counsel, devising defense strategies, and undertaking other duties pertaining to legal aid. Effectively meeting the requirements of legal aid positively influences the quality of the judicial process and promotes justice for suspects or defendants. Consequently, the study offers recommendations to enhance the role of legal advisors and ensure the fulfillment of legal aid rights, such as increasing financial resources and support for legal aid organizations, implementing educational programs to raise public awareness, and improving accessibility to legal aid for vulnerable groups.

Abstract

Fraudulent investment is a form of crime where a certain amount of money is asked to invest in a product or business that does not ictually exist. Business in Indonesia is currently experiencing rapid development following the digital era, namely by utilizing technology to simplify the transaction process. The Indonesian financial services industry has utilized facilities called fintech. Companies and individuals also experience convenience in their business because they are assisted by fintech technology. However, in practice there are still many companies that use technology for illegal business, especially in the field of fraudulent investment with various kinds of schemes. The conditions for imposing criminal responsibility on perpetrators of online fraud are that all elements of the criminal act are fulfilled and the purpose of the act can be proven. This was done deliberately with awarenessm that the act would be condemned by law. To determine criminal responsibility for criminal acts of online buying and selling fraud, you must refer to specific laws, because to avoid misinterpretation if using conventional evidence and avoid the emergence of other interpretations, and there needs to be an understanding from law enforcers regarding the expansion of the evidence. In order to avoid misunderstandings, to have the same thoughts about the value of the evidentiary power of electronic evidence contained in the ITE Law.

Abstract

This research is motivated by the lack of optimal eradication of criminal acts of corruption in Indonesia, which is indicated by data showing that the value of state financial losses in criminal acts of corruption that have been handled cannot be recovered by law enforcement. This issue is a challenge in eradicating criminal acts of corruption, not only imprisoning the perpetrators of corruption but more than that, how to confiscate the assets of the perpetrators of corruption as far as possible and return them to the state. Based on data released by ICW, the handling of criminal acts of corruption has not been followed by optimal asset recovery, including that carried out by the Prosecutor's Office. Using empirical juridical methods, this research concludes that the Prosecutor's Office has a very important role in carrying out Asset Confiscation in eradicating criminal acts of corruption, both as investigators, public prosecutors and as State Attorneys. However, this role cannot be carried out optimally by the Prosecutor's Office, especially in the regional level, in this case the High Prosecutor's Office and the District Attorney's Office, are still experiencing various obstacles. in implementation.
