Abstract

The Consumer Dispute Settlement Agency (BPSK) is a semi-court institution that has the authority to resolve and decide disputes between consumers and business actors on a non-litigation basis. Law Number 8 of 1999 concerning Consumer Protection or commonly known as UUPK is a regulatory basis used by BPSK in deciding consumer disputes because UUPK is a law that overshadows all laws that intend to provide protection to consumers. In practice, BPSK is often referred to as an institution that has the authority to examine, resolve, and decide a dispute with a final and binding decision. However, in one example of a case in the Supreme Court decision Number 175K / Pdt.Sus-BPSK / 2021, BPSK decided to impose sanctions on perpetrators outside the authority of BPSK. This is a problem of how to assess the performance of BPSK in deciding consumer disputes. The research method used is normative juridical with a case approach. To improve the performance of BPSK in deciding consumer disputes, it is necessary to update the contradictory UUPK regulations so that BPSK decisions do not cause legal uncertainty for protected consumers. The role burden borne by BPSK is also not balanced with existing Human Resources, so it needs to be improved so that BPSK's performance in deciding consumer disputes can be more careful without overriding applicable laws.

Abstract

This research aims to find out and analyze what factors influence the implementation of legal assistance for the poor in the city of Makassar. This research uses empirical research methods using data collection methods and studying legal assistance. Then data is obtained from interviews and observations to produce what is expected and conclusions about the problem. The results of this research show that there are factors that influence the implementation of legal assistance for the poor in the city of Makassar. The legal factor itself (law) where the implementation of legal aid itself must be clear in accordance with applicable law. The factor of law enforcement officers/enforcers is very influential in the judicial process in order to assist in the process of implementing legal aid. Community factors in order to be able to help the community in legal aid as a system of institutions or apparatus/law enforcement should pay more attention to several things, for example: providing legal education to people who are not legally competent so that they know more, providing legal counseling

Abstract

Trademark registration in Indonesia refers to a constitutive system with the first-to-file principle. First to file is a trademark registration process that is only granted to the party who submits the application for the first time. The state is not permitted to grant registration to other parties who have a mark that contains similarities to a previous mark that was registered earlier. Trademark registration must go through substantive examination stages so as not to violate other people's rights, considering that registration is a process of granting rights, not granting permission. The purpose of this article is to determine the compliance opinion of appeal commission trademark law related to a trademark dispute involving Kasomax and Kaso, and also know the DJKI responsibilities in this dispute. The research method used is normative legal research with data analysis techniques based on deductive reasoning, which analyzes the considerations of the Mark Appeal Commission Council in connection with the provisions contained in Law Number 20 of 2016 concerning marks and geographical indications relating to the purchase of the KasoMax with the Kaso and its form of responsibility for the two brand struggles. Based on the research conducted, it can be concluded that the application of substantive examination in brand assessment has not been fully implemented, and the responsibility given is in the form of the cancellation of the KasoMax as a form of implementation of the Commercial Court decision.

Abstract

Migrasi manusia telah menjadi fenomena global yang tak terhindarkan. Di Asia Tenggara, migrasi telah menjadi bagian penting dalam dinamika sosial dan budaya. Kebijakan migrasi yang diterapkan oleh negara-negara di wilayah ini memiliki dampak signifikan terhadap integrasi sosial dan budaya para migran. Artikel ini bertujuan untuk menganalisis pengaruh kebijakan migrasi terhadap integrasi sosial dan budaya para migran di Asia Tenggara. Artikel ini juga menggambarkan bagaimana komunitas migran dan bahasa lokal memainkan peran penting dalam integrasi budaya. Secara keseluruhan, kebijakan migrasi dan integrasi budaya di Asia Tenggara adalah faktor penting dalam membentuk dinamika migrasi di wilayah ini dan mendukung mobilitas penduduk yang lebih teratur dan aman.

Abstract

This research discusses the use of evidence, including circumstantial evidence, in the process of examining the Cooking Oil case No. 15/KPPU-I/2022 by the Business Competition Supervisory Commission (KPPU). This case involves alleged cartel practices in the cooking oil industry in Indonesia. This research aims to analyze the extent to which indirect evidence contributes to proving cartel practices in this case and how this evidence is used in law enforcement. The research method used is an in-depth case study, by collecting and analyzing data from various relevant sources. The research results show that indirect evidence plays an important role in building cases of cartel practices and contributes significantly to the enforcement of business competition law. The KPPU's decision in this case was supported by strong evidence, and the use of circumstantial evidence has helped uncover violations of business competition law. This decision has a direct impact on business competition practices in the cooking oil industry and encourages compliance with business competition laws in the future

Abstract

State institutions play a significantly central role in the implementation of governance. The doctrine of trias politica has been implemented in the structure of the Indonesian state, establishing a division of powers among three branches: the executive, legislative, and judicial. Nevertheless, over time, Indonesia has expanded the trias politica doctrine by incorporating a novel branch of power, namely the examinative institution operated by the The Audit Board of the Republic of Indonesia. The high state institutions established in accordance with the constitution enjoy robust and enduring positions and authorities. On the other hand, state institutions formed through legislation tend to possess comparatively weaker and non-permanent positions and authorities, as they are susceptible to amendments or even dissolution by the House of People’s Representatives (Dewan Perwakilan Rakyat, DPR), which holds legislative functions. The Ombudsman and Corruption Eradication Commission (Komisi Pemberantasan Korupsi or KPK), as auxiliary state institutions playing pivotal roles in the governance system, face vulnerability due to their establishment being founded on statutory laws. Consequently, there arises an urgent necessity and opportunity for the establishment of a new high state institution by elevating the Ombudsman and KPK to the status of high state institutions. However, there are inherent challenges that must be navigated, specifically the requirement for an amendment to the 1945 Indonesian Constitution, contingent upon the political will of the members of the People's Consultative Assembly (Majelis Permusyawaratan Rakyat or MPR).

Abstract

Penelitian ini membandingkan penyelesaian sengketa antara Badan Penyelesaian Sengketa Konsumen (BPSK) dan Pengadilan Negeri dalam kasus perjanjian pembiayaan dengan jaminan fidusia. Dalam konteks perubahan kehidupan manusia yang memerlukan tambahan sumber dana, pinjam-meminjam dengan jaminan fidusia umumnya digunakan. Rumusan masalah penelitian adalah perbandingan dalam penyelesaian sengketa antara BPSK dan Pengadilan Negeri. Metode penelitian yang digunakan adalah penelitian normatif dengan analisis data berdasarkan undang-undang, regulasi, putusan pengadilan, dokumen akademik, dan literatur terkait. Hasil penelitian menunjukkan perbedaan signifikan dalam kekuatan hukum putusan antara BPSK dan Pengadilan Negeri. Pengadilan Negeri memiliki kekuatan eksekusi langsung, sedangkan BPSK mengandalkan kesepakatan sukarela. Selain itu, pendekatan penentuan kompensasi juga berbeda, dengan Pengadilan Negeri cenderung memberikan kompensasi lebih tegas. Dalam konteks perjanjian pembiayaan dengan jaminan fidusia, pemilihan metode penyelesaian harus mempertimbangkan karakteristik sengketa dan tujuan pihak yang bersengketa. Kesimpulan dari penelitian ini adalah bahwa pemilihan antara BPSK dan Pengadilan Negeri perlu mempertimbangkan kebutuhan dan kompleksitas sengketa yang bersangkutan. Pihak ketiga yang terpengaruh juga harus melindungi hak-hak mereka sesuai dengan hukum yang berlaku. Saran penelitian adalah untuk mempertimbangkan karakteristik sengketa dengan cermat. Jika penyelesaian dengan kekuatan hukum dan eksekusi diperlukan, Pengadilan Negeri mungkin menjadi pilihan yang lebih sesuai. Namun, jika sengketa bersifat lebih fleksibel dan lebih memilih kesepakatan sukarela, maka BPSK bisa menjadi alternatif yang baik, memungkinkan para pihak untuk mencapai kesepakatan yang moderat.

Abstract

The mortgage execution auction occurs if the debtor defaults, the first mortgage holder has the right to sell the mortgage object on his own authority through a public auction and collect the settlement of his receivables from the proceeds of the sale. In this case the creditor is always the party that directly does have a legal relationship with the debtor through the agreement that they have entered into, of course they are ready with all the attitudes of the debtor, but what about the auction winner, in this case the auction winner is just an individual/legal entity legally and legally carry out sales and purchases in a manner determined and carried out based on law, the auction winner, who in this case becomes the buyer of the collateral object through auction, even gets a lawsuit from the debtor or other parties because he is dissatisfied and has his rights those who are harmed by the creditor's decision to carry out the auction. Of course, this needs to be reviewed again so that the auction winners do not become an outlet for any party's dissatisfaction with the auction of collateral items given to the creditor bank. This study aims to determine the execution of mortgage execution auctions, the process of transferring title certificates of property rights based on auctions, as well as legal protection guarantees for auction winners, the protection referred to here is legal protection that guarantees the auction winner's rights to the object won. From the results of this study it is known that the form of legal protection obtained by the auction winner is a court decision which says that the auction is legal and strengthens the rights of the auction winner over the object of the auction he won. Meanwhile, if the auction is canceled by the court due to law, in this case the legal protection that the winner of the auction gets is that he can demand payment of money for the auction object that has been deposited with the auction official, and can demand costs incurred if he has already registered the auction object.

Abstract

The public prosecutor is indeed given freedom in determining charges and demands, including determining the time limit for a criminal sentence for a criminal offense being handled. Of course, the public prosecutor must remain guided by KUHP, KUHAP and Guideline No. 3/2019 concerning Prosecution, which can also refer to pre-existing prosecutions in similar cases. This is for the sake of creating legal certainty, benefit, and justice. However, unfortunately, in the case of the defendant Rahmat Kadir throwing acid on the victim, Novel Baswedan (an investigator with the Corruption Eradication Commission), The problem that wants to be studied is the basis for the public prosecutor to determine the time limit for punishment in the letter of prosecution for the crime of abuse that resulted in permanent disability in District Court Decision Number 371/Pid.B/2020/PN.Jkt.Utr. This research method is normative legal research with data in the form of secondary data supported by primary, secondary, and tertiary legal materials, where all data comes from literature studies. The approaches used are legislation (the status approach) and cases (the case approach), which are then analyzed using deductive methods. The results of this research show that the basis for the public prosecutor's considerations is very unclear and cannot be understood. By stating that the defendant was proven to have violated Article 353 paragraph (2) KUHP and demanded a sentence of only 1 (one) year in prison, The elements of inadvertence, cooperation, admitting mistakes, and requesting a request made by the defendant are also mitigating factors, while aggravating factors and other factors as stipulated in Guideline No. 3/2019 concerning Prosecution were actually ignored. This shows a bad portrait and an example of failure in implementing law enforcement by the public prosecutor to create the principles of legal certainty, benefit, and justice. On the other hand, in this case, the public prosecutor appears to be the defendant's representative legal advisor.
