Abstract

Dalam Kompilasi Hukum Islam, pengertian nusyuz secara eksklusif mengatur tentang nusyuz yang dilakukan oleh istri. Kompilasi Hukum Islam yang menganut hukum nusyuz tetap berpijak pada fikih patriarki yang berlandaskan pada ajaran agama yang mendasar. Dari segi metodologi, KHI tetap menyerupai gagasan para peneliti sebelumnya. Perspektif dan konteks umat Islam Indonesia belum tertanam secara baik dalam rumusan perundang-undangan KHI. Kandungan materiilnya, sebagai hukum positif di Indonesia, adalah keabsahan fiqh yang memberikan kedudukan tersendiri bagi perempuan. Kajian penelitian dilakukan melalui pendekatan konseptual (conceptual appoarch). Disamping itu penelitian ini juga menggunakan pendekatan perundang-undangan (statute approach). Al-Qur'an memperlakukan nusyuz dari dua sudut pandang, sehingga menjadikannya sebagai penghujatan dalam kaitannya dengan nusyuz. Dengan kata lain, nusyuz itu ada dua macam: satu dari istri (QS. an-Nisa [4]: ​​34) dan satu lagi dari suami (QS. an-Nisa [4]: ​​128). Cara apapun (mauizhatul hasanah, hajrun, dhorbun, islah, ihsan, taqwa) dapat digunakan untuk menyelesaikan masalah tersebut.

Abstract

This study aims to determine the relationship between the implementation of good governance based on employment contracts, bureaucratic reform and e-government to improve the efficiency of government administration in Indonesia. This research also uses qualitative research methods with data collection methods in the form of describing analysis methods, describing and discussing, and on the basis of relevant literature review, studying and collecting data taken from articles published in various scientific journals and book compilations. Secondary data referenced from the relevant literature review is used as a tool. Indonesia has implemented work contract-based bureaucratic reform in an effort to improve government administration. Bureaucratic reform based on work contracts, where the government organizers, such as regional heads, are always required to achieve the pre-determined work goals. The results of this study show that in implementing bureaucratic reform to achieve good governance, the Government uses the concept of working contract. By using the concept of employment contract that uses technology (e-government), the employment contract can be more transparent with the output in the form of work evaluation. This is shown from several points of view, as use of electronic government related to establishment of good governance practices, implementation of good governance related to bureaucracy institutional transformation, there is a relationship between performance and electronic government, performance with bureaucracy transformation, and implementation of good governance with performance.

Abstract

This research is motivated by the fact that there are still many LAHP and/or Ombudsman Recommendations that are not implemented, while the implementation is a necessity for the realization of good, clean and efficient public service delivery and to prevent and eliminate abuse of authority as specified in the laws and regulations. This research was conducted using secondary data, which is sourced from the 2021 Annual Report of the Ombudsman RI, Laws and Regulations on the Ombudsman and on Public Services. From the research conducted, it is known that the factors causing the LAHP and / or Ombudsman Recommendations not to be implemented are due to: First, the legal material factor which still contains legal loopholes, intertwined with the Second factor, namely Law Enforcement, where not all Officials who have the authority to enforce the law oversee the implementation of LAHP and / or Recommendations, as well as impose administrative sanctions on the Reported Party who does not implement LAHP and / or Recommendations, and Third, the factor of those affected by the rule of law, where there is still an assumption of some Reported Party, that LAHP and / or Recommendations are only suggestions, not as something that must be implemented.

Abstract

TikTok Shop is a social commerce feature that allows users and creators to advertise and sell products through TikTok. Currently, TikTok is still not licensed as social commerce. As a platform that connects sellers and buyers, TikTok Shop has the responsibility to ensure the security and validity of transactions that occur in it. However, there are still some unresolved legal issues. This study aims to identify and analyze legal uncertainty related to the Minister of Trade Regulation Number 31 of 2023 concerning Business Licensing, Advertising, Guidance, and Supervision of Business Actors in Trading through Electronic Systems where social commerce must have a license first before it can operate in Indonesia, in this situation TikTok Shop cooperates with one of the largest e-commerce platforms (marketplace) in Indonesia, namely Tokopedia, which occurs in the return of TikTok Shop as a social commerce platform in Indonesia. The method used in this research is normative juridical. This research approach is a statutory approach (statue approach). Based on the results and discussion, it is found that there is legal uncertainty where TikTok Shop is not in accordance with the regulations mentioned above, especially regarding the rules stating that social commerce is not allowed to put a payment transaction feature (checkout) in it. It is hoped that the results of this study can contribute to increasing understanding and legal awareness for TikTok Shop users and provide recommendations for related parties to increase security and trust in transactions on this platform.

Abstract

The code of ethics in the notary profession is not just a set of rules or codes of conduct, but also reflects the essence of integrity and responsibility that a notary must have. In providing services to clients, a notary not only acts as a legal professional, but also as a guardian of trust and legal certainty for the community. Therefore, it is important for notaries to understand and abide by their code of ethics conscientiously. The research method used is normative legal research. With a statutory approach, i.e. examining current laws and regulations, other relevant literature, and case studies related to the research topic. The results showed that the Code of Ethics is important for notaries in providing services to clients, maintaining integrity and professionalism. However, there are still cases of violations that harm the reputation of the profession. To prevent this, it is necessary to increase supervision, education, and training for notaries. Transparency and accountability in handling violations are also important. Public awareness of the importance of choosing notaries who comply with the code of ethics should also be increased through information campaigns. These steps are expected to ensure that notary services remain of high quality and trust.

Abstract

The legal implication of notary negligence for late registration of fiduciary guarantees is that notary acts are very risky and have a negative impact, so it is necessary to provide fair and appropriate legal protection to the parties involved in the transaction. This study aims to remind and encourage notaries to comply with applicable legal provisions carefully and in a timely manner. In addition, it is also to uphold justice and legal certainty in fiduciary guarantee transactions, so that the rights and obligations of each party can be fulfilled properly. By applying appropriate legal implications for notary negligence, it is expected to prevent violations of law that harm the parties and maintain the integrity of the notary profession as a trustworthy law enforcer. The research method used is normative legal research. With a statutory approach, i.e. examining current laws and regulations, other relevant literature, and case studies relating to the topic of legal implications of notary negligence on late registration of fiduciary guarantees. The results showed that the legal implications of notary negligence in the process of registering fiduciary guarantees can be very detrimental to the parties involved in the transaction. Moreover, the lack of regulatory clarity and the lack of a conducive legal culture can be obstacles in carrying out notary duties effectively. However, the notary's role in ensuring the validity and legal force of the fiduciary guarantee deed is essential to provide protection to the parties concerned.

Credit card hacking (carding) is a credit card fraud where the perpetrator knows someone's credit card number which is still valid for use, then the perpetrator can buy goods online where the bill can be addressed to the original owner of the credit card, while the perpetrator is called a carder.

Abstract

A leader is someone who has been chosen by a group who is given the mandate to lead the organization to achieve a goal, and is considered to have an influence on others and has an inherent leadership spirit. In Islam, the criteria for ideal leaders are in the Prophet Muhammad, but as ordinary humans, of course, we cannot equalize the criteria for leaders in the Prophet Muhammad, therefore in Islam there are criteria for imams according to Al-Mawardi which are based on the Qur'an and Hadith. In Indonesia, there are criteria for leaders according to the 1945 Constitution and Law No. 7/2017 on general elections. The two criteria certainly have different views, but if the two are compared whether it will be relevant or contradictory. This study will answer the relevance of the criteria of state leaders in Indonesia with the criteria of the Imam according to Al-Mawardi. This study will answer the relevance of the criteria for state leaders in Indonesia with the criteria for imam according to Al-Mawardi. This type of research belongs to the Qualitative category using descriptive analysis methods with data collection techniques, namely library research or literature studies. The 5 criteria for state leaders according to the 1945 Constitution and Law No. 7 of 2017 are relevant to the criteria for imam according to Al-Mawardi, namely according to the 1945 Constitution and Law No. 7 on elections (never betrayed the country and never committed corruption and other serious crimes, educated at least graduated from high school / vocational or other schools equivalent, spiritually able to carry out the duties of his obligations as President and Vice President and free from narcotics abuse, has a vision, mission, and program in implementing the government of the Republic of Indonesia, and the President is a native Indonesian) and according to Al-Mawardi (fair, healthy, knowledgeable, healthy limbs, have a vision and mission, and descendants of the Quraysh). So it can be concluded that the criteria for state leaders according to the 1945 Constitution and Law No. 7/2017 on elections when compared with the criteria for priests according to Al-Mawardi will be very relevant.

Abstract

Progressive Law emerged from Satjipto Rahardjo's idea of ​​seeing the worrying reality of law enforcement in Indonesia. The law tends to favor the strong and oppress the weak, sharp downwards but dull upwards. This article discusses the importance of having behavior based on Progressive Law in law enforcement. The method used in writing this article is a normative legal research method with a conceptual approach. The results of this research are that law enforcement that improves the welfare of the people in the style of Progressive Law will be formed if law enforcement officers have progressive law enforcement behavior. The meaning of progressive behavior is law enforcement that is sensitive to the realization of the values ​​of justice, and is not confined solely to the formulation of the text of the law. Such law enforcement will create justice, benefit and welfare for society.

Abstract

Globalization brings many conveniences to the activities of the community through technological advances. Globalization also makes the borders and distances between countries invisible, so that countries in the world can be connected to one another. On the other hand, globalization has a negative impact on the world, namely the emergence of transnational crimes. One of the transnational crimes that plague different countries is money laundering. It is the act of processing the proceeds of criminal activity with the intent of concealing the source of the criminal activity or transforming the profits of criminal activity or corruption into ostensibly legal assets. Money laundering has become a transnational crime that is complicated and difficult to solve in various countries around the world. In this journal, the author uses a legal approach and comparative law method to compare the regulation of money laundering in Indonesia, Singapore and the Philippines. The results of this study will be an examination of the development of money laundering in the era of globalization and the regulation of money laundering in Indonesia, Malaysia, Singapore and the Philippines.
