Abstract

Dalam menjalani bisnis ada kalanya perusahaan dihadapkan dengan risiko bisnis untuk itu perlu adanya proteksi atau perlindungan asuransi terhadap bisnis. Askrindo merupakan salah satu lembaga penjamin (Credit Guarantee Institution) yang bergerak dalam bidang Asuransi Kredit dengan produk berupa Kontra Bank Garansi. Piutang atas klaim Kontra Bank Garansi mengakibatkan munculnya subrogasi yaitu hak untuk menagih kembali tagihan (recoveries) kepada principal. Hak subrogasi merupakan pengalihan hak atas kebendaan bergerak tak berwujud, yang berupa piutang. Pelaksanaan recovery hak subrogasi membutuhkan waktu yang lama, karena penyelesaian secara hukum yang membutuhkan banyaknya waktu dan biaya yang dikeluarkan. Guna mempercepat pelaksanaan recovery dilakukan mekanisme maka dengan sekuritisasi yaitu melalui teknik pembiayaan dengan mengumpulkan recovery hak subrogasi yang dikemas menjadi Kontrak Investasi Kolektif Efek Beragun Aset (KIK-EBA). Sekuritisasi hak subrogasi atas Kontra Bank Garansi dapat menjadi alternatif sumber pendanaan dalam memperbesar kapasitas akseptasi asuransi. Guna mengemukakan jawaban atas pokok-pokok permasalahan, maka digunakan metode penelitian hukum normatif dengan pendekatan berupa konseptual approach.

Abstract

This research aims to conduct a comparative study between the Indonesian Land Bank Agency and the Land Bank Agency in the Netherlands. The focus of the study is to analyze the structure, functions, and performance impact of both institutions in supporting land asset management. The research method involves a comparative analysis, incorporating literature review, interviews, and collection of secondary data related to the policies, strategies, and implementation of these institutions. The results of this research are expected to provide a deeper understanding of the roles of the Indonesian Land Bank Agency and the Land Bank Agency in the Netherlands in land asset management and their contributions to sustainable development.

Abstract

Broadcasting institutions as one of the creators included in the neighboring right group often face economic rights violations that cause losses of up to trillions of rupiah. It is undeniable that the value of copyrighted works of intellectual products of the human mind needs to be appreciated with an economic orientation to realise the welfare of the creators' lives. In Indonesia and South Korea, economic rights violations against copyrighted works of broadcasting occur. The case at the end of January 2024 related to organised intellectual property rights violations no longer falls into the realm of civil law but can also be charged with criminal law. The case is related to the arrest of a South Korean citizen who committed an organised copyright crime with a loss value of 19.7 billion rupiah according to a report from Munhwa Broadcasting Corporation (MBC). The research method used by the author is a statutory approach (the statue approach) using normative law or (legal research) by examining legislation in the form of primary, secondary, and tertiary legal materials collected by means of literature study.From the research conducted by the author on the assessment of two regulations, it can be concluded that both countries apply the same rules for the protection of Neighboring Rights in accordance with the agreements in the Bern and Rome Conventions. Broadcasters have neighboring rights that are guaranteed privileges so that violations of the law can be subject to civil and criminal sanctions. The principle of Fair Use or exclusion is also applied by both countries, but no details are provided because they adopt the principle of common law where jurisprudence or previous judicial decisions become the source of law.

Abstract

Every Indonesian citizen has the right to work and live a life worthy of humanity. This includes persons with disabilities. However, in reality, there are still many people with disabilities who experience difficulties and even discrimination in obtaining employment. This research aims to determine guarantees for persons with disabilities in obtaining employment. The research method used is the descriptive normative legal research method. The data type used is secondary data sourced from primary legal materials, secondary legal materials, and tertiary legal materials. The secondary data is collected through a literature study. The data is analyzed using qualitative analysis techniques. The results of this research show that the Law on Persons with Disabilities is sufficient to regulate guarantees for persons with disabilities in obtaining employment, and various government regulations have even been issued which also regulate guarantees for persons with disabilities in obtaining employment as implementing regulations.

Abstract

Pengungsi merupakan fenomena klasik yang muncul akibat dari ancaman terhadap keselamatan. Tulisan ini membahas kebijakan mengenai pengungsi di Indonesia dan Malaysia, dua negara yang menjadi tujuan transit bagi banyak pengungsi dan pencari suaka. Meskipun belum meratifikasi Konvensi Status Pengungsi 1951, keduanya menghormati prinsip non-refoulement. Namun, Mengingat bahwa mereka mungkin harus menunggu hingga 25 tahun untuk bisa direlokasi ke negara ketiga, para pengungsi tentu saja sangat menderita karena kurangnya kesempatan untuk bekerja. Penelitian ini menggunakan jenis penelitian normatif. Hasil penelitian menemukan hak seseorang atas pekerjaan sangat penting bagi kehidupannya berdasarkan hukum internasional termasuk pengungsi, sesuai dengan undang-undang hak asasi manusia internasional sebagaimana diakui dalam instrumen seperti UDHR 1948, Konvensi 1951, dan Protokol 1967. Meski Indonesia melarang pengungsi bekerja berdasarkan regulasi IMI-0352.GR.02.07/2016, Malaysia memberikan visa kerja sementara IMM13. Revisi kebijakan Indonesia, khususnya Perpres No. 125/2016, diusulkan untuk memberikan hak pekerjaan kepada pengungsi. Langkah ini diharapkan meningkatkan martabat mereka, mengurangi stigma negatif, dan memberian kontribusi positif terhadap ekonomi dan Masyarakat. Dengan demikian, pengungsi dapat berperan aktif dalam pembangunan negara.

Abstract

This study aims to determine whether the agreement between the Rafting Operator and the Bartong Village community is valid according to the law when viewed from the valid terms of the agreement. This research uses empirical research, namely research with field data as the main data source, such as the results of interviews and observations. The results of the study found that the mutual agreement between the Rafting Operator and the Bartong Village community has fulfilled the four elements of the valid terms of the agreement regulated in Article 1320 of the Civil Code. The Bartong Village community agreed and agreed that the Rafting activity could use Huta Bayu Village in Bartong Village as a starting point location with agreed operational costs. The parties present and involved in the agreement can be ascertained that they are capable according to the law. The rafting activity does not disturb public order and decency, nor does it violate the law. So the joint agreement between the Rafting Operator and the Bartong Village community can be declared valid in terms of the validity of the agreement.

Abstract

In order to protect the rights and obligations of UN special mission participants while they carry out their duties, this research aims to determine the legal arrangements for UN special missions. It also seeks to ascertain the UN's responsibility for UN special mission participants who die while performing their duties. Normative legal research is the kind of study that is employed. The findings demonstrate how crucial it is for UN special missions to have legal guidelines when performing their duties in order to guarantee that all actions are compliant with UN policies and goals. This entails compliance with international laws like the Geneva Conventions, internal UN policies, and approval from the nations in which the mission operates. When viewed from the perspective of sending countries against participants in special UN peace missions, there is protection in the form of compensation, medical assistance, and family support. Through this arrangement, the UN can carry out humanitarian and peace missions safely and effectively, and provide protection to mission personnel. The sending nation also provides training to the soldiers, including topics such as international law, human rights, law enforcement methods, and mission guidelines. Additionally, to help them deal with the difficulties they could encounter on a peace mission, participants receive training in stress management, communication, negotiation, and conflict resolution techniques. In order for mission participants to contribute to global peace in a secure and efficient manner, it is critical that these legal provisions be upheld and monitored. When a mission member dies while performing their duties, the UN is held accountable. They are required to look into the death with great care, support the relatives of the deceased, and make sure that future missions have stronger preventive measures in place.

Abstract

Corruption crimes in government procurement of goods and services, such as bribery, price mark-ups, and manipulation of bidding processes, can disrupt good governance, cause financial losses to the state, and diminish public trust in the government. Therefore, legal audits by the State Prosecutor play a crucial role in preventing financial losses to the state and identifying administrative errors that potentially harm state finances based on the results of such legal audits. The research findings indicate that the legal audit by the State Prosecutor in avoiding financial losses to the state through the Prosecution is governed by the Cooperation Agreement between the Ministry of Home Affairs, the State Prosecutor, and the Indonesian National Police. This audit involves receiving reports or complaints from the public, verifying with supporting evidence, providing written notices of handling outcomes, and protecting the identity of the reporters. The steps of the legal audit include ensuring objectives, planning, data confidentiality, document collection and analysis, report preparation, result exposition, and result delivery to the applicants. These stages also involve auditing findings analysis, compliance evaluations, decision feasibility assessments, and considerations for further legal actions, all aimed at maintaining integrity and accountability in governance. The State Prosecutor uses legal audits to ensure legal compliance and identify errors that could harm state finances. They determine indications of criminal acts or legal violations and assess sufficient evidence to support allegations of violations. During the audit process, the State Prosecutor looks for irregularities or legal non-compliance related to public fund management, financial misconduct, and other administrative violations involving state finances.

Abstract

This research discusses the making of a marriage agreement before and after the marriage period in terms of Indonesian law. The purpose of this research is to understand the differences in the application of marital agreements made before and after the issuance of the Constitutional Court Decision Number 69/PUU-XIII-2015. This research uses a normative juridical method by examining several laws and regulations governing marital agreements. The results of this study indicate that the making of a marriage agreement during the marriage period is a valid agreement because the Constitutional Court Decision Number 69/PUU-XIII-2015 regarding the timing of making a marriage agreement is a final and binding decision.

Abstract

Bogor City has established regulations on LGBT by issuing Regulation Number 10 of 2021. It is necessary to conduct research on the regulation in order to avoid human rights violations. This research focuses on examining the local regulation of Bogor City on LGBT people from a human rights perspective. This research uses normative legal research. The purpose of this study is to determine the conflict of norms that occur between the Bogor City bylaw and the Human Rights Law, identify human rights violations against LGBT people and determine the efforts of judicial review of the bylaw. Regulation No. 10 of 2021 contradicts the basic rights of citizens stipulated in the Human Rights Law and the rights violated in the regulation include the right to human dignity, the judicial review can be done in two ways. Therefore, it is hoped that there is a need for rule reform so that in the basis of formation there are no conflicts of norms that have implications for violations of human rights.
