Abstract

Pernikahan dalam agama Islam memiliki tujuan menjadikan sebuah keluarga yang sakinah, mawaddah, dan rahmah. Hal tersebut dapat dilihat dalam al-qur’an. Sedangkan bila melihat pada Kompilasi Hukum Islam (KHI), pernikahan bertujuan unutuk membentuk keluarga yang langgeng dan bahagia berdasarkan ketentuan tuhan yang maha esa. Pernikahan selain harus memenuhi rangakain secara agama, dibeberapa tempat didalam melangsungkan pernikahan haryslah juga memenuhi tradisi yang ada salah satunya adalah tradisi pandiq penganten yang ada di Dusun Lonserang Desa Langko Kecamatan Lingsar Kabupaten Lombok Barat. Namun tidak semua tradisi yang ada sepenuhnya sejalan dengan syari’at Islam. Penelitian ini bertujuan untuk melihat tradisi pandiq penganten menggunakan kacamata ‘urf. Dengan menggunakan metode penelitian kualitatif deskrptif. Dalam memperoleh data yang akurat peneliti menggunakan Teknik pengumpulan data dengan observasi, wawancara, dan dokumentasi. Data yang sudah didapat kemudian dianalisi menggunakan Teknik analisis data dengan Langkah reduksi data, penyajian data, dan penarikan kesimpulan atau verifikasi data. Untuk mengetahui keabsahan data peneliti menggunakan triangulasi. Adapun hasil penelitian ini menunjukan bahwasanya didalam teradisi pandiq penganten terdapat prosesi yang tidak sesia dengan syari’at Islam anatara lain: 1) pelaksanaan didepan umum. Hal ini tentunya bertentangan dengan ayat al-Qur’an suarah Al-Ahzab ayat 59. Oleh karena itu prosesi pandiq penganten yang kadang dilaksanakan oleh mempelai Perempuan tanpa menggunakan jilbab menjadikan hal tersebut bertentangan dengansyari’at islam. 2) menyisir bagian-bagian terentu dengan keyakinan menghapus dosa. Hal ini tentu bertentangan dengan ajaran Islam yang dimana dalam penghapusan dosa haruslah dengan Langkah taubat kepada Allah swt. 3) teriakan dalam prosesi dengan keyakinan agar anak tidak tuli saat lahir. Tentu hal ini adalah sebuah keyakinan keliru karena segala sesuatu adalah kekuasaan Allah swt. 4) memecahkan telur bersama. Hal tersebut merupakan perbuatan mubazzir dan Allah menyebut orang-orang yang berbuat demikian adalah saudaranya syaithan.

Abstract

The second marriage or polygamous marriage can be carried out if the conditions have been met and the relevant parties have obtained permission both in the form of an application to the district court in the area where they live and permission from the first wife from a previously existing marriage. This kind of marriage has been carried out by many Indonesian people with a variety of basic reasons and looking for justification so that it can also be carried out. Children or offspring born legally will receive recognition and are clear in the eyes of the law. Heirs who have legitimate children either from their first marriage, second marriage or polygamous marriage have legal position and strength in claiming and receiving their rights to the inheritance of the heirs who have become inherited property. The Civil Code, Marriage Law No. 16 of 2019 and the Compilation of Islamic Law can be a definite description and reference in the calculation and determination of the heirs of the deceased heir. If the determination and distribution are carried out as well, for children or descendants, of course the right to their share will not be wrong and cheated.

Abstract

This research aims to determine the legal consequences of a will deed, one of the contents of which is the appointment of a will executor who is an incompetent person as regulated in Article 1006 of the Civil Code, as well as to determine the responsibilities of the Notary who makes the will deed and sanctions that can be imposed on a Notary who makes a will deed containing the appointment of an incompetent executor of the will. The research method used in this research is a doctrinal research method, which refers to existing legal materials, such as legal rules, legal principles, statutory regulations, legal doctrine and teachings, legal literature, and legal theories. Based on this research method, the type of research used is explanatory research, which is explanatory in nature and aims to test a hypothesis in order to strengthen the existing research hypothesis. The results of the research show that the legal consequences of a will deed appointing an incompetent executor of the will are that the deed can be null and void or a lawsuit for canceling the will can be filed in court. Apart from that, the Notary who makes it can be held civilly responsible and subject to sanctions according to the Civil Code, the Notary Position Law, and the Notary Code of Ethics.

Abstract

Micro, Small and Medium Enterprises (MSMEs) are independent productive business units carried out by individuals or business entities in all economic sectors. To fulfill life's needs to be prosperous, people who have the ability and are keen to see their potential and can identify the environment, can find opportunities and open up business opportunities for the community. Efforts to fulfill living needs include conducting Micro, Small, and Medium Enterprises (MSMEs). MSMEs play a vital role in reducing poverty because the existence of MSMEs can open up large employment opportunities thereby improving the welfare of the people. The aim of this research is to find out the concept of UMKN by sharia. The type of research used in this research is normative legal research. The data collection technique was carried out using a library study. The research results will show MSMEs from the perspective of Islamic law.

Abstract

A notary, holding a dual role as a professional and a public official, plays a crucial preventive role in averting legal complications through the creation of authentic deeds, serving as conclusive evidence. As stipulated by Law Number 30 of 2004 on Notary Positions, notaries are obligated to justify the deeds they produce. This study aims to examine the comprehension regarding the regulation of the responsibilities of notaries found in violation of their duties and to ensure legal protection for parties affected by the notary's data falsification. The research outcomes indicate that, as a legal consequence, notarial deeds can be subject to annulment, and based on legally binding decisions, the implicated notary can face administrative, civil, and criminal accountability.

Abstract

Several large companies are racing to establish app-based transportation companies, and one of them is inDriver. The inDriver app, particularly for drivers, is not immune to application modifications. One of the widely circulated modified applications among drivers is the inDriver MOD Autobid. Given the high interest and usage of inDriver by the public for their daily needs, it's undeniable that the number of inDriver drivers has significantly increased, intensifying the competition among them for orders.Despite this, the inDriver order system is still the one assigning orders to drivers, rather than a "first come, first served" basis. However, in the inDriver driver application, every incoming order must be manually accepted within a certain time frame. If there is no response from the driver within that period, the system will reassign the order to another driver. To minimize the occurrence of failed order acceptances, there is now the inDriver mod Autobid. inDriver Mod is a modified version of the inDriver driver application, with changes made to the system files to enable the automatic functioning of the autobid feature when the application is opened/activated.This modification allows drivers to avoid installing an autoclick application to activate the autobid feature, similar to autobid features in platforms like Lalamove or other online motorcycle taxi applications. Consequently, every time an order comes in, it is automatically accepted. The use of modified applications, especially among online motorcycle taxi drivers, particularly focuses on one online motorcycle taxi application— inDriver. Those involved, both the modifiers and users of the modified application, are found to be in violation of Article 9 paragraph 3 of the Copyright Law, which states, "Any person without the permission of the Creator or Copyright Holder is prohibited from duplicating and/or commercially using the Creation."In Islam, attention is also given to copyright, as it is seen as a form of protection of rights between individuals to achieve harmony in the rights of each person. The National Sharia Council (DSN) through the Decree of DSN Ulama Council has also issued a fatwa on the protection of Intellectual Property Rights outlined in the FATWA of the Indonesian Ulama Council Number: 1/MUNAS VII/MUI/5/2005, which states that selling and pirating others' intellectual property without legal rights is prohibited.

Abstract

The Constitutional Court's involvement of the notary profession in approving marriage agreements without the support of technical regulations regarding the legal mechanism of such agreements has led to normative conflicts, created legal uncertainties, and has the potential to harm husbands and wives who enter into marriage agreements. This situation involves informal changes in legislation and the absence of legal provisions regulating the notary's authority. The issues arising include juridical aspects related to the notary's authority, legal certainty issues, and sociological aspects related to the legality of marriage agreements not recognized by notaries. In this context, this research aims to examine whether the notary's authority to approve marriage agreements, as per the Constitutional Court Decision, is not contrary to the principle of legal certainty and how the understanding of the meaning of marriage agreements for objects other than marital property. The research findings indicate that the new authority granted by the Constitutional Court Decision No. 69/PUU/XII/2015 is an attribution-based authority derived from legislation. In other words, notaries obtain authority directly from the wording of Article 29 paragraph (1) of the Marriage Law. Article 29 paragraph (1) of the Marriage Law after the Constitutional Court Decision No. 69/PUU/XII/2015 stipulates that marriage agreements can be made before, during, and throughout the marriage with a written agreement certified by the Marriage Registrar or Notary. Although marriage agreements with objects other than marital property are not explicitly regulated, they are implicitly addressed, essentially governing family relationships. The existence of marriage agreements with objects other than marital property aims to protect and provide benefits to the parties involved in case of disputes.

Abstract

Layoffs or what is usually called one-sided termination of employment is something that is still problematic to this day and causes the emergence of industrial relations disputes, as happened in Decision Number 101/Pdt.Sus-PHI/2019/PNSmr where industrial relations disputes occurred between PT. NALA PALMA CADUDASA with 6 people from the Public Relations Team and Senambah Village Verification Team. There was a misunderstanding regarding the definition of a partnership relationship and working relationship between the two parties which led to disputes when the relationship was terminated. The research method used in this research is normative juridical with a case approach. A partnership relationship is a relationship based on a partnership agreement, while an employment relationship is a relationship based on a work agreement. The position between parties in a partnership relationship and an employment relationship is also different. In a partnership relationship, each party has the same position in terms of rights and obligations, whereas in an employment relationship the positions of the entrepreneur and employee are superior and subordinate. However, when a partnership relationship has elements of a work relationship, the partnership relationship turns into a work relationship.

Abstract

There are still many violations of workers' or laborers' rights that they should receive in situations where a company is merging or merging where there is legal uncertainty in protecting workers or laborers from companies that are merging or merging in violation of the 1945 Law. The aim of this research is to conduct research regarding the rights of workers or laborers who experience unilateral termination of employment by companies carrying out a merger. The method used in this research is a normative legal method with secondary data collection techniques through literature study. The results of this research show that the implementation of a company merger (merger) has a legal impact on employees, one of the impacts that can be received by employees is the loss of their job. As regulated in legal regulations both in the Limited Liability Company Law and in the Employment Law which provides legal protection for employees. . If the company does not want to take responsibility, employees can sue the company either through litigation or non-litigation.

Abstract

The implementation of the death penalty in Indonesia is something that is seen as contrary to humanity and human rights. The death penalty in Indonesia is still used, but its application is only used for certain types of crimes. The existence of the death penalty is still widely discussed in the national and international realm, as is whether the death penalty still needs to be applied to be used as punishment for a crime.
