Abstract

The Navigation Assistance Facility (SBNP) is an essential component that affects shipping safety and security, so a study was conducted to find out the role of the light tower guard in shipping and what obstacles were encountered in optimizing the part of the light guard. Normative research techniques to study the laws and regulations related to shipping implementation in Indonesia. The data came from statutes, regulations, expert theory, previous research, and books. The results showed that lighthouse keepers have two main objectives in shipping: assisting ship navigation in determining direction and location, warning ships when there is danger, and supporting shipping safety and security according to standards in SOLAS 1947 and ISM Code in the Shipping Law. The obstacles damaged buildings, electrical networks, installations, and light balloons that endangered shipping. The damage affects the performance of the light tower in determining the direction and location when the ship is sailing

Abstract

Konflik yang terjadi di Rusia dan Ukraina sejak tahun 2022 lalu telah mengundang perhatian besar bagi Negara-negara diseluruh dunia. Konflik antara keduanya dimulai karena timbul kehendak dari Ukraina untuk bergabung sebagai anggota the North Atlantic Treaty Organization (NATO). Alhasil, pada tanggal 24 Februari 2022, Rusia lantas melaksanakan operasi militer terhadap Ukraina dengan tujuan untuk mengambil alih keseluruhan Negara tersebut. Hal ini dilakukan atas dasar kekhawatiran Rusia terhadap ancaman independensi Rusia yang mungkin timbul sebab kemungkinan besar perbatasan di Ukraina-Rusia akan dibangun pos pertahanan oleh NATO. Rusia melakukan sejumlah tindakan seperti agresi, aneksasi, dan yang sekarang menjadi sorotan adalah deportasi anak-anak secara ilegal. Sehingga, di tahun 2023, International Criminal Court (ICC) kemudian mengeluarkan surat perintah penangkapan terhadap Presiden Putin atas dugaan deportasi anak-anak secara ilegal. Di beberapa kesempatan, Rusia sempat merespon tuduhan-tuduhan yang dilontarkan oleh masyarakat internasional. Hingga kini, tidak ada yang tahu pasti apakah tindakan Rusia dapat dikatakan sebagai suatu pelanggaran atas kejahatan internasional, mengingat Rusia selalu mengklaim hal sebaliknya atas tuduhan-tuduhan tersebut.

Abstract

Cyber Flashing is a form of Online Gender-Based Violence (KBGO) which is carried out by perpetrators by sending pictures and/or video messages of genitals or things that have sexual content to other people without the consent of the recipient of the message. This study aims to explore Law no. 12 of 2022 concerning Crimes of Sexual Violence which at least can be a hope for victims to get justice and legal protection, one of which is by the threat of punishment as stated in Article 14. The authors in this study used a type of normative juridical research with a statutory, theoretical, and legal approach. and cases. The results of this study are that the legal protection that is obtained by victims of sexual violence, especially those that occur on social media such as Cyber ​​Flashing, cannot be carried out optimally because derivative regulations have not been issued and several obstacles make victims not dare to report them to the parties. the authorities which results in hampering efforts to enforce the law on acts of sexual violence.

Abstract

Regional development is one of the efforts to utilize all the potential of the area in supporting development activities. Regional potential is the basic capital for the development of a society in improving its welfare. The existence of the area's potential is a means of supporting various development activities, both in terms of infrastructure potential, natural potential, population potential and business potential of the population as well as the potential of integrated cultural areas that can be exploited and used to improve development results in the context of justice and equity in an area . An area that is developed and developing is greatly supported by the existence of regional potential. The regional area is the geographical condition of an area which provides various opportunities for an area to manage the potentials of the area within a region. Community business activities also include potential productive areas in contributing to development activities and their results. The existence of sources of livelihood and employment owned by a community in an area, will make a major contribution to development activities, especially in the economic sector which has the potential to increase the ability of an area to become self-sufficient. Based on the description above, it becomes a concrete reference that every spatial planning activity carried out by the Regional Government of West Sumatra, always refers to the whole life of the people, including their economy, to build a just and prosperous society, it is necessary to regulate the development of appropriate integrated cultural areas. with the regional spatial plan. The supporting and inhibiting factors that must be disseminated to the community so that the development of integrated areas according to the regional spatial layout plan can be applied properly, namely socializing the factors of understanding legal substance, institutional structure, local wisdom culture, community knowledge, facilities and infrastructure available to community members know and understand the application in setting regional spatial planning in a region of West Sumatra, which directly or indirectly contributes greatly in participating in developing regional spatial planning in their region.

Abstract

Penelitian ini bertujuan untuk memberikan kontribusi dan pemikiran terhadap dunia hukum kepada pihak – pihak yang nantinya menjadi korban dari Pemutusan Hubungan Kerja ( PHK ) yang dilakukan oleh perusahaan di tempat dia bekerja, Penelitian ini menggunakan metode penelitian normatif dengan menggunakan pendekatan perundang-undangan (statue approach), pendekatan kasus (case approach) khususnya dari hasil penelitian terdapat perbedaan tentang aturan tentang ketenagakerjaan di tinjau dari Perpu No.2 Tahun 2022 dan PP 35 Tahun 2021 adanya aturan yang di dalamnya di tambahkan maupun di hilangkan sehingga di harapkan dengan di sahkan nya UU Ketenagakerjaan dan UU Cipta Kerja ini dapat membawa dampak positif bagi segala pihak terkait khususnya tenaga kerja agar hak – hak nya terpenuhi dengan semestinya sesuai dengan aturan yang berlaku. Rumusan masalah dalam penelitian ini yaitu bagaimakah aturan hukum mengenai pesangon bagi tenaga kerja yang terkena PHK Menurut Perpu No.2 Tahun 2022 dan PP 35 Tahun 2021 Dan Penulisan ini Bertujuan Untuk Mengetahui apakah terdapat perbedaan aturan hukum mengenai Pesangon yang ditinjau dari aturan hukum Perpu No.2 Tahun 2022 dan PP 35 Tahun 2021. Jenis penelitian dalam penulisan ini adalah penelitian hukum normatif yaitu dengan menggunakan sumber bahan hukum primer yakni peraturan perundang-undangan tentang : Perpu No.2 Tahun 2022 Tentang Cipta Kerja dan PP 35 Tahun 2021 tentang Perjanjian Kerja Waktu Tertentu, Alih Daya, Waktu Kerja dan Waktu Istirahat, dan Pemutusan Hubungan Kerja. serta bahan hukum sekunder yakni buku-buku dan jurnal hukum. Kesimpulan dari penulisan ini adalah di harapkan walaupun adanya perbedaan kontradiksi antara UU ketenagakerjaan dan UU Cipta Kerja dengan PP No. 35 Tahun 2021mempunyai visi misi yang sama yaitu dapat meningkatkan kesejahteraan dan memberikan keadilan bagi para tenaga kerja yang bekerja di perusahaan dan juga pemberi kerja atau perusahaan agar mereka mendapatkan hak yang sama sesuai dengan aturan hukum yang berlaku di Indonesia.

Abstract

Menurut Undangundang Nomer 3 Thn 2022 mengenai pembahasan IKN disahkan berbagai kalangan masyarakat mempertanyakan eksistensi undangundang IKN secara formil maupun materil apalagi presiden mengangkat serta mengesahkan Kepala Otoritas serta wakil Kepala Otorita IKN yang di tunjuk langsung oleh Presiden atas dasar hak prerogatif. Yang menjadi pertanyaan yakni tugas, wewenang serta kedudukan Kepala Otoritas dalam pemindahan IKN. Apabila ditinjau dari aspek Desentralisasi, tentu hal ini sudah mengenai dengan sistem Negara sebagai kesatuan yang berbentuk Republik serta juga Otonomi Daerah. Penelitian ini yakni bentuk dari penelitian hukum yang memakai metode penelitian hukum secara normatif. Hasil penelitian menyimpulkan, tidak ada ketegasan serta penjelasan detail dari peraturan undangundang Nomer 13 Thn 2022 mengenai tugas, wewenang serta kedudukan Ketua Otorita IKN

Abstract

Usaha Kecil dan Menengah (UKM) berperan sebagai kekuatan strategis dan memiliki posisi penting, bukan saja dalam penyerapan tenaga kerja dan kesejahteraan masyarakat di daerah, dalam banyak hal mereka menjadi perekat dan menstabilkan masalah kesenjangan sosial. Usaha Kecil Menengah (UKM) memiliki kelenturan menghadapi badai krisis, hal ini antara lain disebabkan oleh tingginya krisis pada faktor-faktor produksi industri, baik pada penggunaan bahan baku maupun pelaksanaan. Selain itu, usaha mereka pada umumnya berbasis pada kebutuhan masyarakat luas dan memiliki keunggulan komparatif. Berbagai peran strategis dimiliki sektor usaha kecil menengah, namun sektor ini juga dihadapkan berbagai permasalahan. Kendala dan permasalahan antara lain dari aspek permodalan, kemampuan manajemen usaha, dan kualitas sumberdaya manusia pengelolanya. Kendala dan permasalahan usaha kecil dan informal lainnya juga disebabkan karena sulitnya akses terhadap informasi dan sumberdaya produktif seperti modal dan teknologi, yang berakibat menjadi terbatasnya kemampuan usaha kecil untuk berkembang sehingga berdampak secara sosiologis.

Abstract

The prohibition of giving money or goods to homeless people and beggars in Makassar City is regulated in Article 49 of Regional Regulation Number 2 of 2008 concerning the Development of Street Children, Homeless People, Beggars and Singers. This ban was issued to prevent the development and spread the number of homeless and beggars and minimize or free public places from the presence of homeless people and beggars. This study aims to analyze the implementation and application of sanctions for giving money or goods to homeless people and beggars. The results of the study show that the implementation of the rules regarding the prohibition giving money or goods to homeless people and beggars in Makassar City has not gone well. The indicators are that there are still policy objectives that have not been achieved, the number of officers is not proportional to number (riders) and the size of the area, the unavailability of adequate facilities/facilities, and the low level of public legal awareness. The lack of coordination between related agencies and the absence a government account to collect money from fines resulted in the implementation/enforcement of sanctions for giving money or goods to homeless people and beggars in Makassar City.

Abstract

Rape is increasingly occurring with perpetrators who are unaware of the place and time. Protecting minors who become victims is a government priority. This study uses a normative research method, referring to primary and secondary legal sources. Law Number 35 of 2014, which amends Law Number 23 of 2002 concerning Child Protection, regulates legal protection for child victims of rape. Victims can file for restitution, receive medical assistance, and undergo psychosocial rehabilitation. Rapists can be sentenced to a maximum of 15 years in prison and a minimum of 5 years, as well as fined up to Rp.5,000,000,000.00. Therefore, it can be concluded that child rape victims receive strong legal protection under the Child Protection Law. Additionally, they also receive the necessary assistance for physical and psychological recovery. On the other hand, rapists face severe sanctions commensurate with the crime committed. This research has important implications for raising public awareness about the importance of protecting child rape victims and ensuring consistent enforcement of existing laws.
