Abstract

The terror of data dissemination when customers default on online loans is indeed very troubling. Law Number 11 of 2008 concerning Electronic Information and Transactions considers that this act violates the law. However, in its implementation in the field, the ITE Law is not very satisfactory in protecting defaulted customers from the terror of spreading data. In this study using empirical juridical methods with a statutory approach and a case approach. The results of this study prove that the terror of spreading data for defaulted customers is usually done by calling emergency numbers first to hijacking galleries and distributing photos of ID cards at the time of submission and also selfies when filing. This terror is also carried out on the numbers of companies where customers work so that it is not uncommon for customers to be fired because of the terror of spreading the data. The factor of indebted customers on online loan platforms in Medan City is due to the ease of selecting loans themselves, due to urgent economic needs, and very minimal financial literacy makes loan customers always trapped in the trap of borrowers who sometimes want to leak data and threaten when billing. In its implementation in the field, Law Number 11 of 2008 concerning Electronic Information and Transactions is not carried out optimally considering the high terror of data distribution carried out by online loans currently in Indonesian technology findusia. That is, the ITE Law is indeed protecting the public from the spread of data, but in its implementation in the field the ITE Law itself is not so strong in protecting the public from the terror of spreading data. This is also because there are rubber articles that have ambiguous explanations and articles whose implementation in the field can be compromised

Abstract

Election implementation is essentially a way of selecting someone to fill a political position in the constitution. It is hoped that the election will produce aspirational, high-quality leaders who are especially able to bring the government closer to the people. However, in practice, facts were found related to the enthusiasm of the people for the election process and election results, where people are less enthusiastic and even hurt democratic values. Especially in the implementation of elections conducted abroad. The lack of public participation abroad in the implementation of elections is caused by their identity not being registered as the Permanent Voters List (DPT) and the long distance to the polling place (TPS). The loss of their rights is the same as the violation of basic human rights for them and this clearly violates the Maqasid Shari'ah concept, in which citizens cannot exercise their rights al-darruriyyat. This study uses the method This research uses the Normative Juridical method in which this research refers to the legal norms contained in the Legislation. The data used was obtained through a literature study. From the research conducted, it can be understood that in Law No. 7 of 2017 concerning General Elections, matters related to election procedures abroad are regulated, where the participation of Indonesian citizens living abroad is a form of fulfillment of constitutional rights and also in the view of maqasid syari'ah elections are important to be implemented in the implementation of elections abroad.

Abstract

Plagiarism is often the most frequently faced thing by all universities, especially among final students who make scientific work. Law Number 28 of 2014 concerning Copyright itself states that scientific work is the object of protection from the law, In this study the author uses a statutory approach and a concept approach because it is considered relevant to the type of author's research which is normative juridical. The results showed that in the analysis of Law Number 28 of 2014 concerning Copyright against plagiarism tests among universities themselves is an effort to protect the copyright of the author. However, plagiarism testing itself is only an effort to reduce the chances of plagiarism, not to overcome and eradicate plagiarism as a crime of copyright infringement. The plagiarism test itself is the minimum form of effort in overcoming copyright infringement committed among universities. Legal protection against plagiarism among universities itself is not only carried out by plagiarism tests alone. Copyright infringement with plagiarism if only punished by a delay in the trial is considered not too meaningful.  Eligibelization is a program from Kemenristekdikti as an effort to protect law against copyright infringement. However, this plagiarism test according to Law Number 28 of 2014 concerning Copyright has still not been able to overcome legal protection from copyright infringement. Eligibleization is an ideal form of legal protection among universities in reducing the number of copyright violations that occur in plagiarism of student scientific works.
