Abstract

AbstractLaw No. 26 Year 2007 on Spatial Planning (UUPR) mandated that all levels of government administration, ranging from the national, provincial, district/ city are obligated to prepare Spatial Plan (RTR). Until 2012, Central Kalimantan is one of the provinces which have not completed its Spatial Plan; one of the reasons was the lack of spatial integration of forestry spatial planning and provincial spatial planning of Central Kalimantan.The absence of spatial integration of forestry and provincial spatial planning of Central Kalimantan has the implication in triggering conflicts of land use. Forest areas were converted into oil palm plantations without any official procedures. There are 282 units of oil palm companies, occupying 3.9 millions hectares of forest area, with non-procedural procedures to convert forest area into oil palm plantation.To resolve this problem, the Government has revised the regulation of forest conversion by issuing PP No. 60/2012, provides opportunities for oil palm plantations, which under the Law of Forestry located in forest area but based on RTRWP of Central Kalimantan lies on APL or cultivation area, given the opportunity to re-apply the permit/license.  IntisariUndang- Undang No. 26 Tahun 2007 tentang Penataan Ruang (UUPR) mengamanatkan bahwa semua tingkatan administrasi pemerintahan, mulai dari nasional, provinsi, kabupaten/kota diwajibkan menyusun Rencana Tata Ruang (RTR). Kalimantan Tengah sampai dengan tahun 2012 merupakan salah satu Provinsi yang belum menyelesaikan Tata Ruang, salah satu penyebabnya karena belum adanya padu serasi antara tata ruang kehutanan dengan tata ruang Provinsi Kalimantan Tengah.Implikasi dari tidak adanya padu serasi antara tata ruang kehutanan dengan tata ruang provinsi Kalimantan Tengah adalah terjadinya konflik dalam penggunaan ruang, dimana terjadi penggunaan kawasan hutan tidak prosedural untuk perkebunan sawit di dalam kawasan hutan di Provinsi Kalimantan Tengah sebanyak 282 unit perusahaan sawit seluas 3,9 juta hektar.Upaya penyelesaian permasalahan penggunaan kawasan hutan untuk perkebunan sawit di Provinsi Kalimantan Tengah diakukan dengan revisi kebijakan tentang alih fungsi hutan PP nomor 60 tahun 2012 yang memberikan kesempatan bagi perkebunan sawit yang berdasarkan Undang-Undang Kehutanan berada di dalam kawasan hutan namun berdasarkan RTRWP Provinsi Kalimantan Tengah berada di kawasan APL maupun budidaya, diberikan kesempatan untuk mengurus perijinannya.

Abstract

Abstract: The objective of this study is to describe the pattern of land tenure and forms of livelihood diversification in rural area. By using qualitative approach, data was collected and presented descriptively. The results are as follows, first, land is an important production factors as capital and labor. Land in Kedungprimpen village is still closely linked to the livelihoods of its inhabitants. High level of dependence of the population on agricultural land is also closely related to the local community's view that underlies the social differentiation of the rich, ample and poor. Second, this fact further encourages households to deal with the crisis, undertake series of livelihood activities to meet their basic needs. The selection of diversified forms of livelihood is mainly based on rational reasons related to the types of resources that can be optimized. Generally, livelihood diversification in Kedungprimpen Village is on agricultural and non-agricultural sectors. Agricultural sector includes land cultivation, sharecrop, rent, mortgage, and labor system. Non-agricultural sector includes trade, handicrafts production, stockbreeding, and carpentry. Intisari: Penelitian ini bertujuan menguraikan pola penguasaan tanah di pedesaan, dan mendeskripsikan bentuk-bentuk diversifikasi nafkah. Data dikumpulkan dengan pendekatan kualitatif dan disajikan secara deskriptif. Hasil penelitian menunjukkan, pertama, tanah merupakan salah satu faktor produksi yang penting sebagaimana modal dan tenaga kerja. Tanah di Desa Kedungprimpen masih terkait erat dengan sumber nafkah penduduknya. Tingginya tingkat ketergantungan penduduk pada tanah pertanian juga terkait erat dengan pandangan masyarakat setempat yang melatarbelakangi diferensiasi sosial tentang orang kaya, cukup, dan miskin. Kedua, fakta ini, selanjutnya mendorong rumah tangga dalam menghadapi krisis untuk melakukan serangkaian aktivitas nafkah dengan tujuan untuk memenuhi kebutuhan pokoknya. Pemilihan bentuk diversifikasi nafkah terutama didasari alasan rasional terkait dengan jenis sumberdaya yang dapat dioptimalkan. Secara umum, diversifikasi nafkah di Desa Kedungprimpen dilakukan pada sektor pertanian dan sektor nonpertanian. Sektor pertanian mencakup pengusahaan lahan milik, bagi hasil, sewa, gadai, dan sistem perburuhan. Sedangkan sektor nonpertanian meliputi perdagangan, kerajinan, peternakan, dan pertukangan.

Abstract

Abstract : The control/ownership of land in Surabaya is marked by the unique phenomenon of surat ijo ; many residents in the municipalities life on state land. Entering Reform Ere (1999), most of the occupants were no longer abide to the existing regulations. Furthermore, solidarity within community of “tanah surat ijo” arises, and has led them to establish their own mass organization and fight for hak milik (HM, land ownership rights) over the land they occupy. It is thus unsurprising that conflict of interest has occurred between the two. Various efforts to resolve this conflict have been undertaken, including mediation and a civil suit, but these have been unsuccessful to date. Similarly, the enactment of Peraturan Daerah No. 16 Tahun 2014 (Surabaya Municipal By law No. 16 of 2014) was unable to resolve the conflict. This paper attempts to understand and explain the context of land control, ownership, and conflict over “tanah surat ijo” in Surabaya. As conclusion, that the system of “tanah surat ijo” -is a transformation of the colonial land rent system-has affected all aspects (be they social, economic political, cultural, or psychological) of its residents lives. Besides that, to promote conflict resolution, there must be a transformation in “tanah surat ijo” system; this requires the involvement, cooperation, and coordination between relevant ministries. Keywords : surat ijo, state land, resolution, conflict, SurabayaIntisari : Penguasaan/pemilikan tanah di Surabaya ditandai fenomena unik tanah surat ijo, yakni permukiman sebagian warga kota di atas tanah negara. Memasuki era Reformasi (1999) sebagian besar warga penghuni tidak lagi patuh pada peraturan yang berlaku. Bahkan, timbul solidaritas komunitas warga pemukim tanah surat ijo yang kemudian membentuk organisasi massa melakukan upaya untuk memperoleh hak milik atas tanahnya. Tak pelak, terjadilah konflik sosial antara keduanya. Berbagai upaya resolusi telah dilakukan mulai mediasi hingga di meja peradilan tertinggi belum bisa menyelesaikan. Demikian pula, pemberlakuan Peraturan Daerah No. 16 Tahun 2014 tentang pelepasan asset pun belum dapat mewujudkan resolusi konflik. Tulisan ini mencoba untuk memahami dan menjelaskan konteks penguasaan, kepemilikan, dan konflik atas tanah surat ijo di Surabaya. Sebagai simpulan, keberadaan tanah surat ijo –sebagai jelmaan sistem sewa tanah pada era kolonialtelah menimbulkan dampak di semua segi kehidupan warga penghuni, mulai aspek sosial, ekonomi, politik, hingga budaya/ psikologi. Selain itu, di dalam kerangka upaya mencapai resolusi konflik diperlukan perubahan system tanah surat ijo, untuk itu perlu keterlibatan, kerjasama, dan koordinasi antara beberapa kementerian yang terkait. Abstract

The high threat of disaster / multi-disaster in Indonesia leads to a number of communities in a state of being exposedand vulnerable to disasters. The high number of people living around the source of disaster / KRB III also causes the high degreeof potential risk and loss if the disaster occurs. The National Land Agency has pivotal role in regulating land for development, in thiscase, through the provision and arrangement of land for settlement (relocation) and for infrastructural development for the peopleliving in the disaster-risk areas. This study employed review of literature and legal products on land availability as its method andapproach. The allocation of land, particularly for the people living in disaster-risk areas, may be provided through land acquisition,land utilization of reserved State land from previously abandoned land, or may also be provided through land consolidation basedon spatial planning.This is intended to achieve the quality of environment, safe and prosperous society.Keywords: land availability, land consolidation, disaster

This article discussed the possible impact of land grabbing practice toward the emergence of internal displacementperson taken a close look to MIFEE project in papua. employed the concept of acumulation by dispossesion, it was found that themajor scale farming development kept a serious impact toward the emergence of internal displacement person. they are oneswhose land, forest and other aource of living had been taken away. Abstract

Abstract: Changing the orientation of land demand from the city center towards the suburbs can alter the physical pattern of spatial and economic pattern in that location. The nominal value of the land within the suburbs is not the same, depending on the quality and quantity of space available, this makes the market different and in the end make the spatial distribution of land values and patterns in every corner of the city. The study was conducted in the city of Madiun where the area is physically not too wide and allows the development of the city. This study aims to describe the structure of land values in the city of Madiun in the form of contours as well as to analyze/explain the pattern of land values from the perspective of spatial economy. The analysis is done by looking at each disparity/ difference between the value of land between objects/samples depicted in the contour line of land values. The value of the various soil contours shows the pattern of soil value which is further examined and studied according to spatial theory. The analysis of the land value pattern from the perspective of spatial economy is done with the spatial economic variables that exist around it, such as public facilities, economic center, land use, quality and road network and so forth. In this case a superimpose / overlap between the land value pattern map (in contour form) with maps of public facilities, road access maps, land use maps, and so on. Spatial pattern of land value in Madiun City tends to spread and in each pattern is not interrelated. There are strong indications that land value patterns in Madiun City are spatial economically influenced by several things, such as accessibility, facilities / services, and economic centers. Intisari: Perubahan orientasi permintaan tanah dari tengah kota menuju ke arah pinggiran kota dapat merubah pola fisik keruangan dan pola ekonomi di lokasi tersebut. Nilai nominal lahan di dalam maupun pinggiran kota tidak sama, tergantung kualitas dan kuantitas ruang yang tersedia, hal ini menjadikan pasarnya pun berbeda-beda dan pada akhirnya menjadikan sebaran maupun pola nilai tanah yang secara spasial berbeda pada setiap sudut wilayah kota. Penelitian dilakukan di Kota Madiun dimana wilayahnya secara fisik tidak terlalu luas dan memungkinkan terjadi perkembangan kota. Penelitian ini bertujuan untuk menggambarkan struktur nilai tanah di Kota Madiun dalam bentuk kontur serta untuk menganalisis/menjelaskan pola nilai tanah dari perspektif ekonomi keruangan. Analisis dilakukan dengan cara mencermati setiap disparitas/selisih nilai tanah antar obyek/sampel yang digambarkan dalam garis kontur nilai tanah. Nilai kontur tanah yang beragam menunjukkan pola nilai tanah yang selanjutnya dicermati dan dikaji sesuai teori keruangan. Analisis mengenai pola nilai tanah dari perspektif ekonomi keruangan dilakukan dengan variabel ekonomi keruangan yang ada di sekitarnya, seperti fasilitas publik, pusat perekonomian, penggunaan tanah, kualitas dan jaringan jalan dan lain sebagainya. Dalam hal ini dilakukan superimpose/tumpang susun antara peta pola nilai tanah (dalam bentuk kontur) dengan peta fasilitas publik, peta akses jalan, peta penggunaan lahan, dan lain-lain. Secara keruangan pola nilai tanah di Kota Madiun cenderung menyebar dan pada setiap pola tersebut tidak saling berhubungan. Terdapat indikasi yang kuat bahwa pola nilai tanah di Kota Madiun secara ekonomi keruangan dipengaruhi oleh beberapa hal, seperti aksesibilitas, fasilitas/layanan, serta pusat-pusat perekonomian.

Abstract

Strictly speaking, the Basic Agrarian Law is not intended to wipe out someone’s or legal body’s rights but ratherto unify the National Land Law. As mentioned at Part II of the Basic Agrarian Law, the conversion had to be done to admit boththe western registered lands and those bearing the adat rights. One of the rights that can be converted into the right ofownership is druwe desa land. Eventhough there has already been a rule on the above conversion, druwe desa at Pakraman BengVillage have not been converted up to the present moment.
