Abstract

The article on the modernization of Indonesian law through revision of the Undang-undang Hukum Perdata (KUH Perdata) aims to analyze the relevance of the Civil Code to current conditions and identify articles in the Civil Code that are no longer relevant to current developments. The research was carried out using a qualitative descriptive method, focusing on a problem based on facts obtained through observations, interviews and studying documents or references that are relevant to the topic being written. This research was carried out by collecting data from various sources such as literature, legal documents and previous research results that are relevant to the data needed. Furthermore, the data obtained was then analyzed qualitatively by identifying patterns and themes that emerged from the data. This research also uses a textual and contextual approach in analyzing the Civil Code. The conclusion of this research is that the revision of the Civil Code is a necessity in adapting to the challenges of the times. In terms of legal and grammatical substance, those who still adopt the old grammar are no longer appropriate to the current Indonesian language context. Likewise, articles that are no longer relevant need to be updated to ensure that the law continues to function effectively in modern society. The revision of the Civil Code is not just an adjustment, but is also an important step in modernizing the Indonesian legal system as a whole

Abstract

This article aims to examine the portrait and fairness of elections in the implementation of campaigns in regional head elections with a single-candidate pair and provide suggestions for the design of campaign implementation rules. This research focuses on electoral fairness in the implementation of the campaign in the 2020 regional head election for each pair of candidates in Pasaman Regency. The research method used a juridical-empirical method that examines existing law and reality. Data collection was through literature reviews such as primary data, and interviews using the purposive sampling method which took into account the characteristics of the sample. This research was a qualitative analysis which described and arranged systematically. This study concludes that there are legal gaps in KPU regulations governing the procedures and distribution of campaign materials to the public. This happened after there was a report of a violation from the public who questioned the legality of volunteers placing campaign props in the form of banners in empty rows, and journalists asked for the banners to be removed. Responding to this violation, the Pasaman Regency Bawaslu determined that the report did not constitute a violation because the empty column did not violate any provisions. The existence of a legal vacuum has an impact on the emergence of gaps in voters' rights in terms of access to information, and the gap between single candidate pairs and empty columns in conducting election campaigns has not been fulfilled.

Abstract

As one of the most well-known types of drink throughout the world, it is not surprising that the presence of tea in Yogyakarta Palace is high. Tea is always served in the Sultan and family's private dishes, traditional ceremonies, and state banquets. In other countries, tea has even become an identity and a diplomatic tool. Seeing this phenomenon, this research was created to dig deeper into the existence of tea in the Yogyakarta Palace, especially at state banquets and its relation to a form of culinary diplomacy known as gastrodiplomacy. In this qualitative research, it was found that tea was always served as choice of drink at state banquets. However, until now there has not been a special format or procedure for a tea party to entertain state guests. It would be interesting if in the future the palace could develop a Yogyakarta Palace style tea reception in order to maximize the potential for gastrodiplomacy which could have various positive implications for collaboration in various needed sectors.

Abstract

The article entitled The Influence of Socio-Cultural Aspects on Village-Owned Enterprises (BUMDes) Maju Bersama Wolotolo Village, Ende Regency, East Nusa Tenggara aims to examine the influence of social and cultural aspects in the formation, participation or selection of business units, as well as the recruitment of BUMDes members between 2016-2017.The focus of this research is to see how customs, traditions and cultural values become the basis and influence the formation process of BUMDes. This research utilizes Structural Functionalism and Social Capital theories. A qualitative approach is used in this research to collect and analyze data. Data were collected through interviews, observation and documentation. Based on the research, it was concluded that the traditions and customs of the local community influenced the pattern of cooperation based on the tradition of gathering together in the village, the recruitment of administrators who were influenced by customs based on closeness and kinship factors, and the pattern of work that was strongly influenced by the development of local community habits to be very fund-oriented. This then brings positive impacts such as loyalty, but on the other hand there are also many negative impacts such as the low professionalism, skills and capacity of the management, the exclusion of other parties from the management of the BUMDes, as well as making a work pattern that always sees the availability of funds as a benchmark for organizing activities so that all of that leads to the stagnation of business activities in the BUMDes.

Abstract

The relocation of the Indonesian Capital from Jakarta to Nusantara in North Penajam Paser has generated both support and opposition. The urgency of the idea has been criticized as not taking into account the current conditions, which is still recovering from the pandemic and facing uncertainties in the global economic situation. To understand this situation, this study used narrative policy framework method to analyze the government's narrative in implementing capital relocation policy, as compared to the counter-narrative conveyed by the community. The government believes that relocation is the best solution to resolving the pressing issues of economic disparity and environmental changes on Java Island. They also claim that the new capital would be a showcase of Indonesia's diversity to the world. On the other hand, the community views policy as being unfavorable to their interests, more business-oriented, and politically driven. The government is seen as unresponsive to the community's needs. The results showed that there was a gap between narrative of capital relocation policy conveyed by the government and the community who opposed this policy. In addition, the government's failure to involve the community in the formulation of policy has resulted in conflicting interests and different perspectives during the implementation stage.
