Abstract

The role of a mediator is crucial in facilitating understanding among parties involved in a dispute. Mediators aid the parties in comprehending each other's perspectives regarding the contested issues and subsequently assist them in making objective assessments of the overall situation during negotiation processes. This research specifically aims to identify the legal standing, both in civil law and Islamic law, concerning the disputed issue of child custody with the assistance of a neutral third party (mediator). The research employs a qualitative method, involving the collection, analysis, and comprehensive interpretation of narratives. Legal materials obtained from literature reviews and legal approaches are analyzed using systematic interpretation techniques. The research findings highlight that the mediator's ability significantly influences the success of mediation. If mediation fails to reach an agreement, the mediator submits a written notification to the presiding judge, who then informs the panel judge handling the case. The disputing parties are expected to appear at the scheduled hearing, and the trial process continues as usual.

Abstract

The transformation of government organizations is necessary to improve government performance. To achieve excellent public services, the community also plays an important role because the community is not only limited to receiving services but also as active partners in the process of planning, implementing, and evaluating policies. This research aims to describe the effectiveness of organizational transformation and government management in achieving excellent public services. The study will consider the impact of community participation in designing and improving policies as well as public services. This research uses descriptive qualitative methods and employs a questionnaire survey method as a research instrument. Qualitative research is a type of research that produces analysis without using statistical procedures or other quantitative methods. The results of this research indicate that organizational transformation and government management can improve the effectiveness and efficiency of public service delivery, while community participation can enhance the quality of public services. Active community participation in decision-making processes and government policy implementation allows the community to participate, provide input, and influence policy processes. Therefore, both factors must work simultaneously and support each other to realize excellent public services.

Abstract

This article aims to examine Sriwijaya University's aggressiveness in preventing and responding to sexual violence. The problem focuses on sexual violence committed by the academic community both verbally and audio-visually, in person or online. Sexual violence is an issue that has long developed in society, although some feel ashamed. Some victims feel that methods are close to what happened to them, and some also because they are under pressure. Since the development of this issue on social media and going viral in 2020 and 2021, the government has begun to take a role in efforts to prevent and handle sexual violence in the world of education, especially in the higher education environment with the existence of Permendikbudristek Number 20 of 2021. Sriwijaya University took the step of establishing aggressiveness as an implementer of the prevention and handling of sexual violence in its environment. With all the tasks and principles that must be carried out and respected. This research provides recommendations for Sriwijaya University to make more concrete and relevant regulations for the Sriwijaya University environment.

Abstract

This research was conducted to examine the influence of the competence of village government officials and internal control systems on accountability in village funds management with the principle of independence as a moderating variable in Kapanewon Tempel Villages, Sleman Regency. The method used in this research is descriptive quantitative and primary data is taken through questionnaires. This research is a quantitative research type. The population in this study were village officials in the villages in Kapanewon Tempel. Units of analysis are the village head, BPD, village secretary, village treasurer, head of finance, head of planning, head of administration, and head of services. Samples were taken using a purposive sampling technique, which makes the entire population sampled in this research. The total sample in this research was 64 respondents. Data analysis shows that 1) the competence of village officials has a positive influence on the accountability of village fund management; 2) the internal control system has a positive influence on the accountability of village fund management; 3) the principle of independence does not moderate the competence of village officials towards accountability in managing village funds, and 4) the principle of independence does not moderate the internal control system towards accountability in managing village funds.

Abstract

Currently in Indonesia there are many cases of criminal acts against copyright. This number is quite fantastic when you look at the fact that from what is known the number is already quite high, not to mention small cases that do not receive special attention by the government. Of course, if left unchecked, this could cause losses, not only for the creator of the work, but also have an impact on the country's social aspects and even the country's economic aspects. This research uses a normative juridical type of research, what is meant by normative juridical research is legal research. literature because normative legal research is carried out by examining library materials or secondary data only. The legal materials referred to will also be used as interesting literature reviews and books, and web-based resources. The occurrence of copyright crimes can harm the creators and thus legal action must be taken against copyright holders during this process. Criminal law against copyright criminals will be implemented. gradually investigation, investigation, prosecution and investigation in court. The concept of the criminal act of complaint offense (klacht delict), from the meaning of the word klacht or complaint, means a criminal act that can only be prosecuted after a report contains a request for prosecution in relation to a particular person or persons. As a country that has ratified TRIPs (Trade Related Aspects of Intellectual Property Rights), this means that Indonesia has a strong enough legal basis to protect the owners or holders of Intellectual Property Rights (IPR), which include Copyright. Copyright Law Number 28 of 2014 has adapted to the agreement agreed in TRIPs. Based on the description above, it can be concluded that the offense of complaints in copyright crimes is not appropriate for the use of copyright crimes. This is because the substance of ordinary offenses has more relevance to prosecuting copyright crimes. In the description above, the state's responsibility to protect citizens, in this case copyright holders, has been explained. The recommendation regarding this problem is to make or formulate copyright crimes into ordinary offenses. So that law enforcers do not hesitate in carrying out inquiries, inquiries and prosecutions for copyright crimes. So don't wait for complaints from copyright holders. The complaint offense will limit law enforcement

Abstract

This article aims to determine the maintenance of the Balinese language by the third generation of Langkat Balinese transmigrants, to determine the religious moderation of Muslims and Hindus in the Balinese Village community in Langkat Regency, to determine the maintenance of Balinese customs by the third generation of the Balinese tribe in Langkat Regency. This research problem is focused in the third generation of Balinese tribal people who live in North Sumatra and Islamic communities in Kampung Bali. In order to approach this problem, customary theory and religious moderation were used, data was collected through literature surveys, observations and interviews and analyzed qualitatively using an ethnographic approach. This research concludes that the Balinese people who have lived in North Sumatra since 1963 have reached several generations, currently they have reached the third and fourth generations, the use of the Balinese language in the third generation has experienced a significant decline, but in terms of maintaining customs, many traditions are still maintained despite simplification. . The Balinese Hindu community also carries out religious moderation which creates harmony between religious communities. The attitudes of the people of Kampung Bali Langkat are in line with the moral teachings of the Hindu religion, namely Tat Twam Asi. Religious moderation is also carried out by Muslims according to the principles of the Islamic religion.

Abstract

Peran kepemimpinan kepala sekolah sangat berdampak pada motivasi kerja guru, kepala sekolah memberikan dorongan kepada para guru untuk dapat meningkatkan motivasinya, sehingga apabila motivasi kerja guru meningkat maka kinerja guru akan semakin meningkat pula. Tujuan dari penelitian ini adalah guna untuk mengetahui strategi yang digunakan kepala sekolah dalam memotivasi guru. Hasil dari penelitian ini strategi yang dapat digunakan dalam memotivasi guru adalah dengan mengenali dan menghargai upaya guru, memberikan dukungan dan sumber daya yang diperlukan, mendorong peluang pengembangan profesional, memberikan otonomi dalam metode pengajaran, mendorong komunikasi terbuka dan dukungan emosional, mempromosikan kerja tim dan kolaborasi, menetapkan tanggung jawab tambahan, dan menawarkan umpan balik yang konstruktif, memberikan kesempatan untuk berbagi pengalaman, mendorong inovasi dan kreativitas, menetapkan tujuan bersama, membangun hubungan yang kuat dengan siswa, memberikan waktu untuk refleksi dan pengembangan diri, menegaskan nilai-nilai sekolah, dan memberikan peluang untuk pengambilan keputusan.

Abstract

Abstract This research aims to describe the process of ethical code violations and analyze the factors causing ethical code violations by members of the Polling Organizers Group (KPPS) in the 2020 West Sumatra Governor Election at Polling Station (TPS) 1 in Salak Village, Talawi Sub-District, Sawahlunto City. This study uses a qualitative descriptive approach with a case study method. The theory used is election malpractice. The results of the study show that there were violations of the ethical code committed by KPPS members at TPS 1 in Salak Village due to the non-compliance of KPPS members in following the rules before the voting process. Violations occurred because KPPS members had not prepared the ballot tools in the voting booth. Voters were not well-informed about the correct voting procedures according to regulations. Factors causing ethical code violations by KPPS members at TPS 1 in Salak Village, Sawahlunto, include KPPS members' inability to work professionally, their limited understanding of the election regulations, insufficient supervision by Polling Station Supervisors (PTPS) during the voting process, lack of communication and coordination between KPPS officers and PTPS, Polling Station Committees (PPS), and Sub-District Election Committees (PPK), as well as inadequate quality of resources and training for KPPS.

Abstract

Tujuan penelitian ini adalah untuk menganalisis dan mengetahui besar pendapatan usahatani nanas dan untuk mengetahui prospek usahatani nanas pada lahan gambut di Desa Pasar Tiga Kecamatan Panai Tengah.Adapun lokasi penelitian ini dilaksanakan di Desa Pasar Tiga Kecamatan Panai Tengah Kabupaten Labuhanbatu. Populasi dalam penelitian ini adalah seluruh petani nanas yang ada di Desa Pasar Tiga. Teknik pengambilan sampel dalam penelitian ini menggunakan accidental sampling dalam penelitian ini diambil sampel sebanyak 28 orang petani. Data yang digunakan dalam penelitian ini adalah data primer dan data sekunder. Teknik analisis data yang digunakan dengan menghitung biaya produksi, penerimaan, pendapatan,dan menggunakan nilai R/C Ratio untuk mengetahui prospek usahatani nanas.Hasil penelitian ini menunjukkan bahwa rata-rata total biaya produksi sebesar Rp. 6.179.714, rata-rata total penerimaan yang diperoleh adalah Rp. 11.318.571, dan rata-rata pendapatan bersih yang diperoleh adalah sebesar Rp. 5.138.857 permusim panen/tahun. Nilai rata-rata R/C Ratio menunjukkan hasil 1,8 dapat diartikan bahwa usahatani nanas memiliki prospek yang menguntungkan untuk dilakukan karena nilai R/C > 1 = Layak.

Abstract

Kecantikan merupakan sebuah karunia dari tuhan yang diberikan kepada setiap Perempuan. Dalam mempertahankan kecantikan Perempuan jawa memiliki banyak cara salah satunya yaitu melaksanakan ritual kecantikan. Sehingga hal tersebut menjadi kebudayaan turun-temurun sampai generasi sekarang (Gen-Z). Sebagai Gen-Z yang sering dikaitkan dengan hal yang bersifat modern dan pola pikir yang rasional. Namun tidak dengan Gen-Z yang melakukan ritual kecantikan di Sendang Bidadari. Mereka masih meyakini adanya mitos atau manfaat yang ada pada air di Sendang Bidadari. dari pemahaman tersebut terdapat rumusan masalah yaitu bagaimana pemahaman Gen-Z dan kepercayaannya terhadap mitos kecantikan di Sendang Bidadari saat ini kemudian ditinjau dari Teologi Islam. Metode dalam penelitian ini yaitu kualitatif dengan pendekatan fenomenologi. Hasil dari penelitian ini menunjukan Gen-Z yang datang ke Sendang Bidadari meyakini adanya kekuatan spiritual air sendang yang dapat mengabulkan beberapa hajat. Gen-Z meyakini hal yang mereka lakukan sebagai bentuk ikhtiar kepada tuhan tanpa ada kemusyrikan. Mereka juga meyakini ritual tersebut merupakan kebudayaan yang sudah dilakukan secara turun-temurun.
