Abstract

This paper aims to explain the legal protection of consumers for the sale of diet drugs without a distribution permit through the marketplace. This research is a normative legal research. The type of approach used in this study is the statutory approach and the conceptual approach. The collection of legal material in this study used the snowball technique as used in empirical research. The analysis of legal material in this research is to use descriptive, comparative, evaluative and argumentative analysis. This study aims to answer the problem of what are the permit provisions for diet drugs sold through marketplaces? Then how about the legal protection for consumers who buy diet drugs without a distribution permit through the marketplace? After conducting the research, it can be concluded that business actors who trade diet/slimming products without a distribution permit are actions that are prohibited for business actors, so these goods must be withdrawn from circulation. Abstract

Cyberloafing is a form of social-loafing that reduces joint performance within an organization. As a reluctance to provide equal effort to communal work, cyberloafing is much more covert because an individual can hide behind their electronic work device. In the form of service work that demands teamwork, this behavior interferes with the performance of public service organizations. This study aims to see how this behavior exists in an organizational institution. This study took the research locus in sub-district offices throughout West Aceh Regency. A total of 73 research respondents consisting of government employees with the status of civil servants were examined for their responses from the main point of view of The Theory of Reasoned Action. The results of the partial least square test on the research construct indicate that the behavioral intention is based on the environment around which the individual interacts. The perceived behavioral control variable does not affect cyberloafing behavior.

Abstract

This study aims to examine how decision analysis studies should be conducted. In addition to examining the case approach in normative legal research, which is a commonly used approach in decision analysis studies, this study was also conducted to investigate the methods and characteristics of decision analysis. Using qualitative and document research methods, data was collected through focus group discussions and documentation. This study found that decision analysis research is specifically a case-specific study, possibly using philosophical and conceptual approaches simultaneously. The steps of decision analysis research also specifically follow the IRAC (Issue, Rule, Attention and Conclusion) method. This study is expected to contribute to the development of the discourse on legal research methodology with its various approaches, especially approaches that have been introduced in normative legal research. Practically, this study is expected to provide guidance for students to conduct normative legal research with a case approach, especially in decision analysis research. The results of this study are also expected to be a guide for supervisors to guide students who conduct normative legal research with a case approach, especially research on the analysis of judges' decisions.

Abstract

This article aims to describe the process of implementing door to door socialization carried out by the General Election Commission of North Bengkulu Regency for voters in the midst of Covid-19 conditions and to determine the effectiveness of door to door socialization carried out by the General Election Commission of Bengkulu Regency as a form of effectiveness of the institution's function in socialization in pandemic period. The problem focuses on the effectiveness of the KPU's function in socializing the election of Regent and Deputy in North Bengkulu Regency. In order to approach this problem, Christopher C Hood's reference theory is used. Data was collected through interviews and documentation methods and analyzed qualitatively. This study concludes that during the implementation of socialization carried out by the North Bengkulu Regency KPU through four categories of tools that influence the effectiveness of institutional functions, they were only effective in participation tools, while the other three tools such as regulations, incentives and law enforcement showed ineffective results. The implementation of door to door outreach, which was used as a new media, apparently did not produce effective results. This can also be seen from resource capacity factors related to system culture and accountability factors related to implementing reports which also show ineffective results. However, the North Bengkulu Regency KPU has tried its best to carry out socialization regarding the 2020 Regent and Deputy Regent elections.

Abstract

This research aims to determine the influence of halal supply chain management for halal cosmetic products on millennial generation consumer satisfaction in Deli Serdang Regency. The type of research used is quantitative associative which aims to determine the influence between the independent variable and the dependent variable. The type of data used is primary data in the form of a questionnaire distributed via social media. The population in this study is the entire millennial generation who use halal cosmetic products in Deli Serdang Regency. The location for Deli Serdang Regency was chosen because Deli Serdang is the regency with the largest population of the millennial generation and Muslims in Sumatera Utara Province. Sampling was determined based on Malhotra's theory so that a total sample of 160 samples was obtained. The results of this research state that halal supply chain management has a positive and significant effect on millennial generation consumer satisfaction in Deli Serdang . With this research, it is hoped that cosmetic companies or manufacturers can pay more attention to the halalness of a product, from ingredients, manufacture to distribution of cosmetics to consumers while still using Islamic provisions or in accordance with sharia.

Abstract

This study aims to explore how the existence of the accusatoir principle in proving criminal justice in Indonesia. This research uses normative juridical method by using primary data approach through library and statutory materials. The results of this study show that the legal study of the existence of the accusatoir principle in proving criminal justice in Indonesia based on indicators is as follows: First, the role of the accusatoir principle in proving criminal justice in Indonesia. Second, obstacles in the implementation of the accusatoir principle in proving criminal justice in Indonesia. Third, the existence of the accusatoir principle in proving criminal justice in Indonesia. The examination of the accused in the judicial process is a crucial stage that determines the direction and fairness in a case, it is also a major milestone in the criminal justice system that outlines the course of justice, provides an opportunity to listen, understand, and ensure the protection of the rights of individuals faced with due process. Research on the existence of accusatoir principles in the context of criminal justice evidence in Indonesia can make valuable contributions in several ways: legal system review, legal awareness raising, policy recommendations, and continuity of legal reform.

Abstract

This article aims to evaluate the law enforcement paradigm for criminal acts of corruption in the business sector. The problem focuses on law enforcement against criminal acts of corruption in the business sector in Indonesia today, as well as the ideal construction of overcoming criminal acts of corruption in the business sector. In order to answer these problems, this research uses a normative approach with qualitative analysis. Based on the results of the investigation and discussion, this study concludes that law enforcement against criminal acts of corruption in the business sector in Indonesia currently tends to be formally legalistic. Such law enforcement results in less than optimal recovery of state losses and makes the state "overdrawn" because the costs of handling cases are more significant than the state losses recovered. The ideal construction of overcoming criminal acts of corruption in the business sector requires a multidisciplinary approach by integrating non-penal penal processes that are not counterproductive to the development of business transactions. The non-penal process emphasizes prevention efforts, while the penal process emphasizes efforts to recover state losses using criminal, civil, and administrative legal instruments.

Abstract

This article aims to explain the phenomenon of bullying from the perspective of Islamic criminal law, specifically focusing on the perpetrators of bullying that caused the death of the victim according to Islamic law. This research approaches the issue using normative legal research methods and literature review. The research method is further detailed to include data collection through legal analysis of relevant laws and scientific literature on bullying. The results concluded that bullying is a prohibited act, which results in physical and mental harm to the victim. In the context of Islamic criminal law, sanctions for bullying differ between adult perpetrators and minors. Adult perpetrators who cause injury, loss, or death to the victim may be subject to severe penalties such as hudud, qishash, and ta'zir. In contrast, if bullying is committed by minors, they may be subject to ta'zir punishments, including diyath, kaffarah, alternative or substitute punishments ('uqubât al-badilâh), which aim to educate and deter the perpetrators and others from repeating similar acts. This comprehensive approach to research methodology provides a deeper understanding of the validity of the findings in the context of Islamic jurisprudence.

Abstract

This study aims to analyze the extent to which the capital structure, debt policy, and company size influence financial performance. This research employs a quantitative method with an ex-post facto approach. With the research data population there are 210 manufacturing companies listed on the Indonesian Stock Exchange per year, with 66 companies that meet the criteria each year using a purposive sampling technique. So the total samples obtained amounted to 330 company samples during the 2017-2020 period. Data were analyzed using SPSS version 25. The results of the analysis indicate that: (1) The capital structure variable (X1) -2.251 is smaller than the t-table value of 1.967267. With a significance level of 0.05 and a significance value of 0.025, Ho is rejected, and H1 is accepted. The first hypothesis is accepted. (2) The Debt Policy variable (X2) -3.499 is smaller than the t-table value of 1.967267. With a significance level of 0.05 and a significance value of 0.001, Ho is rejected, and H2 is accepted. The second hypothesis is accepted. (3) The firm size variable (X3) 4.417 is greater than the t-table value of 1.967267. With a significance level of 0.05 and a significance value of 0.000, Ho is rejected, and H3 is accepted. The third hypothesis is accepted. The results of statistical calculations show that F-count = 22.434 > F-table 2.63231 with a significance of 0.000 < 0.05, then Ho is rejected, and Ha is accepted. It can be concluded that there is a joint influence of the independent variables on the dependent variable.

Abstract

Pendidikan seni kriya di Indonesia menjadi krusial dalam menghadapi perubahan dan perkembangan, terutama di era Revolusi Industri 4.0. Penelitian ini bertujuan untuk mendeskripsikan sinergisitas Pendidikan Seni Kriya pada Kurikulum Pendidikan dan Non Pendidikan dengan fokus pada institusi khusus non LPTK (Institut Seni Indonesia dan ISBI Bandung) serta LPTK (Universitas Negeri Medan). Metode penelitian yang digunakan adalah deskriptif kualitatif dengan pendekatan studi kasus. Hasil penelitian menunjukkan bahwa Pendidikan Kriya di kedua jenis institusi memiliki kurikulum yang mapan, ditandai dengan capaian pembelajaran yang terukur dan penekanan pada pengembangan keterampilan, keahlian, dan pengetahuan dalam seni kriya. Institusi non LPTK lebih menekankan pada penciptaan seniman dan desainer yang inovatif, sementara LPTK memiliki orientasi pada pengembangan kompetensi guru profesional. Sinergi antara kedua jenis institusi dapat memberikan kontribusi signifikan terhadap pengembangan seni kriya di Indonesia, dengan menghasilkan lulusan yang handal dan adaptif terhadap perkembangan global. Adapun peran kurikulum menjadi krusial dalam menyesuaikan pendidikan kriya dengan kebutuhan pasar dan perkembangan zaman, seiring dengan implementasi Kualifikasi Kerangka Nasional Indonesia (KKNI) dan Standar Nasional Pendidikan (SNPT). Evaluasi terhadap kurikulum dan pelaksanaan tracer study dapat menjadi langkah strategis untuk memastikan relevansi dan kualitas pendidikan kriya di Indonesia.
