Abstract

Violence is an act causing physical and psychological disorders. Violence has formed a distinctive feature in criminal field study. In indonesia, if violence not appear in economic and political sectors, it will appear in education sector. In education field, violence not only happen among students but also among teachers, and school guards. Giving physical punishment by teachers often interpreted the same as the crime of violence doing by parents. The purpose of this research is that to analyze regulation of violence against students and to analyze the criminal law policy on protection of teacher profession. This research is a normative law research conducted by collecting and reviewing the theory. Then, it is analyzed by analytical description method, and deductive deductions method. The result of the research concludes that the criminal law policy to overcome the crime of violence against children in education is limited in KUHP and law number 35 year 2014 on child protection. The use of physical punishment in schools by teachers has two juridical implications. First, teachers cannot be justified on the basis of material justification which is Tuchrecht. Second, it can still be accounted for based on the principle of loss and benefit. Protection of the teacher’s profession is regulated in law number 14 of 2005 on teachers and lecturers.

Abstract

Increased globalization encourage the movement of capital and investment flows across the world, there is also a migration of people or movement of labor between countries. The labor movement took place because of the investments made in other countries generally require direct supervision by the owner / investor. Correspondingly, in order to maintain continuity of business and investment. To avoid legal problems as well as the use of foreign labor is excessive, then the Government must carefully determine the policy (policy) to be taken in order to maintain a balance between foreign workers (foreign capital) with domestic labor. Therefore, in this paper, researchers have found -ketentuan legal provisions that have relevance for regulating the use of foreign labor and to analyze the regulation of keberlakuanya juridical aspects, As Intended use of foreign labor is to meet the needs of skilled workers and professionals in the field certain that can not be filled by the Indonesian labor and accelerate the process of national development by accelerating the transfer of knowledge and technology and increase foreign investment as supporting development in Indonesia. The results of this study certainly expected to be on particular subjects Employment Law at the Faculty of Law of the University of Mataram and, if possible, may be on the improvement of regulatory and policy issues -kebijakan the Utilization of Foreign Workers in Indonesia both national and local scale.

Abstract

As a part of international community, which had ratify various of international agreements, Indonesia obliged to create national laws which compatible with international agreements. Since ratification of international agreements is not a final process which must comply by a state to abide the international agreements. The adjusment of national law whether with establish the new law or amendment the existed law, is repercussions of ratifications phase which state have to fulfill. One of Indonesia obligations, based on Geneva Conventions 1949 for the Protection of Victims of War, i.e common articles of Article 49 Geneva Convention I, Article 50 Geneva Convention II, Article 129 Geneva Convention III and Article 146 Geneva Convention IV is to establish national law on grave breaches of the convention and to prosecute the perpetrators. This article try to examine further on the Indonesia obligations based on th common articles and its implementaion in Indonesia, after 60 years of Indonesia accesion to the Geneva Conventions 1949 with the Law Number 59 Year 1958 on Indonesia Participation on all of Geneva Conventions 1949.

Abstract

This research to know and analyze the existence of PERMA No. 02 Year 2012 on Adjustment of Limitation of Criminal Act and Number of Penalties in Criminal Code with limited scope to review and analyze the existence of PERMA No. 02 Year 2012. This research is normative law research. The approach used is the approach of legislation, conceptual approach, philosophy approach, and case approach. Technique of collecting legal material with literature study. After that the processing of legal materials by systematization and then done logical, systematic, and interpretative reasoning with analytical descriptive analysis and draw deductive conclusions. Substantially the provisions in PERMA No. 02 Year 2012 has converted the concept of Criminal Crime especially on the limit of object value of loss of case to Rp. 2.500.000, - (two million five hundred thousand rupiah) and or a fine of up to seven million five hundred thousand rupiah and minor insult. The Articles of the Penal Code converted in the PERMA are 364, 373, 379, 384, 407 paragraph (1) and 482 of the Criminal Code. The position of PERMA in the hierarchy of the Laws and Regulations in Indonesia is as an internal regulation because of its binding power which only covers the environment of an institution so that it has no validity for other agencies and has juridical consequences.

Abstract

Penelitian ini bertujuan untuk mengetahui atau menganalisis Akibat Hukum akta Jaminan Kredit Pemilikan Rumah yaitu pada akta Surat Kuasa Membebankan Hak Tanggungan (SKMHT) yang diperpanjang terus menerus karena sertipikat yang dijadikan Jaminan Kredit Kepemilikan Rumah masih dalam proses pemecahan dimana perlindungan hukum bagi Kreditur Kredit Pemilikan Rumah terhadap Jaminan kredit yang proses pemecahan belum terpasang Hak Tanggungan, dengan menganalisa pembuatan Surat Kuasa Membebankan Hak Tanggungan yang dibuat dihadapan PPAT sesuai dengan ketentuan Undang-Undang Nomor 4 tahun 1996 tentang Hak Tanggungan, dimana banyak Notaris/Pejabat Pembuat Akta Tanah kurang memperhatikan peraturan Undang-Undang dengan membuat perpanjangan Surat Kuasa Membebankan Hak Tanggungan terus menerus tanpa mengadirkan kembali Pihak Pemilik Jaminan dan/atau Debitur dan Pihak Kreditur sehingga mengandung kecacatan dan tidak dapat dilakukan pembatan Akta Pemberian Hak Tanggungan. Dimana Notaris/PPAT pejabat yang bekerja sesuai permintaan/order dari Kreditur (Bank) bukan Pejabat Umum yang menjalankan tugasnya sesuai Peraturan Undang-undang yang berlaku, yang dapat memberikan perlindungan hukum terhadap Kreditur.

Abstract

The purpose of this study is to find out how the forms of cultural conflict marriage sasak community with the community Sumbawa alas kab. Sumbawa. Method This research is empirical research method with approach concept of law sociology. The result of this research is that the process indicates that there is a cultural conflict in the marriage of the Sasak tribe that brings culture or custom which influences the original culture of Sumbawa Alas so that the occurrence of cultural conflict is Sasak culture and Sumbawa culture especially in Alas Subdistrict causing the change In culture.

Abstract

The provisions of Article 22 paragraph (1) of the 1945 Constitution is the cornerstone of the constitutional President in determining Government Regulation in Lieu of Law (decree). However, in practice, the right of the President establishes decree can not be measured objectively about matters of urgency requirement that force. Whereas decree degree and have the same legal force with the Act. It is therefore necessary limits of determination decree by the President in order to avoid abuse of power. It is important, from the point of a government based on the Constitution (constitutionalism), with a tap on the point of fixing restriction decree pursuant to Article 22 paragraph (1) of the 1945 Constitution which should only regulate in the public administration (administratiefrechtelijk). Moreover, the restrictions implemented by applying the mechanism of checks and balances between the organs of state institutions, namely strengthening the supervisory function of the House of Representatives of the establishment decree by the President in accordance with Article 22 paragraph (2) and (3) of the 1945 Constitution.

Abstract

Tujuan penelitian ini adalah untuk menganalisis dan menjawab permasalahan mengenai tanggung-jawab Notaris atas akta salinan yang dibuat tanpa adanya minuta akta dan untuk menganalisis akibat hukum salinan akta yang dibuat tanpa adanya minuta akta bagi para pihak.Penelitian ini adalah pene-litian hukum normatif yang berangkat dari kekaburan norma, sehingga metode yang digunakan adalah metode pendekatan Perundang-Undangan dan konseptual, sedangkan sumber bahan hukum penelitian ini diperoleh dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier, dengan teknik pengumpulan bahan hukum melalui studi dokumen atau studi kepustakaan serta analisis preskriptif yaitu analisis ini dimaksudkan untuk memberikan argumentasi disini dilakukanoleh peneliti untuk memberikan preskripsi atau penilaian mengenai benar atau salah apa yang seyogyanya menurut hukum terhadap fakta atau peristiwa hukum dari hasil penelitian. Hasil penelitian menunjukkan bahwa Pertama, tanggungjawab hukum Notaris, atas pembuatan akta yang tidak membuat minuta akta tetapi hanya membuat salinan akta, dapat dimintakan pertanggungjawaban, baik secara administrasi, perdata, kode etik, dengan dikenai sanksi baik teguran secara tertulis, pemberhentian sementara, pemberhentian secara terhormat, dan pemberhentian tidak terhormat. Kedua, akibat hukumatas akta tersebut dapat tergedradasi menjadi akta di bawah tangan, bahkan dapat dibatalkan oleh Pengadilan Negeri.

Abstract

The Protection of the Right to Education for the Isolated Adat Community under Perspective of the Act Number 20 Year 2003 on the National Education System In Rengga Campong, N’toke Village, Wera District, Bima Regency is the title of this research. The Rengga Compong located in N’toke Village, Wera District, Bima Regency qualifies to be a territory of the Isolated Adat Community under the Decision of Republik Indonesia Predsiden Number 111 Year 1999. This research is intended to know the application of the policy of Local Government of Bima Regency in giving services of Basic Education basic for the isolated comminities and to know the handycap faced by the Local Government of Bima Regency in giving these services. In collecting field data, this research uses participated method conducted through three stages, namely the stages: (1) of the location mapping and plumbing areal; and (b) of the decent study. Its results are: (a) the Local Government of Bima Regency has taken policy in the field of Basic Education basic for the isolated comminities but it implementation is not maximal yet; and (2) the execution of physical development is the handycap by the Local Government of Bima Regency since to reach this Campong is difficult so the cost is very expensive.

Abstract

Tradisi Perang Topat ini dilakukan oleh masyarakat Hindu dan Islam yang berdomisili di Desa Lingsar pada waktu dan tempat yang bersamaan, yaitu di Taman Lingsar (Pura Lingsar), Desa Lingsar, Kecamatan Lingsar, Lombok Barat. Di dalam Taman Lingsar ini terdapat dua jenis kegiatan ritual keagamaan dari dua kelompok masyarakat dengan latar belakang agama, budaya, dan keyakinan yang berbeda. Metode yang dipakai khususnya masalah Tradisi pada masyarakat Lingsar, maka penelitian ini menggunakan pendekatan Kualitatif. Pendekatan kualitatif sebagai suatu bentuk pendekatan yang dilakukan dalam penelitian dengan cara terjun langsung kelapangan, dengan berhadapan langsung dengan responden guna memperoleh data yang valid, prosedur penelitian yang menghasilkan data deskripsi berupa kata-kata, tertulis atau lisan dari orang-orang dan prilaku yang dapat di amati dari subyek itu sendiri, khususnya pada Perang Topat itu sendiri.Hasil yang diperoleh bahwa dalam Perang topat ini merupakan tradisi leluhur yang harus tetap di jaga dan jalankan, karena jika tidak demikian maka mereka meyakini akan mendapatkan sebentuk balak (bencana) dari tuhan karena tidak bersyukur atas apa yang telah dilimpahkan Tuhan Yang Maha Esa.
