Pelaksanaan UU Nomor 22 Tahun 1999 ini, pada hakekatnya adalah sebuat terobosan dan perjuangan yang sangat panjang sejak di era orde baru sampai terjadinya reformasi politik yang berakibat pada turunnya pemerintahan orde baru yang menurut pandangan masyarakat luar dan tokoh-tokoh pro demokrasi dan reformasi, presiden pada waktu itu menjalankan demokrasi yang otoriter dan sangat sentralistik, oleh karena itulah reformasi tahun 1998 telah berhasil menciptakan sebuat era baru dalam segala sektor, terutama adalah reformasi terhadap pelaksanaan otonomi daerah. Berdasarkan uraian diatas penulis mencoba untuk melakukan suatu kajian atau analisis dari sisi regulasi yang digunakan dan mencoba melakukan perbandingan bagaimana pelaksanaan desentralisasi pada era orde baru dan era orde reformasi ini dalam bentuk reformasi desentralisasi fiskal. Jadi penulis mencoba melakukan suatu kajian pelaksanaan desentralisasi fiskal pada era orde baru dengan menggunakan metode kepustakaan.

What people deem so far is that the power of attorney to charge mortgage made by a notary is an authentic deed. Yet, they do not realize that only if a notary makes the power of attorney to charge mortgage out of or beyond his/her authority according to law No 02 of 2014 about the function of notaries, the power of attorney will lose its authenticity value. The theme about the power of attorney to charge mortgage made by a notary is strongly interesting to discuss not only to develop our knowledge so that we do not mislead in making the power of attorney to charge mortgage, and at the same time, it will not lose its authenticity value.Besides, this discussion will also figure out the things a notary can make (according his/her authority) in relation with legal action to charge mortgage. Because it is possible for notaries to make a power of attorney to charge mortgage out of or beyond his/her authority will cause the power of attorney to charge mortgage becomes “underhand agreement”, so that its burden of proof is not as strong as authentic deed.

The PPAT deed is one of the main sources for the maintenance of land registration in Indonesia, which serves to ensure legal certainty of the occurrence of a legal act of transition and the imposition of the Mortgage Rights. The purpose of this study is to analyze the legal implications of PPAT form deed after the enactment of Regulation of the Head of National Land Agency (Agreement) No. 8 of 2012. This research is Normative legal research. This study used a statutory approach, conceptual approach and sociological approach. Technique of collecting legal materials through literature study after that done the processing of legal materials with logical and systematic reasoning and analyzed descriptively qualitative and draw deductive conclusions. Based on the result of research of inconsistency in arranging the form of PPAT deed after the issuance of Regulation of Head of National Land Agency (Agreement) Number 8 Year 2012 and its solution if the rules Regulation of Head of National Land Agency (Agreement) Number 8 Year 2012 which is not in accordance with its application. The existence of Regulation of Head of National Land Agency Number 8 Year 2012 About Amendment of Regulation of State Minister of Agrarian / Head of National Land Agency Number 3 Year 1997 About Regulation of Implementation of Government Regulation Number 24 Year 1997 About Land Registration hierarchically higher position than circular letter. In accordance with the principle of lex superior derogat legi inferior which means higher regulation put aside the low (hierarchy principle) and solution Circular letter issued after Regulation of Head of National Land Agency (Agreement) Number 8 Year 2012 must be revoked / withdrawn.

The credit agreement offered by corporation is significant to enhance its member’s welfare as well as sustainability of small and middle enterprises. There some significant aspects must be considered in the granting of credit within corporation,i.e firstly, concerning credit mechanism or credit procedure because each of coorperation has different policy in granting credit; secondly, concerning prudential standard. The application of which is trongly significant to provide legal certainty not only for debtor but also creditor (corporation) which covers fit and proper test as well as credit analysis by appling some principles as follows:5C,7P, and 3R and;thirdly, concerning technical resolution toward credit’s default caused by the bad faith’s debtor in performing credit agreement such as taking the available legal procedures as well as using alternative dispute resolution either mediation or negotiation.

Tanah Timbul (aanslibbing) merupakan sumber daya alam baru yang secara ekonomis potensial untuk pertanian dan usaha pertanian tambak bahkan kegiatan industri yang dapat menimbulkan penguasaan dan pemilikan atas Tanah Timbul. Undang-Undang Pokok Agraria (UUPA) sebagai peraturan dasar, hanya mengatur asas-asas atau masalah-masalah pokok dalam garis besarnya. Tujuan dari penulisan ini untuk mengetahui pengakuan, perlindungan dan kepastian hukum terhadap penguasaan atas Tanah Timbul oleh masyarakat adat dalam perspektif hukum agraria nasional. Hasil Penelitian tesis ini adalah yang berwenang untuk menguasai tanah timbul (aanslibbing) yaitu tanah tersebut dimiliki oleh masyaratak adat setempat. Dan bentuk penyelesaian sengketa atas tanah timbul (aanslibbing) adalah Kesepakatan dengan Pemerintah bersama dewan adat untuk diterbitkan SK yang dikeluarkan oleh Pemerintah setempat kalau tanah adat tersebut benar milik masyarakat adat maka masyarakat adat harus mengurus Sertifikat tanah tersebut ke kantor Badan Pertanahan Nasional untuk diterbitkan setifikat hak ulayat.

Crime of human trafficking (human trafficking) is a violation of human rights as a form of slavery. To encourage the Indonesian government to protect through legal arrangements with the issuance of Law No. 21 of 2007 on the Eradication of Trafficking in Persons. The focus of the issues raised in this research is how the forms of the crime of trafficking in persons under Law No. 21 of 2007, and how the criminal law policy in combating the crime of human trafficking. The results showed that the forms of the crime of trafficking in persons under Law No. 21 of 2007, namely: First, the recruitment process sexual exploitation (prostitution). Second, trafficking of children as workers, Third, child trafficking through adoption (adoption). Fourth, the policy of criminal law in combating the crime of trafficking in persons (human trafficking) are listed in the Criminal Code, RKUHP 2015, Law No. 39 of 1999 on Human Rights, Law No. 23 of 2002 on Child Protection and Law No. 21 2007 About the Crime of Trafficking in Persons which contains all provisions concerning human trafficking

This study is a literature that studies conducted only based on written work, including the results of both studies have not been well publicized. This study does not directly go into the field in search of data sources and can be done at home, the library and other places. The purpose of this study was to mengetahi more deeply about empowering substitutions which means the person who accepts the power of appoint another person to replace him in a legal action with consequences that are tailored to deal with and to know the limits of responsibility for authorizing and authorized substitution. As for the results to be achieved in this study is the extent to which the legal responsibility of the proxy substitutes the power delegated to him that the original authorizer not feel disappointed premises performance. The conclusion of this study is the original authorizer has the right to request information and the responsibility of the receiving power of substitution to the power that has been given.

Indonesian Bank authority to regulate and supervise the banking sector authorities are granted by the authority of attribution that the authority granted by law, namely Law No. 21 Year 2011 on the Financial Services Authority. But the authority given the nature of Persia, because the authority of Bank Indonesia in conducting the examination and supervision of the bank, Bank Indonesia pemeriksannya results are not given the authority to assess the results of the examination itself, but should be reported to the Financial Services Authority. The authority of the Financial Services Authority in the conduct regulation and supervision by the authority of attribution that the authority granted under Act No. 21 of 2011 on the Financial Services Authority carry out the task of supervising and regulating the activities of financial services in banking sector, the activities of financial services in the capital markets sector and service activities finance in the insurance sector, pension funds, financial institutions, and other financial institutions.

Dalam pemanfaatnnya, banyak terjadi permsalahan yang timbul dalam pemberian hak atas tanah terhadap pulau-pulau kecil yang ada di NTB, oleh sebab itu perlu sekiranya dikaji berkenaan dengan pengelolan pulau- pulau kecil tersebut. Rumusan masalah dalam penelitian ini adalah bagaimana dasar fungsi hukum dalam penataan pulau-pulau kecil yang mencerminkan fungsi hukum integratif , mekanisme dan faktor-faktor yang mempengaruhi hukum dalam penataan pulau-pulau kecil. Metode penelitian yang digunakan adalah penilitan hukum normatif. Terdapat konflik norma yang terjadi pada aturan hukum terhadap penataan pulau-pulau kecil yakni antara Perkaban No. 17 Tahun 2016 dengan Perkaban No. 3 Tahun 1999 sehingga menimbulkan konflik norma. Sehingga ada beberapa faktor yang mempengaruhi kebijakan hukum integratif dalam penataan pulau-pulau kecil di Nusa Tenggara barat diantaranya masalah konflik norma pengaturan pulau-pulau kecil tersebut, faktor penegakan hukum, faktor sarana dan fasilitas pendukung serta faktor ekonomi. Oleh sebab itu, perlu adanya pengaturan hukum yang jelas.

The principle of openness in capital markets means that issuers and capital market supporting professionals are required to provide information about the facts materill regularly and correctly and honestly so that will affect the decisions of investors to invest in the stock market. But the reality was not as ideal as provided in the legislation sometimes issuers are trying to put pressure on the capital market supporting professionals to create beautiful prospectus as advertising on television, but if examined again bahwasannya capital market supporting professionals on the pressure of the issuer's trying to hide information the truth about the state of his company. If these continue to be allowed then of course this would be detrimental to investors or investors. Therefore professions harusbertanggungjawab capital markets and given legal sanction either criminal, civil and administrative as stipulated in Law No. 8 of 1995 on the Capital Market in order to create legal certainty, fairness and convenience of investing in the stock market.
