Abstract

Executive authority to conduct presidential aide as a cabinet minister to prepare to run the government or the president is assisted by the ministers to continue the long-term plans, medium and short time. Based on the ideas which have been described in the above background it can be argued the issues as follows:. How does setting the appointment of a ministerial-level State officials before and after changes in 1945 and What is the procedure and requirements for the appointment of State level Ministry officials. as well as factors affecting the level of Minister of State appointments. From the results of the study as follows: Authority of the President in appointing a minister-level officials from sisitem presidential implementation as stipulated in the Constitution 45 in that it can be said before and after the process of changing the Constitution 45. In the first 45 before changing the Constitution by the president, as leader of the cabinet independently without being affected by elements related to the political overtones, while after the change of political situation is very influential with regard to the requirements and procedures in the appointment of a ministerial-level state officials. Requirements and procedures for the appointment of a ministerial-level officials before the change is highly dependent on the president but the phenomenon after the change of the Constitution a requirement that 45 appeared fit and propertest through a review and consideration of the House even though there are no normative requirements of this recruitment process is proven by the Attorney General and the Chairman and members of the Commission based on an Act to regulate both institutions and norms can be said of the void in the process of appointment of State level officials such as Attorney General and Minister for Leaders and members of the KPK. Factors affecting the authority of the President in the appointment of a ministerial-level state officials can be understood from two aspects: Internally is based on the needs of institutional aspects and the external cabinet. The conclusion of the recommendation is: It needs a legal setting and clear the form of laws and regulations that authorized the President to appoint state officials to ensure legal certainty as head of the cabinet on the basis of the Presidential system. In appointing the President of the ministerial-level State officials should prioritize the aspects of professionalism in accordance with the mandate of Law Number 43 Year 1999 and reduce the political overtones.

Abstract

This study aims to analyze the witness of instrumentair which is a matter related to the Notary and its aktanya products, which should have been set forth in the UUJN regarding matters relating to the witness, although instrumentair witness action in the inauguration of notarial deed is included in the field of notarization , But the Notary's Office Law does not provide special arrangements concerning instrumentair witnesses primarily related to the legal protection and legal liability of instrumentair witnesses, in the Notary Law only regulating legal protection and legal responsibility of Notaries only. In the above explanation the authors found the existence of a void of norms in the Law of Notary Public that is related to the protection of law and responsibility of Notary public as instrument witness in notariil deed so that the confidentiality of a deed is maintained from unauthorized parties to the deed including Police In the inspection process. This research uses normative research method by using approach of legislation and concept approach. The result of the research in this thesis is that the instrumentair witness is not responsible for the contents of the deed in its signature as witness, the instrumentair witness is only personally responsible based on the Act, but only on the formalities which are run in the process of making or The inauguration of the deed and the protection of instrumentair witnesses in the examination by the Police in a juridical manner the instrumentair witness received the protection as a witness in general which is regulated in the Witness and Victim Protection Act set out in Law No.13 of 2006.

Abstract

Research on the Legal Protection of the Coastal Zone, Coral Reef Protection Studies in Central Lombok regency was conducted on the basis of problems in local government's efforts for the maintenance terubu reefs in Central Lombok regency and about the institutional functions of the law enforcement community. The approach used in this study is empirical juridical approach, because the problem will be sought in the realm of social responsibilities, the law as part of social life. The data obtained in the analysis with qualitative analysis. The results of this fieldwork is setting on Coastal, Marine and Coral Reef, a nationally regulated by the sectoral rules, so that its management is also carried out sectorally, Coastal Management Authority, and the Coral Sea, has become a local government authority. However, in Central Lombok regency protection is not implemented as well as arrangements regarding the management of coastal, marine and coral reef communities and institutions have not shown concern for the protection of coastal, marine and coral reefs. The implications of this state that all the activities legalized by the law, because each instasi implement the program on their own rules, the consequences of coastal and marine activities be coordinated and not cause damage. On the basis of these two suggestions of this study is the Central Lombok regency administration must publish rules Coastal, Marine and Coral Reef to provide protection to the natural potential to be used for the maximum benefit of the people as it also should set up institutions that function is to coordinate the management and monitoring of coastal, marine and coral reefs to reduce damage caused by the construction of a sectoral nature.

Abstract

Penelitian ini bertujuan menemukan keberadaan konflik penyerobotan tanah terlantar oleh masyarakat, faktor yang menyebabkan terjadinya konflik penyerobotan tanah terlantar dan akhirnya mengetahui peran BPN dalam menyelesaikan konflik penyerobotan tanah terlantar oleh masyarakat di wilayah kerja BPN Lombok Barat. Disamping itu, penelitian ini juga bertujuan untuk menemukan dan menganalisis peran BPN dan model penyelesaian konflik penyerobotan tanah terlantar oleh masyarakat di wilayah kerja di BPN Lombok Barat. Metode dalam penelitian ini adalah metode penelitian hukum empiris. Hasil penelitian ini menunjukkan bahwa tidak ada satupun dari tanah yang ditinggalkan oleh pemegang hak (investor) sebagai tanah terlantar. Tanah-tanah hak tersebut baru hhanya berstatus sebagai tanah yang terindikasi terlantar. Kasus penyerobotan tanah oleh masyarakat terjadi di berbagai lokasi. Akan tetapi, kasus penyerobotan tanah dan berujung pada konflik dengan investor namun belum dilaporkan kepada BPN Lobar baru satu, yaitu dalam kasus PT. Mekaki Indah. Adapun kasus penyerobotan tanah oleh masyarakat yang berujung pada konflik dan telahh dilaporkan ke BPN Lobar juga satu kasus yaitu dalam kasus PT WAH di Gili Terawangan. Ada beberapa faktor yang menyebabkan terjadinya konflik tersebut. Pertama: karena adanya konflik kepentingan dalam mengeksploitasi dan menguasai tanah. Masyarakat butuh tanah untuk keperluan bisnis. Kedua, masyarakat mengangggap bahwa tanah yang dikuasai oleh investor merupakann hak milik nenek moyang mereka. Disamping itu, peluang ekonomis juga menjadi salah satu penyebab terjadinya penyerobotan tanah oleh masyarakat.

Abstract

This study was conducted to analyze the agreement used in the process of player’s transfer based on the principle of freedom of contract and the obstacles encountered in the implementation of contract manufacturing for professional players. The method used in this study was a empirical normative legal research, by using the statute approach, concept approach and case approach. The results showed that the written contract made between players and the club showed the existence of freedom of the parties in making the contract, in which the parties have made a contract with the evidence of a signature by the parties. As for the obstacles in the process of professional players’ transfer were the factor of age or minors, financial shortages and the number of players injured at the time when the transfer was opened.

Abstract

One of the duties of Newmont Nusa Tenggara Ltd. as stipulated in the article 24 of contract work is to divest gradually the share up to 51%. Such share shall be distributed either to government (central or local government), private enterprise or government enterprise. Since it spends huge budget to purchase the share, then the local government of West Nusa Tenggara through consortium among Provincial Government of West Nusa Tenggara, District Government of Sumbawa and District Government of West Sumbawa establish Daerah Maju Bersaing Ltd. cooperating with private enterprise Multi Capital Ltd. as capital provider have succeed to do acquisition 24% of the share of Newmont Nusa Tenggara Ltd.

Abstract

Under the terms of Article 16 paragraph (2) of Law No. 4 of 2004 on Judicial Power stated that the Court does not rule out the possibility for businesses in the peace settlement of civil cases (mediation). Peace institute in Article 130 HIR / 154 RBg in practice run by the Judges as a mere formality, not functioning optimally . As a result, the number of civil cases that enter and must be resolved and decided by the District Court the longer the number is increasing and becoming the burden of the Supreme Court . Hence the birth of PERMA No. 01 of 2008 on Mediation in the Court procedure is part of efforts to reduce the burden on the justice sector in Indonesia .

Abstract

The research aims to study the competence of the District Court of Central Jakarta to annul the arbitration award of Geneva, and whether the judgment of the District Court of Central Jakarta annulling the arbitration award of Geneva is relevant to the existing law of arbitration in Indonesia. The research is juridical normative, i.e., using library research to obtain secondary data in the field of law and using field research for support. Therefore, it uses two types of data: primary data from interview with resource persons and secondary data from library research by means of document study on the primary, secondary, and tertiary legal materials. It uses qualitative method to analyze the data. The research reveals, according to the Arbitration Law No. 30 of 1999, Regulation of the Supreme Court No. 1 of 1990, Rules of International Centre for Settlement of Investment Disputes, and New York Convention 1958, that the District Court of Central Jakarta has no competence to annul the arbitration award of Geneva. The use of public policy as ground for annulment of arbitration award of Geneva by Forum of District Court of Central is not correct because public policy is not found, ether in Rules of International Centre for Settlement of Investment Disputes or New York Convention 1958, as ground for annulment of arbitration award. Besides, public policy provided in the Arbitration Law No. 30 of 1999, Regulation of The Supreme Court No. 1 of 1990, and New York Convention 1958 is not related to the annulment of international arbitration award but the refusal and enforcement of international arbitration award. Nevertheless, Forum Court's interpretation toward public policy is correct because such interpretation is not based on assumption but on the fact that the enforcement of arbitration award of Geneva violates the Presidential Decree No. 39 of 1997 and No. 5 of 1998, as well as the monetary crisis threatening Indonesian prosperity.

Abstract

Deposit Rights is the right to pledge the right to land as a credit guarantee to the Bank. The Deposit Rights is an accecoire agreement (agreement) of the main agreement, namely debt agreement receivable. The right of Dependent must be made a Deed of Granting of Dependent Rights and must be registered in the Land Registry Office of the National Land Agency to obtain a certificate for guarantee of legal certainty, and must also diroya 'if the debts are due. Roya is a deletion of the security expense of a land right that is the object of the Mortgage Right that has expired or has been removed because it has already ended its credit by the Land Registry Office at the request of the interested parties. This research is empirical law research that aims to examine the juridical-empirical implementation of roya Object of Mortgage by the Land Registry Office of Mataram City. The result of the research shows that the implementation of registration of the Land Rights of the Land on Land has been clearly regulated with the requirements and procedures. While the implementation of Roya Object of Mortgage Rights at the Office of BPN Kota Mataran has been implemented well in accordance with the provisions and procedures that have been determined by the applicable legislation.

Abstract

As the country's financial supervisory institutions / regions that are external to make the CPC as an institution that is very strategic in order to realize financial management area that is free of corruption. Combating corruption is not enough to rely on law enforcement officials, the police, the AGO and the KPK. Especially if done with no underlying advance by the CPC recommendations, a potential cause of criminalization on the area of financial management officer and it is very harmful. Supposedly the issue of errors in the financial management area has been completed if the local government officials have been corrected in accordance with the recommendation of the CPC, and it should no longer be done on the basis of criminal law enforcement. This is important in the context of legal protection against officials of the regional finance manager criminalization measures.
