Abstract

Freedom of speech or expression is an indication of a democratic country. Indonesia that has transformed itself from an authoritarian government during the New Order Era into a democratic country in the so called Reform Era. This study is an attempt to find out the existence of freedom of expression in the Indonesian printed media. The data were collected from the Jakarta Post Readers’Forum from 1 November 2010 to 28 February 2011. The data were then classified and analysed based on Brown and Levinson’s theory of politeness strategies. The data analysis shows that a lot of utterances can be classified under Politeness Strategy 1 (the least polite strategy out of the four strategies). This proves that people are now free to express their ideas and criticisms in the most direct manner without fear of being arrested or reprimanded by the government. Even the sensitive issues like SARA (Ethnic, Religion, Racial and Communal) conflicts can be freely discussed in the printed media. Thus freedom of expression is prevailing in Indonesia under the New Era government.

Abstract

The content of this article is an attempt to show that the word research in traditional sense (within the Cartesian scheme) is hostile to design activity. It will reduce the process of design into a merely fix mechanical process, burying the aspect of imagination, creativity, and more importantly proposing in it that is a crucial aspect to design. This imposition might indiscipline (in a formal academic sense) design as a discipline in human sciences. In order to achieve this, the article is divided in three sections. The first section will discuss what scientific research is and what traditionally presupposed in it: objective, neutral, and a-historical; simply the disinterestedness of research. As for the second, epistemological concerns on traditional scientific research from two philosophers of science will be discussed: Thomas S. Kuhn and Paul K. Feyerabend. As for the third, the closing section, an attempt to delineate design and what designers do in comparison to scientists’ will be discussed. It is how design and designers are different in their manners with traditional science and scientist.

Abstract

The worker is the weaker party in terms of worker-employee relationship system. The problem that often arises in the event of bankruptcy decision issued by the judiciary is the ignorance of labor rights. As we know that termination of employment (layoffs) may be conducted by the employer in accordance with article 165 of Law Number 13 Year 2003 on Manpower, which is when the company is closed due to creditors’ law suit on unpaid credit within a specified time and therefore stating bankruptcy. Employers who are declared bankrupt by a competent judge shall settle all obligations, including in this case, paying workers' compensation regulations. In practice, the curator, the official havint the authority to calculate the company's assets can be invited to cooperate in terms of the repayment obligation, and they rather put the assets of the creditor's rights in front of workers’ rights. The receiver and or parties related to tend to prioritize the interests of the group more than the fulfillment of labor rights as compensation from the bankruptcy decision occurs. Whereas Article 95 Paragraph (4) of Law No. 13 of 2003 has stated that labor rights should come first before completing the receivables of the creditors.
