Abstract

This paper looks at the object of law from the perspective of Islamic law the concept of ushul fiqih (Islamic legal philosophy). This study is based on an in-depth study of Islamic law sources oriented towards ushul fiqih. The method used is literature with a data collection system to mix sources that study the science of ushul fiqih, from classical books to mutaakhir books. From the results of the author's search that the object of the law is the act or action of a person who is already mukallaf (legally capable). However, it depends largely on the condition that the deeds of a mukallaf be considered as a legal object or not. The main condition is that a person knows exactly about the deed from the side of the law and the method of its execution. Besides that, there is an element of ability and intentionality when doing so. The object of law is not limited to mere action but rather that everything related to deeds, utterances, neglects, and also azam (strong desires that are in mind).

Abstract

The condition of sharia insurance in Indonesia shows limited development; it ranked fourth and only rose one rank from 2019 as the country with the highest number of operators in the world. The market share of sharia insurance, when compared to conventional insurance, reached 6% at the end of 2020. This study aims to analyze the development of sharia insurance in Indonesia through statistical data analysis of sharia insurance financial performance during the 2018–2022 period. This article is classified as literature research with a qualitative approach. The methodology used is a content analysis study. The results found that sharia insurance in Indonesia experienced asset growth of 3.53%, total gross contribution year-on-year of 16.38%, and continued to record investment results in the 2018–2022 range. The growth was dominated by the capital market sector and the banking sector, which experienced an increase.

Abstract

As a country with the largest number of Muslim populations in the world, the ideology of Pancasila is often contradicted, as if it is incompatible with the identity of an Islamic state. In fact, the debate about the form and sovereignty of the Indonesian state is final and discussed strictly by the hero of the proclamation of independence. This article is classified as literature research with a qualitative approach. The methodology used is content analysis and a comparative study between the Pancasila ideology and the Medina Charter. The results of the study concluded two things: first, the Prophet did not specifically formulate the formal form of an Islamic state, but what the Prophet emphasized was the importance of a state that adheres to Islamic values. Second, although Indonesia is not an Islamic country, the ideology of Pancasila does not contradict, let alone ignore, the essence of Islam and the existence of adherents to it.

Abstract

The rise of controversy programs on live Tik Tok is very detrimental to various parties. One of them is the trend of begging online to generate massive rupiah coffers. Open-access digital platforms should require users to be careful because they become public consumption. In fact, this application is used to beg openly and even display the user's name and face. This study aims to analyze the phenomenon of online begging from the live Tik Tok perspective of Imam Al Ghazali. This research method is qualitative research with a focus on literature research. The data analysis used in this study is descriptive qualitative analysis. The result is that begging online is haram because it is deceitful and takes advantage of certain circumstances to get as many gifts as possible. This is evidenced by the aqli arguments about begging, the impact of online begging on live Tik Tok, and Imam Al Ghazali's perspective regarding begging.

Abstract

This article explains the role of female lecturers at STAIM Probolinggo in fostering sakinah families. This article belongs to field research with an empirical-sociological approach. The methodologies used are qualitative methods and analytical descriptive studies. The results concluded that a career woman is an individual who combines professional dedication and personal aspirations. Career women are examples of women who can achieve success as lecturers and do not override their obligations as housewives. Female lecturers complete work on campus. So that time at home is indeed for family. That's how it's done to maintain household harmony. When viewed from the perspective of maslahah mursalah, career women are included in the category of al-Mashlahah at-Tahsiniyyah, which can increase family economic income. In addition, by entering the world of education, existing knowledge can be more blessed and useful.

Abstract

This article discusses the debates and controversies surrounding the authoritative interpretation of Sharia law regarding the caning punishment process in correctional facilities (prisons) in Aceh, which was previously conducted in open fields. The debate emerged and took place across various media platforms, including social media, following the issuance of the Aceh Governor's Regulation in 2018 concerning the relocation of the punishment process. The discussion extended to deliberating the most legitimate interpretation regarding the necessity for the caning punishment to be witnessed by a group of believers; the selection of the location where the punishment is carried out; and the intent and purpose of the caning punishment itself to be witnessed by the public, as explicitly stated in Q.S. An-Nur: 2. Using literature study as the research method, this article concludes that there has been a shift in religious interpretation towards authoritarianism by considering and asserting certain interpretations as authoritative and "supposedly" in accordance with Sharia, as intended by the implementation of the caning punishment during the formalization of Sharia law in Aceh.

Abstract

This study examines the integration of rajah (spiritual chants or incantations) and local spirituality within the context of Islamic law through a hermeneutic interpretative analysis. The research explores how local spiritual practices, particularly the use of rajah, coexist and interact with the principles of Islamic jurisprudence. By employing a hermeneutic approach, the study aims to uncover the deeper meanings and implications of rajah in relation to the spiritual and legal frameworks of Islam. It investigates the cultural and historical significance of rajah, its acceptance and adaptation within various Islamic communities, and the interpretative challenges it presents. The findings reveal a complex interplay between local traditions and Islamic legal thought, highlighting the dynamic nature of religious interpretation and the need for contextual understanding in the application of Islamic law. This study contributes to a broader comprehension of how local spiritual practices can be harmonized with Islamic jurisprudence, offering insights into the evolving relationship between tradition and religion.

Abstract

Ideally, the principles of law, religion, and social norms in Indonesia establish marriage as a long-term bond characterized by mutual respect and responsibility, aimed at forming a harmonious family. However, in reality, contract marriages, which are driven by subjective agreements and have a fixed term, contradict these norms and are not recognized under the Civil Code (KUHPER). This practice results in negative consequences such as pornography, prostitution, human exploitation, trafficking, and domestic violence. This study identifies the discrepancy between the ideal principles and the actual practice of contract marriages and proposes direct criminal sanctions as a more effective solution to address this issue. The research is classified as a qualitative library study. The methodology employed is a normative juridical approach with qualitative descriptive analysis of legal regulations and contract marriage practices. The findings indicate that contract marriages are inconsistent with civil law principles and potentially violate criminal law. Therefore, it is crucial to develop a more comprehensive legal framework by implementing direct criminal penalties, bypassing civil violations. This approach is expected to provide a stronger deterrent effect against perpetrators and reduce the prevalence of contract marriages in Indonesia.

Abstract

Ideally, the application of Islamic economics in empowering the agrarian community in Kerinci Regency could provide significant opportunities to improve farmers' welfare through Sharia principles such as profit-sharing and fair rental systems. However, the reality on the ground reveals several challenges, including a lack of understanding of Islamic economics, limited access to modern technology, and issues in capital management and market access. This study aims to explore the opportunities and challenges of Islamic economics in the context of agrarian empowerment in Kerinci Regency and to provide strategic recommendations to address these obstacles. This article falls under field research with a qualitative approach, utilizing a case study method. The research concludes that, despite its challenges, consistent application of Islamic economic principles can enhance productivity and welfare for farmers and positively impact the mechanisms of agrarian empowerment in accordance with Islamic economic principles.

Abstract

As the country with the largest Muslim majority in the world, it is only natural to frame Islamic law as the legal framework for pornography legislation. The reality is that Indonesia is a unitary state, so the establishment of an Islamic state is not feasible. This article falls underthe category of literature research with a qualitative approach. The methodology used is normative legal studies with a content analysis approach. The research concludes that the transformation of Islamic legal values can be manifested in positive law by implementing Islamic law in Indonesia without establishing an Islamic state. The transformation of Islamic law into positive law in national politics regarding the Pornography Law has had a significant impact on the process of accommodating Islamic law within Indonesia's legal system. The pattern of transformation in Islamic law is substantive (essential). Although not exactly the same as what exists in the concept of Islamic law, the substance or essence is in line with Islam or not contradictory to Islamic teachings, as seen in Law No. 44 of 2008 concerning pornography.
