Abstract

Ideally, polygamy law in Islam sets a maximum limit of four wives, requires the husband to act justly, and considers material and emotional factors, as stipulated in the Qur'an. However, in reality, there are differences in the implementation of the law in Indonesia. Law No. 1 of 1974 does not limit the number of wives, while the Compilation of Islamic Law (KHI) limits it to four wives and requires the wife's consent, which must be proven in court. These differences reflect a discrepancy between Islamic legal principles and current positive regulations. This article aims to provide a deeper understanding of the differences between polygamy law in Islam and positive regulations in Indonesia. This research uses a comparative approach with a literature study method to analyze and compare Islamic legal principles with positive regulations in Indonesia related to polygyny. The results show that over time and with changes in the state system, the contextualization of polygamy law has undergone justification and rationalization, leading to significant changes in its application.

Abstract

Ideally, countries are responsible for protecting the environment sustainably through international cooperation. Islamic law offers principles such as khilafah (human stewardship of the earth), amanah (responsibility), and mizan (balance) to guide humanity in preserving nature. However, in reality, state sovereignty often hinders addressing cross-border environmental issues, with many countries prioritizing national interests. The implementation of Islamic environmental law is also suboptimal and underappreciated in international legal discourse. This study employs qualitative methods, including literature analysis and comparative approaches, to explore Islamic legal principles through sources like the Qur'an, Hadith, and fatwas. It compares Islamic legal approaches with international legal frameworks to identify potential integrations that can enhance global environmental preservation efforts. The findings indicate that Islamic law offers a unique perspective that enriches the global discourse on ecological sovereignty. Integrating Islamic legal principles into international legal frameworks can create more sustainable and equitable approaches, strengthening global efforts in environmental preservation and contributing to sustainable development for all beings on earth.

Abstract

Ideally, the selection of leaders in a multicultural country should be a political issue free from the subjectivity of religious beliefs. In reality, however, the urgency of faith and political interests are often mixed, leading to friction within society, including in Indonesia. This gap is intriguing to study, especially how Indonesian Muslims perceive the existence of non-Muslim leaders within the context of Islamic Law. To address this gap, this article examines the thoughts of two figures with substantially opposing views, namely Ibn Taymiyyah and Qurais Shihab. This article falls under library research with a qualitative approach. The methodology used is a comparative study. The results of the research conclude that Ibn Taymiyyah, a classical scholar, emphasizes the importance of a leader's faith and piety, as well as their ability to uphold Sharia law. According to him, a leader must be a Muslim capable of safeguarding and protecting the interests of the Muslim community. However, Qurais Shihab, a contemporary intellectual, offers a more contextual and inclusive perspective. He emphasizes universal values such as justice, welfare, and the common good. Qurais Shihab acknowledges that in the modern socio-political context and pluralism, a non-Muslim leader can be accepted if they are able to ensure justice and the welfare of society.

Abstract

Ideally, Islamic financial institutions like Pegadaian Syariah Cabang Babakan Surabaya should conduct the execution of pledged collateral through the akad rahn fairly and in accordance with sharia principles, with clients understanding and fulfilling their payment obligations on time. However, in reality, there is a significant level of default among clients who do not fully understand the content and consequences of the contract, leading to delays or inability to repay loans on time. This study employs an empirical juridical method with conflict and stratification approaches to understand the execution of pledged collateral and identify the obstacles and solutions. The results indicate that Islamic pawning, conducted through akad rahn and ijarah, as stipulated by DSN-MUI Fatwa No. 25/DSN-MUI/III/2002, with a loan repayment period limited to 120 days, is not comprehensively understood by clients. This results in suboptimal understanding and awareness of the akad rahn and the auction execution process, especially when compounded by fluctuating market conditions. Despite clear regulations, the number of collateral objects auctioned each year remains significant, highlighting the need for more intensive education and more effective promotional strategies to address these challenges.

Abstract

Ideally, family planning (FP) is considered important for maintaining family well-being. However, in reality, there are still many negative views in society that oppose the practice of FP, even causing problems in its implementation. This article falls under library research with a qualitative approach. The methodology used is descriptive analysis, specifically explaining the meaning and essence of FP in the context of family well-being through the analysis of Maqasid Shariah theory. The results of the study indicate that FP plays a significant role in family well-being, especially for young couples who have recently married. Mental and financial preparation before educating and caring for children becomes a key factor in maintaining family stability. In the context of Maqasid Shariah, FP actively contributes to preserving health, lineage, wealth, life, and even religion.

Abstract

This study aims to analyze the legal consequences of the transfer of fiduciary collateral to a third party without the creditor's knowledge and the debtor's responsibility for such actions. The issue arises when a fiduciary creditor executes a process that violates existing procedures and regulations by seizing the collateral without selling or auctioning it. This execution is carried out due to time and cost considerations that are disproportionate to the expected results. The research employs a normative juridical approach, reviewing literature sources, including the Civil Code and Law No. 42 of 1999 concerning Fiduciary Guarantees. The study finds that fiduciary registration is a matter of publicity, meaning that all parties are deemed to be aware of the existence of fiduciary collateral through public access. Therefore, third parties transferring fiduciary objects must examine them carefully. The debtor's responsibility for transferring fiduciary collateral without the creditor's consent involves both civil and criminal consequences. This study highlights the importance of adhering to legal procedures to protect creditor rights and ensure debtor responsibility in fiduciary transactions.

Abstract

Ideally, reporting narcotics transactions is a moral and legal obligation to maintain the safety and welfare of the community. However, in practice, many individuals fail to report such actions, creating gaps in law enforcement and community protection efforts. The purpose of this study is to analyze the Islamic Criminal Law perspective on the failure to report narcotics transactions and assess the extent to which Islamic principles such as Maṣlaḥah Mursalah, Amar Ma'ruf Nahi Munkar, and Islamic ethics and morality are applicable. The research methodology employed is a qualitative approach with library research and normative analysis. The study finds that the failure to report narcotics transactions contradicts the principle of Maṣlaḥah Mursalah, which prioritizes public interest and community safety. Additionally, such actions violate the principle of Amar Ma'ruf Nahi Munkar, which calls for the prevention of wrongdoing. The research also reveals that this non-compliance is inconsistent with Islamic ethics and morality, which emphasize individual responsibility in promoting the common good and protecting the community from harm.

Abstract

The village head election in Simangambat has sparked a dispute over the number of votes that has attracted the attention of the community, authorities and legal experts. The conflict reflects the challenges of local democracy, which is often characterized by dissatisfaction and conflict. This research explores the complexity of the dispute through the perspective of Siyasah Qadhaiyah, an Islamic legal framework that emphasizes justice, benefit and peaceful conflict resolution. Using a descriptive-analytical qualitative approach, data was collected through in-depth interviews, direct observation, and analysis of official documents, taking into account the local social and cultural context. The results show that the application of Siyasah Qadhaiyah principles can provide a fair and effective solution in resolving disputes in Simangambat. The principle of deliberation allows all parties to express their views openly and reach a mutually acceptable agreement, reduce tension, and prevent conflict escalation, creating an atmosphere conducive to peaceful resolution. The findings of this research not only enrich the legal literature on village head elections, but also offer a model of harmonious and sustainable dispute resolution. This model can be adopted by other villages facing similar situations, increasing public trust in the election process and village governance. This research opens new avenues for the application of Siyasah Qadhaiyah in local governance, potentially making a significant contribution to the development of legal systems and democracy at the village level in Indonesia.

Abstract

Ideally, business should be conducted ethically and honestly, as it involves interactions with others. However, in reality, many entrepreneurs engage in fraudulent practices to gain greater profits. This gap has prompted the author to explore how Islam formulates its business concepts. The aim of this research is to explore the basic concepts of Islamic business ethics, analyze the application of these principles in business practice, and determine the indicators of true success from an Islamic perspective. This article is classified as a library research with a qualitative approach. The methodology used is descriptive analysis. The findings reveal that while there is a good understanding of Islamic business ethics principles, their application often lacks consistency with theory, particularly in aspects of social responsibility and spiritual good. The study finds that to achieve true success, businesses must balance worldly profits with social contributions and charitable acts.

Abstract

Ideally, the Principle of Legality serves as the fundamental basis in criminal law to ensure legal certainty and justice. However, in reality, with the enactment of Law No. 1 of 2023, there has been controversy regarding the evolving application of the law in Indonesia. The issue that arises is how this change impacts the application of criminal law, particularly in the context of protecting collective and individual interests. This study aims to analyze the position and consequences of the Principle of Legality in the development of criminal law in Indonesia. The method used is normative juridical research with a descriptive qualitative approach. The results of the study show that the Principle of Legality in Law No. 1 of 2023 emphasizes the principles of lex scripta, lex stricta, lex certa, and lex praevia, which reinforce legal certainty. The consequence of its application for the future of criminal law is the creation of a principle that is more adaptive and relevant to the diverse needs and culture of Indonesian society.
