Abstract

The ideal division of shared property, as stipulated in Article 96, Paragraph 1 of the Compilation of Islamic Law (KHI), mandates an equitable division of two equal parts in the event of divorce. However, the reality in Bagan Sinembah reveals prolonged delays in resolving shared property issues, attributed to a lack of understanding and legal socialization. This study aims to explore the dynamics and challenges of applying shared property laws in the region. The article is a literature-based study with a qualitative approach, employing empirical legal research and socio-legal analysis. The research findings reveal that the dynamics of shared property division in Bagan Sinembah highlight challenges in legal implementation, particularly concerning prolonged delays. Differences in opinion among religious leaders regarding the division of shared property contribute to this issue. Some religious leaders believe that the husband has the right to use shared property without involving the children, while others refer to QS. An-Nisa, verse 10, which addresses the rights of children in inheritance.

Abstract

As part of the global community, the death penalty for terrorism should ideally comply with international standards that respect human rights and justice. However, in Indonesia and Egypt, the implementation of the death penalty is often influenced by external and internal factors that deviate from these principles. This study aims to analyze how externalization affects the implementation of the death penalty for terrorism from the perspective of Islamic criminal law in Indonesia and Egypt. This article is classified as library research with a qualitative approach. The methodology used is a comparative study explained through descriptive analysis. The findings show that both countries are influenced by external pressures, with Indonesia experiencing tension between national policies and international standards, while Egypt struggles to balance Sharia principles with global demands. Although there are similarities in the impact of externalization, differences in implementation reflect the diversity of responses to international pressure within the context of Islamic criminal law.

Abstract

Ideally, legal protection for children born out of wedlock should ensure that they receive civil rights equivalent to those of legitimate children without discrimination. In reality, there are still differences in treatment between positive law in Indonesia, especially after the Constitutional Court Decision No. 46/PUU-VIII/2010, and Islamic law, which holds differing views on the status of children born out of wedlock. The challenge lies in how to harmonize legal protection for these children amidst the differing perspectives between positive law and Islamic law, ensuring that their civil rights are upheld while also minimizing negative social impacts, such as fornication. The purpose of this study is to analyze and compare legal protection for children born out of wedlock according to the Constitutional Court Decision and Islamic law and to seek solutions that can integrate both perspectives to create fair and dignified legal protection. The methodology used in this study is a normative juridical approach, examining various laws, court decisions, and related Islamic legal literature. The results of the research indicate that although there are differences in views between the Constitutional Court's decision and Islamic law, the integration of both approaches can provide more comprehensive legal protection for children born out of wedlock. By balancing both perspectives, it is hoped that it will guarantee the civil rights of these children while also preserving societal morality by minimizing the practice of fornication.

Abstract

Ideally, Islamic family law regulates polygamy with clear provisions to ensure justice and the welfare of all parties involved. In reality, within the culture of Agen Thrifting families in Teluk Nibung, Tanjung Balai, polygamy and nikah sirri (unregistered marriages) are often adopted as strategies to circumvent stringent legal regulations, creating issues related to legal status and family rights. This study aims to examine the practices of polygamy and nikah sirri in the context of Agen Thrifting families, focusing on how these practices interact with Islamic family law provisions. This article is categorized as qualitative field research. The methodology employed is a juridical-empirical approach, combining legal analysis with direct field observations. The research findings indicate that the culture of polygamy among Agen Thrifting families is often accompanied by nikah sirri as an effort to evade strict legal regulations. This results in negative impacts, including family separation and unclear status of children. Such practices undermine the principles of Islamic family law, particularly the assurance of family rights protection and legal recognition in accordance with justice principles.

Abstract

The COVID-19 pandemic was expected to impact not only the economic and health aspects of society but also potentially affect social dynamics and household stability, including an increase in divorce cases. However, the reality shows a significant surge in divorce cases, particularly khulu', at the Sidoarjo Religious Court following the pandemic. This phenomenon marks a significant change in divorce patterns occurring after the COVID-19 period, warranting further investigation to understand the causes and potential solutions. This study aims to analyze the dynamics of khulu', identify factors influencing the rise in divorce cases, and evaluate the role of the Sidoarjo Religious Court in addressing and reducing divorce cases. The research is field-based with a qualitative approach. The methodology used is a case study with descriptive analysis. The results indicate that the dynamics of khulu' in Sidoarjo have undergone significant changes, with an increase in divorce cases during the post-COVID-19 period. Factors such as economic pressure, changes in social interaction patterns, and emotional instability have triggered this surge. To minimize the prevalence of khulu' and divorce, the Sidoarjo Religious Court focuses on strengthening mediation, public education, rationalizing administrative requirements, and assisting families in resolving conflicts peacefully.

Abstract

Ideally, government supervision of foreign worker (TKA) permits, in accordance with Law No. 13 of 2003, should be carried out optimally to prevent violations. However, in reality, there are still many violations in the field, highlighting a gap between legal provisions and implementation. Issues arising from this gap include a lack of labor inspectors and weak coordination with relevant agencies, leading to the proliferation of illegal foreign workers. This study aims to analyze the effectiveness of TKA permit supervision from a normative juridical perspective. This article falls under the category of literature research with a qualitative approach. The methodology used is a normative legal study of labor-related regulations. The results of the study conclude that although regulations provide a strong legal foundation, the implementation of supervision in the field still needs to be improved through the enhancement of human resource capacity and inter-agency coordination to achieve the desired effectiveness.

Abstract

Ideally, the judicial review of regulations by the Constitutional Court aims to ensure the conformity of regulations with the constitution and protect human rights. The Constitutional Court has the authority to test the constitutionality of regulations, but in practice, there are challenges such as procedural complexity and institutional independence. This study aims to compare the function of judicial review by the Constitutional Court in Indonesia, the United States, and Austria. This article is classified as a literature review using a normative legal study approach. The methodology employed is a comparative study. The research results show that although all three countries have regulatory review bodies, there are differences in the process and structure of the institutions. The Indonesian Constitutional Court has a broad role, while the U.S. Supreme Court focuses on specific regulations, and in Austria, the review is conducted by a specialized court with a narrower focus.

Abstract

Ideally, religious moderation and communal harmony should serve as the cornerstone for building a harmonious social life, particularly in diverse societies. However, the reality reveals that interfaith conflicts and a lack of tolerance still often occur, driven by narrow and exclusive interpretations of religion. This phenomenon hinders the creation of peace and harmony within pluralistic communities. This article is based on qualitative research. The methodology employed is a content analysis of Quranic verses through a hermeneutic approach. The findings indicate that maqasid shariah provides a strong foundation for promoting religious moderation and communal harmony. Values such as justice, welfare, and the protection of individual rights embedded within maqasid shariah can serve as guidelines for creating a tolerant and harmonious society. The Quranic hermeneutic approach also aids in understanding the messages of moderation contextually, enabling practical solutions to the challenges of diversity in modern society.

Abstract

Ideally, human emotions should be well-managed to cope with life’s pressures, thereby creating harmony within families that supports family resilience. However, in reality, many individuals struggle to regulate their emotions, particularly in stressful situations, which often leads to family conflicts and threatens family stability, as observed in Gampong Sungai Pauh. The purpose of this study is to explore the strategies employed by the people of Gampong Sungai Pauh to regulate their emotions in stressful situations and to examine how emotional regulation affects family resilience. This research is classified as field research using a qualitative approach. The methodology employed is a phenomenological study. The findings reveal that the people of Gampong Sungai Pauh use various strategies to regulate their emotions, such as gathering with friends, refreshing themselves, seeking new activities, being patient, focusing on positive things, improving mental and spiritual well-being, and practicing solitude. However, the inability of some respondents to regulate their emotions has led to recurring conflicts, which negatively impact children and family stability.

Abstract

Ideally, the dispensation of marriage for urgent reasons is expected to provide a solution for couples caught in difficult situations, especially in the context of legal norms that protect individual rights. However, the implementation of marriage dispensation often faces challenges, particularly regarding the criteria and limitations set forth in Supreme Court Regulation No. 5 of 2019, leading to injustice for prospective brides and grooms. The aim of this research is to analyze the implementation of marriage dispensation at the Mojokerto Religious Court and assess the extent to which this regulation meets public expectations. This article is categorized as qualitative literature research, employing normative legal studies and comparative studies between classical scholars' thoughts and modern regulations. This research concludes two things: First, from a legal perspective, although challenges remain in its implementation in the field, Supreme Court Regulation No. 5 of 2019 provides clear guidelines for the dispensation of marriage. Second, the comparison between classical thought and modern regulations indicates a shift in focus from socio-cultural aspects to a more comprehensive protection of individual rights, reflecting the need for legal adaptation in response to evolving social dynamics.
