Abstract

Ideally, the legal system in Indonesia should guarantee justice and uphold human rights by protecting individuals from arbitrary arrests and fabricated cases. However, in reality, incidents of fabricated arrests, particularly in drug-related cases, continue to occur due to weak law enforcement and deficiencies within the system. This study aims to analyze the legal protection mechanisms for victims of fabricated arrests in drug cases from a human rights perspective, with the goal of achieving substantive justice. The methodology used is juridical-normative with a descriptive-analytical approach, utilizing primary and secondary data from literature review and analysis of relevant legal frameworks. The research findings indicate that although regulations exist that provide access to pretrial, compensation, and rehabilitation, their implementation is hindered by complicated procedures and lack of oversight over law enforcement authorities. The human rights perspective emphasizes the importance of physical, psychological, and social recovery for victims as part of efforts to achieve substantive justice.

Abstract

Ideally, the seizure of evidence in Money Laundering Crimes (TPPU) should be conducted in accordance with applicable laws and regulations to ensure the validity of evidence that can be used in legal proceedings. In reality, numerous issues arise regarding the regulation and procedures for evidence seizure, which often impact the validity of the evidence. This study aims to analyze the regulations and procedures for evidence seizure in TPPU cases and their implications for the validity of evidence in legal processes. This article is categorized as library research using a qualitative approach. The methodology employed is normative juridical analysis. The findings reveal that evidence seizure in TPPU cases is often not conducted in accordance with established procedures, thereby potentially undermining the validity of the evidence. The money laundering process, which consists of the placement, layering, and integration stages, frequently involves suspicious transactions that require stricter supervision.

Abstract

Ideally, the management of radioactive waste should be carried out safely to prevent harmful impacts on the environment and human health. In reality, radioactive waste management in Indonesia faces challenges regarding clear standards and procedures, despite existing regulations. This study aims to analyze the development of radioactive waste management policies in Indonesia, specifically comparing Government Regulation No. 27 of 2002 and Government Regulation No. 61 of 2013. The research uses a normative legal research method with an approach that analyzes regulations and the relevance of policies to international safety standards. The findings show that Government Regulation No. 61 of 2013 provides a more detailed and structured management framework compared to Government Regulation No. 27 of 2002. The newer regulation adopts a more detailed classification of radioactive waste, as well as stricter licensing and monitoring procedures, which in turn enhance the effectiveness of management and safety.

Abstract

Ideally, human resource management (HRM) development within the government sector should improve employee performance through structured and targeted programs such as education and training (diklat), technical guidance, and seminars that support skill enhancement and work quality. However, in reality, at the General Bureau of the Regional Secretariat of North Sumatra, HRM development is often poorly organized and not aligned with employees' work schedules, leading to inefficiency in achieving organizational goals. The purpose of this study is to evaluate the existing HRM development implementation model and to identify the evaluations carried out to improve employee performance. This research uses a qualitative approach with a descriptive study methodology. The findings show that the implementation model of HRM development at the General Bureau of the Regional Secretariat of North Sumatra has not been optimally implemented. Evaluations of HRM development programs reveal a mismatch between the implementation of the programs and the employees' needs, as well as a lack of sufficient financial support for development activities.

Abstract

In the submission of compensation for victims of terrorism, there should be a legal framework that provides justice and comprehensive protection for victims without administrative barriers or time limitations for claim submissions. In reality, terrorism victims often face difficulties in accessing compensation due to convoluted procedures and legal uncertainties, particularly related to the time limit for submission. This research aims to analyze the legal framework for compensation submission for terrorism victims based on Constitutional Court Decision No. 103/PUU-XXI/2023 and the changes in compensation procedures following the decision. This article uses a library research method with a qualitative approach, analyzing legal documents and relevant literature to describe and explain the legal dynamics in compensation for terrorism victims. Constitutional Court Decision No. 103/PUU-XXI/2023 brings significant changes by removing the time limit for compensation submission, providing broader opportunities for victims. However, challenges in implementing this decision still exist, particularly regarding administrative barriers and the lack of awareness and information for victims.

Abstract

Ideally, the TAPERA policy in Indonesia is designed to help the public, particularly workers, own decent housing through a systematic housing savings program. However, in reality, many people do not fully understand this program and question its implementation, especially regarding its alignment with the principles of Islamic economics. The purpose of this study is to analyze the government's policy on TAPERA in Indonesia and examine its application from the perspective of Islamic economic principles. This article falls under literature research with a qualitative approach, using normative legal studies methodology, explained with descriptive analysis. In conclusion, the Indonesian government's policy on TAPERA aims to improve access to decent and equitable housing for the public, especially those with limited income, while reducing social disparities. From the perspective of Islamic economics, TAPERA applies the principles of justice, maslahat, ta'awun, and balance, offering interest-free financing and focusing on more sustainable social welfare.

Abstract

The increasing outstanding in the al-Qardhul Hasan-based BankZiska financing scheme reflects the gap between the ideals of an interest-free, penalty-free, and solidarity-based program and the reality of potential abuse by partners, such as failure to repay. BankZiska, as a program based on zakat, infaq, and sadaqah funds, aims to help small communities, especially MSME players, free themselves from loan sharks and ribawi practices. The program provides soft loans without additional fees, which are designed in accordance with sharia principles and DSN-MUI fatwas. This study identifies the risk mitigation strategies applied by BankZiska to maintain the sustainability of the financing scheme. A literature study-based qualitative approach is used to analyze the effectiveness of the joint liability system, periodic monitoring, and intensive mentoring. The findings show that these strategies effectively reduce the risk of default, increase the ethos of economic independence, and build community awareness of Islamic economics. The program also has a positive impact on partner empowerment through entrepreneurship training and Islamic financial education. BankZiska is not only a financial solution, but also part of economic da'wah to encourage people's independence.

Abstract

This study aims to analyze the legal protection of the famous Biostime trademark registered by Biostime Indonesia under Law Number 20 of 2016 on Trademarks and Geographical Indications, as well as to examine the responsibility of the Directorate General of Intellectual Property in handling the trademark dispute. The methodology of this research is categorized as normative legal research with legislative, conceptual, and historical approaches. This article uses an analysis of applicable regulations, trademark protection theories, and legal practices in resolving trademark disputes in Indonesia. The findings of this study show that legal protection for famous trademarks in Indonesia needs to be improved to provide better legal certainty for trademark owners, especially in dealing with the registration of similar or identical trademarks. The Directorate General of Intellectual Property, as the responsible institution, must be more careful and thorough in conducting substantive examinations to ensure that no violations occur against famous trademarks that could harm their owners.

Abstract

Interfaith marriage in Indonesia ideally requires a clear and harmonious legal framework aligned with societal values and religious principles. However, in reality, the absence of explicit regulation in Law Number 1 of 1974 on Marriage has created legal uncertainty and social challenges, particularly prior to the issuance of SEMA Number 2 of 2023. This study aims to analyze the implementation of interfaith marriage regulations, their socio-legal impacts, and efforts to harmonize the legal framework in Indonesia. Using normative legal research methods with a juridical approach, this study is based on library research analysis. The findings reveal that SEMA Number 2 of 2023 has provided a clearer legal framework for the registration of interfaith marriages, although technical challenges persist. Socially, the regulation has shifted societal paradigms, while legally, it has increased legal certainty. Legal harmonization requires an integrated approach that considers legal pluralism, religious values, and the realities of Indonesian society.

Abstract

Ideally, every individual holds a balanced responsibility toward their rights and legal freedoms, as guided by Islamic Fiqh and the Universal Declaration of Human Rights (UDHR). However, in reality, imbalances between the exercise of rights and responsibilities often occur, both in social and legal contexts. This study aims to analyze the concept of individual responsibility toward rights and legal freedoms from the perspectives of Islamic Fiqh and the UDHR, as well as to identify the common ground between these two perspectives. This article falls under normative research with a qualitative approach, utilizing analysis of relevant primary and secondary literature. The findings reveal that both Islamic Fiqh and the UDHR emphasize a balance between rights and responsibilities, although differences exist in principles and contexts of application. These findings underscore the importance of harmonizing Islamic legal principles and universal norms to achieve social justice.
