Abstract

Berdasar hasil penelitian dan pembahasan dapat disimpulkan bahwa bentuk penyelesaian secara kekeluargaan/perdamaian atau non-litigasi adalah dengan cara muyawarah antara pelaku, korban, keluarga pelaku atau keluarga korban serta disaksikan oleh pihak LPA dan Polisi sebagai mediator. Penyelesaian secara kekeluargaan/perdamaian atau non-litigasi dilakukan dengan alasan : menghindari stigmatisasi pelaku sudah menyadari kesalahannyapihak korban sudah memperoleh ganti rugi dari pelakutindak pidana yang dilakukan pelaku ringan Penyelesaian secara non litigasi dapat memenuhi dan mencapai perlindungan terhadap anak yang melakukan tindak pidana, karena : saling memaafkan antar pelaku dan korbananak pelaku tindak pidana kembali ke orang tuatercapai keseimbangan dalam masyarakatsudah tidak ada stigma bagi anak. Namun demikian, penyelesaian non-litigasi ini juga memiliki beberapa kendala dalam praktik pelaksanaannya yakni: pihak korban tidak mau menerima penyelesain secara non litigasitindak pidana yang dilakukan diancam dengan pidana berataparat penegak hukum kurang mendukung tidak ada juklak atau juknis untuk pelaksanaannya.

Abstract

In the provisions of the law, marriage must be carried out in accordance with the terms and conditions of marriage. One of the conditions of the marriage is an agreement between the parties who wish to marry, including knowing the identity of each party. This means that a marriage is prohibited if it does not meet the requirements, while such a marriage which has already been carried out can be canceled. In the writing of this thesis, research was carried out on problems in the form of the process of implementing an application for a marriage cancellation case at the Religious Court and the legal consequences of cancellation of marriage on children and joint assets. In the research method used was normative juridical. The procedure for filing a cancellation request at the Religious Court begins with registration of the application and goes through several administrative processes which are then followed by a trial where at the first trial the panel of judges is obliged to reconcile the applicant with the respondent, furthermore, the cancellation of the marriage has a legal effect on the relationship between the applicant and the respondent which is no longer bound by ties. a legal and essential marriage, and there is no civil obligation for the applicant or the respondent.

Abstract

Tulisan ini memaparkan tentang demokrasi internal partai serta kaitannya dengan proses pemilihan ketua partai yang demokratis, bertujuan untuk mengulas dan menghadirkan perspektif tentang proses demokrasi khususnya di dalam tubuh partai politik. Penulisan makalah ini menyentuh berbagai aspek mulai dari aspek sosiologis, politik dan hukum yang menggunakan pendekatan konseptual, komparatif, deskriptif dan historis, yang penerapannya disesuaikan dengan kebutuhan. Dengan menggunakan beragam teori yang digagas oleh beberapa pemikir klasik maupun kontemporer tentang tema demokrasi internal partai serta kaitannya dengan proses pemilihan ketua partai yang demokratis, sebagaimana diterapkan dalam praktek berdemokrasi di Indonesia dan juga menghadirkan beberapa negara sebagai komparasi seperti Inggris, Kanada dan Malawi selanjutnya direvisi secara teoritik dalam wacana akademik, tulisan ini menunjukkan bahwa praktek demokrasi internal partai belum berjalan secara utuh seperti yang diharapkan di Indonesia, masih banyaknya ditemukan fakta bahwa pemilihan pimpinan partai politik masih menggunakan pola patronase dan oligarki seperti pemilihan tertutup dan pemilihan secara aklamasi, ditambah dengan cara-cara perbuatan melawan hukum seperti politik uang. Realitas yang seharusnya adalah partai politik sebagai representasi masyarakat dan jembatan keterwakilan warga negara pada posisi kursi kekuasaan baik legislatif maupun eksekutif, seharusnya mampu menjadi contoh demokrasi terapan sebagai sebuah cerminan dari negara modern. Akhir dari tulisan ini memberikan beberapa solusi yang dapat diterapkan oleh partai politik dalam proses pemilihan pimpinan partai, baik sebelum berlangsungnya munas/kongres maupun setelahnya. Dengan tujuan kedepannya partai politik benar-benar menjadi partai kader yang memiliki prinsip-prinsip demokrasi dari level tertinggi hingga akar rumput. Abstract

Process verification of state quantity costs due to corruption regulated in law number 8 of 1981 on the Criminal Procedure Law. The verification of state quantity costs arising from of corruption is difficult to find. This cause by several factors. The problems in this research is: (1) how the process verification of state quantity costs from corruption? (2) what is obstacles find from officials in the process of proving total losses of countries on criminal acts of corruption ?(3) how correlation due to the number of the state a loss of corruption in drop by a judge? This research adopting juridical sociological, the data use covering primary and secondary data. Data is collect through interviews , the study documents and analyzing with qualitatively .The results of research it: (1) the process of due to the number of the state a loss of corruption in a total loss. (2) the obstacles find in the process of proving for of public prosecutors and judges namely covering juridical obstacles and non juridical? (3) Correlation amount of losses that the State decide by the judge as a criminal judgment in the case of restitution for the losses that State.

Abstract

Election is a means of exercising people's sovereignty. Election regulations continue to change every time an election is held. So that there is no permanent and long-term election regulation. The 2019 simultaneous elections which were regulated by Law No.7 of 2017 concerning General Elections would not last for a period of five years. This is because the DPR and the President are currently forming a new Election Bill which is being discussed between Commission II of the DPR and the government. In Law No.7 of 2017 concerning General Elections, several laws have been codified, namely the Law on Election Implementation, the Law on Legislative Elections, and the Law on Presidential and Vice-Presidential Elections, several separate laws then become one in Law No.7 of the year. 2017 concerning General Election. This is what is called the codification of elections, namely the compliance of laws and regulations relating to elections. When the formation of the Election Bill, there was also a very sharp intersection of interests between political parties, especially those discussing the parliamentary threshold, the electoral system, the threshold for presidential and vice presidential candidates. Because the Election Law is drafted within a period of five years, ideally the Election Law contains very technical and very detailed matters. It is intended that election regulations in the form of regulations at the General Election Commission (KPU) level and Election Supervisory Body Regulations (Bawaslu) can be reduced because at the level of the Law itself, technical regulations are already regulated. This is because too many regulations at the PKPU and Perbawaslu levels will make it difficult for election organizers in provinces, districts / cities, especially when PKPU tends to undergo changes because they have to consult with the DPR. This does not mean that PKPU and Perbawaslu are unnecessary but reduced so that election regulations are not obese. And the enforcement of election law, both administrative disputes, process and criminal law enforcement, must contain the principle of equality of the parties to the dispute. It is prohibited to enforce one-sided election law, selective cutting and so on.

Abstract

Law Number 1 of 1974 concerning Marriage has regulated the registration of marriages, detailed in Article 2 of Law Number 1 of 1974. Provisions regarding this registration are further regulated in detail in Government Regulation Number 9 of 1975 as a regulation for implementing Law Law No. 1/1974. Registration of marriages of those who are Muslim is carried out by Registrar as interpreted in Law Number 32 of 1954. The fact is that in the midst of the community many people still do not register their marriages at the authorized institutions. Resulting in unfavorable consequences for women or the wife and children born. The research method used is normative juridical legal research. The registration of a marriage is intended as an authentic means of proof with the evidence that a marriage can be prevented or canceled. This painting is not a valid marriage or not a marriage that occurs is only for administrative order only. The law requires each marriage to be recorded according to the applicable laws and regulations which means that a marriage is an important social event, therefore it is necessary to be recorded in a record provided specifically for that and to make the event an clear events for the concerned person or others.

Abstract

Secara umum DPRD mempunyai 3 (tiga) fungsi dasar yaitu: fungsi perwakilan, fungsi pembuatan kebijakan (legislasi), dan fungsi pengawasan. Fungsi Legislasi DPRD diwujudkan dalam membentuk Peraturan Daerah bersama Kepala Daerah, hal ini berarti bahwa hubungan Kepala Daerah dengan DPRD merupakan hubungan kerja yang kedudukannya setara dan bersifat kemitraan. Namun dalam kenyataannya, dalam fungsi legislasi, DPRD belum mempunyai kedudukan yang setara dengan pemerintah daerah. Hal ini terbukti masih banyaknya produk Peraturan-peraturan Daerah yang merupakan inisiatif dari Pemerintah Daerah, bukan dari DPRD. Sangat sulit untuk berharap banyak adanya kesetaraan antara pemerintah daerah dengan DPRD khususnya dalam proses legislasi. Meskipun secara normatif DPRD sebenarnya mempunyai fungsi sentral dalam proses legislasi, walaupun efektifitas pelaksanaan hak inisiatif DPRD dalam menjalankan peran dan fungsi legislasi telah mulai dilakukan baik melalui pembenahan regulasi, kelembagaan maupun peningkatan kualitas SDM-nya. Seperti terbentuknya Panitia Legislasi sebagai bagian dari alat kelengkapan DPRD (meskipun belum bersifat tetap), pengangkatan Tenaga Ahli untuk mendukung kinerja DPRD, penentuan Program Legislasi Daerah sebagai instrumen perencanaan pembentukan Peraturan Daerah yang disusun secara berencana, terpadu dan sistematis dan pelatihan-pelatihan sebagai upaya peningkatan kualitas anggota DPRD khususnya dalam bidang perlegislasian.

Abstract

This research background was found in the implementation of the program Baitul Maal Wat Tamwil (BMT) in Empowerment’s actors UMKM in Padang. The aims of this research was to describe the implementation of Sharia Baitul Maal Wat Tamwil (KJKS BMT) Cooperative Program and to know the impact of KJKS Program implementation through savings and loan program in approaching the access of business capital to SMEs in Padang City. The method used in this research was qualitative research using descriptive method. The research found that the Role of Sharia Financial Services Cooperative Program Baitul Maal Wat Tamwil (KJKS BMT) for the Empowerment of Micro Small Medium Enterprises has been effective by providing financing in the addition of venture capital to UMKM for the development of their business. Although the implementation of KJKS program has been in accordance with existing procedures but has not fully able to improve the welfare of its members. This can be seen from its still found some obstacles in the implementation, constraints faced can be categorized into two forms. Internal obstacles such as: lack of KJKS capital, poor people's mindset about KJKS program, lack of supervision on KJKS program implementation, external constraints such as: the utilization of aid funds that have not maximized, Fructuative Community Economic Condition (unstable), Competitor with product Just like the existence of loan sharks, obstacles that come from the participants of the program carried out efforts such as guidance, the system pick up the ball against members who are stuck in the payment.

Abstract

This objective is to examine the original income of the region for sustainable regional development in Indonesia, using normative legal research. Regional government finance is a very decisive factor in the administration of regional government. The financial capacity of a region is determined by the existence of a source of regional income and its level of lucrative. The level of a local source of revenue is determined by the extent to which the basis for imposing taxes is responsive to inflation, population growth and economic growth. Generally in developed countries that implement decentralization policies tend to give greater authority to the regions to manage sources of revenue that are lucrative. On the other hand, in developing countries, financial resources are controlled by the central government. Local governments only manage financial resources that are less potential.

Abstract

The pension fund is one of the potential event, which can be a source of national development supporting all Indonesian people. With the Pension Fund, the sustainability of income in old age can be realized, employees can work more quietly, and the expected productivity and employee loyalty can meningkat.Dana Bank Nagari Retirement Pension Fund is established by Bank Nagari with a view to organizing Defined Benefit Pension Fund and with the aim of providing continuity of income for participants after full devotion. Therefore, it can not be separated from the responsibility of the Pension Fund for the adequacy of funds to meet the obligations to pay retirement benefits to participants and parties entitled to pension benefits.
