Abstract

Revenge Porn  phenomena that are very appalling in Indonesia are happening to some public figures. Such boundlessly evolving technology ultimately poses online hazards to its users. As intimate images and videos spread across online and social media, women who were victims of revenge pornography could not resist and became increasingly helpless to seek justice for themselves. Women victims of revenge porn violence must fight in the criminal justice system for legal protection over the settlement of their case. Criminalization and sexual gender discrimination are experienced by victims because of the culture of blaming victims, so they are afraid to report to the authorities and get intimidated to pursue a peaceful path. The lack of evidence is also a threat to legal protection for the victims of revenge porn because of the late reporting, so there is no visa or repertum. The law enforcement's understanding of obtaining a minimum of evidence in accordance with the criminal law on sexual violence is also not well implemented.

Abstract

AbstractIndustri makanan merupakan usaha yang menarik minat masyarakat, baik ketika pandemi maupun ketika keadaan mendekati masa normal seperti ini. Tidak mengherankan jikaUMKM dibidang kuliner jumlah nya sangat banyak. Indonesia adalah salah satu negara yang memiliki Jumlah penduduk muslim terbesar di dunia, sehingga Pemerintah tidak ragu untuk menetapkan Visi Pusat Halal Dunia 2024 ini. Upaya akselerasi sertifikasi halal dilakukan dengan sertifikasi Halal Self Declare dimana pelaku UMKM menyatakan produknya halal dengan proses pendampingan dari BPJPH dan penetapan halal oleh Komisi fatwa MUI. Dalam salah satu syarat self declare ini, apabila dalam produknya menggunakan bahan daging maka disyaratkan pembelian di Rumah Potong Hewan (RPH) yang bersertifikat. Persyaratan ini menjadi kendala tersendiri bagi pelaku UMKM mengingat belum banyak tersedia Juru Sembelih Halal (Juleha) dan RPH bersertifikat halal. Tujuan dari penelitian ini adalah untuk mengetahui peluang bagi Muhammadiyah untuk ikut ambil bagian dalam memenuhi kebutuhan produk halal tersebut (supply chain). Metode penelitian ini adalah degan menggunakan model penelitian sosio legal dan pendekatan yuridis empiris. Responden dalam penelitian ini adalah pelaku UMKM kec, kartasura dan para Pimpinan Lembaga yaitu PDM Kota Surakarta, MUI Kota Surakarta dan Dinas Pertanian Kota Surakarta. Dalam upaya menakar peluang Muhammadiyah menyediakan Juleha dan mendirikan RPH bersertifikat Halal. Hasil yang diperolah adalah Muhammadiyah memiliki peluang dalam menyediakan juru sembelih hewan (juleha) di kecamatan kartasura. Dari data yang diperoleh bahwa UMKM merasakan kesulitaan memenuhi persyaratan tersebut, disatu sisi jika diminta mengganti bahan tanpa menggunakan daging maka akan merubah minat masyarakat akan produknya. Disamping itu diperoleh data bahwa 85% RPH belum memiliki sertifikat Halal. Oleh karena itu penelitian ini menjadi penting dalam mendukung upaya pemerintah menjadikan Indonesia sebagai Pusat Halal Dunia di tahun 2024 ini.Keywords: Self Declare, Supply Chain, Muhammadiyah, Halal

Abstract

Exchange agreements for immovable objects are still carried out in the community, especially in exchange agreements for land and building objects. This article discusses the lack of detailed regulation on the imposition of income tax for the exchange of immovable objects, such as land and buildings, in Indonesia. It explains the importance of taxes as a source of revenue for the government and explores the differences between central and local taxes, as well as how taxes are closely related to legal relations in civil law. This research uses normative legal research methods. The results show that the legal relationship outlined in an agreement called exchange is equated with buying and selling which is subject to income tax. The exchange that is carried out and equated to buying and selling from the understanding of the object of income tax is not appropriate. This incompatibility is because the exchange is essentially carried out not to obtain profit. This article concludes by highlighting the need for more detailed regulations on the imposition of income tax for the exchange of immovable objects, as it cannot be equated with a sale and purchase transaction.

Abstract

This study set out to address the question, "How is the future legal construction of the pattern of implementing inclusive, specialized, and equal Education for Persons with Disabilities in Indonesia?" The normative issue of how disabled people in Indonesia are often managed inspired this study. The Law on the Education System and the Law on Disabilities both include ambiguous principles on inclusive and special (segregated) education. The Statute Approach method was used to conduct this normative assessment of the law. The study's findings suggest that moving forward, Indonesia will revise legal norms in both laws and the integration of special schools and regular schools by establishing special units in regular schools to accommodate students with disabilities, all with the goal of achieving full inclusive education for people with disabilities. This may be done in increments, on a continuous basis, and using metrics based on the state of Indonesia's infrastructure right now

Abstract

The purpose of this study is to analyze and find out the urgency of criminal sanctions against the behavior of Lesbian, Gay, Bisexual, and Transgender in the Conception of Criminal Individualization. The type of research used in this study is sociological juridical which is analyzed using qualitative data analysis methods. The results of this study indicate that the actions of Lesbian, Gay, Bisexual and Transgender are regulated in Article 414 of Law no. 1 of 2023 concerning the Criminal Code. In addition, criminal sanctions for same-sex crimes should not be imprisonment, bearing in mind that one of the principles of criminal individualization must look at the conditions and circumstances of the offender.

Abstract

Political parties and political party wings are organizations that play a role in democracy in Indonesia. Apart from that, there are still community organizations that appear to have no political affiliation but actually play a role in democratic contestation, then sporadically, almost every year before the election, similar community organizations emerge, which generally called volunteers. Political parties and their wing organizations have the same responsibility in building democracy, but we often find that party wing organizations can become an extension of political parties, committing various violations of campaigning rules or breaking the law in general; Here there is an intersection of whether political party wing organizations are subject to Law No. 2 of 2011 concerning political parties, or the law on social organizations. Researchers examine the problems of the existence of OSP in the Indonesian legal system, especially the phenomenon of legal violations. This research uses a normative juridical approach using legal norms that apply in Indonesia. At the end of the research, it was concluded that party wing organizations are more appropriately regulated in the political party law than in the law on social organizations, and violations are the responsibility of the parent political party.Keywords: law, politics, party, wing, underbouw

Abstract

The Articles of Association of the Foundation in its rules can be changed except regarding the purpose and objectives of the foundation. Amendments to the foundation’s articles of association are carried out with the application submission procedures. They are regulated in Article 15 to Article 23 of Law Number 16 of 2001 concerning foundations. The foundation’s founder is one of the parties that plays an important role in every action. Moreover, Article 28 paragraph 4 of the Foundation Law states that if the Foundation for any reason no longer has a Trustee, no later than within 30 (thirty) days from the date of vacancy, the Management members and Supervisory members must hold a joint meeting to appoint a Trustee by taking into account the provisions referred to in paragraph (3). Such an event requires the role of a Notary to make a Deed of Minutes of the Meeting to record the changes in the deed to replace the management in the deed of amendment or adjustment of the foundation.

Abstract

Radbruch has long discovered three basic values in law, namely the values of justice, expediency, and certainty in law, however, Radbruch has not yet explained the applicability of these three values within the framework of a harmonious system, this in its development has resulted in spannungsverhaltnis between these three values. This paper, which uses a sociological and philosophical juridical method, tries to explain the disharmony of the three basic values of Radbruch's law. Based on various existing studies, it can be seen that Radbruch only divides the three basic legal values partially, not as a unit as a sub-system, therefore the ecosystem in law which is based on Radbruch's three basic values experiences distortion, problems of distortion or spannungsverhaltnis between the three values. This basis can be avoided by creating harmony between these basic legal values through an ecosystem of interrelated legal basic values as a holistic integrated system.

Abstract

The aim of this research is to determine the implementation of parate execution carried out by PT. Bank Papua and to find out form of execution of collateral objects charged with Rights Dependents.The method used in this research is approach normative law and empirical legal approaches. Legal research Normative is legal research that places law as a norm, rule and statutory regulation. Whereas Empirical legal research is legal research that will provide a complete understanding and response to the law in the context of norms to answer questions about the implementation of the rights execution parate dependents. The research results show that the implementation of the execution parate carried out by PT. Bank Papua is not running well because there is resistance from the debtor who does not want the object the collateral is auctioned off. Pursuant to Article 6 of the Bill of Rights Dependents then the creditor has the right to carry out parate execution without requires a fiat of execution from the Court

Abstract

Misuse of customer deposits as a banking crime is a very worrying and detrimental problem for both customers and the bank concerned. The aim of this research is to analyze, understand and explain that misappropriation of customer deposits is a banking crime and the government should implement a customer deposit guarantee model. The method used is normative and empirical, namely research that examines the literature and applicable laws and regulations using descriptive characteristics, then analyzes it carefully and thoroughly in accordance with the research objectives and looks at the reality that occurs at the research location. The results of the research reveal that misuse of customer deposits by bank leaders, bank employees and stakeholders is a banking crime based on Article 48 paragraph (2) of Law Number 10 of 1998. Legal protection for customers by providing a model implemented by the government to safeguard customer deposits namely the Law on Deposit Insurance Corporation (LPS), Law no. 24 of 2004 which has two functions, namely guaranteeing bank customer deposits and clearing or handling failed deposits as well as synergy between Bank Indonesia and the Financial Services Authority (OJK).
