Abstract

Marunda Grahamineral is a coal company, in its mining activities using the services of the contractor PT. Riung Mitra Lestari in Pit East Kawi. The objective of this study is to analyze the productivity of the plywood on overloading with the Overall Equipment Effectiveness method. (OEE). OEE is a method of measuring the level of efficiency of a device that can help identify the actual problem placement of the produced production. With quantitative descriptive methods the researchers developed mathematical models and theories that relate to the land clearance activities of the cover. The result of the calculation of the actual productivity of the Excavator CAT 395 (1215) is 569.61 BCM/hour with an OEE value of 66%, whereas the excavator Cat 395 (1226) is 391.81 BCM / hour with a OEE rate of 45%, where the target productivities of the excavator CAT 396 are 620 BCM per hour. Advanced calculations of the Six Big Losses and analyzed with the pareto chart the greatest factor resulting in the low OEE values of the exhaustor CAT 395 (1215) are reduced speed of 12.9%, and of the extractor CAT 395, (1216) are breakdown losses of 30.8%. In order to efficiency improvements are performed on the OEE factor, with the utilization factor and speed factor the value of OEE is obtained after improvement is 72%, and the performance after improvements is 620,31 BCM./hour on the excavador CAT395 (1215). This value does not meet the world-class OEE value of ≥ 85%, but for the post-improvement productivity value of 629.31 BCM/hour, the value exceeds the plan's productive target of 620 BCM /hour.

Abstract

Peneltian ini bertujuan untuk mengetahui sejauh mana efektifitas peran dan kontribusi mediator dalam penyelesaian sengketa perceraian di Pengadilan Agama Sungai Penuh. Di dalam penelitian ini juga, peneliti menguraikan gambaran umum proses mediasi di Pengadilan Agama Sungai Penuh serta faktor- faktor apa saja yang mempengaruhi tingkat keberhasilan proses mediasi di Pengadilan Agama Sungai Penuh. Penelitian ini menggunakan pendekatan normatif- empiris yaitu suatu metode yang menggabungkan atau mengkombinasikan antara metode pendekatan normatif dan pendekatan empiris. Peneliti berusaha membedah permasalahan proses mediasi serta peranan mediator di Peradilan Agama secara umum sebagaimana data- data kepustakaan dan ketentuan perundang- undangan yang berlaku. Kemudian peneliti melakukan observasi dan wawancara dengan narasumber secara langsung ke lapangan yaitu Mediator Pengadilan Agama Sungai Penuh sebagai objek penelitian. Hasil penelitian menunjukkan bahwa peran dan kontribusi mediator di Pengadilan Agama Sungai Penuh dalam keberhasilan mediasi perkara perceraian belum maksimal. Hal ini dikarenakan masih minimnya jumlah perkara perceraian yang berhasil dimediasi setiap tahunnya. Faktor keberadaan mediator menjadi salah satu faktor yang mempengaruhi keberhasilan proses mediasi disamping faktor lainnya. Keterbatasan jumlah mediator di Pengadilan Agama Sungai Penuh menjadi salah satu faktor yang mempengaruhi keberhasilan mediasi. Pengadilan Agama Sungai Penuh hanya memiliki 3 (tiga) orang mediator yang kesemuanya adalah mediator hakim. Ketiadaan mediator non hakim di Pengadilan Agama Sungai Penuh menjadikan proses mediasi hanya mengandalkan mediator hakim yang juga harus membagi waktu dengan tugasnya sebagai hakim di persidangan.

Abstract

The number of cases of pulmonary tuberculosis based on data from the Central Statistics Agency in DKI Jakarta in 2020-2021 has increased. Pulmonary tuberculosis is an infectious disease that currently causes a high mortality rate. In the implementation of National Health Insurance (JKN), pulmonary tuberculosis is a type of disease that is guaranteed and can be treated with FKTP services. This study uses BPJS Health tertiary data with Poisson regression modeling and Negative Binomial regression which aims to determine the description of visits by JKN participant tuberculosis sufferers to outpatient services in DKI Jakarta. The subjects of the research were all patients diagnosed with pulmonary TB who were undergoing outpatient treatment based on BPJS Health contextual tuberculosis sample data. The results of this study showed that there were 625 participants diagnosed with pulmonary TB, the majority of whom were male, in the adult age category, and in the Contribution Assistance Recipient (PBI) segment. From the modeling carried out, it was found that 8 (eight) variables significantly influenced the utilization of outpatient health services in DKI Jakarta with the age variable in the elderly group (>55 years) being most dominantly related to the utilization of outpatient services. Service flow as well as promotive and preventive efforts in the target population involving cross-sectors play an important role in treating pulmonary tuberculosis. Based on the description above, research was conducted with the aim of finding out what factors influence the utilization of health services for tuberculosis sufferers of JKN participants in DKI Jakarta.

Abstract

Ethical teachings in principle emphasize that law only aims to achieve justice. In Indonesia, justice is the ideal and goal to be achieved. However, the issue of justice still has not found its relevance. This article explains more deeply the ethical teachings of legal objectives and seeks their relevance to social justice in Indonesia. Normative juridical is this type of research with a statutory and historical approach. Qualitative descriptive is used as analysis. This research produces: (1) the parameters of justice are not single, starting from state political regulations to resistance to arbitrariness; (2) the relevance of ethical teachings to social justice finds its anchor point in the existence of equal opportunities before the law and government without exception for Indonesian citizens.

Abstract

Penafsiran hukum yang beragam oleh lembaga yudikatif, eksekutif, dan legislatif dapat mengakibatkan ketidak konsistenan dalam penegakan hukum di Indonesia. Variasi dalam interpretasi hukum antara lembaga-lembaga ini sering kali menghasilkan kebingungan hukum, ketidakpastian, dan bahkan potensi ketidakadilan. Hukum normatif menjadi jenis penelitian ini, sedangkan pendekatan menggunakan perundang-undangan dan konseptual, serta dokumen sebagai analisisnya. Penelitian ini menghasilkan: (1) Implikasinya adalah penegakan hukum yang tidak konsisten dan terkadang tidak merata, yang dapat mengancam kestabilan dan kepercayaan masyarakat terhadap sistem hukum. (2) Penyelesaian yang efektif membutuhkan kerja sama yang lebih baik antara lembaga-lembaga tersebut, serta peningkatan pemahaman atas prinsip-prinsip hukum yang diterapkan. Peningkatan koordinasi dan komunikasi antara lembaga-lembaga tersebut serta pendekatan yang lebih holistik dalam penegakan hukum dapat membantu memastikan konsistensi dan keadilan dalam sistem hukum Indonesia. Dengan menggunakan kombinasi metode ini, penelitian dapat memberikan pemahaman yang holistik tentang implikasi hierarki hukum dalam konteks pembentukan undang-undang serta penafsiran dan penegakan hukum di Indonesia.

Abstract

Pembentukan undang-undang melalui omnibus law seringkali tidak demokratis, pragmatis, mempersempit ruang partisipasi dan mengabaikan penghormatan terhadap harkat dan martabat manusia, sehingga omnibus law menimbulkan kontroversi. Artikel ini dimaksudkan untuk mengulas cara mengatasi kontroversi dalam pembentukan undang-undang melalui omnibus law. Penelitian ini menggunakan metode penelitian yuridis normatif, dengan pendekatan perundang-undangan, kasus dan perbandingan. Hasilnya menunjukkan: (1) Penerapan pembentukan undang-undang melalui omnibus law berulangkali menjadi kontroversi, utamanya terkait dengan minimnya partisipasi publik. (2) Model partisipasi pada pembentukan undang-undang melalui omnibus law menjadi lebih bermakna apabila dilakukan dengan memberikan kemudahan akses bagi masyarakat. Lebih sempurna jika dilengkapi dengan Sistem Informasi Geografis Partisipasi Publik.

Abstract

Judicial power is independent to administer justice to uphold law and justice. However, the exercise of his powers must not be left uncontrolled. In fact, modern supervision is needed to prevent abuse of power as has occurred. This article seeks new breakthroughs as necessary steps in carrying out external supervision of the behavior of Constitutional Justices. This type of research includes normative juridical with a statutory and conceptual approach. Meanwhile, the analysis used is analytical juridical and described qualitatively descriptively. Research results: (1) steps that can be taken to monitor the behavior of Constitutional Judges by making changes to the 1945 Constitution and/or forming laws; (2) the most appropriate construction of state institutions to supervise the behavior of Constitutional Judges is the Judicial Commission apart from the Financial Audit Agency and the Ombudsman Commission.

Abstract

This research is research based on the world of education which is related to the examination process which is usually related to level advancement carried out at the high school level. This research refers to research on listening tests compared to reading tests on English language arts works. Participants were given two types of input, where previously participants were divided into two groups. Listening test group and reading test group. The listening test group was given the task of listening to audio in the form of a song being played. The reading group was given treatment in the form of being asked to read a text containing the lyrics of the song played to the listening group. This research is quantitative research that uses numerical data in the form of student grades, the analysis uses regression analysis, namely analysis that correlates variables, the analysis tool uses the SPSS application and also ANOVA analysis. As a result, the difference in results from the type of test was not very significant, and it turned out that personality type had no effect on test results or final test scores.

Abstract

Building budget design (RAB) is a way to calculate the costs that will be required from a building and with this cost the building can be realized as planned. In Indonesia, there are methods for planning the unit cost price of project budgets, namely BOW (Burgelijke Openbare Werken) and SNI (Regulation of The Ministry of Public Works and Housing Republic Indonesia Number 1 of 2022 concerning Guidelines for Preparing Estimated Costs of Construction Work in the Field of Public Works and Public Housing) where the SNI method is an adjustment and renewal of the BOW analysis which is an analysis of the legacy of the Dutch Government which contains a labor-intensive and conventional work system. However, the reality in the field is that the BOW method is still widely used for building construction work because the coefficient used is greater than using the SNI method so that it is possible to get a greater profit. This study aims to find out the RAB of the SNI and BOW methods and then find out the difference to be an alternative reference in planning construction costs with the SNI and BOW methods and add insight. In the calculation of the budget plan for concrete work costs for the construction of the UPN Veteran Yogyakarta Integrated Research Laboratory Building using 2 methods, the SNI method was obtained at Rp 9,659,059,280.45 while using the BOW method at Rp 14,474,237,708.85. The difference between the SNI and BOW method budget plans is Rp 4,815,178,428.39.

Abstract

Penelitian ini bertujuan untuk meneliti bagaimana penanganan masalah yang terjadi karena kesalahan dalam melakukan transfer dana. Penelitian ini menggunakan metode penelitian hukum normatif. Data yang dipergunakan akan data sekunder, dalam hal ini Undang-Undang No.3 Tahun 2011 tentang Transfer Dana (UU No.3/2011). Hasil dan analisis penelitian ini menunjukkan bahwa hubungan hukum yang terjadi dari suatu kesalahan transfer merupakan hubungan keperdataan sehingga menimbulkan hak dan kewajiban dari pihak-pihak yang terlibat. Proses penyelesaian salah transfer dapat dilakukan melalui proses mediasi dan kordinasi antara para pihak yang terkait. Bank merupakan pihak yang diberikan kewajiban untuk menyelesaikan salah transfer, sebagaimana diamanatkan dalam ketentuan Pasal 56 ayat (1) UU No.3/2011yang menyatakan bahwa “Dalam hal penyelenggara pengirim melakukan kekeliruan dalam pelaksanaan transfer dana, penyelenggara pengirim harus segera memperbaiki kekeliruan tersebut dengan melakukan pembatalan atau perubahan
