Abstract

This research discusses the role of Islamic law in the formation and interpretation of positive law in Indonesia through a study of the decisions of the Constitutional Court (MK). The main issue raised is the extent to which the principles of Islamic law are accommodated in the national legal system, especially in the process of legislation and judicial review. In a plural legal system like Indonesia, the existence of Islamic law is often faced with the challenge of harmonization with the constitution and the principles of human rights. Therefore, this study aims to examine how the values of Islamic law, such as justice, benefit, and protection of rights, are applied in the jurisprudence of the Constitutional Court and how the normative mechanism of absorption of these values into positive law. The research method used is normative qualitative with a juridical-constitutional approach and analysis of relevant Constitutional Court decisions. Data were obtained from literature studies, documentation of the Constitutional Court's decisions, as well as fiqh literature and Islamic legal theory. The analysis was conducted on sharia principles reflected in the Constitutional Court's decision, including aspects of maqāṣid al-syarī'ah. The results show that the Constitutional Court has selectively integrated Islamic legal values in various decisions, especially those concerning public morals, civil rights, and the Islamic economic system. Although Islamic law is not a formal source of national law, its values have substantially contributed to the formation of positive law and strengthened the ethical and justice dimensions of the Indonesian legal system.

Abstract

The purpose of this study is to determine the validity of the sale and purchase acquisition in evidence in decision number 332/Pdt.G/2024/PN Tnn. The method used in this research is Normative Juridical. The results of this study are that the Panel of Judges to decide the case, the Panel of Judges looks at the facts of the trial from the proof of letters, witness evidence and even other legal facts presented at the trial. Especially in deciding this case with number 332/Pdt.G/2024/PN Tnn, the panel of judges considered that the Plaintiff, who was actually burdened with proof, could not prove the truth about the arguments and claims he presented at the trial. Meanwhile, the Defendant was able to prove so accurately in denying every argument postulated by the plaintiff against the plaintiff through presenting accurate letter evidence and also witness testimony showing that the true ownership of the land that was the object of the dispute belonged to the Defendant. So the judge's consideration in looking at the flow of the trial to decide this case focuses on every evidence and fact of the trial presented by the Defendant. As well as in the burden of proof in Article 163 HIR, the plaintiff has the obligation to prove the facts they submit, while the defendant is obliged to prove the rebuttal submitted. The plaintiff is not required to prove the truth of the defendant's rebuttal, and vice versa, there is no need to prove the truth of the rebuttal.

Abstract

Layanan Pendanaan Bersama Berbasis Teknologi Informasi (LPBBTI) adalah salah satu inovasi pada bidang keuangan dengan pemanfaatan teknologi yang memungkinkan pemberi pinjaman dan penerima pinjaman melakukan transaksi pinjam meminjam tanpa harus bertemu langsung. Mekanisme transaksi pinjam meminjam dilakukan melalui sistem yang telah disediakan oleh Penyelenggara Fintech Lending, baik melalui aplikasi maupun laman website. LPBBTI awalnya disebut Layanan Pinjam Meminjam Uang Berbasis Teknologi Informasi diatur dalam POJK Nomor 77 /POJK.01/2016. POJK Nomor 10 /POJK.05/2022 Tentang Layanan Pendanaan Bersama Berbasis Teknologi Informasi menggantikan POJK Nomor 77 /POJK.01/2016. Pada bulan Desember 2024 terbit POJK Nomor 40 Tahun 2024 tentang Layanan Pendanaan Bersama Berbasis Teknologi Informasi menggantikan POJK Nomor 10 /POJK.05/2022 . Tujuan dari penelitian ini adalah untuk mengetahui, memahami dan menganalisis perlindungan hukum terhadap konsumen LPBBTI. Penelitian ini tergolong jenis penelitian hukum normatif (legal research). Hasil penelitian adalah banyaknya Masyarakat (Konsumen) mengakses produk jasa keuangan termasuk LPBBTI tidak berarti bahwa Konsumen sudah memahami produk dengan baik. Terkait dengan perlindungan konsumen dalam LPBBTI telah diatur dalam POJK Nomor 10 /POJK.05/2022 yaitu mengenai perlindungan konsumen, transparansi penyelenggara, penagihan dan sanksi. Untuk mewujudkan perlindungan konsumen, Penyelenggara wajib menerapkan prinsip: transparansi, perlakuan yang adil, keandalan, kerahasiaan dan keamanan data/informasi konsumen dan penanganan pengaduan serta penyelesaian sengketa konsumen secara sederhana, cepat, dan biaya terjangkau. meskipun POJK Nomor 40 Tahun 2024 tidak secara eksplisit mengatur perlindungan konsumen dalam satu atau beberapa pasal, namun ketentuan-ketentuan yang ada di dalamnya secara implisit menjamin perlindungan konsumen dalam konteks LPBBTI. Perlindungan konsumen dilaksanakan sesuai dengan Peraturan Otoritas Jasa Keuangan mengenai perlindungan konsumen sektor jasa keuangan yaitu POJK Nomor 22 Tahun 2023 Tentang Pelindungan Konsumen dan Masyarakat di Sektor Jasa Keuangan.

Abstract

This study aims to examine the role of the Palangka Raya City Government in preserving customary law based on the Huma Betang philosophy, which represents the cultural identity of the Dayak community in Central Kalimantan. The research employs a normative legal approach using statutory, conceptual, and historical methods. Constitutionally, the preservation of customary law is guaranteed by Article 18B paragraph (2) of the 1945 Constitution of the Republic of Indonesia, which recognizes and respects indigenous law communities along with their traditional rights. At the regional level, the commitment to preserving local cultural values is affirmed through Central Kalimantan Provincial Regulation No. 1 of 2008 concerning Dayak Customary Institutions in Central Kalimantan, which serves as the legal foundation for involving customary institutions in regional development. The findings indicate that the Palangka Raya City Government has made efforts to integrate Huma Betang values into development policies and social life through support for customary institutions, cultural education programs, and preservation activities. However, challenges remain in terms of policy synchronization, comprehensive community involvement, and the internalization of cultural values amid the current of modernization. Strategic steps are needed through cross-sector collaboration and the strengthening of regional regulations to ensure the sustainability of customary legal values within an inclusive and sustainable development framework.

Abstract

Abstract: Law No. 11 of 2012 concerning the juvenile penal system faces challenges in immoral crimes. Article 1 paragraph (3) of the SPPA Law states that children who have not reached the age of 12 cannot be submitted to formal legal proceedings, but returned to their parents or referred to social institutions. Children who have become perpetrators of immoral acts committed by children under the age of 12 (twelve) years are under the supervision of negligent parents, so the author argues that by returning the child perpetrator to his parents, he is worried that he will repeat his act. This research is written normatively from library materials such as books, literature, journals and websites for the research to be discussed. The data analysis in this study is qualitative, meaning that it is based on the relevance of the data to the problem, not the quantity of (quantitative) data. Based on the results of the study, a larger effort to address children's social problems in Indonesia is to develop an interdisciplinary network that includes social institutions or services, law enforcement officials, and other related organizations in an effort to protect children. ABH (Children Facing the Law) rehabilitation is intended for children who have not reached the age of 12 years, who have committed or are suspected of committing criminal acts, and are undergoing legal proceedings at the level of investigation, prosecutor's office, or police. ABH rehabilitation is expected to be able to carry out its role, fulfill children's rights, solve problems, develop self-actualization and potential, and create a social environment that supports ABH's success in reintegrating into society with excellent learning and playing conditions like children of their age.

Abstract

To build a strong character within Indonesian society, particularly in the higher education environment, through the implementation of religious moderation today, it requires the involvement and collective commitment of the entire academic community, including lecturers, students, and educational staff. The implementation of religious moderation has a strong legal foundation, as it aims to prevent the spread of radicalism and extremism ideologies that are contrary to Indonesian laws and regulations, such as Law Number 12 of 2022 concerning Criminal Acts of Terrorism, as well as other legal provisions that prohibit actions threatening national security and the integrity of the Unitary State of the Republic of Indonesia (NKRI). This effort is carried out through the strengthening of national commitment based on the four national pillars: Pancasila, the 1945 Constitution, the Unitary State of the Republic of Indonesia (NKRI), and Bhinneka Tunggal Ika, all of which possess legal legitimacy as the foundation of national and state life. Secondly, the strengthening of attitudes of tolerance and respect for differences is pursued in accordance with the principles of human rights law guaranteed by the constitution, particularly Articles 28E and 28I of the 1945 Constitution. Thirdly, fostering a way of religious practice that respects the traditions and local cultures of Indonesia’s diverse society also reflects the protection of cultural rights within the framework of national law. The method used in this research is a qualitative method with a literature study approach, which enables the exploration of various legal instruments and government policies related to religious moderation in the higher education environment

Abstract

Perkembangan teknologi finansial telah melahirkan berbagai inovasi layanan keuangan digital, salah satunya adalah aplikasi Buy Now Pay Later (BNPL) yang memungkinkan konsumen membeli barang atau jasa dengan pembayaran tertunda. Meskipun menawarkan kemudahan, penggunaan BNPL juga berpotensi menimbulkan risiko bagi konsumen, seperti bunga tersembunyi, denda keterlambatan, dan penyalahgunaan data pribadi. Penelitian ini bertujuan untuk menganalisis bentuk-bentuk perlindungan hukum yang tersedia bagi konsumen pengguna BNPL, serta mengevaluasi efektivitas regulasi yang mengatur layanan tersebut di Indonesia. Metode penelitian yang digunakan adalah pendekatan hukum normatif dengan memanfaatkan kerangka regulasi dan kajian pustaka. Temuan penelitian menunjukkan bahwa perlindungan konsumen dalam layanan BNPL belum sepenuhnya optimal karena belum adanya regulasi khusus yang mengatur skema BNPL. Namun, perlindungan sementara dapat ditemukan dalam Undang-Undang Perlindungan Konsumen, Undang-Undang Informasi dan Transaksi Elektronik, serta regulasi dari Otoritas Jasa Keuangan dan Bank Indonesia. Konsumen dilindungi dalam hal hak atas informasi, data pribadi, dan penyelesaian sengketa. Disarankan agar pemerintah memperkuat regulasi, penyedia BNPL bersikap transparan dan akuntabel, serta konsumen lebih berhati-hati dalam menggunakan layanan.

Abstract

Carbon trading as an instrument for climate change mitigation has been regulated through national policies and international frameworks (the 1997 Kyoto Protocol, the 2015 Paris Agreement, and Presidential Decree No. 98 of 2021), but to date there are no official Islamic jurisprudence guidelines guiding Islamic economic actors in carbon transactions. The absence of a fatwa from the National Sharia Council (DSN-MUI) has created legal uncertainty, with concerns about usury, gharar, and speculation, leading to the underutilization of the potential of Islamic green financing. This article aims to formulate a framework for carbon trading fatwas that aligns with the objectives of the maqashid al-shari'ah (environmental preservation), 'adl (justice), and the prohibition of gharar/usury. The method used is a juridical-normative approach with a literature review of conventional regulations, mu'amalah fiqh fatwas, and classical (al-Shatibi) and contemporary (Yusuf al-Qardhawi, Ali Yafie) thought. The results of this research are a draft fatwa framework governing the contract scheme, Measurement-Reporting-Verification mechanisms, and the roles of regulators and business actors in Sharia-compliant carbon trading. This framework is expected to serve as a reference for the National Sharia Council (DSN-MUI) and policymakers to strengthen legal certainty and encourage green investment in the Islamic economy. Implications of the research include recommendations for fatwa implementation, the development of Sharia-compliant carbon market instruments, and directions for future empirical research.

Abstract

Abstract: This research discusses the critical issue of marital rape in Indonesia, a form of sexual violence within households that persists despite being criminalised by the Domestic Violence Law (UU PKDRT) and the Sexual Violence Crimes Law (UU TPKS). The rising number of case reports indicates a gap between legal provisions and public perception, which is still influenced by social, cultural, and religious values. This study, which is, examines public legal awareness and the role of these values in viewing the criminalisation of marital rape, using a comparative approach between urban and rural areas. Using a juridical-empirical method, data was collected through questionnaires from 49 respondents in the city of Palangka Raya and several surrounding villages, then analysed using the approaches of legal positivism, legal realism, and natural law theory. The findings reveal a significant gap between the recognition of the term 'marital rape' and the understanding of its substantive legal aspects, particularly in rural areas. A strong patriarchal mindset was evident, with the majority of respondents rejecting bodily autonomy within marriage. Social values (57.1%) were identified as the primary influencing factor, surpassing religion (37.7%) and culture (6.1%). This study concludes that the mere presence of law is insufficient; a holistic approach that integrates massive education and cultural reconstruction is essential to align societal values with legal norms and ensure effective protection for victims. Keywords: Rape, Marriage, Criminalisation, Legal Awareness Abstrak Penelitian ini membahas mengenai isu kritis marital rape di Indonesia, yaitu bentuk kekerasan seksual dalam rumah tangga yang masih berlangsung meski telah dikriminalisasi oleh UU PKDRT dan UU TPKS. Meningkatnya laporan kasus menunjukkan kesenjangan antara ketentuan hukum dengan persepsi masyarakat yang masih dipengaruhi oleh nilai sosial, budaya dan agama. Studi ini menganalisis kesadaran hukum masyarakat dan peran nilai-nilai tersebut dalam memandang kriminalisasi marital rape secara komparatif di wilayah perkotaan dan pedesaan. Dengan metode yuridis-empiris, data dikumpulkan melalui kuesioner terhadap 49 responden di wilayah Kota Palangka Raya dan beberapa desa disekitarnya, lalu dianalisis dengan pendekatan teori positivisme hukum, realisme hukum, dan hukum alam. Temuan mengungkapkan kesenjangan besar antara pengenalan istilah marital rape dengan pehaman hukum substantif, khususnya di daerah pedesaan. Pola pikir patriarki yang kuat terlihat dari mayoritas responden yang menolak otonomi tubuh dalam perkawinan. Nilai sosial (57,1%) terindentifikasi sebagai faktor pengaruh utama, mengungguli agama (37,7%) dan budaya (6,1%). Studi ini menyimpulkan bahwa kehadiran hukum tidak cukup; diperlukan pendekatan holistik yang mengintegrasikan edukasi masif dan rekonstruksi budaya sangat penting untuk menyelaraskan nilai masyarakat dengan norma hukum dan menjamin perlindungan yang efektif bagi korban. Abstract

The background of this thesis is the implementation of the right to accessibility for public facilities in Palangka Raya City based on Law Number 8 of 2016 concerning Persons with Disabilities. This study uses a qualitative approach involving primary and secondary data. Primary data was collected through interviews with relevant parties, such as persons with disabilities and local governments. Secondary data was obtained through document and literature studies. The results of the study indicate that the implementation of the right to accessibility for public facilities in Palangka Raya City still faces several obstacles. One significant obstacle is the lack of public awareness and understanding of the importance of accessibility for persons with disabilities. This has resulted in a lack of attention in the planning and construction of disability-friendly public facilities. In order to improve the implementation of the fulfillment of the right to accessibility in public facilities, several recommendations are proposed. First, the Palangka Raya City government needs to increase public awareness through more intensive educational campaigns. Second, adequate budget allocation must be prioritized for the construction and maintenance of accessibility facilities. Third, clear regulations and strict law enforcement must be consistently applied. Fourth, the active involvement of persons with disabilities in planning and evaluation is a crucial step to ensure better fulfillment of the right to accessibility. With better implementation and support from the government and the community, it is hoped that the fulfillment of the right to accessibility in public facilities in Palangka Raya City will improve, creating an inclusive environment, and providing equal opportunities for persons with disabilities.
