Abstract

Motor Vehicle Tax (Pajak Kendaraan Bermotor/PKB) is a major source of regional revenue in Indonesia. However, the current administrative mechanism for determining the Motor Vehicle Sales Value (Nilai Jual Kendaraan Bermotor/NJKB) fails to adequately reflect the economic depreciation of vehicles, creating potential distributive injustice in tax assessment. This study examines the synchronization of PKB regulations, identifies inconsistencies between the administratively determined NJKB and actual market value, and develops a regulatory reconstruction model based on Hans Kelsen’s theory of the hierarchy of legal norms and John Rawls’s theory of distributive justice. Using a normative legal methodology with statutory, conceptual, and comparative approaches, the study finds that substantive regulatory inconsistencies remain despite formal legal synchronization. It proposes a Distributive Justice-Based Synchronization Model that strengthens statutory norms, adopts market-responsive depreciation, harmonizes implementing regulations, and promotes a fairer, more legally certain regional tax system.

Abstract

The rapid advancement of digital technology has increased children’s involvement in cybercrime as both victims and offenders, creating challenges for Indonesia’s juvenile justice system. This study examines the legal framework governing juvenile cybercrime, evaluates law enforcement practices at the Surakarta District Court, and proposes an adaptive child-centered justice model. Using an empirical legal method with a socio-legal approach, the research analyzes legislation, court decisions, documentary evidence, and semi-structured interviews with law enforcement officials. The findings reveal incomplete harmonization among the Electronic Information and Transactions (EIT) Law, the Juvenile Criminal Justice System Law, and the Child Protection Law, limiting the effective implementation of diversion and restorative justice. Persistent normative, institutional, technical, and sociological barriers further reduce enforcement effectiveness. The study concludes that regulatory harmonization, stronger institutional capacity, modern digital infrastructure, and an integrated child protection ecosystem are essential for an effective juvenile cyber justice system.

Abstract

The unilateral cancellation of marriage following engagement may cause significant legal harm because Indonesian law does not explicitly regulate pre-marital legal relationships. This study examines the legal consequences of such cancellations and evaluates the effectiveness of existing legal protection under Law No. 1 of 1974 on Marriage, as amended by Law No. 16 of 2019, Articles 58 and 1365 of the Indonesian Civil Code, relevant legal doctrines, and judicial precedents. Using a normative legal research method with statutory, conceptual, and case approaches, the study analyzes primary, secondary, and tertiary legal materials. The findings indicate that unilateral cancellation following engagement constitutes a tort by causing economic, non-economic, social, psychological, and cultural harm. The current legal framework remains predominantly remedial, creating legal uncertainty. Therefore, regulatory reform is needed to establish integrated preventive and remedial legal protection for affected parties.

Abstract

The fulfillment of inmates’ communication rights is a fundamental aspect of human rights protection within Indonesia’s correctional system under Law No. 22 of 2022 on Corrections. This study examines the legal basis and implementation of the Special Correctional Telecommunications Service (Warung Telekomunikasi Khusus Pemasyarakatan or Wartelsus) at the Class I Surabaya Correctional Institution. Using an empirical legal research design with a socio-legal approach, data were collected through observations, semi-structured interviews, document analysis, and a review of relevant legal literature. The findings indicate that Wartelsus has been implemented in accordance with statutory regulations through standardized procedures, effective supervision, and equitable access policies, including complimentary communication vouchers for economically disadvantaged inmates. The study concludes that Wartelsus effectively safeguards inmates’ communication rights while supporting rehabilitation, social reintegration, institutional security, and the broader protection of human rights within Indonesia’s correctional system.

Abstract

Motorcycle gang violence involving children poses significant challenges to law enforcement and child protection in Indonesia. This study examines the legal handling of child offenders by the Sukoharjo Regional Police, evaluates the implementation of diversion and restorative justice, and identifies obstacles to effective law enforcement. An empirical legal method with a qualitative approach was employed using interviews, document analysis, and a review of relevant legal materials. The findings indicate that investigations are conducted in accordance with Law Number 11 of 2012 on the Juvenile Criminal Justice System, ensuring the participation of parents, legal counsel, and Community Guidance Officers while prioritizing diversion whenever statutory requirements are satisfied. However, implementation remains constrained by evidentiary difficulties, collective offending, peer and social media influences, inadequate parental supervision, and unsuccessful diversion agreements. Effective juvenile justice therefore requires integrated legal, preventive, and rehabilitative strategies.

Abstract

Fatal traffic accidents involving alcohol consumption raise significant questions regarding criminal liability, particularly because Indonesian law lacks an objective standard for Blood Alcohol Concentration (BAC) and does not consistently distinguish between culpa (negligence) and dolus eventualis (eventual intent) in determining driver culpability. This study examines the relationship between alcohol-induced impairment and criminal responsibility, identifies the normative and evidentiary problems arising from the absence of a standardized BAC threshold, and proposes a more consistent and equitable framework for determining criminal liability. The study employs a normative juridical method using statutory, conceptual, medico-legal, and case-based approaches, with an analysis of ten judicial decisions. The findings demonstrate that alcohol intoxication does not automatically preclude criminal liability. However, the absence of a standardized BAC threshold creates evidentiary uncertainty and contributes to inconsistencies in judicial decision-making. The study concludes that a more coherent framework should integrate the doctrine of actio libera in causa, mens rea analysis, medico-forensic evidence, and sentencing guidelines to strengthen legal certainty, promote consistency in judicial reasoning, and ensure effective protection of victims.

Abstract

The development of Food, Energy, and Water Self-Sufficiency Areas in South Papua may conflict with the ulayat rights of customary law communities that continue to exist and have been exercised across generations. This study aims to analyze the protection of ulayat rights and to formulate an appropriate legal protection model. It employs a normative legal research method using statutory, conceptual, and historical approaches. The findings indicate that ulayat rights are recognized under the Constitution, agrarian law, and Papua’s Special Autonomy framework, but their implementation continues to face challenges concerning territorial recognition, community consent, land use, and project oversight. Legal protection must therefore operate from the planning stage through restoration by incorporating the mapping of customary territories, community consent, legal certainty regarding land use, benefit-sharing, monitoring, dispute resolution, and environmental restoration. This model is necessary to ensure that development can proceed without severing the relationship between customary law communities and the land and natural resources that constitute their living territories.

Abstract

This study analyzes the legal certainty of registering land subject to the hak ulayat of customary law communities following the enactment of Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency No. 14 of 2024. It employs normative legal research using statutory and conceptual approaches. The primary legal materials consist of legislation and judicial decisions, while the secondary legal materials comprise relevant literature and research findings. The study finds that ATR/BPN Ministerial Regulation No. 14 of 2024 establishes a multi-tiered framework for the administration and registration of Tanah Ulayat through inventory and identification, surveying and mapping, recording in the Daftar Tanah Ulayat (Customary Land Register), and optional registration as Hak Pengelolaan (Right of Management) for a Kesatuan Masyarakat Hukum Adat or as Hak Milik (Right of Ownership) over collectively held land for a Kelompok Anggota Masyarakat Hukum Adat. This framework strengthens legal certainty regarding the legal subject, land object, procedures, and legal consequences of registration. However, such certainty remains affected by the formal recognition of customary law communities, potential overlapping claims to land, and communities’ access to land administration. The study concludes that legal certainty concerning Tanah Ulayat must integrate administrative and substantive legal certainty so that registration does not diminish the communal character of customary tenure, the authority of customary institutions, or the continuing applicability of customary law.

Abstract

Changes in mining policy under Law Number 3 of 2020 introduced a priority mechanism for granting Mining Business License Areas (WIUP) alongside the auction system. This policy raises constitutional issues concerning limitations on equal opportunity principles and potential deviations from the state's right of control. This normative legal research analyzes the legal construction of priority WIUP allocation and evaluates its constitutionality based on the State's Right of Control standards articulated in Constitutional Court Decision Number 36/PUU-X/2012. The findings indicate that granting priority without measurable merit criteria risks reducing the constitutional essence of state control intended for the greatest prosperity of the people. This study formulates constitutional criteria for priority WIUP allocation, comprising legitimate affirmative purposes, technical and financial capacity, transparency, and continuous oversight, ensuring that such preference remains aligned with the principles of fair legal certainty.

Abstract

This study analyzes legal protection and equitable carbon benefit sharing for customary forest holders within forestry-sector carbon trading under Presidential Regulation No. 98 of 2021 and Minister of Environment and Forestry Regulation No. 7 of 2023. It employs normative legal research using statutory, conceptual, and case approaches. The findings show that customary law communities holding a formal determination of customary forest status are recognized as actors in carbon trading, although such protection operates through conditional inclusion due to reliance on administrative formalization. Furthermore, tenure rights over customary forests do not automatically confer ownership of tradable Carbon Units. Regarding benefit sharing, current regulations mandate free, prior, and informed consent (Padiatapa), agreed benefit-sharing plans, reporting, evaluation, and grievance mechanisms, yet fail to establish substantive parameters to evaluate equitable distribution. To ensure comprehensive legal protection and substantive justice, this study proposes a rights-and-contribution-based carbon benefit-sharing framework built on four core parameters: recognition, consent, contribution, and distribution.
