Abstract

In carrying out the main task of maintaining domestic security and public order, the Police are required to anticipate disturbances in Kamtibmas (public security and order). The preferred service pattern is the pre-emptive and preventive strategy to anticipate anarchic rallies and prevent them from spreading. In facing the 2024 Election, the readiness of equipment of the Dalmas unit of the Samapta and PHH unit of the Brimob, both individually and collectively, needs to be evaluated, to what extent the equipment of the Dalmas and PHH in the area is adequate both in quantity and quality. This research uses a mixed method which is a combination of quantitative and qualitative methods with a total of 2,635 respondents. From the results of research and analysis, it can be concluded that the real condition of the Dalmas and PHH equipment in terms of quantity is still quite adequate. However, there are some equipment that needs to be added, especially for units that often face crowds. The equipment that needs to be added are shields, helmets, batons, smooth bore weapons, and tear gas. In terms of material quality, some of the equipment deployed in the field were found to be cracked, broken, loose, and soaked, such as smooth bore weapons, helmet glass, and shields. In addition, an improvement in the quality of equipment used for the preparation of securing the 2024 Election or other situations is necessary. This improvement is needed for the comfort and protection of personnel themselves when facing or colliding with the public. Therefore, it is concluded that there is a need to add equipment and improve the quality of materials in the Dalmas and PHH equipment to improve the quality of the equipment in maintaining domestic security and public order.

Abstract

This study aims to conduct a policy evaluation in selecting the main tool for the National Police in the form of airplanes using TOPSIS. Quantitative was chosen as the methodological choice using seven steps in the Technique of Order Preference by Similarity to Ideal Solution (TOPSIS) method. The data collection strategy was carried out by reviewing the aircraft documents to be selected and determining the criteria to be used. The data analysis technique is to use data processing in excel using the formula contained in the seven steps of the Technique of Order Preference by Similarity to Ideal Solution (TOPSIS) which is then included in the formula for each cell. Based on the analysis with the Technique of Order Preference by Similarity to Ideal Solution (TOPSIS), the results obtained were based on the calculation of the preference value (V), it was found that the largest preference value was 0.88. The ranking results show that the first order is the Boeing B737-900ER, the second is the Boeing B737-800, the third is the Airbus A-320 and the fourth is the Boeing 737-500. This shows that the most appropriate type of aircraft to choose is the Boeing B7373-900ER

Abstract

From a public complaint perspective, according to the Ombudsman, the Indonesian National Police is one of the public service delivery agencies that "subscribes" to complaints. In fact, in the last few years Polri has always been in the top 8 to 5 nationally as the institution with which the most complaints have been made. To overcome this, the National Police Chief, General Listyo Sigit Prabowo, included 5 priority programs related to public services and handling public complaints among the 16 National Police Chief Priority Programs. Then on February 24, 2021 the National Police Chief also launched the Dumas Precision application and to further emphasize the importance of cross-functional and sectoral cooperation and synergy regarding handling public complaints, the Indonesian National Police Chief issued a Chief of Police Circular Number: SE/5/II/2021 dated February 24, 2021 concerning the National Police System. Information on Integrated Community Complaint Handling within the National Police. This research was conducted in 11 Polda and 54 Polres. Data collection was carried out by distributing questionnaires to people who had made complaints to the National Police and Dumas operators, FGD with key officials at the Polda and Polres, as well as FGD with operators of public complaint services. The results of the study show that the responsiveness, trustworthiness, transparency and accountability of public complaint services by the Police are at a moderate level. There are still many personnel, both in Polda and Polres, who do not understand the concept of the Integrated Dumas Service Center (SPDT) and its implementation. The majority of Polri personnel who were complained about/didumas complained about the occurrence of repeated examinations/holdings of cases with the same case, both by internal and external parties. In fact, many personnel still have to undergo inspections, even though the handling of the Dumas has been completed

Abstract

Law is essentially a system of human life in society and state. In the criminal criminal system, the police institution is a state instrument that plays a role in maintaining security and protecting the community, enforcing the law, and providing protection, protection and services to the community in order to maintain domestic security. The effect of the criminal criminal process on the sense of justice and the benefits of law for the community in handling cases is not yet optimal, which has encouraged law enforcement agencies, especially the police, to look for alternative case resolution solutions to the existing criminal criminal system by resolving cases outside of court, the method in question is by means of mediation as entertainment from restorative justice so that it is necessary to think about resolving criminal cases through the Alternative Dispute Resolution route (ADR. The National Police Research and Development Center carried out this research using a qualitative approach and secondary data collection. Respondents and informants consisted of internal and external Polri. Internal Polri consisted of Regional Police Officers , Polres, as well as related Polres members. Externally, the Polri are Community Leaders, Religious Leaders, Traditional Leaders, Youth Leaders, Government Agencies (Kesbangpol), and NGOs/Ormas. The results of the research state that: the implementation of restorative justice requires socialization of Perpol Number 8 2021 concerning Restorative Justice; coordination between functions has not been implemented optimally because cross-functional knowledge transfer has not occurred; cross-functional and stakeholder coordination activities need to be optimized; training in the ability to detect, identify and solve security and community welfare problems must be carried out on an ongoing basis; Technical direction is needed to emphasize that investigators are not directly involved in the peace process between the perpetrator and the victim; The need to increase publication of criminal handling based on restorative justice; It is necessary to regulate the time limit for the process from investigation to fingerprints to speed up the restorative justice process.

Abstract

Restorative justice is a growing justice concept being adopted worldwide. The Indonesian National Police and Attorney General have created regulations to ensure legal certainty of its application. However, their implementation has faced a number of impediments. Scotland has been making similar efforts to adopt restorative justice practices. Meanwhile, the implementation of this initiative is supported not just by legislative provisions but also by a thorough action plan. As a result, this study compares Indonesia's progress towards the adoption of restorative justice to Scotland's ongoing efforts in the same arena. This research uses qualitative methodology involving literature review, examination of socio-legal phenomena, and inductive reasoning to draw conclusions. The study's findings show that both Indonesia's police-led conferencing and Scotland's practitioner-led conferencing have advantages and drawbacks. However, Scotland's restorative justice has more involvement in community reconciliation after the conference than Indonesia's pursuit of crime clearance. Furthermore, while both jurisdictions show favourable support in the implementation of restorative justice, Indonesia emphasises macro-level criminal policy and resource conservation, while Scotland emphasises micro-level results like fewer re-offending and victim satisfaction.

Abstract

The concept of causality in criminal law is a fundamental element that determines the relationship between actions and consequences, which is essential in upholding criminal responsibility. The cyanide coffee poisoning case involving Jessica Wongso and Mirna Salihin highlights the complexity of applying the theory of causality, where the interaction between personal motives and actions leads to fatal consequences. This research aims to delve into the application of causality theory in criminal law in the case of cyanide-laced coffee poisoning involving Jessica Wongso and Mirna Salihin. The research method used is content analysis by referring to relevant literature sources related to causality theory in criminal law. The results of the study indicate that the concept of causality law becomes the main focus in determining criminal responsibility, where the importance of an action as a cause of a consequence that violates legal norms is the main concern in the analysis and assessment of the relevant actions. In the context of the cyanide-laced coffee poisoning case, the analysis of causality law using the Social Explanation method provides a deep understanding of the application of causality theory in criminal law. Thus, this research provides in-depth insights into the concept of causality in the realm of criminal law, especially in cases involving the infamous poisoning incident and cyanide elements.

Abstract

This paper explores the application of predictive policing in Indonesia, to overcome challenges such as large geographic areas, uneven population distribution, and insufficient police numbers to handle a large population. Predictive policing involves collecting and analyzing data to anticipate and prevent crime. The study identified issues such as disproportionate police to population ratios, unequal distribution of society, high crime rates, and low utilization of police resources. Using a qualitative approach, especially realist ethnographic studies and action research, this research aims to assess the feasibility and implementation of predictive policing in Indonesia. By combining an in-depth qualitative approach with an understanding of institutional infrastructure and current technology, this study provides valuable new insights into the implementation of predictive policing in Indonesia. The benefits of this research include theoretical contributions to police science and practical insights for future studies of predictive policing in the police. Analyzing crime data from 2018 to 2020 shows a decline in crime rates nationally, but regional variations. The decision-making bureaucracy in the Indonesian National Police is described by emphasizing a centralized system. This paper explores current applications of predictive policing, and highlights the role of intelligence reports. Despite declining crime rates, the study concludes that predictive policing faces challenges in considering qualitative research and a lack of comprehensive data. This paper calls for future discussions regarding predictive policing, technology integration, and Big Data program development to increase accuracy and effectiveness in Indonesia.

Abstract

General elections are a fundamental pillar of Indonesia's democratic system, conducted periodically. Each stage of the elections holds the potential to disrupt public safety and order with varying degrees of escalation. The Indonesian National Police (Polri), as the frontline guardian of the electoral process, faces significant challenges in ensuring its security. Chief of the Indonesian National Police, General Listyo Sigit Prabowo,M.Si. supports precision policing by planning the security for the 2024 general elections and regional elections (Pilkada) through budget allocation, personnel deployment, as well as facilities and infrastructure. In the context of facilities and infrastructure, Polri's radio communication equipment becomes one of the operational support systems for Polri in securing upcoming elections. Through a comprehensive, reliable, and effective communication network, along with suitable communication devices, Polri is able to carry out its tasks more efficiently and swiftly. This research aims to identify and analyze the quality of the currently deployed Polri radio communication equipment, as well as to analyze the conditions, quantity, and functions of its deployment. The methods used involve both qualitative and quantitative approaches, with data collected through in-depth interviews, observations, checklists, and questionnaires. The research findings reveal that the distributed Polri radio communication equipment across 10 regional police departments (Polda) consists of both conventional and trunking communication systems. From technological and security aspects, Polri's radio communication equipment has adequately met operational requirements, providing support for security and operational tasks. However, challenges exist in the form of malfunctions in Handy Talky devices and repeaters. Furthermore, in operating the communication equipment, there are deficiencies in knowledge, experience, and maintenance. Administrative constraints and the availability of spare parts also need attention in the maintenance of Polri's radio communication equipment.

Abstract

Research of public trust in the performance of the National Police aims to measure the level of public trust in the performance of operational functions, namely Binmas, Intelkam, Lalu lintas, Criminal Investigation and Sabhara. This research uses quantitative and qualitative methods. The quantitative method used survey and the qualitative method used Focus Group Discussion. The results show Public Trust Index is 85.77 in the Very Good category. Binmas: 84.16; Intelkam: 87.10; Lantas: 83.83; Reskrim: 86.67; and Sabhara: 87.08. The regression results of the questionnaire data that influence each function are categorized as; a) superior, b) improvement, c) improvement. Diversity public perceptions and expectations shows that public is very enthusiastic about the service programs provided, such as: Bhabinkamtibmas approach, improving technological facilities and infrastructure, increasing cybercrime investigation capabilities, and patrolling vulnerable areas. Meanwhile, the police's internal perspective has also made breakthroughs and service innovations, such as: optimizing the Police presence in living environment, applying technology in operational services, and forming special teams for crime control. However, there are still obstacles for Polri in providing excellent service to community, limited technological facilities and infrastructure in the region, the lack of a culture of orderly community traffic, and the limited quality of human resources for investigators. Therefore, the recommendations given are adjusted from the results of regression tests in each function, namely 1)taking steps to maintain superior category services, 2)taking steps to improve category services that need to be improved, and 3)taking steps to steps to revitalize services that need improvement.

Abstract

Increasing development of society gives rise to various social changes which can take the form of changes to norms, regulations and habits. The impacts of social change is emergence of street crime and thuggery which can become a potential threat. Actions of thuggery can be carried out by small groups, as well as large groups. One of the National Police's programs is the eradication of thugs and acts of thuggery which is a follow-up to the National Action Plan. Therefore, Puslitbang Polri needs to conduct research on "Strengthening the Eradication of Street Crime and Actions of Thuggishness" that can be used in making policies. This research uses qualitative and quantitative methods. Respondents consisted of community and staff. The results stated: 1)The most types of street crime and acts of thuggery are theft, robbery, illegal racing and mugging; 2)In 2 out of 10 respondents have been victims of street crime and acts of thuggery; 3)The victims of street crime and acts of thuggery were those with low income levels; 4)Respondents agree that community participation is very necessary to assist in the detection and early warning; 5)Majority respondents agree that police patrols have a significant impact on reducing street crime and thuggery; 6)The community expects the police quickly come in scene of the crime and prosecute the perpetrators of street crimes and thuggery; 7)The partnership between Police and community has an important role in early detection and warning efforts in realizing strengthening the eradication of street crime and acts of thuggery.
