Abstract

Children's rights should be treated differently from adults, especially in vulnerable situations such as after a disaster. In some cases, the fulfillment of children's rights is often neglected due to the chaotic situation because the parties involved are still busy revitalizing the affected areas and meeting the needs of other vulnerable groups. This study is a normative study by examining children's rights after the disaster in several international and national regulations. The study results show that both the Convention on the Rights of the Child and Law Number 35 of 2014, which has been amended by Law Number 23 of 2002, clearly state the protection of children, including in the event of a disaster. However, the Disaster Management Law not detail the protection and fulfillment of children's rights specifically and still places children as beneficiaries, not as actors whose aspirations must be heard.

Abstract

Illegal retrieval of flying fish eggs in the waters of Southeast Maluku has a negative impact on sustainable capture fisheries activities. This study aims to analyze the criminal policy of using flying fish eggs in the waters of Southeast Maluku. The research method used is normative juridical research. Assisted with a social legal approach. The data sources used are secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials. The data was collected by means of a literature study, then analyzed qualitatively. The exploitation of flying fish eggs carried out by fishermen from the provinces of South Sulawesi and Southeast Sulawesi is illegal. There has been a memorandum of understanding (MoU) between the Maluku government and the South Sulawesi government but there has been no follow-up in the form of a cooperation agreement (PKS) between the two regional governments. As for the Regional Government of Southeast Sulawesi, there is no MoU and there is also no PKS with the Regional Government of Maluku. Likewise with the Regent and Mayor Regulations which essentially prohibit fishermen from outside from entering the surrounding area, due to the Covid-19 pandemic. There needs to be a policy to overcome the exploitation of flying fish eggs. Either by using penal means (criminal law) or by using non-penal means (non-criminal law). There needs to be community participation through Pokmaswas, outreach to the community, and guidance to fishermen who use flying fish eggs.

Abstract

Diskriminasi terhadap ras dan etnik rentan terjadi di berbagai negara, tidak terkecuali di Indonesia. Indonesia Memiliki UU Penghapusan Diskriminasi Ras dan Etnis untuk menangani masalah tersebut, namun demikian hingga saat ini masih banyak kasus rasisme yang terjadi di Indonesia hal ini tentunya tidak sesuai dengan ideologi dan jiwa bangsa kita Pancasila. Artikel ini membahas mengenai bagaimana upaya untuk menangani Diskriminasi Rasial dengan menggunakan Kebijakan Hukum Pidana dan penguatan nilai-nilai Pancasila. Metode Penelitian yang digunakan dalam artikel ini adalah Yuridis Normatif, dengan bersifat deskriptif analitis dan menggunakan data sekunder. UU Penghapusan Diskriminasi Rasial sudah mengatur mengenai kebijakan Hukum pidana dengan semangat Pancasila, namun demikian masih banyak catatan yang perlu diperbaiki oleh pemangku kepentingan utamanya penegak hukum, diperlukan dialog dengan para pihak terkait supaya dapat mereformasi hukum untuk penanganan diskriminasi rasial yang baik ini tentunya dengan mengutamakan nilai-nilai Luhur Pancasila dalam formulasi kebijakan hukum pidananya.

Abstract

Terrorism has become a worldwide concern since the events of September 11, 2001, in the United States, in addition to the Bali bombings in Indonesia in 2002 and the bombings at Davao City airport in 2003. The broad impact of terrorism has caused Indonesia and the regional countries of Southeast Asia to feel very interested in actively participating in solving this problem. Forums for discussion and cooperation in the fight against terrorism have also arisen in the Southeast Asian region, such as the ASEAN Ministerial Meeting on Transnational Crime (AMMTC), which is a meeting forum within ASEAN to discuss issues of transnational crime. The purpose of this document is to examine and discuss the legal aspects of international cooperation in efforts to combat criminal acts of terrorism. The method that the researcher uses is a normative method, which uses a statutory approach, a case approach, and a conceptual approach. The technique of collecting legal materials used is by reviewing, identifying, and classifying primary and secondary legal materials based on library research. Then, the researcher describes qualitative description. Terrorism is all forms of actions and attitudes that are directly implemented against a country with the aim of creating terror against certain persons, groups, individuals, or the wider community. International cooperation between countries in order to maintain security against counter-terrorism crimes in ASEAN is necessary for achieving dynamic peace and stability while still prioritizing Indonesia's national interests which will also support the creation of an ASEAN Community in 2015 which consists of three mutually supportive principles, including the political-security community, the economic community, and the social and cultural community. The legal aspects of international cooperation between countries in efforts to combat terrorism include preventive, preventive, and repressive measures.

Abstract

Corruption is a common enemy that must be eradicated by Indonesia in order to achieve a just and prosperous life. The Indonesian government has made various efforts to eradicate corruption and save state finances. Various products of legislation, institutions, special teams and commissions have been formed by the government to combat corruption to its roots in order to save the economy and state finances. However, corruption is still a problem as an inhibiting factor for the country's economic development. The research was conducted using a normative juridical method with a statute approach and a conceptual approach. Eradication of criminal acts of corruption as an extraordinary crime, because it is serious, systematic and structured, should also be carried out in an extraordinary manner. Extraordinary eradication of criminal acts of corruption is carried out through extraordinary duties and authorities of the Corruption Eradication Commission (KPK), through investigations, investigations and prosecutions carried out in an extraordinary manner by the Corruption Eradication Commission (KPK), development of international cooperation in the context of mutual legal assistance, investigations joint and extradition treaty.

Abstract

Korupsi yang terus melanda Indonesia pada umumnya dan Provinsi Maluku pada khususnya, bukan lagi merupakan masalah hukum semata akan tetapi sudah menjadi masalah sosial-budaya, ekonomi, bahkan masalah kemanusiaan. Provinsi Maluku dengan karakteristik wilayah kepulauan juga ikut mengalami dampak perbuatan korupsi selama ini, di mana hampir sebagian para pejabat baik di daerah kabupaten/kota maupun propinsi terlibat sebagai pelaku bersama-sama dengan pihak swasta. Kasus korupsi terhadap pengelolaan dana desa cukup signifikan, bahkan tersebar diberbagai kabupaten/kota, umumnya modus operandi didominasi oleh penyalahgunaan wewenang dengan cara mengalokasikan dana untuk kegiatan lain sementara pertanggungjawaban disesuaikan dengan Rencana Anggaran Belanja Desa. Tujuannya adalah untuk menganalisis polarisasi tindak pidana korupsi dana desa di wilayah kepulauan. Penelitian ini menggunakan penelitian hukum empiris. Hasil yang diperoleh adalah pola korupsi merupakan sebuah model perilaku yang dilakukan dengan akal bulus untuk menutupi perbuatan keserahakan guna mencari keuntungan diri sendiri datau orang lain. Pola-pola korupsi ini lebih berisikan tentang motif dan modus operandi tindak pidana yang merugikan keuangan negara dan perekonomian korupsi dana desa dan alokasi dana desa oleh oknum kepala desa, bendahara dan perangkat desa lainnya yang memanfaatkan peluang dan kesempatan yang ada di dalam pengelolaan dana desa disamping masih lemahnya pengawasan terhadap aparat pemerintah; untuk itu berdasarkan penulisan ini maka didapatkan 14 pola korupsi di Provinsi Maluku.

Abstract

The study aims to describe the role of parents in children who run in with the law. It employed a qualitative approach with a descriptive method. Data were collected through in-depth interviews with the research objects. The findings showed that parents’ role in children who run in with the law is important because they are responsible for building children’s character and the communication patterns they apply to determine how close they are. The communication patterns applied by parents when talking with the children who run in with the law are various, including permissive and authoritarian.

Abstract

The purpose of this paper is to discuss the interpretation of the limits of the pretrial process and the start of the examination of the main case examination, often causing debates between judges, prosecutors, legal advisors and the defendant. The research method used is normative juridical. The results of the study show that there are two contradictions between the Constitutional Court Number 102/PUU-XIII/2015 and the Supreme Court Circular Letter Number 5 of 2021, which both provide different explanations regarding Article 82 paragraph (1) letter d of the Criminal Procedure Code, The Supreme Court Circular does not protect the defendants human rights by taking into account the due process model principle, because when the public prosecutor submits a case to the court, it is considered that the suspect's rights in the judicial process are automatically invalidated. In fact, if seen in Article 143 paragraph (1) of the Criminal Procedure Code, the indictment is only a requirement for delegation, not reading the indictment at the time of the main case, and Article 79 and Article 80 clearly explain the protection of the rights of suspects and victims' rights in the pretrial process.

Abstract

Terrorism is a crime that is included in the category of extraordinary crimes. So, to overcome it, it is necessary to carry out extraordinary measures, one of which is by involving military forces in this case the Indonesian National Army (TNI). The purpose of writing this article is to analyze the legal aspects of the involvement of the Indonesian National Army in countering terrorism in Indonesia. The research method used is qualitative with data collection techniques in the form of literature studies. The results of the study show that the involvement of the Indonesian National Army in counter-terrorism efforts is regulated in Law Number 5 of 2018 concerning Amendments to Law Number 15 of 2003 concerning Stipulation of Government Regulations in Lieu of Law Number 1 of 2002 concerning Eradication of Criminal Acts of Terrorism into Law, Law Number 34 of 2004 concerning the Indonesian National Army and Presidential Regulation Number 62 of 2016 concerning Amendments to Presidential Regulation Number 10 of 2010 concerning the Organizational Structure of the Indonesian National Army. Currently, the draft Presidential Regulation which is the mandate of the Amendment to the Law on Criminal Acts of Terrorism to serve as a guide for the involvement of the TNI in the task of assisting the handling of terrorism has been discussed and approved by the House of Representatives (DPR RI), it is just waiting for the President signature to be ratified.

Abstract

Election Crimes are criminal acts with administrative character (administrative penal law) because they threaten criminal sanctions for administrative of administrative crime is guided by the ultimum remedium principle, namely using criminal sanctions as the last alternative after prioritizing administrative sanctions. However, because criminal offenses ini elections have different destructive powers against elections, there should be a clear classification between each election crime. This means that even though they are included in the administrative penal law category, not all of them adhere to the ultimum remedium principle. This papare will discuss the characteristics of election crimes and aims to propose a clustering of election crimes based on certain measures, so that in their enforcement it is not gereralized between different criminal offenses. This paper uses a normative research method with conceptual opproach and statuta approach.
