Abstract

This research discusses the concept of an expert in the KHES which is a guideline for shari'ah economic practitioners so that the Compilation of Sharia Economic Laws should be a study. Especially for experts (who are capable of law), it is quite an important discussion to be parsed, studied and discussed. Given that legal competence has an important position in the contract because it is a condition that must be met by the contract subject which implies that the contract can be considered valid or not. In this research, the researcher examines the concept of expert in KHES from the perspective of Islamic law (the opinion of the ulama) which is contained in fiqh books, as well as the integration of existing regulations in Indonesia. The purpose of this study is to provide an understanding of the community as legal subjects, so that the contracts they do are not only correct under Islamic law, but also not against Indonesian positive law. Besides that, as a guideline for economic or legal practitioners, the existing articles must be studied. So that in this study there were things that the researchers found in KHES that needed to get additional, namely, barriers to skills. This research is in the form of literature using a normative-juridical approach, where most of the data sources are in the form of fiqh literature, and books relating to research material. It is said to be normative-juridical, because this research examines a legal norm, namely legislation with legal doctrine analysis. So that in this study the researchers describe in a qualitative-descriptive form. The legal competence referred to in KHES is actually an expertyatul ada '(active skill) in fiqh or ushul fiqh. Legal competence in KHES applies to personal legal subjects and legal entities, the requirements that must be possessed by personal legal subjects are adults at the age of 18 or married. As for a legal entity it can be considered legally competent if it does not fail. The provision of legal competence with these conditions is more inclined to the opinion of the hanafi school, both according to Imam Hanafi himself and according to Abu Yusuf and Muhammad Ibn Hasan.

Abstract

The impact of the Covid-19 pandemic is felt at all levels of education, from elementary to higher education. The existence of this pandemic has become a challenge for educators to innovate in developing and implementing lesson plans that have been prepared previously. One of the learning approaches used is the scientific approach. This approach trains students to learn with the scientific method through the process of observing, asking questions, gathering information, experimenting, associating and communicating the material they are learning. This is where the ability of a teacher is required to be creative in integrating the steps of the scientific approach with online methods. During the past year, the implementation of a scientific approach in online learning during the Covid-19 pandemic has been carried out in basic education institutions with quite good results. Some of the advantages of the scientific approach using online learning include (1) the dependence of students on educators is slightly reduced because learning is carried out more at home through the network (online) (2) the flexibility of time and place to take the steps of the scientific approach to be a separate experience for students (3 ) train students to use learning technology from an early age. The weaknesses of online learning include (1) internet signal/connection is not very stable (2) teacher and student interactions cannot interact directly (3) still lack of facilities and infrastructure in the implementation of online learning (4) inadequate parental supervision This causes students to often lose focus in learning.

Abstract

This paper aims to present the results of an analysis of the phenomenon of religious communities, especially Muslims in the Covid-19 pandemic era which shows various patterns of spirituality. This paper is a review of the attitude patterns that appear to the surface, not providing justification or criticism of the attitudes of each pattern that appears. The methodology used is phenomenological analysis on social media which is currently emerging with various presentations. The author sees it from the point of view of epistemology proposed by a modern Muslim philosopher Muhammad Abid al-Jabiri who suggests three kinds of reasoning that humans have taken throughout the ages to produce their knowledge, namely bayani, irfani, and burhani reasoning. The religious phenomenon of the Muslim community in this pandemic era is the embodiment of its scientific system so that it will automatically show which epistemology is the basis for understanding the teachings of Islam. The conclusion of this analysis is that Muslims are divided into several attitudes of spirituality in response to government policies, namely; 1) intolerant (counter-active) attitude towards government policies based on their religious understanding, 2) tolerant attitude (pro-active) and providing support to the government based on their understanding and 3) indifferent attitude towards government policies.
