Abstract

The purpose of this research is to provide an idea of how to realize the potential application of the concept of granting the right to build on waqf land. This concept is a new thing that can add value to waqf land so that it can be optimized productively without losing the basic essence of waqf itself. The research method used in writing this article is normative legal research. Using primary legal materials in the form of legislation on waqf and land rights, as well as secondary legal materials in the form of scientific articles related to waqf and land rights. The data analysis technique used in organizing the available data is a qualitative data analysis technique. This study found that waqf land has similarities in practice and concept to the right of management. So, if land managed properly can be granted the right to build, Waqf land can also be granted the right to build. The benefits of implementing this concept in the future could be felt by developers, nazhir, and the general public. Developers get benefits in the form of freedom from land acquisition costs and can guarantee the right to build on waqf land. Nazhir gets benefits in the form of land use fees and recommendation fees that must be paid by the developer as a condition for using waqf land and for certification purposes. Then the profits received by Nazhir can be used for the welfare of the people according to the waqf pledge.

This study will try to measure the efficiency of waqf funds in zakat institutions in Indonesia using the non-parametric Data Envelopment Analysis (DEA) method. The objects in this study are eight zakat institutions that manage waqf funds in Indonesia. The data in this study comes from the annual reports of each of these institutions during the period 2013-2020. The input variables in this study include operational costs and HR costs. In comparison, the output variables in this study include the collection and distribution of waqf funds. This study indicates that during 2013-2020, the efficiency of zakat institutions in managing waqf funds has a fluctuating trend. This study will also look at the possibility of improving inefficient programs from input and output variables; in general, the main factor in the efficiency of waqf funds lies in the output variable, namely the acceptance and distribution of waqf funds. In addition, this study provides a reference for other decision-making units (DMUs) in improving efficiency, and the average DMU used as a reference is the one who has good professionalism and innovation. Abstract

This research aims to determine the potential of waqf and renewable energy and their benefits in reducing the impact of climate change. The research method used is qualitative research obtained from the results of studies of several research institutions engaged in waqf and energy. The data is collected and then translated through a descriptive method that emphasizes the potential for energy waqf that needs to be developed to respond to the impacts of climate change. The results of this study indicate that waqf and renewable energy have enormous potential in Indonesia. As a country with the largest Muslim population in the world, BWI estimates that the potential for waqf in Indonesia every year is 188 T. Likewise, as a country with a tropical climate with the sun shining all year round, Indonesia can become a leader in the development of solar energy with a potential of 4.8 KWh/m2 or equivalent to 112,000 GWp. The integration of waqf as a fund to finance the use of renewable energy has a positive role in reducing the impact of climate change, especially in Indonesia.
