Abstract

  The purpose of this study was to determine the form of service at the Bulukumba Religious Court Office, a study of Siyasah Syar'iyyah and the public's views regarding the quality of public services at the Bulukumba Religious Court Office. The method used in this research is a qualitative field (field research) with a normative theological approach and a fiqh siyasa approach, the data are primary and secondary data obtained through observation, interviews and literature. The results of this study indicate: 1) The forms of services for the Bulukumba Religious Court are court administration services, legal aid services and complaints and requests for information. 2) The public's perception of the performance of the Women and Children Empowerment Service is in accordance with the results of interviews with the public's perception of the performance of the Women and Children Empowerment Office in Kab. Bulukumba has 2 different versions, starting from the performance of the Women and Children Empowerment Service which has not been maximized due to the lack of campaigns/socialization related to empowering women and children so that many local people do not know what the duties and functions of the Women and Children Empowerment Service are and there are also those who think that it is already done. carry out their duties and functions in accordance with Standard Operating Procedures (SOP) well because many repressive efforts have been made to empower women and protect children.

Abstract

    This study aims to determine how the implementation of the Ministry of Agriculture in the management of subsidized fertilizers and the perspective of Siysah Syar'iyyah in the distribution of fertilizers in the village of Tonrorita, sub-district. Biringbulu Kab. Gowa, based on the Decree of the Minister of Agriculture Regulation No. 49 of 2020 concerning the Allocation and Highest Retail Price of Subsidized Fertilizer. The method used in this research is descriptive qualitative and data acquisition is done through structured interviews, field observations and documentation. The results showed that fertilizer management in Tonrorita sub-district went through several stages, namely socialization, preparation of the RDKK (Definitive Plan for Group Needs), distribution/distribution and reporting, but in its application it was still not optimal. This is because of the abuse of authority carried out by GAPOKTAN (Association of Heads of Farmers Groups), and Head of farmer groups in distributing fertilizers to farmers and the application of prices that are not in accordance with the HET (Highest Retail Price) of subsidized fertilizers, which results in a lack of fertilizer supply. which must be spread to farmers because of manipulation by Gapoktan

Abstract

The implementation of the Jeneponto Regency Regional Regulations is often hampered in its implementation. This study aims to determine how the implementation of Regional Regulation no. 19 of 2018 at the Jeneponto Regency Environmental Service and also to study fiqh siyasah analysis of environmental management and protection through the application of regional regulation no. 19 of 2018 in Jeneponto district. This type of research uses qualitative research with descriptive methods. There are two sources of data used, namely primary data sources and secondary data sources. From this study it was found that the implementation of the Jeneponto Regency regional regulation Number 19 of 2018 concerning environmental management and protection was not as effective as it should be. This is caused by several factors inhibiting local governments in carrying out these efforts, both in terms of finance (financial), facilities and infrastructure, as well as socialization that is still not given to the community. In the view of fiqh siyasa, the management and protection carried out by the local government of Jeneponto Regency are in accordance with Islamic law, because humans as caliphs on earth are to be able to prosper the earth in accordance with Islamic law.

Abstract

This study examines the empowerment of waste pickers at the Tamangngapa Final Waste Disposal Site (TPA) in Manggala District from the perspective of Siyasah Syar’iyah. The focus includes the realities of waste pickers’ lives, existing empowerment efforts, and an analysis based on Siyasah Syar’iyah principles. This qualitative research employs a syar’i and juridical approach. The findings reveal that waste pickers at TPA Tamangngapa live in highly concerning conditions, marked by limited education, inadequate skills, and poor living facilities. No specific empowerment programs from relevant institutions were found to target this group directly. From a Siyasah Syar’iyah perspective, this situation reflects a weak role of the state in protecting and empowering marginalized communities. The study recommends the development of government policies focused on empowering waste pickers based on social justice and Islamic legal principles to achieve sustainable well-being.

Abstract

The purpose of this research was to find out how  the role of Makassar City’s DPRD in carrying out the supervisory function of the Makassar City Government and find out what obstacles are faced by Makassar City’s DPRD in supervising the Makassar City Government. As for the method used in this research is field research with an empirical juridical research approach and syar’i normative. The result showed that optimizing the role of DPRD in carrying out the supervisory function of the Makassar City Goverment running optimally although there all still some obstacles faced by DPRD in carrying out the supervisory function. The obstacles faced by Makassar City’s DPRD in carrying out the supervisory function are : The people was unable to cooperate, Covid-19 pandemic, the company was unable to cooperate and people still fear convey their opinions and rights to the government. The Siyasah Syar’iyyah concept views that accountability for something that has been mandated was a basic thing whose substance demands professionalism and accountability.

Abstract

This study aims to identify the form and effectiveness of transparency in the management of village funds in Bontoala Village, Pallangga District, Gowa Regency. It employs qualitative field research methods, including observation, interviews, and documentation. The findings reveal that the village government applies transparency through public deliberations and the installation of budget boards. However, this implementation does not fully comply with Article 4 Paragraph 7 of Minister of Home Affairs Regulation No. 13 of 2006, which defines transparency as providing the public with broad access to information. The application of transparency remains ineffective, as many residents are unaware of the budget boards, and community participation in deliberations is low due to the lack of direct communication from village officials. From the perspective of Siyasah Syar’iyyah, transparency is reflected in two core values: Shidiq (honesty in managing and conveying information) and Amanah (delivering information to those entitled to receive it). These shortcomings highlight the need for improved communication and more meaningful openness to ensure community involvement and accountability in village fund management.

Abstract

Simultaneous general elections are electoral systems that hold several elections at the same time. The purpose of this study was to determine the views of siyasa syariyyah on the decision of the Constitutional Court No. 55/PUU-XVII/2019 regarding the 2019 simultaneous elections. This research uses normative, juridical, and syar'i research. The results of this study indicate that the concept of the 2019 simultaneous elections against the Constitutional Court's decision no. 55/PUU-XII/2019 encourages the strengthening of the presidential system and is more efficient, both in terms of financing and the time of holding simultaneous elections. However, in the community, this is the first simultaneous election that has been held, leaving several problems that still need to be evaluated and reconsidered until the next period. The view of the Syariyyah siyasa regarding simultaneous general elections has existed since time immemorial, although the implementation is not exactly the same today. Elections in Islam are called waqalah and the law is permissible (permissible). Elections have similarities with the bai'at method carried out at the time of the Prophet and Khulafa al-Rashidin. In addition, a more appropriate and efficient way has not been found to replace the election method.

Abstract

Community empowerment is an effort for the potential and capabilities of the community, so that the community can realize their identity, dignity and worth to survive and develop themselves in the social, economic, religious and cultural fields. This study aims to determine the role of the Community Empowerment Institution (LPM) in Manjapai Village, Bontonompo District, Gowa Regency. This research is a qualitative field research with research methods using observation, interviews and documentation. The results showed that the role of the Community Empowerment Institution (LPM) in Manjapai village had not been carried out optimally, members of the Community Empowerment Institution (LPM) did not understand the functions and duties of the institution they carried out. One of the causes is the lack of communication between the community and community institutions and the village government. This shows that the function of the Community Empowerment Institution (LPM) based on the Indonesian government regulation no. 72 of 205 regarding villages cannot be implemented properly. Based on the perspective of Siyasah Syariyyah, the performance of community institutions in terms of leadership for village development has not met the characteristics of good leadership. In this case, in terms of trust, members of the Community Empowerment Institution (LPM) have not been optimal in carrying out their duties or mandates given, for example uneven development, and have not continued the empowerment program that the community wants.

Abstract

This study aims to examine the permissibility of charitable giving (ṣadaqah) in the context of political contests using the al-Umūr bimaqāṣidihā legal maxim approach. The phenomenon of political charity is often equated with money politics, sparking debate among scholars, government authorities, and the public. The discussion explores the concept of ṣadaqah in Islam and the role of intention (niyyah) as the foundation of legal rulings, based on al-Umūr bimaqāṣidihā and its derivative principles. This research employs a qualitative normative method through library research of classical and contemporary Islamic legal sources. The findings indicate that ṣadaqah during political contests is not inherently prohibited, but its legality depends heavily on the giver's intention. If the act is done sincerely for the sake of Allah’s pleasure, it is considered permissible. However, if it is meant to influence voters or gain political support, it is deemed unlawful. In conclusion, government regulations should not impose an absolute ban on political charity, but rather implement strict oversight to ensure that it aligns with sincerity and the principles of fair and honest elections
