Abstract

Unlawful Actions (PMH) in land cases is an important issue in the legal system in various countries, including Indonesia and France. Although both countries have similar basic principles regarding PMH, there are fundamental differences in the way they are regulated and implemented, especially in the land context. This research aims to analyze the comparison between the PMH concept in Indonesia and France, with a focus on resolving land disputes. The method used is a comparative approach, comparing the legal provisions applicable in both countries, as well as the dispute resolution mechanisms applied in practice. The research results show that although there are similarities in the aim of protecting land rights and providing compensation to injured parties, each country has different legal characteristics in dealing with unlawful acts in the land context. In Indonesia, dispute resolution is more formal and bureaucratic, while in France it prioritizes mediation and a social approach. Apart from that, the difference in the application of subjective and objective responsibility is also an important differentiating factor in law enforcement related to PMH.

Abstract

This study analyzes the influence of the development of Tourism Special Economic Zones (SEZs) on regional development, focusing on economic growth, poverty, and unemployment in the area around the SEZ. Using spatial econometrics methods, this study includes four SEZs: Tanjung Lesung, Mandalika, Morotai, and Tanjung Kelayang. The results show that Tourism SEZs have a positive impact on economic growth in certain regions, especially Tanjung Lesung, although their impact on the surrounding areas is still limited. Poverty and unemployment showed varied outcomes; some SEZs have decreased, but the influence has not been significantly evenly distributed. Domestic tourists play an important role in supporting economic growth, with variables of tourist attraction and accommodation capacity having a positive impact. However, the effectiveness of Tourism SEZs is still constrained by limited infrastructure and local community empowerment. The study emphasizes the importance of facility development and community involvement to optimize the benefits of SEZs as a new economic growth center.

Abstract

This research was conducted to understand how “Organizational Citizenship Behavior and work environment affect employee performance with job satisfaction as a mediating variable at PT Inhutani V”. This study used saturated sampling technique, where the entire population of 138 people became respondents. Data were collected through questionnaires, then analyzed using the SEM method processed with the Smart PLS 4.0 application. The findings of the analysis tested on employee performance at PT Inhutani V show that Organizational Citizenship Behavior (OCB) and the work environment are proven to have a positive and significant effect. In addition, it was also found that the factor of employee job satisfaction had a positive and significant relationship with their performance. Furthermore, OCB plays a positive and significant role in influencing employee job satisfaction, as well as the work environment. Furthermore, OCB contributes positively and significantly to employee performance when job satisfaction acts as a mediating variable. Meanwhile, although the effect of work environment on employee performance through mediating job satisfaction is positive, the effect is not significant.

Abstract

Doctors are a professional that is needed by society and is a profession that carries a high level of responsibility. To support the capabilities of health workers, medical education has a Specialist Doctor Education Program and a Subspecialist Doctor Education Program. This is intended so that the needs of health workers, especially doctors who have certain health qualifications, can be met. This journal examines further the rights that participants in the Specialist Doctor Education Program and Subspecialist Doctor Education Program should have in carrying out their education. Through a normative juridical approach with qualitative analysis methods, this research explores the existing regulatory framework, identifies gaps in implementation, and formulates comprehensive regulatory solutions. The research results reveal that there is a legal void regarding the status of participants in the Specialist Doctor Education Program and Subspecialist Doctor Education Program, whether as interns or as workers. This research recommends the establishment of a special regulatory framework that regulates the determination of the status of participants in Specialist Medical Education Programs and Subspecialist Medical Education Programs..

Abstract

Business decisions made by the directors of a company are often the subject of legal interpretation, especially when the decision results in losses to the company or the state. This research focuses on the application of the Business Judgement Rule (BJR) principle in the case of LNG business development by PT Pertamina in the United States involving Karen Agustiawan as President Director. Through a normative juridical approach and qualitative analysis, this study evaluates the extent to which the BJR can protect the board of directors from lawsuits as well as identify the factors that cause the decision not to be protected by the BJR principle. The results of the analysis show that the application of BJR cannot provide legal protection if the business decision is not based on good faith, prudence, and without conflict of interest. In this context, the study also discusses the application of progressive legal theory as an alternative framework for handling this kind of case. The study recommends strengthening regulations to set limits on BJR implementation and ensure transparency in the business decision-making process.

Abstract

Strategic management has a very important consideration and must be reviewed as part of the evaluation of the accreditation process in FKTP (First Level Health Facilities). A well-formulated strategy must be skillfully implemented to ensure growth and progress. This strategy needs to be implemented by every FKTP staff member to improve service quality, evaluation, and accreditation status. The purpose of this theoretical research article is to understand and push back to the theoretical field of various literary works. One of the methods used is theoretical research by analyzing and comparing existing theories. The results of this theoretical study show how strategic management functions in evaluation and helps FKTP make better plans with a more logical, rational, and systematic approach to each choice found during the planning process. It is clear that to improve the quality of health services, strategic management is also needed. The focus of FKTP accreditation strategic management is the assessment and determination of the hospital's eligibility according to service standards that have been set by an independent accreditation institution. So that it can improve patient perceptions and their trust in health facilities. After accreditation, FKTP must carry out strategic management optimally. Thus, the organization improves infrastructure, adequate human resources, and supporting facilities.

Abstract

Indonesia, as a country with high biodiversity, is vulnerable to biopiracy. In response, Indonesia ratified the Convention on Biological Diversity which introduced the concept of Access and Benefit Sharing (ABS) to genetic resources and traditional knowledge that contain high economic value. This paper explains the mitigation of biopiracy against genetic resources and traditional knowledge with bioprospection so that it can be utilized sustainably for the greatest prosperity of the people. This paper is a normative legal research that uses legislative and conceptual approaches which will later elaborate whether genetic resources and traditional knowledge have received sufficient mitigation efforts from the threat of biopiracy, as well as bioprospection actions to improve the welfare of people who depend on genetic resources and traditional knowledge with sustainable technological development and innovation.

Abstract

This article aims to analyse the effect of SSD (Solid State Drive) and HDD (Hard Disk Drive) selection on computer boot speed. With the development of data storage technology, many computer users are faced with the choice between SSD and HDD. This research will compare these two storage media in terms of operating system boot performance, with the aim of providing a more appropriate recommendation based on the measured performance. This research is conducted by experimenting on two computers, one that uses SSD and one that uses HDD. Each computer will be tested by booting the same operating system under similar conditions. The boot speed is measured in seconds from the start of the computer until the operating system is ready for use. In addition, special software is used to measure the boot time with high accuracy. The results show that computers with SSDs have much faster boot speeds compared to HDDs. On average, SSDs can complete the boot process in 12-15 seconds, while HDDs take around 30-34 seconds. In addition, the boot time variability of SSDs is lower, indicating a more stable performance compared to HDDs. Based on the test results, it can be concluded that the use of SSD significantly improves the boot speed of a computer compared to HDD. Users who want faster system performance, especially in terms of boot time, are recommended to use SSD.

Abstract

This research aims to market business potential by implementing sales strategies that produce profitable and sustainable products. MOOEW Hair Tonic has a Return of Investment (ROI) of more than 100% which means that the profits obtained have exceeded the capital. This research uses qualitative exploration methods and economic feasibility studies, resulting in data that this product has a Return of Investment (ROI) of more than 100%, showing significant business sustainability potential. The results show that MOOEW Hair Tonic is able to answer the health care needs of cat fur effectively with a safe material composition and affordable price. This product is expected to encourage concern for the health of pets while supporting environment-based waste reduction. Conclusion, MOOEW Hair Tonic. MOOEW Hair Tonic offers simple, attractive and practical packaging so that it is easy to carry, easy to store and easy to apply. MOOEW Hair Tonic products are sold at affordable prices. However, the product prices we set do not reduce the quality of the raw materials we use.

Abstract

This study aims to analyze the opportunities and challenges faced by Micro, Small, and Medium Enterprises (MSMEs) in utilizing the Gojek and Grabfood applications in Jekan Raya District, Palangka Raya City. The method used is a mixed approach with surveys and in-depth interviews with MSME owners. The results show that this application provides significant opportunities, such as wider market access and reduced marketing costs. However, challenges in the form of fierce competition, high commission costs, and technological limitations are also faced by MSME actors. This study recommends technology training and community collaboration as strategic steps to maximize the potential of MSMEs.
