Abstract

Perkawinan adalah media pembentuk keluarga, yang merupakan lembaga terkecil dari sebuah masyarakat. Dalam rangka memperkuat lembaga tersebut, pemerintah mewacanakan kembali apa yang disebut dengan Sertifikasi Pranikah. Sebuah pelatihan yang di dalamnya peserta pelatihan akan diajarkan materi-materi tentang bagaimana mempersiapkan sebuah keluarga yang kuat sebelum perkawinan dilaksanakan. Kebijakan ini diwacanakan kembali oleh pemerintah melihat fakta dilapangan yang menunjukkan peningkatan kasus perceraian, dan itu merupakan indikator buruk bagi lembaga keluarga dan tentu akan berdampak pada pemben-tukan masyarakat. Dalam kajian Hukum Islam, kemaslahatan, yang kemudian dija-wantahkan menjadi maqashid syari’ah, harus menjadi tujuan utama dari adanya sebuah kebijakan/peraturan. Sehingga sangat perlu memperhatikan seberapa besar kemaslahatan yang dapat diraih dan seberapa banyak mafsadat yang dapat dihindari dengan adanya Sertifikasi Pranikah yang kembali diwacanakan.

Abstract

Marriage is a bond between the inner and outer wanitasebagai a man with a husband and wife with the aim of forming a family (household) were happy and everlasting based on God. The scholars agreed that the wedding for pregnant women should be carried out again after giving birth. Reconstruction of the law relating to the validity of the marriage ceremony for a pregnant woman, in this case the Indonesian Islamic scholars consider the elements of sociological and psychological especially the local culture of Indonesian society, which is a compromise approach to customary law. Perkawinan ialah ikatan lahir batin antara seorang pria dengan seorang wanitasebagai suami isteri dengan tujuan membentuk keluarga (rumah tangga) yang bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa. Para ulama sepakat bahwa pernikahan bagi wanita hamil haruslah dilaksanakan kembali setelah melahirkan. Rekonstruksi hukum terkait dengan keabsahan akad nikah bagi wanita hamil, dalam hal ini ulama Islam Indonesia mempertimbangkan unsur-unsur sosiologis dan psikologis khususnya budaya lokal masyarakat Indonesia, yang merupakan pendekatan kompromistis dengan hukum adat. Pengkompromian itu ditinjau dari segi kenyataan terjadinya ikhtilaf dalam ajaran fikih dihubungkan dengan faktor sosiologis dan psikologis. Tujuan utama azas kebolehan kawin hamil adalah untuk memberikan perlindungan hukum yang pasti kepada anak yang dalam kandungan, walaupun anak tersebut statusnya anak zina, walaupun Kompilasi Hukum Islam tersebut terkesan memperlihatkan sikap pemerintah yang sangat ambivalen/ambigu.

Abstract

ABSTRAK Penelitian ini berawal dari adanya kontraversi di kalangan para ulama apakah pembagian harta waris secara kekeluargaan (bilateral) bertentangan dengan hukum Islam atau tidak. Karena itu penelitian ini menitikberatkan pada pemikiran Hazairin tentang konsep kewarisan bilateral, dimana konsep tersebut akan dilihat dari perspektif teori hukum Islam. Metode yang digunakan dalam penelitian ini adalah metode analisis comparative-inductive. Adapun poin permasalahan yang hendak dikaji dalam penelitian ini adalah: Pertama, bagaimana konsep kewarisan bilateral sebagaimana yang digagas oleh Hazairin?; Kedua, bagaimana pandangan para ulama tentang pembagian kewarisan secara kekeluargaan (bilateral)?; dan Ketiga, bagaimana pandangan hukum Islam tentang konsep kewarisan bilateral tersebut? Hasil penelitian ini adalah: Pertama, konsep kewarisan bilateral menurut Hazairin adalah suatu konsep pembagian harta waris secara kekeluargaan dengan penentuan ahli warisnya dengan cara menarik garis keturunannya melalui dua jalur keturunan, yakni keturunan ayah maupun melalui keturunan ibunya. Kedua, para ulama berbeda pendapat tentang hukum pembagian kewarisan secara kekeluargaan (bilateral), kelompok yang satu menolak dan kelompok lainnya membolehkan. Dan ketiga, pembagian harta waris secara bilateral dalam pandangan penulis tidak bertentangan dengan Hukum Islam. ABSTRAC The beginning of this research is a presence of the controversy between muslim scholars about the question as is the heritance distribution held in a family atmosphere (bilaterally) abrogated by Islamic law or accepted? Depart from this problem the research focused to the Hazairin’s thought about the concept of bilateral inheritance law, the concept will be analyzed based on theory of Islamic law afterwards. The method used in this research a comparative-inductive analysis method. The main problems which will be investigated in this research are about: First, how is the concept of the bilaterally inheritance law in the Hazairin’s thought?; Second, how is opinions of the muslim scholars about it?; and Third, how is perspective of Islamic law about it? Among the result of this research are: First, the concept of the bilaterally inheritance law in the Hazairin’s thought is a law which it arrange about distribution of inheritance held in a family atmosphere (bilaterally) with taking some legal heir from two generation strip, it is generation strip from his/her father and mother without making a distinction among them; Second, the muslim scholars have been difference in opinion about tle law of bilaterally inheritance, one side reject it and other side o them accept it; and Third, the distribution of inheritance bilaterally have a base theoretically in the Islamic law based on researcher’s opinion. Abstract

The issue about corruption after a decade of reformation has not brought Indonesia to the point of free corruption zone. The existence of institutions such as KPK has ever cosidered as the spearhead to rid the republic from corruption virus. However, it finally comes upon an anti climax because it doesn’t give a deterrent effect to the doers of corruption. KPK is faced on a difficult situation. It can be seen from the weakening of its authority, while the death penalty for corruptors was still considered by some parties that it is not urgent. Explicitly, the Law of KPK is actually available on the space for the death penalty for corruptors, but it seems that it still has not found the momentum yet. The criminal of corruption is a problem that needs to be solved seriously and it becomesthe problem of law in every country in the world, include Indonesia. The disease of corruption becomes more rampant day by day. The government's seriousness in finding solution about criminal of corruption is that an establishment of Law No. 31 of 1999 changed into Law No. 20 of 2001 about the Eradication of corruption.

Abstract

This paper aims to determine the implementation of Law No. 23 of 2011 on the Management of Zakat by Bazda (Badan Amil Zakat Local) Metro City and its influence on society. And aims to determine the contributing factors; inhibiting the movement of charity in the city Metro. This paper is descriptive qualitative data collection using the techniques of observation, in-depth interviews (depth interview) with the life history of various actors in the community. This paper also uses participatory action research in order to obtain accurate data relating to zakat and performed well Focus Group discussion. Data analysis techniques using qualitative analysis and induction yaang analysis was used to analyze the legal system of zakat and social reality in the public notice on the implementation of zakat. Based on the results of the research, that the issuance of Law No. 23 of 2011 on the Management of Zakat affect the fulfillment of zakat in Metro City are becoming more organized and in accordance with the purpose of compulsory zakat. As a key enabler of charity movement activities in Metro City is the positive response of the Mayor with the additional rules to respond to the performance of Act No. 23 of 2011 on the Management of Zakat. Source zakat collected Metro City has been perceived by society such as; house renovation, scholarships, provision of means of places of worship. Inhibiting factor is understanding people in just the tithe, so zakat mal still less become a major breakthrough. Then further inhibiting factor is the lack of motivation of people to channel funds through the zakat BAZNAS Metro City.

Abstract

Abstract The universal nature as inherent in Islamic Law and International Humanitarian Law makes these two laws often compared. The comparison in terms of the principles between the two legal instruments is very interesting considering they both originate from two poles of thought which are always competing and without being insulated by space. There is no law that is permanent and final, that is what happened to those two legal methods. Law develops according to the era without reducing values. Islamic values were born much earlier than International Humanitarian Law. The basic principles of Islamic Law concerning the relationship of humanity in society between nations and nations during wars have become a strong foundation for international humanitarian law norms. For example, such as legal principles that contain the principles of equality, freedom, peace, humanity and so on

Abstract

Konsep fiqh al-wa>qi’ al-Qarad}a>wi> secara praktis dapat diaplikasikan dalam menjawab problematika hukum Islam kontemporer. Misalnya, masalah penentuan waktu shalat Jumat di Eropa, ucapan selamat hari raya kepada ahli kitab, status pernikahan wanita yang masuk Islam di Eropa, hukum menerima warisan dari non-muslim. Dengan demikian, dinamika ijtihad dalam Islam memberikan ruang kepada dinamika perkembangan masyarakat (realitas social) dan obyek hukum (mukallaf) dalam menentukan dan merealisasikan hukum yang memberikan kemaslahatan bagi mereka. Hal ini menunjukkan Islam mampu mengakomodir gejala social yang berkembang di masyarakat.

Abstract

The parties who could not afford, can file a lawsuit/petition in prodeo. The State can't afford it should be proved by certificate of the head of the concerned villages. In the register matter it will be recorded. All receipts and expenditure, though none in the journal must remain recorded. Before a lawsuit is recorded in the register book, plaintiff in advance are to apply for litigants in prodeo, which if granted, the Judge makes the determination about the permit litigants in prodeo, after previously opposing parties are given the opportunity to respond to the petition. About granting permission beracara in prodeo applies to each level of the judiciary in own-¬ itself and can not be given to all levels of the judiciary. Defendant who cannot afford to pay the fees, are also eligible to apply in such a way the prodeo above. The petition against the litigants in prodeo, the judge makes the determination of diizinkannya beracara in prodeo after previously opposing parties are given the opportunity to determine ¬ patan to respond (in accordance with article 237, and HIR Article 273 RBg).

Abstract

sebelum Perppu Nomor 2 Tahun 2017 Tentang Organisasi Kemasyarakatan disahkan menjadi UU Nomor 6 Tahun 2017 terjadi pro kontra berkaitan dengan isi muatan Perppu tersebut. Kita ketahui bahwa Perppu Nomer 2 Tahun 2017 disahkan menjadi undang-undang melalui mekanisme voting. Ada tujuh fraksi partai politik yang menerima Perppu Nomor 2 Tahun 2017 Tentang Ormas yang dirapatkan sebagai undang-undang yaitu fraksi PPP, PDI-P, Golkar, PKB,Hanura, Demokrat, dan Nasdem. Namun Fraksi Demokrat, PPP dan PKB menerima secara bersyarat Perppu tersebut, yakni mengharuskan supaya DPR dan Pemerintah segera melakukan revisi Perppu yang baru saja disetujui menjadi Undang-undang itu. Setelah dikeluarkannya Perppu No. 2 Tahun 2017 dan dibubarkannya HTI, terjadi perlawanan hukum dengan mengajukan judial review oleh beberapa Organisasi Masyarakat seperti Front Pembela Islam (FPI), Dewa Dakwah Islamiyah (DDI), Perkumpulan Hidayatullah dan Pemuda Indonesia serta HTI sendiri yang lebih dahulu mengajukan judial review ke Mahkamah Konstitus. Dari beberapa uraian di atas, pro kontra berkenaan dengan Perppu No. 2 Tahun 2017 Tentang Ormas juga terjadi pada Organisasi-Organisasi Islam di Kota Metro.

Abstract

Mediation is an alternative way to resolve disputes. With the approach of a win-win solution, mediation can bring a sense of fairness in resolving disputes without going through trial procedures are familiar with legal terminology that is difficult to understand by the general public. However, not all disputes can be resolved through mediation way. Perma No. 1 of 2008 on mediation procedure in court mediation limit applies only to disputes / civil cases. This paper questions the back of the scope and types of cases that can use alternative settlement by way of mediation. Here will be presented mediation according to the viewpoint of Islam well as analysis for Perma No. 1 Year 2008. Islamic law is an integral part of building laws in Indonesia, so that it opens the possibility of treasures in Islamic law becomes the input for the law in Indonesia, including on mediation. In the mediation of Islam known as Sulh encompass a broader scope than the scope of mediation in Perma No. 1 Year 2008. This paper will parse the opportunity to broaden the scope of mediation in Perma No. 1 of 2008 is based on the viewpoint of Islamic law, one of which is mediation in criminal cases. The State does not only present as a punisher, but more widely present state as a mediator in criminal matters (public).
