Abstract

The relationship between companies and consumers is governed by binding agreements, intended to promote mutually beneficial cooperation and ensure smooth transactions. However, in practice, breaches of contract, such as delayed installment payments or violations of agreed terms, can occur. These breaches may have broader social and political implications, as they can affect consumer trust, economic stability, and the regulatory environment. This study aims to analyze the legal consequences of such breaches in motor vehicle lease agreements. Utilizing a normative legal research method with a qualitative descriptive approach, this research provides insights into the legal outcomes of defaults in motor vehicle lease agreements within the framework of the Civil Code. The study finds that the losing party in a civil case must bear the court costs. If there are multiple losing parties, the judge will determine how the costs are divided. This rule is important for ensuring legal certainty, preventing frivolous lawsuits, and ensuring that court proceedings are conducted fairly and efficiently.

Abstract

This research explores the dynamics of village community political participation in the digital era with a focus on the context of problems and solutions which are the subject of analytical study, then this research uses a qualitative descriptive-analytical method with a desk study approach. The findings indicate that village community participation in the digital era has two problems, namely lack of access to technology which has implications for a lack of understanding of the information obtained, where this connection is found through the village digital literacy index. The second is the low level of trust that exists, where village communities tend to be indoctrinated with unethical political behavior so that the tendency towards political promises that are initiated is not felt by village communities which ultimately gives rise to community distrust of certain political actors or figures. In the end, the solution designed requires efforts from the government to provide information-supporting infrastructure, digital literacy education, community involvement in the digital political process, and protection of community data in accessing information through the media.

Abstract

The study of the relationship between Islam and the State is of significant academic importance and warrants further exploration. The debate surrounding this topic remains ongoing. This paper seeks to address three key aspects: First, the paradigms of Islam-State interrelations. Second, the internal and external factors influencing the relationship between Islam and the State. Third, the positive and negative implications of this interrelationship on state governance and societal structures. This research employs a literature review method with a descriptive qualitative approach, analyzed through content analysis techniques. The findings reveal three key points. The study identifies three paradigms: (1) Secularistic, (2) Integralistic, and (3) Symbiotic Mutualistic. Internally, the interrelation is shaped by: (1) The social structure of Indonesian society, (2) The ideological perspectives of Indonesian political leaders, (3) The history of Indonesian independence, and (4) The religiosity of the Indonesian populace. Externally, it is influenced by: (1) The ideological positions of foreign political leaders, (2) Foreign policies, and (3) Islamic-based state ideologies. The implications for society and state governance are both positive and negative. On the positive side: (1) A compromise between secular and integral paradigms contributes to societal harmony in Indonesia, (2) Human rights, particularly in the domains of religion and state, are respected, and (3) Amendments and changes to state statutes and laws are made in alignment with the evolving conditions of Indonesian society. On the negative side: (1) Disputes over the fundamental ideology of the Indonesian state persist, (2) Divisions in understanding based on differing paradigms are evident, and (3) There is a growing fanaticism associated with these ideological paradigms. In conclusion, the paper argues that the symbiotic mutualistic paradigm governing the relationship between Islam and the State is both valid and relevant to the social conditions in Indonesia.

Abstract

In Musi Banyuasin Regency, the quest for gender equality in political representation faces multifaceted challenges. This study explores the barriers hindering female participation and representation in local electoral processes. Through qualitative analysis, interviews with key stakeholders including female candidates, local officials, and community leaders were conducted to uncover underlying issues.The findings reveal several critical challenges. Firstly, structural barriers such as entrenched patriarchal norms and limited access to financial resources significantly impede women from contesting elections on an equal footing with their male counterparts. Secondly, despite legal frameworks promoting gender equality, cultural perceptions and societal expectations often undermine women’s political ambitions. Thirdly, the role of political parties emerges as pivotal, with varying levels of support and nomination opportunities affecting women’s candidacy viability. Moreover, the study highlights community attitudes towards female leadership, where biases and stereotypes persist, shaping voter preferences and electoral outcomes. These dynamics perpetuate a cycle of underrepresentation and marginalization of women in decision-making bodies like the local legislative council. Ultimately, achieving gender equality at the polls in Musi Banyuasin Regency necessitates concerted efforts from various stakeholders to dismantle barriers, reshape cultural narratives, and advance inclusive governance practices

Abstract

Students represent a significant segment of new voters in General Election contests. As newcomers to the electorate, students must develop a thorough understanding of political awareness and participation in elections. This study aims to examine students' comprehension of political awareness and their engagement with money politics, as well as the impact of such practices on elections. Utilizing both qualitative and quantitative methods, data were collected through surveys and in-depth interviews with 30 students. The findings reveal diverse levels of political awareness, shaped by factors including education, information access, social environment, and political experience. While most students demonstrate a solid understanding of money politics and express negative attitudes towards it, some encounter moral dilemmas. Economic background, education, and political experience significantly affect their views on money politics. This practice also influences their political participation by diminishing trust in the political system and reducing their motivation to engage. These results underscore the necessity of enhancing political awareness and addressing money politics among students to fortify democratic processes.

Abstract

This paper aims to analyze the conflict between Palestine and Israel, particularly following the martyrdom of Hamas leader Ismail Haniyeh. The transition in leadership within Hamas may lead to significant strategic shifts in the group's operations. Employing a qualitative approach and a literature review method, this research will explore relevant literature and incorporate geopolitical perspectives to assess the impact of Ismail Haniyeh's martyrdom on Middle Eastern security and its implications for regional and international stability. Despite the International Court of Justice (ICJ) instructing Israel to prevent genocide against Palestinian civilians and address the humanitarian crisis in the Gaza Strip, Israel continues to carry out attacks and killings in densely populated areas. International pressure, including from the United Nations, appears ineffective in curbing Israel's military aggression. Israel's inhumane treatment of Palestinians is not a new issue but has been a recurring problem. Therefore, given the aforementioned facts and realities, it is appropriate for countries around the world, including Iran, to adopt a firmer stance against Israel's arrogance and brutality towards Palestinian sovereignty and the geopolitical security of the Middle East.

Abstract

The Election Supervisory Body (Bawaslu) holds a central mandate to oversee and address election violations, including monitoring vote counting, campaign finances, campaign materials such as banners, and preventing black campaigns and money politics. Bawaslu's supervision is guided by PERBAWASLU No. 11 BN 2023/No. 844 on the oversight of general election campaigns. However, there are frequent violations by political parties and legislative candidates, including the involvement of minors in campaigns, the installation of billboards that disrupt public order, and the use of campaign materials exceeding regulated dimensions. This study aims to examine the strategies employed by the Bandar Lampung City Election Supervisory Body (Bawaslu) in supervising the 2024 election campaigns and to identify the challenges encountered during this process. The research adopts a field-based approach with a descriptive-analytical method. The findings reveal that Bawaslu Bandar Lampung City employs several strategies, including: socialization and communication efforts, supervision of campaign materials, and monitoring indications of money politics. However, the institution faces significant obstacles, such as the anonymity of black campaign perpetrators, intimidation experienced by whistleblowers, and limitations in addressing campaign violations effectively. Although Bawaslu lacks full authority in legal enforcement, it remains committed to ensuring electoral integrity and fairness. This commitment underscores the importance of community involvement in fostering a clean and democratic electoral process.
