Abstract

Islam memiliki prinsip-prinsip ekonomi yang mana salah satu prinsip yang dianut adalah prinsip kebebasan. Kebebasan dalam sistem ekonomi liberal dan Islam menjadi menarik untuk ditelaah. Penelitian ini bertujuan untuk menggali makna kebebasan dalam prinsip kebebasan dalam ekonomi Islam dan apa perbedaannya dengan kebebasan dalam konteks ekonomi liberal. Penelitian ini merupakan penelitian kepustakaan dengan menerapkan paradigma kualitatif. Datanya berasal dari berbagai literatur seperti buku, jurnal ilmiah, dan artikel yang relevan. Hasil dari kajian dalam makalah ini adalah bahwa kebebasan dalam pandangan Islam ialah kebebasan bagi setiap manusia untuk mengambil segala tindakan yang diperlukan untuk memperoleh kemaslahatan tertinggi. Dalam implementasinya, prinsip kebebasan dapat dipraktikkan secara beragam, baik secara individual dan kelompok, secara pikiran dan tindakan, dan secara teologis atau ushul fiqh.

Abstract

One of the sharia financial institutions that is experiencing very rapid development is sharia insurance. In sharia insurance there is a mudharabah musytarakah contract. The presence of this contract in sharia insurance in Indonesia is basically not explained in the Al-Qur'an and Sunnah. This research is a literature review, the reading sources consist of books, journals and fatwas relating to mudharabah musyarakah contracts in sharia insurance. This research uses a qualitative approach with descriptive methods. The analytical techniques are used to analyze the meaning contained in the data extracted through library sources. Based on fatwa Number 51/DSN-MUI/III/2006 concerning mudharabah musytarakah contracts on sharia insurance, there are no detailed arguments in the Al-Qur'an and Sunnah regarding halal, haram and syubhat laws regarding mudharabah musytarakah contracts on sharia insurance. However, its implementation must uphold the principles of Islamic law and fulfill the terms and conditions of engagement to avoid gharar, usury and maisir. This fatwa is a manifestation of the seriousness of law makers to develop contracts for sharia insurance institutions which aim to bring benefits.

Abstract

This research is motivated by Village Development and Development in Parit Raja Village, Sejangkung District, seen from the level of Village independence as measured based on the Village Development Index (IDM). This research aims to analyze the concept of village development from an Islamic economic development perspective. The theory used in this research is Ibn Khaldun's Development Economic Theory. This research uses a qualitative research approach which is field research in nature and tends to use analysis which emphasizes process and meaning. The data collection techniques used were observation, interviews and documentation. The data source used is primary. Research data analysis techniques are data reduction, data presentation, drawing conclusions. Based on the results of this research, it is concluded that Parit Raja Village has implemented the concept of Islamic development economics which consists of 5 variables including state, institutions, human beings, wealth, and justice and development.

Abstract

This descriptive quantitative research was conducted to determine the selling price of rice through the calculation of the cost of goods manufactured. The data used consisted of primary data from interviews with the manager of the Talago Rice Mill. Data processing was carried out using the full costing and variable costing methods to determine the cost of goods manufactured. The results of the analysis and discussion show that the selling price of rice determined by the manager is lower than the selling price calculated by the full costing method and higher than the selling price by the variable costing method. The selling price obtained from the full costing method is IDR 16,200/kg, while the selling price using the variable costing method is IDR 15,400/kg. This price is different from the selling price determined by the manager as the producer, which is IDR 16,000/kg.

Abstract

This research discusses the analysis of criminal acts of theft with violence, with a case study of Decision No. 448 K/PID/2016 Pekanbaru District Court. This research refers to the increase in crime cases in Indonesia, especially theft, which can harm individuals and society. This research focuses on cases of criminal acts of violent theft involving the defendant Febriadi Panjaitan Alias Adi and hiscolleagues. This research uses normative juridical methods with specifications for using primary and secondary data as well as the application of the law by judges. Criminal sanctions against perpetrators of violent theft are heavier than ordinary theft. Research findings show that the defendant and his colleagues were proven guilty of committing violent theft which resulted in the death of the victim. The Pekanbaru District Court's decision initially imposed a prison sentence of 7 years, then the Pekanbaru High Court upheld the decision by increasing thesentence to 8 years, and the Supreme Court rejected the appeal.

Abstract

Marketing strategy is the right step to face increasingly fierce competition in promoting a product in the era of globalization. Several analyzes can be done to determine the marketing strategy used by a company. Marketing strategies are useful for formulating company goals, such as increasing the number of customers at BMT Eka Mandiri Muntilan Branch. This research adopts a descriptive method with a qualitative approach. The 4P theory (product, price, place, promotion) is also applied in this study by analyzing customer responses using the AIDCA concept (Attention, Interest, Desire, Conviction, Action). The focus of the research is to understand the marketing strategy of wadiah savings at BMT Eka Mandiri Muntilan Branch and analyze its impact on saving interest. The results showed that BMT Eka Mandiri uses a 4P strategy that successfully creates aspects of buying interest, encouraging potential customers to buy and use wadiah savings products. This research is expected to provide information and become a reading material for the readers regarding the marketing strategies and the analysis conducted.

Abstract

This research focuses on implementing the Murabaha contract in BNU'26 Magelang District, the only community bank in Indonesia. BNU's problems in implementing the concept of pure Sharia are related to the constraints of banking laws prohibiting direct transactions. Therefore, to carry out Murabaha transactions, BNU has to partner with suppliers of goods. The second problem is more customer understanding of the Murabaha contract. This research was conducted at BNU'26 Magelang using a qualitative method. Data was collected through interviews. The results of this study indicate that murabaha financing uses murabaha bil wakalah, where the bank does not provide goods directly. Alternatively, the bank works with other parties to provide goods used as Murabaha financing to customers.

Abstract

One of the obstacles in the Musyarakah Mutanaqisah contract is that two contracts must be carried out, namely cooperation (Syirkah) and rent (Ijarah). In implementing musyarakah mutanaqishah, two types of transactions are involved in one agreement. Therefore, capital goods are not only the object of transactions in musyarakah mutanaqishah but also function as objects in ijarah transactions for business development and as objects in buying and selling transactions to protect ownership of capital goods. This research aims to determine how the implementation of the musyarakah mutanaqisah contract at Bank BNU'26 Syariah Magelang is implemented. Mutanaqisah musyarakah contract is an agreement or arrangement between two or more people that is derivative and in the form of an agreement. This study uses qualitative methods with two approaches, namely interviews and observations. The results of this study confirm that BNU'26 Syariah, implementing the mutanaqisah musyarakah contract to customers, is there is cooperation between the bank and the customer in an effort based on mutual agreement. The contract can be agreed upon if the customer agrees to the requirements that Bank BNU'26 Syariah Magelang has determined.

Abstract

The heirs and their shares in Islamic inheritance law have been rigidly regulated in the Qur'an, hadeeth and ijma', everyone who has a relationship of marriage, descent, and kinship, whether the status is still in the womb, male and female have their respective rights and shares. However, in reality of life, there are heirs whose status is unclear because they have multiple sexes (khunṡa), so that the share of inheritance received cannot be determined with certainty. The purpose of this study is to find out the inheritance rights of khunṡa, the opinion of the mażhab scholars and the calculation method for resolving khunṡa cases in detail. This research uses an analytical descriptive method with a qualitative approach. The results of this study identify two types of khunṡa: first, khunṡa ghairu musykil, whose inheritance is determined by the method of urination. If it is through the male sex, it inherits the male share; if it is female, it inherits the female share. If it is through both sexes, it is determined by the sex that urinates first, because it is considered the original identity. If it comes out at the same time, it is determined by the greater volume. Secondly, khunṡa musykil is divided into two conditions: first, when it is still possible to clarify the status of khunṡa because she has not yet reached puberty. In this case, he and the other heirs are given the smallest share of the two estimates of a male or female, with the rest of the estate deferred until the status of the khunṡa becomes clear. Secondly, when it is no longer possible to clarify the status of the khunṡa because he has reached puberty, but he does not have the characteristics of a male or female. In this situation, he and the other heirs are given half of the two estimates of male or female. This share calculation can be the best alternative in resolving khunṡa inheritance cases because there is still a legal vacuum in the compilation of Islamic law in Indonesia.

Abstract

Islam is a religion that has a universal system that regulates good business and is in accordance with religion. Many companies are switching to an Islamic business system, called sharia economics. Currently, people really like the Islamic business system. Sharia-based companies include PT HPAI (Herbal Penawar al-Wahida Indonesia), which later became HNI-HPAI (Herba Penawar Al-Wahida Indonesia-Halal Network International). This research aims to determine the supporting and inhibiting factors for implementing supply management at the herbal HPAI halal mart in Sambas Regency. In this research, qualitative research was used. The data collection technique is carried out by means of interviews, then analyzed through data reduction, classifying the data, presenting the data and finally drawing conclusions. The data sources in this research consist of 2, namely primary data and secondary data. One of the supporting factors for carrying out herbal medicine supply management in Sambas Regency can involve operational efficiency, product quality and good marketing strategies. Meanwhile, inhibiting factors may include raw material supply instability, regulatory changes, or logistical constraints. The external supporting factor is that many people know the quality of HPAI products, so they are easy to sell because the prices are affordable. The internal inhibiting factor is not having its own way or rules to handle orders for lots of herbal products by consumers and delays in delivery of goods. These delays are due to an overload of goods to be sent by the expedition.
