Abstract

The research began with the problem of the city/district minimum wage as a basis for calculating health insurance contributions, where there are still several regions that overlap with each other, where the minimum wage difference is large and there are still employers who have not registered workers in the health insurance program. The research method uses a normative juridical research type with a statutory approach and a case approach. The results of the discussion are that the system for calculating BPJS contributions according to the UMK is still regulated in Presidential Decree 59/2024, where there is potential for social inequality and efforts to resolve the calculation of health insurance contributions in the form of making a collective agreement between workers, employers and elements of trade unions regarding adjustments to the amount of wages linked to payment capacity. health insurance contributions.

Abstract

This study examines the capital conversion process in the transformation of Bank NTB from a conventional bank to an Islamic bank, focusing on the regulatory, institutional, and operational aspects involved. Using a qualitative literature review method, this study explores the institutional restructuring and financial implications of the conversion process. The results of the study indicate that despite a temporary decline in financial performance indicators during the transition period, Bank NTB Syariah managed to record an increase in asset growth, third-party funds (DPK), and financing in the following years. This study concludes that the success of the conversion is highly dependent on strategic planning, organizational synchronization, and the effective implementation of Islamic economic principles. This study contributes to the literature on institutional transformation in the Islamic banking sector in Indonesia.

Abstract

This article explores the Islamic legal perspective on the use of contraceptives, particularly through the lens of Ahkamul Fuqoha and the decisions of Nahdlatul Ulama’s Legal Advisory Council (LBM NU). Employing a qualitative method with a normative-theological approach, this study is based on comprehensive literature analysis. The findings indicate that LBM NU formulates legal rulings on contraception using a collective ijtihad (istinbath jama’i) methodology grounded in the objectives of Islamic law (maqashid al-shari’ah). Contraceptive use is considered permissible (mubah) if not permanent and aimed at protecting health, family welfare, and adhering to Islamic ethical guidelines. This reflects the adaptive nature of Islamic jurisprudence in addressing contemporary social challenges in Indonesian Muslim society.

Abstract

After the Constitutional Court (MK) published Decision Number 168/PUU-XXI/2023, which was read aloud in an open plenary session of the Constitutional Court on October 31, 2024, employment law standards underwent changes. The court stressed that employers and employees must engage in bipartite discussions through debate to reach an agreement if workers/laborers reject Termination of Employment (PHK). Additionally, the layoff can only be carried out following a decision from an industrial relations dispute resolution body whose ruling has permanent legal force (inkracht) if bipartite negotiations fail to result in an agreement. With a focus on the inventory of positive law, legal doctrine, and principles, this study employs a normative legal method. Employers must therefore take into account the following dynamics: employers are not allowed to implement layoffs until they have received a decision from an industrial relations dispute resolution body that has permanent legal force, and every worker rejection of layoffs must be preceded by bipartite negotiations through deliberation to reach consensus.

Abstract

This study aims to find out the law regarding non-cash money exchange and how to avoid riba (usury) by carrying out alternative types of transactions. This research is a library study using a descriptive qualitative method with a normative legal approach. It examines and studies texts from Islamic law, such as the Qur'an, hadith, and the opinions of scholars that are relevant to the topic. After collecting the data, the information is processed and analyzed by summarizing and connecting theories related to the problem in order to draw conclusions. The results of the study show that paper money can be compared to gold and silver because it shares the same 'illah (legal reason), namely muṭlaq aṡ-ṡamaniyah (having value and serving as a means of exchange). Since the 'illah is not limited only to gold and silver, the rules of riba also apply to paper money, and zakat must be paid on it. In transactions exchanging the same type of money, such as rupiah for rupiah, the amounts must be equal, and the exchange must happen immediately. If there is a delay, either partially or fully, it will prevent the immediate transfer between the two parties, causing the transaction to fall into riba nasiah — a form of riba caused by delaying the delivery or acceptance of one of the exchanged riba items.Therefore, if such an exchange must happen, it is necessary to use an alternative form of transaction to avoid riba, such as a qardh (loan) contract or a qardh contract with collateral.

Abstract

This study examines the system and principles of Islamic economics from both a theoretical perspective and its contemporary implementation in Indonesia. Using a literature review method and a descriptive-analytical approach, the research aims to identify and analyze the fundamental principles of Islamic economics, such as tauhid, justice, khilafah, and al-Mas’uliyah, as well as evaluate their application in the context of modern economics in Indonesia. Through a review of relevant literature sources, this study finds that although Islamic economics holds significant potential to create a just and sustainable system, its implementation in Indonesia faces various challenges, such as social inequality, unsustainable resource management, and lack of transparency in business practices. Therefore, efforts are needed to improve the understanding and implementation of Islamic economic principles to create a more inclusive and just economic system.

Abstract

This study aims to analyze the concepts, principles, implementation, as well as the challenges and opportunities of Islamic Financial Institutions (IFIs) in Indonesia through a qualitative literature review method. The findings show that IFIs—including Islamic banks, Islamic insurance, Islamic cooperatives, Islamic pawnshops, and Islamic finance companies—have grown significantly and contributed to the economy, particularly in financing the real sector and empowering micro, small, and medium enterprises (MSMEs). This development is supported by regulations, fatwas issued by the National Sharia Council–Indonesian Ulema Council (DSN-MUI), and the increasing public awareness of Sharia-based finance. Nevertheless, IFIs still face challenges such as low Sharia financial literacy, limited product variety, and the need for consistent Sharia compliance. On the other hand, there are substantial opportunities through product innovation, government support, and digitalization, which can enhance financial inclusion and expand service reach. Therefore, strengthening literacy, ensuring consistent Sharia compliance, and utilizing digital technology are crucial strategies to reinforce the role of IFIs in establishing a just, ethical, and sustainable financial system.

Abstract

This study examines the development of Indonesia’s economic system from the early independence period, the New Order era, to the Reform era, highlighting the dynamics of policy changes, challenges faced, and their implications for public welfare. In the early independence period, the economy was characterized by etatism, with the state acting as the main controller; however, weak infrastructure and political instability hindered its effectiveness. The New Order era was marked by rapid economic growth through a mixed economic model and industrialization, yet it was overshadowed by inequality, dependence on oil and foreign debt, as well as corruption, collusion, and nepotism (KKN). Meanwhile, the Reform era introduced market liberalization and global openness, although issues of equity, economic sovereignty, and foreign capital dominance remained unresolved. Using a descriptive qualitative approach, this study emphasizes that the success of Indonesia’s economic development depends on balancing market efficiency, political stability, good governance, and the implementation of social justice principles in accordance with Article 33 of the 1945 Constitution.

Abstract

The phenomenon of online gambling in Indonesia has experienced a significant increase in line with the advancement of digital technology, leading to various social, economic, and moral impacts within society. From a sociological perspective, online gambling is not only regarded as a legal violation but also as a social symptom that reflects weak social control, a crisis of values, and economic disparities. It has triggered multiple problems such as rising debt, divorce, criminality, and even structural poverty. From the perspective of Maqashid Syariah—which encompasses the five essential objectives of preserving religion (hifz al-din), life (hifz al-nafs), intellect (hifz al-‘aql), lineage (hifz al-nasl), and wealth (hifz al-mal)—online gambling is clearly in contradiction with Islamic law, as it destroys wealth, intellect, and family stability. Efforts to eradicate it cannot rely solely on legal measures but must also be reinforced through moral education, the strengthening of community-based economic resilience, and integrated technological supervision. The Maqashid Syariah approach provides a normative and strategic foundation to assess and comprehensively address online gambling, not only for legal compliance but also for the pursuit of sustainable social well-being. Therefore, the integration of state policy and religious values becomes the key to effectively responding to this phenomenon.

Abstract

This study examines the existence of hadith as the second source of Islamic law after the Qur’an, as well as the methods employed to interpret and implement it in the formation of Islamic legal rulings. Hadith serves as an explanation of Qur’anic verses, a source of new legal rulings, and a guide for Muslim daily life. The research combines library study and field observation, employing the maqāṣid al-syarī‘ah approach to analyze the principles, methods, and both textual and contextual approaches in understanding hadith. Findings reveal that a comprehensive understanding of hadith requires verification of the chain of transmission, analysis of the text, and consideration of historical and social contexts. Accordingly, hadith not only reinforces its position as a source of Islamic law but also contributes to the development of relevant, applicable, and contemporary-oriented legal solutions.
