Abstract

This study aims to identify and analyze the factors underlying farmers’ decisions to preserve local rice seeds, particularly the Sampit and Kakbulat varieties, in Sungai Rambah Village. The research employed a qualitative descriptive method, with data collected through observation, interviews, documentation, and questionnaires involving 23 farmers selected using a convenience sampling technique. The data were analyzed tabulatively in percentage form and further reinforced using a Likert scale approach. The findings indicate that farmers in Sungai Rambah Village preserve local seeds due to knowledge (100%), experience (100%), habitual practices (91%), and capital efficiency (100% relying on self-funding without significant costs). Moreover, biological (95.65%), psychological (97.83%), and environmental (91.30%) factors also influence their decision to maintain local seeds. In-depth interviews further revealed that local seeds are considered more efficient, resilient to extreme weather conditions, and are deeply embedded in the farmers’ inherited cultural practices.

Abstract

Consumers have many considerations when choosing to buy a product, paying attention to product quality, service quality, and price quality because these factors are part of consumer satisfaction. The purpose of this study is to determine consumer satisfaction with red ginger products. This study was conducted from February to April 2025 at Cafe Negeri Nikmat (CNN) Sambas. The basic method of this study uses a qualitative descriptive methodology where the data used in this study are primary data and secondary data collected from 100 respondents. The results of this study indicate that product quality with a total of 3270 and a percentage of 82% is stated to be very satisfied by consumers, service quality with a total of 3264 and a percentage of 82% is stated to be very satisfied by consumers, and price quality with a percentage of 3285 and a percentage of 82% is stated to be very satisfied. Overall, the level of consumer satisfaction with red ginger drinks at Cafe Negeri Nikmat is in the very satisfied category. This reflects that this product has succeeded in meeting consumer expectations in terms of quality, service, and price, and has the potential to encourage repeat purchases and consumer loyalty.

Abstract

The purpose of this study was to analyze the effect of green marketing and environmental attitude on green purchase intention, both directly and through the mediation of green brand image and moderation of consumer involvement, in MSMEs in Medan City. This study used the partial least square method using 250 samples. The results showed that green price, green product, green place, green promotion, and environmental attitude had a positive and significant effect on green purchase intention, and each also had a significant effect on green brand image. Green brand image was proven to significantly increase green purchase intention, while consumer involvement also had a significant effect on green purchase intention. However, only the moderation of consumer involvement on the relationship between green product and green purchase intention was significant, while the moderation on the relationship between green price, green place, green promotion, and environmental attitude was not significant. In addition, all mediation relationships through green brand image between green marketing components and environmental attitude on green purchase intention were proven to be significant, confirming the important role of green brand image in shaping consumer purchase intention towards environmentally friendly products of MSMEs in Medan City. In conclusion, green marketing and environmental attitude have a significant effect on green purchase intention, both directly and through green brand image as a mediator, while consumer involvement only significantly moderates the relationship between green products and green purchase intention.

Abstract

This study aims to analyze the implementation of Jambi City Regional Regulation Number 5 of 2024 concerning the Spatial Planning (RTRW) of Jambi City for the period 2024–2044, particularly in relation to the use of public road space by informal economic actors, specifically street vendors (PKL). Employing a normative-empirical legal method with a qualitative approach through field observation and interviews, this research identifies a significant discrepancy between the planned spatial framework outlined in the RTRW and the actual use of public space by the community. The findings reveal that the occupation of road shoulders for informal trade has exceeded the designated function of primary collector roads as regulated in Article 21 paragraph (3) of the RTRW, and does not fully align with spatial zoning principles under relevant sectoral laws, including technical guidelines as per Ministry of Public Works Regulation Number 5 of 2023. Such inconsistencies have led to traffic congestion, urban aesthetic degradation, and potential horizontal conflicts between informal and formal economic actors. The study further evaluates the regulation within the framework of legislative drafting principles under Law Number 13 of 2022, concluding that its implementation has not yet achieved full sociological enforceability. As a recommendation, the study calls for the enactment of derivative regulations in the form of a Mayor Regulation (Peraturan Wali Kota) to govern technical aspects of spatial usage for informal economic activities, and the formal designation of city squares (alun-alun) as strategic zones to ensure legality, spatial order, and distributive justice.

Abstract

Blood transfusion is a vital medical practice that saves lives and has become a standard procedure in modern healthcare. Within the Islamic context, it raises fiqhi discussions regarding its permissibility, especially considering that blood is categorized as impure. However, contemporary scholars view transfusion as a necessary act allowed in emergencies to preserve life, aligning with the objectives of Islamic law (maqāṣid al-syarī‘ah). Fatwas issued by religious authorities such as the Indonesian Ulema Council (MUI) and Al-Azhar affirm its permissibility, provided the intention is sincere, medical safety is ensured, and the need is evident. Therefore, blood transfusion is not only medically valid but also religiously endorsed as a form of social worship and humanitarian rescue. This indicates that Islam is a religion that is responsive to human needs.

Abstract

The Sole Proprietorship Company (Perseroan Perorangan), introduced by the Job Creation Law, created a single-owner legal entity with limited liability. This novel structure, however, generates significant legal ambiguities within national bankruptcy law, particularly regarding the separation of corporate and personal assets. This study employs a normative juridical method to analyze these ambiguities and proposes a necessary regulatory reconstruction to ensure legal certainty. Findings reveal that the absence of specific bankruptcy norms for Sole Proprietorship Companies directly facilitates the harmful practice of serial bankruptcy. This maneuver involves repeated corporate liquidation by the sole owner to evade financial obligations, thus undermining the principle of good faith and eroding creditor trust. To address this, the research recommends a legal reconstruction built on three critical pillars: rigorous testing of the owner's good faith, mandatory strengthening of asset separation, and the strict application of the Piercing the Corporate Veil (PCV) doctrine. This reconstruction is vital to ensure the Sole Proprietorship Company genuinely serves to empower Micro and Small Enterprises (MSEs), rather than functioning as a loophole for corporate abuse.

Abstract

Murabahah financing, as a prevalent Islamic banking product, frequently encounters default issues requiring resolution that aligns with sharia principles. This study aims to analyze the application of sharia economic law principles in resolving Murabahah contract defaults at the Situbondo Religious Court. Employing a qualitative method with a normative juridical approach, this research analyzes court verdict documents as primary data, supplemented by DSN-MUI fatwas and relevant literature as secondary data. The findings indicate that while the Murabahah contract formally fulfilled its pillars and conditions, the implementation of sharia principles in default resolution faced challenges, particularly regarding the imposition of late penalties that did not fully reflect the principles of justice (al-'adl) and compensatory damages (ta'widh). The study concludes that despite procedural adherence, substantive sharia compliance requires greater attention, especially in sanction clauses. It recommends enhanced socialization and assistance for sharia financial institutions to ensure comprehensive alignment of financing practices with sharia principles, encompassing both formal and substantive aspects of the contract.

Abstract

The proliferation of scams disguised as Multi-Level Marketing (MLM) in Indonesia has raised public doubts about the legitimacy of MLM practices, including Oriflame, from the perspective of Islamic law. This indicates the need for a deeper study to assess the compatibility of Oriflame's MLM business mechanism with maqasid al-syariah and Fatwa DSN MUI No. 75 of 2009. This article is composed using a qualitative approach involving in-depth interviews and observations. Based on the research conducted, the mechanism of Oriflame's MLM practice begins with registering as an Oriflame reseller, promoting Oriflame products through social media, recruiting members or resellers, and developing downlines through training and sales tools. Oriflame's MLM practice involves reseller registration, product promotion via social media, member recruitment, and downline development through training. This system is halal and compliant with Sharia because it fulfills the maqasid syariah (hifz ad-din, al-nafs, al-aql, al-nasl, al-mal). In accordance with MUI Fatwa No. 75/2009, it meets 12 Sharia requirements, including real sale objects, halal certification, transactions without fraud/fixed prices, commissions from real sales/recruitment without ighra'/coercion, unpaid recruitment, downline development, and not being a money game.

Abstract

The environmental crisis in Indonesia is marked by various problems that threaten human life and various economic sectors. The Indonesian government has issued green sukuk products as an effort to improve the environment and provide alternative investments for the public. This study examines the potential of green sukuk products in promoting sustainable economic development in Indonesia from the perspective of maqāṣid al-syarī‘ah. This study uses a qualitative approach with data derived from literature related to sukuk, green sukuk regulations in Indonesia, and the maqāṣid al-syarī‘ah framework. This study will emphasize the thoughts of Imam al-Syatibi in his monumental work al muwafaqot in which he argues about the concept of istiqro'i in the application of the maqāṣid al-syarī‘ah paradigm to arrive at the qosd sharia objectives. Sheikh Thohir Ibn Asur's thoughts on maqāṣid al-syarī‘ah are also used as a basis for analyzing this research. The results of the study indicate that green sukuk has great potential to become a key pillar in the transformation of a sustainable economy in Indonesia. The integration of maqāṣid al-syarī‘ah in the implementation of green sukuk can ensure that economic growth is not only oriented toward financial gain but also toward achieving syariah objectives that prioritize environmental sustainability and social justice.

Abstract

The problem regarding the interpretation of the meaning of imprisonment and corporal punishment as stated in Article 73 paragraph (3) of UNCLOS 1982 has caused differences in judges' decisions against perpetrators of IUU Fishing in the Indonesian Exclusive Economic Zone (ZEEI). On the one hand, there are courts that explain that confinement in lieu of a fine is contrary to UNCLOS 1982, while on the other hand it is said that it does not violate UNCLOS 1982. This study was conducted to provide a legal study of whether the imposition of confinement in lieu of a fine on perpetrators of IUU Fishing in ZEEI. The results of this study, namely according to the interpretation of grammatical and the meaning of words/terms (taalkundige interpretation) and the explanation of legal experts, can be concluded that imprisonment and confinement (including confinement in lieu of a fine) are included in the scope of the prohibition of Article 73 paragraph (3) of UNCLOS 1982, because this punishment eliminates a person's freedom. Courts in Indonesia should be consistent not implementing imprisonment and corporal punishment considering that Indonesia has ratified UNCLOS 1982 and is bound by the principle of pacta sunt servanda. This paper provides proposals to amend the Fisheries Law and Judges are also encouraged to make independent legal discoveries to create substitute criminal sanctions for fines that do not conflict with UNCLOS 1982.
