Abstract

This study aims to analyze the practice of granting marriage dispensation at the Kraksaan Religious Court from the perspective of positive law in Indonesia. Marriage dispensation is the court's authority to grant marriage permits for couples who have not reached the minimum age limit as stipulated in Law Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage. The research method used is qualitative with a juridical-sociological approach. Data were obtained through interviews with judges and studies of marriage dispensation decisions at the Kraksaan Religious Court during the enactment of Law Number 16. The results of the study indicate that the granting of marriage dispensation at the Kraksaan Religious Court is still dominated by reasons of pregnancy outside marriage and family pressure, although normatively it must consider aspects of the welfare and protection of children. In practice, judges tend to use social and psychological considerations in deciding cases, although sometimes they do not fully refer to the spirit of child protection in positive law. These findings indicate a tension between social reality and applicable legal norms, so that synergy is needed between regulations, public education, and child protection policies.

Abstract

This study discusses the status of children from unregistered marriages from the perspective of Islamic law and Indonesian positive law. The results of the study show that the two legal systems provide different approaches. Islamic law recognizes children from unregistered marriages as legitimate children who have a blood relationship, rights to support, and inheritance, as long as the marriage meets the pillars and requirements of validity according to sharia. In contrast, Indonesian positive law requires official registration as a form of legal recognition of marriage, so that children from unregistered marriages initially only have a civil relationship with their mother. Although the Constitutional Court Decision Number 46/PUU-VIII/2010 opens up space for recognizing the relationship between children and their biological fathers, complex legal evidence procedures still make it difficult for children to access their legal rights. The difference between the substantial approach in Islamic law and the formal approach in national law creates gaps in legal protection for children. Therefore, it is necessary to harmonize the two legal systems through simplification of marriage confirmation procedures, increasing legal education, and reforming technical regulations to ensure legal certainty and protection of the rights of children from unregistered marriages.

Abstract

Inheritance disputes often occur due to unilateral control over inherited property, so that the application for bail confiscation is submitted as a preventive measure in the Religious Court. This research examines the legal basis and implementation of bail confiscation in inheritance cases at the Klaten Religious Court through a study of Decision Number 0219/Pdt.G/2024/PA.Klt. As a result, the application was rejected because the object of inheritance was not controlled by the defendant and the evidence did not support it. It was concluded that the submission of a security seizure must be accompanied by strong evidence, as well as the need for technical guidelines to ensure legal certainty for the parties.

Abstract

This study aims to analyze the impact of income disparity between husbands and wives on the development of sakinah (harmonious) families within the framework of Islamic family law. The phenomenon of wives earning a higher income than their husbands is increasingly prevalent, particularly among families in semi-urban areas such as Banjar Agung District, Tulang Bawang Regency. In the context of Islamic family law, the husband is positioned as the head of the household, bearing primary responsibility for financial support and leadership within the family. Thus, it is essential to examine how income inequality influences spousal relations and the realization of sakinah values. This research employs a qualitative approach using a field study design. The informants consist of six women, all wives who work as market traders and earn more than their husbands. Data were collected through in-depth interviews, participant observation, and documentation, then analyzed using data reduction, data display, and conclusion-drawing techniques. The findings reveal that despite economic disparities, most families maintain household harmony by fostering effective communication and cooperative relationships. Domestic responsibilities and decision-making processes are predominantly shared through mutual consultation, although some couples experience challenges due to unbalanced role distribution. In general, wives continue to uphold their husbands’ position as heads of the household and do not fundamentally alter the normative structure prescribed by Islamic family law.

Abstract

Marriage in Indonesia is regulated by Law Number 1 of 1974 concerning Marriage in conjunction with Law Number 16 of 2019. One form of dissolution of marriage is through divorce decided by the court. This study examines the application of the principle of ne bis in idem in divorce cases, namely the legal principle that prohibits the retrial of the same case that has obtained permanent legal force. This study found differences in academic opinion regarding its application in divorce cases. Some legal experts argue that ne bis in idem applies in divorce cases, while others consider this principle inappropriate to apply considering the dynamics of emotional relationships and the possibility of new legal facts emerging. This study also discusses the regulation of divorce law in Indonesia, both for Muslims and non-Muslims, divorce procedures, and the legal consequences that arise, such as child custody and division of joint property. The findings indicate the need for special regulations, for example through a Circular of the Supreme Court, to provide legal certainty in the application of the principle of ne bis in idem in divorce cases.

Abstract

Mut’ah marriage or contract marriage is a temporary marriage that is carried out in a secret manner. It is often done for sexual and economic reasons. From the perspective of positive Indonesian law, mut’ah marriage is contrary to the essence of eternal marriage as stated in the Marriage Law and the Compilation of Islamic Law. From the perspective of Islamic law, mut’ah marriage is declared haram by the majority of scholars because it is not in accordance with the purpose of marriage which prioritizes continuity, responsibility, and protection of the rights of the wife and children. Mut’ah marriage can also give rise to several criminal problems such as adultery, embezzlement of the origin of marriage, and other criminal acts. This study was conducted to examine the urgency of the probability of criminalization of perpetrators of mut’ah marriage.

Abstract

Inheritance law is closely related to various aspects of human life, as every individual will inevitably encounter the legal event of death. Upon the death of a person, land ownership certificates forming part of the estate are transferred to the heirs. Heirs may initiate a name transfer and certificate splitting process if there are multiple heirs. This study is a normative juridical legal research with a descriptive nature. The research employs a statutory approach and a case approach. The data used is secondary data, consisting of primary, secondary, and tertiary legal materials. Data collection techniques involve literature study, and data collection tools include document review. The data gathered is analyzed qualitatively. The findings indicate that the splitting of land certificates inherited from the deceased can be legally valid without the consent of all heirs, provided there is a court ruling in which one of the heirs has filed a lawsuit. The legal consideration of the judges in case number 137/Pdt.G/2023/PN.Mdn essentially explains that the Panel of Judges ultimately granted the Plaintiffs’ claim in full and validated the splitting of the inherited land certificate, despite the absence of the Defendants’ signatures.

Abstract

This research examines the influence of customary mediation in resolving inherited land disputes in Nifikiu Village, Amanuban Timor Sub-district, TTS District. The case study shows that customary law-based mediation, such as the Natoni ritual, is an effective alternative to formal litigation. Customary mediation promotes peace, strengthens land tenure rights and maintains social harmony. However, the absence of one of the parties hinders the settlement process. The results show the importance of collaboration between customary law and state law to create fair and sustainable agrarian legal certainty.

Abstract

The case of the loss of minutes of a notary's deed who died in Labuhanbatu Regency has raised serious legal problems related to the accountability and legal protection of the parties. Based on normative legal research with a descriptive analytical approach through literature studies and interviews with three Notaries in Labuhanbatu Regency, it was concluded that the responsibility is divided between the notary's heirs who are obliged to report the loss to the MPD, make a report, and submit the remaining protocol, and the notary receiving the protocol who is fully responsible for storing and managing the protocol based on Article 65 of the UUJN. Legal protection for the parties can be obtained through the creation of a replacement deed (Article 57 of the UUJN), court decisions, compensation claims, and assistance from the MPD in reconstructing the deed while maintaining the rights of the parties to obtain complete information about the handling of the loss case.

Abstract

A notary is an official authorized to create authentic deeds with perfect evidentiary power, including in inheritance matters. Negligence in omitting certain heirs from an inheritance certificate may harm other heirs and result in legal accountability. Under the Civil Code, the notary may be subject to civil sanctions, such as compensation, if proven to have caused losses through unlawful acts. The inheritance certificate can be null and void if there is intent from the appearing party to misrepresent facts or documents. Alternatively, it may be annulled by a court decision based on a complaint from a harmed party.
