Abstract

The philosophy of health law plays a pivotal role in guaranteeing the right to health, social justice and state responsibility for equitable services. This right is grounded in the Universal Declaration of Human Rights and the International Covenant on Economic, Social and Cultural Rights; however, its implementation in Indonesia still faces social, economic and geographical disparities. Universal Health Coverage programs, such as the National Health Insurance (JKN), are expected to expand access, although the distribution of services remains uneven. This research analyzes the role of the philosophy of health law in formulating solutions that are equitable, inclusive and oriented toward human rights.

Abstract

Dispute resolution does not always have to be through litigation, but can also be achieved through mediation, which has a legal basis in Perma Number 1 of 2016. Mediation is expected to produce a win-win solution, but practice in the field shows an imbalance between certified and non-certified mediators. This study found differences in strategy: certified judges tend to use a collaborative approach, while non-certified judges are more oriented towards positivism, thus encouraging litigation. In conclusion, mediator certification affects the effectiveness of mediation, emphasizing the importance of improving the competence of judges to strengthen the role of mediation in the judicial system.

Abstract

This study examines the legal vacuum in the repatriation of deceased Indonesian Migrant Workers (IMW) from Malaysia in 2024 and the protection diplomacy practices of BP3MI East Java. A juridical-empirical method combines analysis of Law Number 18 of 2017 with a case study of 101 IMW remains repatriations from East Java. The findings identify the absence of a dedicated bilateral Memorandum of Understanding on remains repatriation, normative ambiguity on financing for non-procedural IMWs and an average burden of around twenty million rupiah per case. The study recommends three operational steps: a bilateral MoU with a specific remains clause, revision of Article 27 of Law 18/2017 and the creation of a status-blind emergency fund.

Abstract

Intellectual Property Rights (IPR) protection in Indonesia, as regulated in Law No. 28 of 2014 concerning Copyright and Law No. 20 of 2016 concerning Trademarks and Geographical Indications, is a fundamental basis in ensuring legal certainty for creators and business actors. However, in reality, legal disharmony often occurs when an object has a dual function as both a work of art and a commercial distinguishing mark (trademark). This normative conflict is triggered by a conflict of registration principles, namely the declarative principle of copyright versus the constitutive principle (first-to-file) of trademark rights, which often leads to overlapping protection claims. This study aims to analyze the resolution of legal disharmony between copyright and trademark rights over the same object by referring to Decision Number 40/Pdt.Sus-Hak Cipta/2024/PN.Niaga.Jkt.Pst. The research method used is normative juridical with a statute approach and a case approach. The results of the analysis show that the Panel of Judges resolved the disharmony by applying the originality test as a benchmark. The findings of the study confirm that when an object has been registered and used as a trademark first, the subsequent registration of that object as copyright is considered to not meet the criteria of originality. Harmonization of protection can be achieved through the synchronization of originality testing.

Abstract

Online buying and selling transactions have become a dominant practice in economic activities, yet they raise legal issues when consumers receive damaged goods. This study analyzes the legal consequences of online sale and purchase agreements for damaged goods from the perspective of the strict liability principle. The research employs normative legal research using statutory and conceptual approaches. The findings show that damage to goods gives rise to the seller’s liability as an inherent business risk without requiring proof of fault. The application of strict liability provides more effective consumer protection and enhances legal certainty in resolving online transaction disputes.

Abstract

During the implementation period of law Number 1 of 2023 concerning the Criminal Code (KUHP) and law Number 20 of 2025 concerning the Criminal Procedure of Code (KUHAP), restorative justice as emerged as one form of criminal case resolution that emphasizes the restoration of victim’s conditions, the accountability of offenders into society in order to achieve social harmony. This approach has become an alternative to the conventional criminal justice system in Indonesia. At the Prosecution stage, the Attorney General’s Office of the Republic Indonesia plays important role in implementing restorative justice through the policy of terminating prosecution base on restorative justice. This paper aims to provide a deeper understanding of the concept of restorative justice. This paper aims to provide a deeper understanding of the concepsts of restorative justice, both in terms of its legal basis and its implementation mechanism at the prosecution stage during the transitional period and the simultaneous enforcement of new regulations throughout Indonesia. It is expected that this approach will promote more substantive justice, reduce case backlogs, and encahnce public trust in the criminal justice system in Indonesia, particularly in the Attorney General’s Office of the Republic of Indonesia.

Abstract

This study aims to analyze the criminal liability of perpetrators of Rupiah counterfeiting in Decision Number 319/Pid.B/2023/PN Rap through a normative legal approach and a criminological perspective. The results indicate that the panel of judges correctly applied Article 36 paragraph (1) of Law Number 7 of 2011 in conjunction with Article 55 of the Criminal Code, by proving the fulfillment of the elements of the act, fault, and participation. The sentencing considerations reflect the balance between legal certainty and substantive justice, taking into account the defendant's role and economic motives. Operationally, it is necessary to strengthen law enforcement coordination, optimize counterfeit money detection technology, and improve public financial literacy to prevent similar crimes.

Abstract

Notarial deeds in e-commerce reseller business agreements play a role in ensuring legal protection in digital transactions. This study examines the possibility of legal protection for resellers and the effectiveness of its legal implications in practice. Using a normative juridical approach, the study shows that notarial deeds are key to legal protection for resellers in the digital era, guaranteeing certainty, balance of rights and preventing disputes in online transactions. In the context of e-commerce reseller transactions, notarial deeds remain an essential legal instrument that guarantees legal certainty, protection of rights and the effectiveness of agreement implementation, even though electronic regulations have not yet fully accommodated them.

Abstract

Piercing is a popular form of body modification in Indonesia that has led to the emergence of many piercing services. Every consumer has the right to security and safety in using services as emphasized in Law Number 8 Year 1999 on Consumer Protection. Every piercing service provider is obliged to fulfill consumer rights and obligations as a good faith service provider. However, until now the Indonesian legal system has not specifically regulated the practice of piercing and the liability of piercing service providers if consumers suffer losses due to procedural errors or malpractice. This causes the position of consumers to be very weak and need to get legal protection. This study uses a normative-juridical approach to analyze the urgency of legal regulation and liability of piercing service providers in Indonesia and to compare the regulation of piercing practices with the United States. Legal provisions related to the practice of piercing in the United States have been regulated in detail through licensing, sterilization training, and strict health supervision so as to provide legal protection for consumers. The results showed that legal arrangements related to the practice of piercing in Indonesia are still general and do not specifically address the technical standardization of piercing procedures, resulting in the absence of adequate consumer protection. Consequently, if losses occur, service providers are held liable. Based on this research, it is deemed necessary to formulate specific legal regulations regarding piercing practices in Indonesia in order to ensure safety, health, and legal certainty.

Abstract

This study analyzes the lawsuit for Unlawful Acts (PMH) related to additional service standards for elderly passengers with special needs resulting in death, based on Decision Number 523/Pdt.G/2023/PN Mnd. The main focus of the study is to evaluate the legal responsibility of airlines in providing pre-flight services and the basis for the judge's considerations in deciding the case. Using a normative legal research method with a case approach, the results of the study indicate that the airline's non-compliance with standard operating procedures for serving passengers with special needs constitutes a form of negligence that fulfills the elements of PMH according to Article 1365 of the Civil Code. [REVISI] This study also examines airline obligations under Law Number 1 of 2009 on Aviation and applicable passenger protection regulations. Decision Number 523/Pdt.G/2023/PN Mnd established that the airline was proven to have committed unlawful acts and was ordered to provide compensation to the plaintiff.
