Abstract

The use of bankruptcy as a debt collection tool has become a significant issue within the Indonesian bankruptcy law system. The fundamental principle should be that bankruptcy serves as a collective solution for debtors unable to pay their debts to creditors, rather than a coercive instrument to force a debtor to settle a specific debt. However, in practice, there are instances of misuse where bankruptcy petitions are filed by a single creditor or a group of creditors with the primary objective of pressuring the debtor for immediate payment, even when the debtor still possesses financial capacity. This situation threatens the balance between debtor protection and creditor rights.This research is normative legal research utilizing a case study approach. Normative legal research is employed to examine prevailing norms, principles, and legal rules, specifically the Law on Bankruptcy and Suspension of Obligation for Payment of Debts (UUKPKPU), Supreme Court Circular Letter (SEMA) No.3/2023 and legal doctrines related to bankruptcy. The case study approach is applied through an in-depth analysis of Decision Number 97/Pdt.Sus-PKPU/2024/PN Niaga Jakarta Pusat and Decision Number 71/Pdt.Sus-PKPU/2024/PN Niaga Jakarta Pusat. The analysis of these decisions indicates that the panel of judges applied the principle of prudence as mandated by SEMA No.3/2023. In their considerations, the panel did not merely rely on the formal requirements of simple evidence but also conducted a substantial verification of the existence of the debt and the number of creditors. The judges rejected the PKPU (Suspension of Debt Payment Obligations) petitions on the grounds that the submitted debts were still in dispute (disputed debt) and did not constitute mature and collectible debts (liquidated debt). The implications of these decisions are highly significant.

Abstract

The development of information technology has brought significant changes to commercial activities in Indonesia, particularly through e-commerce. One popular payment method is Cash On Delivery (COD), where buyers pay for goods in cash upon receipt. However, the COD system poses various problems, especially for couriers who are tasked with delivering goods and receiving payments. Couriers often face risks such as order cancellations by buyers, verbal and physical threats and misunderstandings regarding responsibility for product discrepancies. This study aims to identify the legal issues faced by couriers in COD transactions and analyze the legal protections available to couriers in the event of a dispute. The research method used is empirical juridical with a normative and empirical approach that combines the study of legislation and field data collection through questionnaires and interviews with couriers in the South Jakarta area. Legal protection theory is used as the basis for analysis, focusing on the protection of couriers as third parties who are not directly involved in sales and purchase transactions but play an important role in the transaction process. This study analyzes complaints received by couriers in COD transactions from 100 respondents. The most common complaint was order discrepancies (81,6%), followed by damaged goods (9,7%) and unilateral cancellations (8,7%). Couriers are often the first to face complaints even though they are not directly responsible for the product. A total of 77,7% of complaints have been responded to by the marketplace, demonstrating an active response, but there are no specific regulations governing legal protection for couriers in the COD system, causing uncertainty and injustice. This study recommends the establishment of regulations, legal education, complaint mechanisms and social security for couriers. Collaboration between the goverment, business actors and digital platforms is needed to create legal protection and fairness in the e-commerce ecosystem.

Abstract

This study examines the possibility of joining environmental destruction crimes and corruption offenses before the Corruption Crimes Court. It employs normative legal research with statutory and conceptual approaches. The findings indicate that the limited jurisdiction of the Corruption Court under Article 6 of Law No. 46 of 2009 obstructs the implementation of fast, simple, and low-cost justice, as environmental cases must be tried separately. In fact, the concurrence doctrine under the Criminal Code allows case consolidation. Therefore, this study recommends expanding the Court’s jurisdiction and establishing integrated prosecution guidelines to enhance legal effectiveness.

Abstract

Violent crimes against women identified in society today have increased significantly compared to previous years. In response to this phenomenon, both formal and substantive studies have been conducted by criminal law scholars in Indonesia in an effort to identify the underlying causes. Compared to earlier periods, crimes against women are now more easily detected. One prominent phenomenon is the advancement of technology, through which almost all abnormal or extraordinary activities are monitored, rapidly disseminated via social media and promptly responded to by law enforcement authorities. Several issues warrant further examination, particularly the criminal justice system’s orientation toward offenders, which has generated a sense of injustice in the provision of legal protection for victims of crime. This condition has resulted in victims—especially those of violent and sexual crimes—tending to remain silent, refraining from reporting incidents to law enforcement authorities, or, in other cases, refusing to act as witnesses in sexual violence cases. This phenomenon poses a significant obstacle to the effective operation of the criminal justice process and ultimately affects the success of comprehensive crime control efforts. Furthermore, the lack of comprehensive crime disclosure may lead to a sense of disparity in the administration of justice.

Abstract

The complexity of environmental issues in Indonesia is escalating due to unsustainable exploitation of natural resources, particularly in vulnerable karst ecosystems affected by mining activities. Karst ecosystems, featuring unique hydrological functions and high biodiversity, often suffer irreversible damage such as groundwater degradation and loss of endemic habitats from illegal or environmentally unfriendly permitted mining.The case of kumbung stone mining in Tuban, East Java, exemplifies regulatory disharmony between conservation and mining laws. This study emphasizes the need to harmonize criminal sanctions between Law No. 32/2024 and Law No. 4/2009 to protect karst ecosystems, alongside environmental law enforcement solutions. Using a normative juridical approach grounded in Pancasila and the 1945 Constitution, it proposes regulatory revisions, enhanced sanctions (billions in fines, longer imprisonment, ecosystem restoration), mining permit moratoriums, independent audits, and community involvement to create deterrent effects and support sustainable development.

Abstract

This research was conducted in the context of the rapid development of digital technology that is changing the way companies interact with consumers, particularly through data-driven advertising on the TikTok platform, which has the potential to give rise to misleading advertising practices and serious consumer protection risks. The main objective of this research is to analyze the legal regulations in Indonesia regarding consumer protection against misleading data-driven advertising on TikTok, and to evaluate the effectiveness and need for strengthening existing regulations. The method used is a library research with a normative juridical approach, utilizing primary data in the form of laws and regulations and secondary data from legal literature and official reports to conduct a descriptive-qualitative analysis. The main findings reveal that current regulations are unable to anticipate the complexity of TikTok's algorithm and the challenges of data transparency, resulting in less effective oversight and law enforcement. This study makes an important contribution to an integrative understanding of technological, legal, and ethical aspects in the context of digital advertising, highlighting the need for increased algorithm transparency, law enforcement capacity, and active consumer participation. In conclusion, the implementation of consumer protection regulations must be adaptive and collaborative, combining legal, technological, and educational aspects to create a fair and accountable digital advertising ecosystem. This research also recommends the development of technology audit mechanisms and regulations that are responsive to digital dynamics for optimal consumer protection.

Abstract

The balance of e-wallets as digital assets raises legal problems when the owner dies and has not been explicitly regulated in the inheritance system. This normative research analyzes the position of e-wallet balances as inherited assets according to Islamic law and Indonesian civil law through a regulatory and conceptual approach. The results of the study show that e-wallet balances are recognized as an object of inheritance based on Article 171 letter (d) of the KHI, Fatwa DSN-MUI Number 116/DSN-MUI/IX/2017, as well as Articles 499 and 511 paragraph (3) of the Civil Code, with the mechanism of division of faraid in Islamic law and ab intestato in civil law, so special arrangements are needed to ensure legal certainty and protection of heirs' rights.

Abstract

Normatively, Crypto Tumblers are not explicitly prohibited under the Anti-Money Laundering Law, the P2SK Law, or OJK regulations, although their use may be associated with money laundering activities. Nevertheless, the automated, decentralized and cross-jurisdictional nature of crypto transactions creates significant criminal procedural challenges under both UU TPPU and KUHAP 2025. Given Crypto Tumblers positive role in protecting financial privacy, blanket criminalization is therefore inappropriate and unrealistic. Accordingly, Indonesia should adopt a graduated prohibition model through clear eligibility criteria, whitelisting by OJK and the classification of transactions involving non-compliant Crypto Tumbler users as suspicious transactions as typically monitored by PPATK.

Abstract

Law Number 27 of 2022 on Personal Data Protection regulates criminal sanctions in the form of fines and additional sanctions of compensation payment, enforced through the seizure of the convicted person’s assets or income. This policy aims to ensure the fulfillment of criminal sanctions and to provide legal protection for victims of personal data violations. However, this study finds that the current formulation policy contains fundamental weaknesses, as asset seizure may only be conducted after a court decision has obtained final and binding legal force, thereby allowing the convicted person to transfer assets during the lengthy criminal process. This research employs a normative legal research method using statutory and conceptual approaches. The findings indicate that such weaknesses may hinder the execution of fines and compensation payments and undermine the objectives of punishment. Therefore, this study recommends reformulating the policy by allowing asset seizure at the investigation stage as a legal guarantee to ensure effective enforcement of fines and compensation payments, as well as stronger protection for victims of personal data misuse.

Abstract

The phrase "sepanjang menurut kenyataannya masih ada" in Article 3 of the UUPA creates normative ambiguity that places indigenous peoples in a vulnerable position. This study aims to analyze the juridical implications of the phrase and formulate ius constituendum policies. The discussion results indicate that this phrase is a transitional arrangement resulting in sectoral regulatory fragmentation and complex administrative burdens of proof for indigenous peoples. In conclusion, a paradigm shift from conditional to inherent recognition is required. Future policies must remove the phrase, adopt self-identification principles and harmonize regulations to ensure legal certainty and justice for indigenous peoples.
