Abstract

The practice of doxing, in the form of disclosing personal data without a lawful basis, may cause non-material harm to victims, while the parameters for compensation under Law Number 27 of 2022 concerning Personal Data Protection remain inadequately regulated. This study is relevant because an initial legal basis is needed for victims of personal data violations to seek remedies through Indonesian civil law mechanisms. This article constitutes normative legal research employing statutory, conceptual and comparative approaches. The study aims to analyze the construction of civil liability for doxing perpetrators and to formulate a basic reconstruction of the mechanism for determining non-material damages for victims. The findings show that doxing may be qualified as an unlawful act by positioning Article 12 of the PDP Law as the basis for the right to sue and Article 1365 of the Indonesian Civil Code as the framework for proof. This study also proposes a factor-based assessment model for determining non-material damages, using Article 82 of the General Data Protection Regulation as a principled reference that must be adapted to the Indonesian legal system. In conclusion, this study is not intended to serve as a final guideline for determining damages, but rather as an initial legal basis for doxing victims in constructing civil claims and as a conceptual foundation for developing parameters of non-material damages in Indonesia. Abstract

This study examines the controversy over the standardization of income zakat in Decree No. 15 of 2026 with a focus on the differences in the ijtihad of ulama in the determination of nisab. The absence of explicit nash opens up the space of ijtihad and produces various approaches. This study aims to analyze the pattern of ijtihad, the dominance of regulatory authorities and its implications in the perspective of maqāṣid al-syarī'ah. The method used is qualitative through literature studies with content and comparative analysis. The results show 3 (three) findings: the fragmentation of ijtihad (gold, agriculture, hybrids), the shift of authority from fiqh to regulation and the tension between standardization and flexibility of maqāṣid al-syarī'ah. Standardization is seen as an institutional ijtihad that needs to be balanced in order to maintain normative legitimacy.

Abstract

This research examines the urgency of reformulating the judicial review authority in Indonesia, which is currently divided between the Constitutional Court (reviewing Laws against the Constitution) and the Supreme Court (reviewing regulations below Laws against Laws). This bipartite system, or dualism of judicial review, is found to trigger inconsistent rulings, divergent legal interpretations, and legal uncertainty due to the separation of legality and constitutionality aspects. The study recommends the integration of judicial review authority into a unified judicial review system under the Constitutional Court. This integration aims to create linear legal harmonization and ensure that the entire hierarchy of legal norms aligns strictly with the principles of a democratic constitutional state.

Abstract

This study aims to analyze the collection mechanism regulations in Fintech Peerto-Peer Lending services based on Financial Services Authority Regulation Number 40 of 2024 and Financial Services Authority Circular Letter Number 19/SEOJK.06/2025 from the perspective of consumer protection and civil law. This research is a normative legal study with a statutory and conceptual approach. The results indicate that POJK 40/2024 provides a normative basis for collection implementation, but does not explicitly regulate operational standards regarding ethics, frequency and collection limits, resulting in unclear norms. Meanwhile, SEOJK 19/SEOJK.06/2025 regulates restrictions on device access and the use of emergency contacts, but the phrase "confirmation of presence" remains open to interpretation and has the potential for misuse. Furthermore, regulations regarding user data processing in collection activities have not been clearly formulated. Therefore, the development of more measurable collection operational standards is necessary to strengthen consumer protection in the implementation of Fintech Peer-to-Peer Lending services.

Abstract

The urgency of this research lies in strengthening the management of procurement contracts for goods based on Islamic principles to support the identity of UMM General Hospital as an Islamic hospital. The focus of the study covers the regulation of Islamic principles in SIRSMA, the level of compliance of contractual practices particularly regarding riba and risywah as well as the factors triggering both. The research aims to analyze the compliance of contracts with Sharia principles through a normative legal approach encompassing legislative, conceptual and case study methods, utilizing secondary data from literature reviews. The results indicate that although SIRSMA has established Sharia contracts, they may potentially lead to legal consequences regarding the validity and implementation of the contracts. Therefore, strengthening internal policies and oversight is necessary to avoid practices that contradict Islamic principles.

Abstract

The implementation of e-litigation in the Constitutional Court represents an institutional response to the demands of digital transformation within the constitutional justice system. However, its application faces fundamental normative challenges, particularly the lack of comprehensive regulations governing electronic proceedings and the insufficient protection of the constitutional rights of litigants in a digital environment. This study aims to analyze and identify normative gaps in the regulatory framework of e-litigation in the Constitutional Court and to examine their implications for safeguarding the constitutional rights of the parties involved. Employing normative legal research methods through statutory, conceptual and analytical approaches, this study finds that the existing regulations of the Constitutional Court on e-litigation remain inadequate in several key aspects. These include the legal validity of electronic evidence, data protection for litigants, guarantees of digital accessibility for marginalized groups and mechanisms for addressing technical disruptions that may affect court proceedings. The novelty of this research lies in the construction of a new normative framework, namely the Trias Digitalis Constitutionalis Principle, which encompasses three dimensions: equitable accessibility, digital procedural integrity and constitutional guarantees within the electronic sphere. This study recommends a comprehensive revision of the Constitutional Court’s regulations on e-litigation, along with the development of more detailed technical rules.

Abstract

The regulation of outsourced work is not merely a matter of industrial relations, but also concerns the protection of workers’ constitutional rights. Constitutional Court Decision Number 168/PUU-XXI/2023 provides a constitutional direction for limiting outsourced work. As a follow-up, the government issued Minister of Manpower Regulation Number 7 of 2026 concerning Outsourced Work. This article analyzes the implementation of the Constitutional Court decision through the regulation in protecting the constitutional rights of outsourced workers. This research uses normative legal method. The study finds that the regulation strengthens worker protection, but still leaves issues of interpretation and supervision effectiveness.

Abstract

The amendment to the Taxable Sale Value (NJOP) of Land and Building Tax (PBB-P2) based on the Decree of the Mayor of Pematangsiantar Number 900.1.13.1/1210/IX/2024 has significantly impacted the performance of Land Deed Officials (PPAT) in the transfer of rights over the land and the buildings. The increase in NJOP, reaching up to 1,000%, has sparked public controversy by raising the burden of Land and Building Rights Acquisition Duty (BPHTB) and impeding the smooth flow of transactions. Employing a normative-empirical method with qualitative analysis, this study finds that the policy is legally valid yet problematic in its implementation, particularly concerning legal certainty, transparency and justice. Policy evaluation and a clear objection mechanism are needed to balance regional revenue optimization with the protection of taxpayers' rights.

Abstract

This research examines the effectiveness of e-court implementation as an electronic judicial service at the Magetan District Court, employing an empirical legal research method with statutory and sociological approaches, complemented by interview data, observations and literature studies. The findings indicate that e-court enhances accessibility, accelerates service delivery and reduces litigation costs. However, its effectiveness remains sub-optimal due to a high dependence on Legal Aid Post (Posbakum) officers and low digital literacy among the public. This study recommends the reinforcement of technology socialization and the formulation of more structured service standards to support a simple, speedy and low-cost judicial system.

Abstract

Indonesia has numerous Occupational Safety and Health (OSH) regulations dispersed across various sectoral laws, resulting in regulatory inconsistencies, overlapping authorities and inefficiencies in implementation and enforcement. Moreover, the national OSH framework, primarily based on Law No. 1 of 1970 on Work Safety, has not fully adapted to contemporary workplace transformations such as digitalization, automation, the gig economy, platform work and remote working. This study aims to examine regulatory disharmonization within Indonesia’s OSH legal system and to propose a reconstruction of OSH law aligned with International Labour Organization (ILO) standards. Using a normative legal research method with statutory, conceptual and comparative approaches, the study finds that fragmented regulations and the absence of an integrated OSH framework are the main challenges. Therefore, legal reconstruction is necessary through the development of a comprehensive riskbased framework, the strengthening of OSH culture, the harmonization of supervisory authority and the ratification of ILO Conventions No. 155 (1981) and No. 187 (2006) to establish a modern, responsive and prevention-oriented national OSH system.
